S&S Engineering 17034 Eagle River Loop, Suite 204 Eagle River, Alaska 99577 'JUN 1 4 1989 RECEIVED RE: Lot 9, Block 4A, Lake Ridge Terrace Subdivision, Eagle River, Alaska; On-Lot Water Supply and Wastewater Disposal Systems Dear Mr. Shafer: ~/~ ~ ~ ~ (.q~.~.~~ This is in response to your recent letter 24, 1989, which requested a re-evaluation of a decision made by the Anchorage Western District Office, denying approval of the water supply and wastewater disposal systems serving the duplex on the referenced property. Your letter was quite lengthy and dealt with several other issues not technically pertinent to your request or this decision. I attempted to segregate these and spent considerable time on the history and sequence of events leading to the decision by my Anchorage Western District Office. As a result of this review, the following finding of facts are made: 1) 2) STEVE COWPER, GOVERNOR In 1974, this Department issued a waiver for the existing separation between the community water supply well and the wastewater disposal system serving a six bedroom duplex on this property. (Note that this well required a 200 protective radius at this time.) In 1976, a wastewater disposal system was installed on the adjacent lot, within the community well's protective radius. No notification to or involvement of ADEC was noted in the records. 3) 4) In 1977, the 150 ft. protective well radius for Class C systems was established in State regulations. In May 1984, A Certificate of Approval was issued by the Department for the water supply and wastewater disposal systems serving a 5 bedroom duplex on this property. The number of bedrooms does not appear to have changed, rather, the approval reflects the results of a test of the adequacy or performance of the wastewater disposal system at that time. In the application for the Certificate, information on the conflict with the adjacent system was included. No other reference or correspondence regarding the problem was noted in our files. By issuance of the Certificate, though, a waiver'seems to have been implied. Mr. Robert A. Shafer, P.E. Page 2 June 9, 1989 5) 6) 7) 8) 9) lO) The size of the duplex was subsequently increased from 5 or 6 bedrooms to 8 bedrooms. In January 1989, based on a need to obtain approval for the increased number of bedrooms, plans were submitted for an upgrade of the wastewater disposal system, including relocating the system to provide the 150 ft. minimum separation distance from the well. Though the protective radius was shown, no details were provided in your plans on the conflict with the system on the adjacent property. Neither was any mention made of the proximity of the proposed absorption field to the steep highway cut. In February 1989, the Department issued a conditional approval of the plans that you submitted for the upgrade, allowing construction to proceed, and in March the system was installed. Following completion of the installation, you submitted a completed application for approval, including as-built drawings. In two locations in the application, where separation distances to the closest wastewater disposal system components on adjacent lots were required, you clearly showed that the minimum separations had been achieved. In another portion of the application, it was specifically shown that "no points of contamination" existed within the well's 150 ft. protective radius. The property was subsequently inspected by Mr. Steve Eng of the Anchorage Western District Office, who determined that there was a conflict with the wastewater disposal system on the adjacent lot and the application/as-built was incorrect. As a result, the Department issued the April 6, 1989, denial letter. April 1989 correspondence from you requested reconsideration of the denial and provided additional information and your justification in support of a request for a waiver for the separation from the Class C well to the wastewater disposal system on the adjacent lot. 11) On May 1989, the Department's letter denied the requested waiver. You immediately responded, again requesting approval and subsequently met with Mr. Eng and Mr. Bruce Erickson to personally argue your position, to no avail. 12) Your May 24, 1989 letter to me requested my attention to this issue and a re-evaluation. Mr. Robert A. Shafer, P.E. Page 3 June 9, 1989 I have considered the facts and evaluated the technical merits of this issue. In my review, I found that I had significant concerns regarding your deletion, whether intentional or unintentional, of certain, critical details in your submittal of plans and as-builts. I also find many flaws in the arguments which you presented in your letter to me. My effort, though, at this time, is not to let these issues influence the technical considerations of the waiver request. Finding that waivers, formally issued, in the case of the on-lot separation problem, and implied, in the case of the conflict with the adjacent lot, have existed for a considerable period of time, the main effort in this review is to evaluate the impacts of the recent changes. Obviously, the use of the structure has increased to an 8 bedroom duplex. The formal waiver had been based on 6 bedrooms, and while the implied waiver indicated 5, by issuance of an approval certificate for that number, it recognized use of the structure at the higher, 6 bedroom number. Therefore, I would conclude that both recognized and were based on a 6 bedroom duplex. In a positive sense, to offset the higher usage, the wastewater disposal system was upgraded and relocated outside the well's protective radius. In addition, rather than concentrate all the effluent at a single point, as with the old seepage pit, the new absorption system utilized a 100 ft. long deep, trench thereby distributing the effluent over a much larger area. The issue of separation of this absorption trench to the cut is not a major one according to Mr. Eng. Though you argue that this is a Municipal Ordinance, which applies only to single family residences, this is only due to the responsibility that the Municipality has for on- lots. The Municipality does not regulate multi-family on-lot systems, therefore the reason for the limitation. Due to the higher flows, the need for this separation becomes more critical with multi-family systems. In this particular case though, your arguments relating to soil conditions and increased separation, due to depth, have merit. I have also noted that this slope has been vegetated, which is another positive factor. As a result, I find that the separation, though marginal, is acceptable. From the negative side, the encroachment of the existing .system remains. Considering the depth of the aquifer, and on-site soil conditions, I find that the upgrade adequately compensates for the increased usage in this case. Though a potentia% does exist for contamination, there is found to be a low probability for it. This is supported by the results of the nitrate evaluation after many years of use of the old system and the neighbor's system. As a result, it is my finding that a waiver is justified and is therefore granted by the Department, in accordance with provisions of 18 AAC 72.021 (c) and 18 AAC 80.020 (e). This waiver is Mr. Robert A. Shafer, P.E. Page 4 June 9, 1989 conditional upon the maximum usage of this structure as an 8 bedroom duplex and use of the structure on Lot 8, Block 4A as a single family residence. Any change in either use will void this waiver. Also, any problem with the wastewater disposal system on Lot 8, Block 4A, requiring upgrade or replacement, will necessitate that this system be installed to meet all minimum separation and design requirements at that time. I also wish to strongly emphasize that issuance of this waiver should no~ be construed to imply that ADEC is supportive of this type of density of development. To the contrary, lots of this size are viewed as being much too small to support multi-family development with on-lot systems. The facts of this specific case, however, served to override the Department's policy and general position. By copy of this letter to the Municipality of Anchorage and to the owners of Lot 8, Block 4A, I am advising them of the conditions of this waiver as they apply to that lot.
