Dear Mr. Shaf'er:
The department has reviewed your April 10, 1989 request for a
waiver of separation bet~en the ~pgraded sewer system on Lot 9
and the top of the cutbank.
As you point out, this office does not review waivers for
community sewer systems or wells, which are under the
jurisdiction of the State of Alaska. To the best of my
knowledge, however, the state does not have its own criteria for
this type of waiver, AMC 15.65.005 defines the scope of the
Wastewater Ordinance as being applicable to disposal systems
serving single family dwellings. Since our ordinance does not
pertain to multiple family dwellings, we can only offer general
guidance to you as to our method of evaluating waivers for
single family dwellings~
AMC 15.65.040I requires that all portions of a sewer system be
"fifty (50) feet uphill' ~rom any man-made or' any.~natural break
in the natural slope of the tesrain wh%Ye the slope changes by
twenty-five (25%) percent or greater .... " In evaluating a
waiver request, the following criteria would be considered:
Area well logs and evidence of hydrostatic pressure
Depth of cutbank
Soil conditions, percolation data, and water table
information at the site of the installation
Total depth of the sewer system
Presence of impermeable soil layers

Dear Dan,
This letter is to follow-up your site visit with me to the referenced
property on April 7, 1989. Our site visit was made as a reset
of the State of Alaska, Department of Environmental Conservation
(ADEC)/Steve Eng letter dated April 6, 1989 responding to a request
for approval we submitted to their office for the referenced property.
Although there is a multi-family dwelling located on the referenced
property and approval of wastewater disposal systems serving such
facilities is not under the jurisdiction of the Municipality of
Anchorage (MOA), Department of Health and Human Services (DHHS),
we request you issue a w~iver letter showing you have no objection
to the referenced septic system being located 30 feet from the cut-bank
as apposed to the 50 feet prescribed by Municipal Ordinance 15.65.040.
The primary force which would cause the liquids from the septic
system to travel horizontally toward the cut-bank would be a hydro-static
force. The hydro-static force wo~d be caused by a liquid build-up
in the absorption trench and a saturation zone located around the
leachfield area. However, the tight GM soils in the area (soil
and well logs attached) cause a large friction loss for liquids
travelling through the soil. This friction loss would deplete the
energy given to the liquid from the hydro-static pressure. Therefore,
the liquid cannot travel horizontally. Instead, the primary force
acting on the liquid would be the force due to gravity. This force
will tend to draw the liquid vertically downward.
The other method by which liquids from the absorption trench could
travel horizontally toward the cut-bank is to traverse along an
impermeable layer of soil sloping toward the cut-bank. However,
the test hole excavated on the lot to a depth of 19 feet showed
no signs of an impermeable layer. There is no log on record for
the well located on the referenced property. The closest well for
which a log does exist is located on the neighboring Lot 10; Block 4A;

Lake Ridge Terrace. From this well log it app~ras there is no impermeable
layer u~il a depth of 98 feet below ground level at the location of the
well. This is a much lower elevation than the bottem of the cut-bank. Therefore,
there is extremely little possibility of the liq~ds from the absorption
trench travelling over 30 feet horizontally to the cut-bank.
It is also noted the cut-bank is covered with a wire mesh for slope stability.
The cut-bank is also covered with vegetation consisting of young willows,
birch trees and various grasses.

Dear ~ Shafer:
The Department has reviewed your March 27, 1989 letter which
attempts to explain an error in your engineer as-built, dated March
7, 1989.
Your March 7, 1989 as-built contains a drawing which shows a 150
foot radius of noncontamination from the subject Class C well.
Your as-built is in error due to a neighboring septic system
located 114 feet from the Class C well. Also, the new septic
system which was constructed was built within 30 feet of a steep
cut bank, again not reported on your engineer as-built drawing.
Mike Lewis of this office explained these violations to you on
March 24, 1989.

You have violated 18 AAC 80.100 by not identifying the location of
the existing wastewater treatment system within the 150 foot radius

Dear Mr. Lee:
As the well for the duplex has been drilled and the foundation
for the building exists, we have no objection to the distances from
the well to the sewage disposal system elements meeting the require-
ments which were in effect prior to the effective date of the Waste-
water Disposal Regulations.
This waiver is based on our belief that the well was drilled by
mistake as the owner was not aware of the new requirements and also
because of soils and topography, this should provide an acceptable
situation.
