Septic System Design and Permit Application
Dear On-Site Services Engineer:
The lift station on the subject lot is leaking and must be replaced prior to the issuance of a COSA
for the property. The attached site plan identifies the location of the home and the existing well
and septic system. No conflicts exist between this proposed system and any other well or septic
system,whether on this lot or adjacent lots.
The septic tank and lift station are located inside the 200' protective radius for the Class A Well
on the lot. ADEC has stated a new waiver is unnecessary as the replacement of the lift station does
not constitute an overall change in the design and function of the septic system. A copy of the
correspondence with ADEC is attached.
The existing Class A Well serving the subdivision is shown. The placement of the new lift station
will not alter the encroachment into the well radii. Please refer to the attached plan sheet for the
septic design. If this design is followed, there will be no adverse impacts to adjacent properties.

Morning Jake,
It was nice to speak with you yesterday.
Usually waivers from Drinking Water are written so they are voided if there is a modification, however as you've noted this one isn't. Given the satisfactory
nitrate and TC that you've provided, and assuming the site layout/system configuration is largely the same I see no issue with keeping the existing waiver in
full force and effect. No additional Separation Distance Waiver from Drinking Water will be required for the planned lift station replacement at this address.

Dear Mr. Spurkland:
On January 8, 1988, you submitted an "as-built" drawing for an
upgrade of the on-site wastewater disposal system on Lot 15
Borealis #1. During a recent site inspection by this office, it
was observed that the lift station is not an approved design by
today's standards or the standards at the time of construction.
AMC 15.65 was very clear then, as it is now, in establishing
procedures and criteria for obtaining DHHS approval of lift
station design and construction.
This letter serves as a Notice of Violation for installation of
the inadequate and unapproved lift station on the subject
property. Under terms of the ordinance in effect at the time of
the violation, the subsections violated by the installation are
as follows:
15.65.095B. "When a lift station is required, the
system must be designed by an engineer and have the
approval of the department. A design bearing the
original signature and stamp of an engineer must be
submitted to the department for approval before a
permit will be issued. The design must meet the
standards contained in this chapter."
Your permit application, submitted in January 1988, did not
specify that a lift station would be part of the proposed
wastewater system.
15.65.135D. "...The as-built shall demonstrate
installation consistent with the permit and site plan
or survey submitted with the application."
The as-built plans of the wastewater system which you submitted
to this office were not at all consistent with or reflective of
the approved permitted design.

To resolve the above noted violations, the existing unapproved
lift station must be replaced by an approved lift station. In
addition, the septic tank capacity must be increased to a
minimum of 1250 gallons for the system to be approved for four
(4) bedrooms. These required modifications must be accomplished
by June 15, 1991. Failure to do so may result in enforcement
action being initiated by this office.

Dear Mr. & Mrs. Guzialek:
On January 24, 1991 this office visited your lot at the request
of your excavator, Carl Elsenbach. While at the site we
observed him repairing a blocked pipe between the septic tank
and the lift station. Also we observed that the lift station,
installed during the upgrade of your wastewater system in
January of 1988, is not of a type or configuration approved by
DHHS. This unapproved lift station, however, was not associated
with the problem of the blocked pipe between the septic tank and
the lift station.
On January 25, 1991, a meeting was held at our office with
Tobben Spurkland, P.E., Ed Sanderson of Acreage Systems, On-Site
Services staff and yourselves in attendance. Based on
information presented at the meeting, it is our conclusion that
an existing 500 gallon steel septic tank was inappropriately
converted to a lift station in 1988 and as a result not only is
the lift station inadequate but also the septic tank capacity is
inadequate for a 4 bedroom house.
To resolve the deficiencies in your wastewater system, you must
hire a civil engineer, registered in the state of Alaska, to
design and oversee the installation of a new lift station and
septic tank.
You are advised that your wastewater system will remain
ineligible for a Health Authority Approval Certificate until an
upgrade of the system is complete.

this office at 343-4744.

Excavator (Carl's Excavating) repairing a clogged pipe
between the septic tank and lift station.
Excessive amount of grease and black sludge observed
in the lift station.
The Orenco pump and screen installed in the 500 gallon
steel tank on January 5, 1988 had been replaced by an
Acreage System, Inc., grinder pump without use of hte
ORENCO screen. Apparently the ORENCO screen could not
be pulled from the sludge and was pushed to one side
of the 500 gallon tank.

Meeting at DHHS with the property owners, Guzialek and
attorney, Spurkland, Sanderson of Acreage Systems,
Inc, Roth, and Smith of DHHS January 25, 1991
resulting in the following determinations:
10.1. The 500 gallon septic tank was inappropriately
converted to a lift station in 1988. This lift
station would not approved.
10.2. The septic tank capacity is inadequate for four
bedrooms.
10.3. The system is not eligible for a Health Authority
Approval.
10.4. The property owners, the engineer and the excavator
agreed to jointly resolve the above specified
problems

Notice of Violation to Spurkland, letter dated
February 18, 1991. Resolution of violation required:

Lift station must be replaced with an approved lift

Septic tank capacity must be increased to a minimum of
1,250 gallons.

The first item was to decide upon the issuance of a waiver for
placement of a septic system within 200 feet of our well. The
septic system is being installed at 11895 Wilderness Drive.
Discussion ensued on various levels. Steve brought up the question
of setting a precedent. The idea being that if we say yes now, we
will have to say yes to any waiver in the future putting our well in
greater peril with each incident.
John stated, this new system was going to virtually be an extension
of his own septic system, which is not working properly. He stated
that his system was designed by the same engineer and he has since
been told that it is not up to municipal codes.
The fact that the majority of the homes in this association could
fail septic system checks and upon a resale require the installation
of a mound system similar to the one in question was a hot topic.
Especially as four or more of our own homes septic systems fall
within the 200 foot protective radii of the well.
Steve suggested that we put a provisional statement in the letter
stating that should our well develop any fecal contamination within
one year of the said septic systems completion a portion (1/11th,
dividing the responsibility evenly between all Omega homeowners
and the property at 11895 Wilderness Drive equally) of the cost of
bringing our well back to a potable condition. And the 11895
Wilderness Drive would share and equal share of the testing for that
one year period.

It was decided to refuse the waiver unless the property mentioned
agreed to assume the one year responsibility. The initial draft of

need to get this to Mr. Spurkland. 345-7256 after 6:30PM.
Jody brought up the second item of business. The checking account
we have now is expensive to keep for as few checks that we write
and we are starting to see a small surplus. She suggested that we
transfer our account to AK USA Credit Union which would .prove to be
more economical. The motion was passed unanimously. Jody will
file the appropriate paperwork
The last item was the fact that we should have financial recourse
when a homeowner sells their home with an outstanding balance due
to the association. We unanimously decided to attach the title of
all the homes so the association will be paid any outstanding debts
upon the sell of the home. Jody is also going to take care of that for
us. She is going to be busy!
The meeting broke up at about 9:00 pm.

In regards to your letter dated January 10, 1994, Borealis Omega
Homeowners association has objections to the placement of the
proposed septic system within the 200 foot protective radii of our
well. We are required by the United States Environmental Protection
Agency and the State of Alaska Department of Environmental
Conservation to perform extensive testing, at a great cost to our
association, to verify that the quality of our drinking water is up to
national standards. With each additional year a greater burden is put
upon the small Class A systems, such as ourselves, to maintain our
pure drinking water.
If your client would be willing to shoulder a portion of that burden
we would be more inclined to take the risk of the encroachment of
our protective radii. For the term of one year commencing upon the
completion of the septic system we would like payment of 1/11th of
the water testing costs to be paid by your client. For the year of
1994 your portion would be approximately $50.00, if no unusual
testing is required. In addition, for the same time period, if our
well shows signs of fecal contamination your client will pay 1/11th
of necessary costs to return our well to its now safe and potable
condition.

A permit issued by this Department for an individual well
and/or on-site sewer system has expired as of December 31,
1987.
Permits are issued on a calendar year basis by authority of
Municipal Ordinance. A new permit must be obtained from this
Department for any well and/or on-site sewer system not
installed by the expiration date.
If you have drilled the well, a well log needs to be sent to
this Department for documentation of the installation and to
close the permit.
If a private engineer inspected the installation of the on-site
sewer system, the original as-built inspection report (three-part
form) must be sent to this office for review and approval, and
for documentation.
Effective January 1, 1988, a new fee schedule is in effect.
When re-applying for a new permit, the new fees are; $90.00 for
an on-site sewer permit; $50.00 for a well permit; $140.00 for
a combined sewer and well permit.

SUBJECT: Waiver Request for Lot 15, Borealis
Class A Well to Septic System
Dear Mr. Eng;
On behalf of our client, John Guzialek, we request a waiver from
the separation distances between a class. A well and a private
septic system as stated in Title 18, Alaska Administrative Code,
Chapter 80.020
A septic system was installed on Lot 15, Borealis Subdivision in
June on 1975. The water system for this subdivision was then
called a semi-public system and the separation distances
applicable to the well and septic system were 80 ft. to tank and
120 to drainfield. The system was installed under these criteria,
and approved.by the Municipality.
An inspection of the system was performed on November 25, 1987.
The tank was found surcharged,, and the clean out at the beginning
of the trench had 40 inches of liquid.
On December 2, the trench was exposed and it was found that the
distribution was completely blocked.with sludge. 'The trench had
been installed without a silt barrier and the sewer rock had been
completely contaminated with silt. The trench was considered a
complete failure and a replacement trench will be necessary.
The Class A well is located 165 feet from the back lot line.
Based on percolation tests performed on December 2, an 80 feet
long trench will be required. This trench will be located along
the back lot line, at the closest point 155 feet from the well.
At present the G~zialek are without a working septic system.. We
request a speedy review of this request so that a replacement can
be installed before Christmas.

landscaping is included in this bid. The ~ob will be finished to rough
grade; some settling may occur.
Ail of the above work is to he completed in a substantial and

part of the contract to meet the Nunicipal Codes on the septic.
Therefore, if the septic is not fixed properly to pass the City
Codes,or plans finalized within (10) days, we have no alternative
but to:

File a Small Claims action against you and Acreage
Systems for $3,000.00 and punitive damages for
$2,000.00, totaling $5,000.00.
Because you kno~ingly put in a system not approved by the
Municipality of Anchorage, also Anchorage Tank states in
January of 1988, Acreage Systems only purchased one system
and were told it was illegal for Anchorage and would not pass
city code. You were given an open check book by State Farm
to fix the system properly and you did not.
Furthermore, we will file a complaint against
you a~]d Acreage Systems with the State of Alaska,
Department of Commerce & Economic Development,

Dear Mr. Spurkland:
This office has reviewed your proposed solution to remedy the
deficient wastewater disposal system located on the subject
lot. Based on.our review, we do not agree that your proposed
remedy will yield a system that satisfies State and Municipal
regulations. Your proposal of modifying the float switch
settings in the existing lift station for the purpose of
converting a portion of the lift station tank capacity to serve
as septic tank capacity doe~onform with established standards
and regulations and will not be approved.
Please refer to our February 15, 1991 letter which'clearly
outlines the minimum requirements to rectify the deficiencies of
the system. Specifically ~the septic tank capacity must be
increased from 1,000 to 1,250 gallons if the structure is to
remain a four bedroom dwelling. Also the lift station must
either be replaced with a DHHS approved station or modified to
conform with Municipal regulations and standards.

installed as required in Department of Health and Human Services (DHHS)

Site visit by Dan Roth, January 24, 1991 findings:
Excavator (Carl's Excavating) repairing a clogged pipe
between the septic tank and lift station.
Excessive amount of grease and black sludge observed
in the lift station.
The Orenco pump and screen installed in the 500 gallon
steel tank on January 5, 1988 had been replaced by an
Acreage System, Inc., grinder pump without use of hte
ORENCO screen. Apparently the ORENCO screen could not
be pulled from the sludge and was pushed to one side
of the 500 gallon tank.

Meeting at DHHS with the property owners, Guzialek and
attorney, Spurkland, Sanderson ef Acreage Systems,
Inc, Reth, and Smith ef DHHS January 25, 1991
resulting in the following determinations:
10.1. The 500 gallon septic tank was inappropriately
converted to a lift station in 1988. This lift
station would not approved.
10.2. The septic tank capacity is inadequate for four
bedrooms.
10.3. The system is not eligible for a Health Authority
Approval.
10.4. The property owners, the engineer and the excavator
agreed te jointly resolve the above specified
problems

A permit issued by this Department for an individual well
and/or on-site sewer system has expired as of December 31,
1987.
Permits are issued on a calendar year basis by authority of
Municipal Ordinance. A new permit must be obtained from this
Department for any well and/or on-site sewer system not
installed by the expiration date.
If you have drilled the well, a well log needs to be sent to
this Department for documentation of the installation and to
close the permit.
If a private engineer inspected the installation of the on-site
sewer system, the original as-built inspection report (three-part
form) must be sent to this office for review and approval, and
for documentation.
Effective January 1, 1988, a new fee schedule is in effect.
When re-applying for a new permit, the new fees are; $90.00 for
an on-site sewer permit; $50.00 for a well permit; $140.00 for
a combined sewer and well permit.

SUBJECT: Waiver Request for Lot 15, Borealis
Class A Well to Septic System
Dear Mr. Eng;
On behalf of our client, John Guzialek, we request a waiver from
the separation distances between a class A well and a private
septic system as stated in Title 18, Alaska Administrative Code,
Chapter 80.020
A septic system was installed on Lot 15, Borealis Subdivision in
June on 1975. The water system for this subdivision was then
called a semi-public system and the separation distances
applicable to the well and septic system were 80 ft. to tank and
120 to drainfield. The system was installed under these criteria,
and approved by the Municipality.
An inspection of the system was performed on November 25, 1987.
The tank was found surcharged,, and the clean out at the beginning
of the trench had 40 inches of liquid.
On December 2, the trench was exposed and it was found that the
distribution was completely blocked.with sludge. 'The trench had
been installed without a silt barrier and the sewer rock had been
completely contaminated with silt. The trench was considered a
complete failure and a replacement trench will be necessary.
The Class A well is located 165 feet from the back lot line.
Based on percolation tests performed on December 2, an 80 feet
long trench will be re.quired. This trench will be located along
the back lot line, at the closest point 155 feet from the well.
At present the G~zialek are without a working septic system.. We
request a speedy review of this request so that a replacement can
be installed before Christmas.
