Thc~ ii, formation as provided indicates that from O' -- 15' the
soil is clay and grave, l; from 15' - 6.0' th~, soil is gravel and

As there are no imp(~rvious layers of material to prevent con~
~amination from enCeri.qg ti~,~ water aquifer, we wilt not be able

Subject: Sewer System for Lot 7, Block 1
Lake Otis Heights Subdivision
Dear Mrs. Deacon:
You called tills Department concerning what exactly was required
for your sewer system. Borough'.Ordinance 28-68 pretty well lays
down all tile requirements but basicallY there can be no contamina-
tion source of any kind within 10' of the well, septic tanks must
be at least 50' from thc well and seepage pits must be at least
lOD' from the well.
The distance from the wel.1 to the seepage pit on your lot is
which means that you are 15' short of the 100' requirement. The
distance from your well to the septic tank and the remaining part
of the sewer system is great enough so no change meed be made there.
If the adjoining property is under your ownership, we would have
no objection to your placing your seepage pit on that lot to obtain
proper distances.

A cesspool ~tas discovered to have been installed on
the property mentioned above. The cesspool had not
yet been backfilted. A m~n who was ~orking on a b,~ckhoe
install a se).~er syste~ on the above mentioned p~operty.
The man said that he had not and h~ asked since uhen v~as
m permit needed. )la was then informed that permtt~
stall sewer systems have been required since the ordtmance
was adopted in 19~2. At this ti~e, I offered him my card
and told him he ~vould need to 9o to the Borough Offices,
(Department of Envirom~ental Quality) and obtain the
necessary permits and tnfo~matton, tie refused my card,
said no a~d kept -orking. I returned to the Borough
office and ~rote out a uarning ticket and returned to
the lo~s i~ question. The excavator by this time had
left. The warning ticket was left on the log crib of
the cesspool. It was noted at this time by Lynn Coad
and Les Buchholz that the lo~ crib was set tn uater.
The w~ter uas appro~im~tely 5' below the [morn~al ground
level. !~ater was seeping through the ualls of the pit
into the hol~.

A warntn~ tic,,et was also left on the premises of the
person who is listed as the owner - Victoria Anne
~eakt~. Err address tvas 3701 ~u~eka, Space 67B,
response was received from either of these warning
tickets. The Building D~partm~nt was infor~ed of the
activity on the lots tn Question.
I checked on the lots in question at I0:20 and found
that a ~ohile home had been moved onto the property.
The sewer systec ~as hackfilled and beino Used. A
~oll had also been drilled on the property.
I ret~rnad to the property at 5:~$ to issue ~ court
citation to Victoria Anne Peaktn, A ~an answered the
door (the sa~ man ~ho was worktn~ on th~ b~ckhoe on
~/22/72) ~nd asked me ~hat ! wanted, ! stated that I
was from the gorough concerntn~ the sewer syste~ and.
:hat ! ~anted to talk to V.A, Deakln, ~e stated that
that ~as his wife. I then asked "then you are )~r.
Deaktn?" ~e said he was. I crossed out Victoria
Anne on the ticket and put ~r. in freer of Deakin and
~sked hi~ to sign the ticket - he refused.~ I told him
~hen th~ arraignment ~as and offered hi~ the pl~k copy
of the ticket, he refused it so I let it drop to his
feet at which tt~e he b~canle violent and ordered ~e
of~ his property. I stepped do~n off the porch a~d
turned just itl tt~e :o ~ee hi~ shove me with his fore~
ar~s. ! kept ~oving toward my vehicle and he shoved
me again knocking a s~all ruler fro~ ~y pocket. He
stepped between me and the ruler and I had to shove
him hack to retrieve ~ny ruler. ~e then followed ~m to
my vehicle and told')ue never to come back. I then
left at approximately 5:55 p,m.
Judge Hason reco~)nended that since a na~e had been
crossed out and nnother put i)~ its place thet the
ticket be reissued.

Enclosed please find the page from the State Administrative
Code, Title 7 - Healtii and Uelfare, Division l, liealth, Chapter
2, Sanitation and £ngineering, Subchapter 1. As you can see,
for a private ~tell there must be no contamination withi)l 10 feet
Of the well, selbtic tanks must be at least 50 feet from the vtell
and seepage pits must be ~t least lO0 feet from the well. Also
note that it says these distances are minimum and greater removal
fro~ contamination may be required under certain conditions.
'Jrt your lot the distanc~ fro~;J the well to tile seepage pi~ is
approxi~',:~atuly ,~5 feet which ~:Jeans that you are considerably s~ort
of the lO0 foot requir~,~ent. For this reason, we ~ust disapprove
the subject system. The distance fror,! the well to the septic
tank and the rely, allying part of the sewer syste)~ should be saris-
fac tory.
It is our underst~.nding that you are the owe)er of the adjoining
lot and we would be agreeable to you using this property for
placing your seepage pit on. Tills would probably mean that
this property could not be sold u)~til public sewer is made
available.
