REFERENCE: Proposed Septic Upgrade for Borealis S/D; Lot 7.
To whom it may concern,
The subject property is served by a private well and a septic system consisting of a 1250 gallon
septic tank and a seepage pit type drainfield. The septic system is in a state of failure and needs to
be upgraded. We are proposing to install a Category III advanced treatment system consisting of
a 1500 gallon S.T.E.P. tank, one AX -20 treatment pod, a secondary Orenco pump vault and a
trench type drainfield. Design comments are summarized as follows:
SOILS: One testhole was excavated on property. See attached soil log for soils profile,
groundwater readings and percolation test data.
SURFACE WATERS: There are no surface waters within 100 feet of the proposed septic
upgrade.
TOPOGRAPHY AND WAIVER: The topography in the area of the proposed upgrade is
approximately 0-12% running south to north. We are proposing to install the drainfield
perpendicular to the slopes in the area. Attached is a profile drawing showing that shows the
feasibility to construct the system this way and keep the drainfield within the soils profiles that
was perked and maintain proper soil cover. There are no slopes in excess of 25% within 50 feet
of the proposed septic upgrade.
LOT LINE WAIVER: Due to site contraints, we are requesting a 1+ foot lot line waiver to the
east lot line. The adjacent septic system is over 10 feet from the lot line.
A.D.E.C. WAIVER: As can be seen on the site plan, it is impossible to construct a new septic
system on this lot without encroaching on the 200 foot radius of the Class A wells serving the
neighborhood. A waiver package will be submitted to the A.D.E.C. shortly. This permit will be
contingent on receiving this waiver for these distances. When we receive authorization from the
A.D.E.C., we will forward it to you.

To whom it may concern,
The design for the subject property proposes an upgraded trench that may encroach upon the
separation distance required by MOA code (2x the effective depth). The exact boundary of the
existing system is unknown. We request that you waive the distance from drainfield to drainfield
to 5 feet. The following items are justification for this waiver:
The replacement trench is being placed as shown to maximize distance to the public water
source. This is being considered as more important than maximizing separation to a
drainfield that will not be used concurrently with the replacement trench.
Both drainfields will be served by an intermittently dosed Category III advanced treatment
system. This will significantly minimize the risk associated with one drainfield influencing
the other.
Based upon the aforementioned facts, we believe there is minimal risk associated in granting this

On April 15, 2015, this office received your submittal requesting a waiver of the State's minimum separation
distance requirement between a community drinking water source and potential sources of contamination.
This letter approves the requested reduction in the State's minimum separation distance
requirement from 200' to 140' between the drinking water well serving the Borealis Alpha Public
Water System, located in the cul-de-sac on the west end of Alpha Circle, and a proposed septic
system located at Borealis S/D, Lot 7, this encroachment includes an Advantex septic treatment
package at 140', an existing (now a reserve) drainfield at 160', and a proposed drainfield at 1701.
Waiver Determination
As indicated in your submittal, the septic system serving Borealis S/D, Lot 7 consists of a 1250 gallon tank
and a seepage pit type drainfield installed on July 16, 1974, its replacement is now proposed. As with the
original septic system, the location of proposed septic system fails to meet the State's 200' tniuimurn
separation distance requirement between a community water system source and a wastewater disposal system.
At its nearest, the septic system and its appurtenances are 140' from the well serving the Borealis Alpha P%VS.
This well was believed to be drilled in 1974, however the associated well log couldn't be located. Static water
level in the well was measured at 97' below the top of the casing on August 26, 2013. Well logs in close
proximity to the subject well show lenses of slit, clay, gravel, and mixes thereof, and range in depth from 117'
to 137.
In addition to the proposed septic system to serve Borealis S/D, Lot 7, the well serving the Borealis Alpha
PWS is also subject to several other separation distance encroachments. The septic system serving Talus
West, Block 1, Lot 8 and Talus West, Block 1, Lot 9 received Separation Distance Waivers from this office on
September 24, 2013 and July 24, 2014, respectively. Additional encroachments are summarized below:

The following additional items were taken into consideration as part of this waiver approval:
1. From February 2001 to January 2015, source water sampling results for nitrate -nitrite concentration
rose from 0.79 mg/l to 1.89 mg/l. This suggests that the well may be minimally influenced by septic
system exfiltration, decomposition of organic matter in soils; and/or erosion of natural deposits,
however nitrate -nitrite concentrations remain well below the 10 mg/L Maximum Contaminant Level;
2. From February 2001 to June 2015, source water sampling results for total coliform and e. coli
recorded one total coliform positive result (repeat samples were negative) and no e. 4nli positive
results;
3. The proposed septic system is located down grade of the wellhead and is separated by the house,
landscaping, and driveway grading;
4. The septic system has been in place for over 41 years without significant effects on water quality;
5. The location of the septic system maximizes horizontal separation as grade, configuration, and
existing utilities allow; and
6. The well accesses a presumed confined/semi-confined aquifer.
Based on an evaluation of the available information and in accordance with the State's Drinking
Water Regulations, 18 AAC 80, a Separation Distance Waiver for the proposed septic system located
at Borealis S/D, Lot 7 is issued.
Limitations
Any changes, constructed or natural, that affect the conditions to which this approval was granted will void
this approval. This approval does not imply the granting of additional authorizations, nor obligate any federal,
state, or local regulatory body to grant required authorizations. This is not an approval of omissions or
oversights by this office or noncompliance with any applicable regulation. The Department's approval does
not guarantee correctness of the functional design or waiver the owner's responsibility for continued
compliance with State regulations.
Appeal Process
Any person who disagrees with this decision may request by mail, e-mail, or facsimile an informal review in
accordance with 18 AAC 15.185 or an adjudicatory hearing in accordance with 18 AAC 15.195-15.340.
Informal review requests must be delivered to Division Director Elaine Busse Floyd within 15 days of receipt
of this decision. Adjudicatory hearing requests must be delivered to Commissioner Larry Hatdg within 30
days of this decision, otherwise, the right to appeal is waived. Visit

Dear Mr. Vines:
We are submitting herewith the test boring results and our comments
regarding soil conditions encountered at the subject site. This
investigation was performed in accordance with your request- of June 25,
1974, and those procedures outlined in a letter dated September 13, 1971
by Mr. Rolf Strickland of the Greater Anchorage Area Borough Department.
of Environmental Quality.
A single test hole was put down within the Lot 7 area for the purpose
of defining general subsurface soil conditions for the proposed sanitary
system. Excavation was accomplished with a tractor -mounted backhoe and
the test hole was extended to a total depth of 15.0`feet below ground
surface. The final log prepared for the test hole has been included in
Drawing A-01.
Ground water was not encountered in the test hole.

In conducting this evaluation, GEG provided an engineering evaluation of the well and/or septic system
in accordance with the guidelines and regulations established by the Municipality of Anchorage and
industry practices. The reported results descrbe the condition of the system/s on the date/s of the
evaluation. Separation distances were measured to readily identifiable features. Hidden defects or
encroachments may exist that were not identified during the evaluation. The operational lite of all wells
and septic systems depend upon a variety of variables, Including but not limited to, soil conditions,
groundwater levels (that may fluctuate during the year), quality of construction (materials and
workmanship), and the water usage of the family utilizing the system/s. These conditions can vary, and
are outside the control of GEG. Satisfactory test results do not guarantee future performance of the
system/s; therefore, GEG makes no warranty (express or implied) regarding the future performance of
the well or septic system. GEG makes no representation whether an alternative well or septic system
can be installed on the property in the event either of the current systems fall to perform adequately in

The justification for the passing result for the subject lot (Borealis; Lot 7) are as follows:
1. 833 gallons were introduced into the drainfield
2. This caused a rise of 32 inches in the monitoring tube (70-38)
3. This equated to 26 gallons/inch of rise in the drainfield (833/26)
4. Over a 120 minute period the drainfield dropped 16 inches (70-54)
5. 26 inches of drop in the dranifield equates to 416 gallons (26 gallons x 16 inches)
6. This equates to an absorption rating of 3.46 gallons/minute (416 gallons/120 minutes)
7. This equates to an absorption rating of 600+gallon/day, which meets the MOA requirements

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AW WTS), described as

2. Definitions.
Alteration. Any change to the design or function of an AW WTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AW WTS that were included
in the original design which would allow the AW WTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AW WTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AW WTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations. Installation and Removal of Additional Eauipment. Prior to
performing any alterations to an AW WTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AW WTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AW WTS
service and maintenance Provider approved by the municipality and the
manufacturer of the AW WTS for the entire term of the AW WTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AW WTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AW WTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AW WTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
H. Owner agrees that the AW WTS installation and maintenance requirements as
provided by the AW WTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AW WTS.
I. Owner agrees to provide and maintain a telephone connection to the AW WTS as
required by the AW WTS approval.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
S. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govem the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

Subject: Lot 7, Borealis Subdivision
Septic System Inspection and Test
Dear Mr. Schoff:
We recently completed the inspection and testing of the septic system on your
property. Records indicate the tank was placed and the absorption crib
constructed in 1974 to serve a four bedroom home. Soils tests performed at the
time estimated the absorption rate at 220 square feet per bedroom. The crib was
constructed with an effective absorption area of 819 square feet which is slightly
less than the '880 square feet required. The system was approved as
constructed and has been in service since that time.
Our initial probe of the crib indicated a standing water depth of 63" with a total
depth of the crib of 108". Water was then injected into the crib to determine the
absorption rate over a 24 hour period. The water level rose rapidly to the top of
the crib after 400 gallons of water had been added. The test was then halted as
water was starting to backflow into the septic tank. Three hours later the water
had receded to the 83" level. Additional water was then added to the crib
bringing the level again to the top. The water level was then checked the
following day and found to have receded to the 83" depth. It appears therefore,
the crib is capable of absorbing more than 600 gallons of water per day. The
surge capacity, however, is limited to 400 gallons.
The normal life of a septic system is from 8 to 12 years and can be less
depending on the type of system and quality of soils in which it is constructed.
Your system is now more than 25 years old and showing signs of failure. It is
difficult to estimate the remaining useful life of the system, but due to the limited
surge capacity it may be no more than 2 to 4 years.

Subject: Lot 7, Borealis Subdivision, Separation Distance between Class A public water system
source well and wastewater disposal system; ADEC Project Number: 704; Review
Dear Mr. Anderson:
I have completed my review of your November 8, 1999 submittal regarding the above -referenced project.
I could not find any information in the Department's files that showed when the Borealis Alpha Class A
public water system (PWSID Number 211708) was classified as a public water system. In the historical
information that I have on separation distances, the existing separation distance between the existing
source well and the wastewater disposal system located on Lot 7 meets the separation distance for semi-
public water systems.
Since the wastewater disposal system located on Lot 7 has passed a recent adequacy test, I believe that
your request is reasonable. Therefore, this Department has no objection to the existing separation
distance between the source well for Borealis Alpha Class A public water system (PWSID Number
211708) and the wastewater disposal system located on Lot 7, Borealis Subdivision.
This letter of non -objection is valid as long as the existing wastewater disposal system located on Lot 7,
Borealis Subdivision does not fail. Once any part of the wastewater disposal system fails, the home will
need to be placed on a holding tank or a separation distance waiver will need to be applied for. The
waiver request will need to include additional treatment to the wastewater stream and follow the submittal
requirements found in either the State Wastewater Disposal or Drinking Water Regulations.
