Narrative & Permit Application
Dear Mr. Cross:
The proposed septic system upgrade will have very limited impact on adjacent properties for the
following reasons:
1. This permit is for an Anchorage tank Advantex system, allowing reduction in
leachfield area.
2. The surrounding lots are large, allowing sufficient room for septic sites.
3. Immediate neighboring septic systems are all +30' distance.
4. Reserve space is limited, and but the old bed could possibly be used in the future.
5. Drainage will not be affected and is not a major consideration in our design.
This well and septic system will have little impact on adjacent lots, due to the large lot sizes.
Neighboring wells and septic systems have been located and identified. Impact to future wells
and reserved spaces will be minimal, or none. Drainage will not be affected by this design.
Please see attached letter requesting a lot line waiver.

Lot Line Waiver Application
Dear Mr. Cross:
The purpose of this letter is to request a waiver for the separation distance between the proposed
Anvantex leachfield, and the lot line of the above referenced property. The distance we are
requesting to be off of the lot line is 0'. The proposed site for the septic upgrade will have very
limited impact on adjacent properties for the following reasons:
1. The surrounding lots are large, allowing sufficient room for septic sites.
2. Immediate neighboring septic systems are all +30' distance, and wells +100'.
3. The lot line in question is common with the road right-of-way.
4. The road right-of-way is 60' wide, excluding any development (other than
roadway improvements) within that right-of-way.
For the reasons listed above, we believe that granting this lot line separation distance waiver of 0'
will not impact adjacent properties. If you have any questions please call our office at 694-5195.

SPECIFICATIONS FOR ON-SITE SEPTIC SYSTEM — MOA CERTIFIED INSTALLER
LEGAL: Broadwater Heights, Lot 5 Block 1
REV April 9, 2004
A. GENERAL
1. The well and septic plan is for a 3 bedroom single family residence only.
2. The drawing and or site plan shall be a part of this specification.
3. All materials and workmanship shall meet the Anchorage Department of Health and State Department of
Environmental Conservation requirements.
4. All soil tests are advisory to the design and are to be verified or modified in the field by the engineer.
5. All excavations and depths are advisory and are to be verified in the field by the contractor to meet Municipality of
Anchorage, Department of Environmental Conservation requirements.
6. The excavation is to be exactly in the area shown on the site plan, any deviation requires engineer approval.
B. ADVENTEX SYSTEM AND SEPTIC TANK
1. Septic tank shall be a fiberglass 1500 -gallon tank capacity of MOA approved construction for use with Advantex
system. Install as per manufacturers recommendation.
2. Install one AX -20 filter pod over septic tank capable of treating 600 gallons per day of waste flow.
3. Install Orenco 24" pump basin PB -2496 outside septic tank, with OSI pump model P30-05 and controls to allow 23
gallon dosing of septic leachfield. Set pump float to 13.5" above pump, timer for 1 minute dose time. Controls to be
installed to MOA code by licensed electrician familiar with OSI applications. Controls to include web based
monitoring system. NOTE: NO AUXILLARY PUMP STATION IS NEEDED IF A 2% SLOPE MINIMUM TO
LEACHFIELD CAN BE MAINTAINED.
4. A municipal inspection report or receipt from a licensed electrician shall be provided to the engineer verifying lift
station wiring to all applicable codes.
C. DRAINFIELD TRENCH
1. The trench is to be located as shown on the site plan.
2. The total depth of the initial drainfield excavation is to be 4' relative to existing ground elevation at ground water
monitor tube and end in scarified native GW soil material. The bottom of the trench shall be level, plus or minus
1.5".
3. A one foot layer of sewer rock is.to be placed over the native gravel. The 1.0" effluent piping is to be buried within
the gravel layer with 2" of gravel cover over the piping.
4. The completed trench gravel and piping is to be covered with typar fabric material.

Dear Mr. Granade:
it has come to the attention of this office that a water well on your property
thought to have been permanently decommissioned in October 1997 in fact still
exists. This water well is being encroached by a wastewater system located on
Broadwater Heights Block 1 Lot 4.
Our records indicate that in October 1995 you attempted to obtain waivers from
our office for two water wells on your property to this wastewater disposal system
on the neighboring property. The status of the water wells was that the furthest
well from the wastewater system was producing adequate water and was
connected to your house. The second well that was closer to the wastewater
system in question had an inadequate supply of water, was not connected to
your house, and was temporarily decommissioned. This office then granted a
conditional waiver with a list of conditions to be accomplished of which one was
to permanently decommission the second water well. These conditions were
never accomplished and an unconditional waiver was not granted.
In September 1997 a permit was issued to S & S Engineering for Broadwater
Heights Block 1 Lot 4 to move the end of the absorption field on this property so
that a 100 feet separation would be created between the producing well on your
property and the wastewater system in question. As part of the permitted project
the temporarily decommissioned water well on your property was to be
permanently decommissioned. Subsequently on or about October 1997 an "as-
built/inspection report" was submitted to our office by S & S Engineering that .
indicated the temporarily decommissioned water well no longer existed and the
wastewater disposal absorption field had been moved outside the 100 feet
setback to the water well connected to your house.
Please be advised that this office will not grant a Certificate of Health Authority
Approval until we are satisfied that the temporarily decommissioned water well
on your property has been permanently decommissioned pursuant to AMC
15.55.

Dear Mr. Cowan:
The subject waiver request submitted by your office on October 5, 1995 may be granted
provided the following conditions are followed and dye tests are negative. The requested
waiver was for a drainfield on lot 4 Block 1 Broadwater Heights to the well on the subject
lot. These conditions are necessary due to the unusually close proximity of the
temporarily abandoned well, the source of contamination is almost directly upgradient
from the wells in question, bedrock is encountered at very shallow depths, nitrate levels
are already elevated in the well water and the A.D.E.C. Waiver Guideline points do not
come close to the 16 necessary to justify the granting of the requested waiver.
The conditions are as follows:
1. The existing temporarily abandoned well shall be permanently abandoned;
2. The well that is currently being used shall be grouted to a minimum depth
of 40 feet from ground surface;
3. An adequate solution of dye penetrant shall be placed into the cleanout at
the end of the drainfield on Lot 4;
4. The subject well shall be tested on day 3, 5, 7, 9, 11, 13, 15, 17, 19, and 21
after the dye has been added into the subject drainfield.
5. The subject well shall be retested for production, coliform and nitrates.

The mitigating factors involved which support the issuance of
the waivers are as follows:

approximately 270 feet of bedrock.

The septic system on Lot 4 was installed in 1985. The wells
on Lot 5 were installed in 1975 and prior to 1975.
Therefore, the owner of Lot 5 is not responsible for any

ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE

THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AW WTS), described as
located at (legal/ descriptio/n).
2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On -Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On -Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AW WTS for the entire term of the AW WTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay
for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement
costs, and (5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules
and orders for the AW WTS.
C. Upon request by the Municipality, the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to grant the Municipality reasonable access to test and inspect the
AW WTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and
every provision hereof.
7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with
the same formality that this Maintenance and Repair Agreement was executed
with, and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement, the only authorized representatives of the parties
are:

C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

Approval (COSA) based only upon the representations given in paragraph 4 by an independent, professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer of

RE: Lot 5, Block 1, Broadwater Hts Well/Septic Comment Sheet on COSA Application
Dear Mr. poet/Ms Wockenfuss:
Reference is made to the "Comment Sheet" of November 18, 2011 (attached), from
Debbie Wockenfuss, pertaining to the COSA application that had submitted for the
referenced property. Each comment was discussed at some length with Debbie last week.
The purpose of this letter is to document my responses to these comments. Each response is
made in the same order and number of the comment. Also, to clarify, contrary to language
in the "Comment Sheet", the paperwork/COSA application that I submitted was not
returned to me.
1. A water storage tank, approximately 165 gallons in size, already existed for this
system. Per discussions with Debbie, due to the low outputlyield of the well, a total of 500
gallons was required for tank storage. This means that additional storage of 335 gallons was
being required. In response, a new 500 gallon tank has been installed in the garage.
2. The property has been vacant for more than six months; therefore the soil absorption
system was soaked for two consecutive days immediately prior to conducting the Adequacy
test on the septic system. A quantity in excess of 400 gallons was added to the system on
each of the two days used in soaking the system and a total of 610 gallons was used for the
adequacy test on this three (3) bedroom system. At no time, either on the two (2) days for
soaking the system or during the actual test, was there any measurable liquid in the soil
absorption field. It was also brought to my attention by Debbie, that another engineer had
previously tested the septic system in April, 2010, atime during which the previous owners
(prior to foreclosure) were still occupying the property and using the septic system. Debbie
advised me that the system had passed the Adequacy Test at that time and that there had
been no measurable liquid in the field at that time either. Given this information and the
results of my recent testing, using higher than the required test volume, I feel that the
volume of water used to soak the field was more than adequate. As such,l professionally
support my finding that, under use, the existing soil absorption field is able to absorb in
excess of the required 450 gallons per day.
3. This property has been foreclosed on and has been vacant; without a phone line for
Anchorage Tank to monitor the performance of the septic system. i did contact Tom Varney
of Anchorage Tank, requesting a copy of the maintenance records that he had on file. His e-
mail response and records are attached. In summary, he states that the system has performed
well in the past and that once someone moves in and reactivates the telephone line, that he
will resume the remote monitoring.
4. This comment pertained to the separation between the well and the septic tank (97')
and the waiver that was granted last year by the MOA. With the residence between the well
and septic tank there is no direct line of sight. I had. used the figure of 100' from the 2004
inspection report that had been accepted by the MOA. Information from the COSA
application of last year and the waiver for the 97' separation was not in the on-site files
made available to me. The previous application and this separation problem and subsequent
waiver, came as a surprise to me. Please make this correction for me in the checklist that I
had submitted for the COSA.
5. Debbie states that a STEP tank has 2 compartments. To me this is really an issue of
semantics. I have always taken the position that, with the lift station, there are three (3)
chambers or compartments in a STEP tank. I believe that history will show that in my
COSA applications to the MOA, that figure has been consistently used. However, if it is the
formal position of the MOA that this has to be termed a two (2) compartment tank; please
change the figure in my checklist for me.
G. Per Debbie's comment, the "total depth" of the soil absorption field is from the
existing grade. This question or blank to fill in on the MOA checklist has always been
confusing to me. I had assumed that "existing grade" was the grade at the time of the
installation: of the system. Debbie explained that it the current existing grade; in other words
after any fill has been added to the original existing grade. That being the case, please chine
the figure in my checklist from 4' to 5.5'.
7. The correct figure for "Pump Off', typed in the completed checklist that I submitted
is 73".
8. The method of determining the value for well production was discussed at length
with Debbie. She advised me that I could consider this comment as being resolved.
I hope that this now satisfactorily resolves all the outstanding issues and that a COSA
can now be issued for this property. The buyers are ready and very anxious to close on this

General
1. From the water sample, total coliform was 0, and total nitrates was 2.15 mg/L.
2. Any overflowing sewage would have to travel around the house to get to the well head.
3. Overflowing sewage would flow away from the well head.
4. The location of the system is in a visible area and any surfacing effluent will be seen and corrected.
5. The proposed system is the Advantex, Category III, nitrate reducing. Effluent meets secndary wastewater
treatment standards and is constantly monitored with remote telemetry by Anchorage Tank and Welding.

Ref: Waiver Request from Well to Septic Tank: Broadwater Heights; Block 1, Lot 5
The existing 4 bedroom house is served by a private well and septic system. During our site investigation
work to obtain a COSA, we discovered that the well on the subject property is only 97 feet away from the
existing 1500 gallon STEP tank on the subject property. We request you grant a 97 foot separation
distance waiver from the well to the STEP tank. The following items are justification for the waiver:
• The well and septic system are on opposite sides of the house. If effluent were to surface, it would be
unable to travel uphill towards the well head.
• The existing encroachment has existed for over 6 years.
• The topography of the lot is laid out in such a way that if the tank were to overflow, the effluent
would travel down the slopes in the complete opposite direction of the well head.
• We are only asking for a 3% variance.
• The existing septic system is a category III advanced wastewater treatment system that has remote
telemetry which monitors the system 24/7. If a high water alarm is encountered, the certified service
provider is notified and an audible alarm occurs automatically. This minimizes the potential for any
effluent to surface or daylight. The alarm condition will be responded to by the service provider to
make any corrections or fixes necessary. If the tank were to leak, a low discharge pump run time
would create an alarm condition that the service provider would respond to.
Based upon the aforementioned facts, it appears that there is minimal risk associated with granting the
requested 97 foot separation distance waiver.

SUBJECT: Private well to septic tank horizontal_ separation waiver,
Lot 5; Block 1; Broadwater Heights Subdivision (8521 -WA -006)
REFERENCE: Our letter. dated June 10, 1984 and your response dated
July 9, 1984.
Request you reconsider your rejection of the subject waiver. Tn
our telephone conservations subsequent to mailing of these letters,
you indicated that you had two significant concerns in granting the
waiver; (1) that the well casing terminated approximately 2 feet
before it reached. bedrock. I believe this to be in error and that
the well log reflects the well casing extending to a depth of 22
feet with bedrock beginning at 20 feet and extending to 625 feet.
The second concern you had was in that it was your belief that the
Municipality required a 100 foot separation distance from the well
to the septic tank in 1.974; however, the on-site inspection report
clearly shows that John R. Lee accepted a septic tank horizontal
distance of 85 feet on July 30, 1974 at the time he inspected
the system's installation.
This septic system is located down hill :from the well. There is
approximately 600 feet of bedrock between the point of discharge
of the septic ef>luent and the bottem of the well. There is over
155 feet of bedrock between the septic effluent and the normal
static water level in the well. This well and the septic system
have been in operation for almost 10 years without any evidence
of contamination. The coliform bacteria water analysis submitted
dated May 28, 1984 was satisfactory.

It is our contention that there is sufficient evidence to show
that the separation distances required by 18.AAC 72.:021 are not
necessary to prevent contamination of this well. If you desire
quarterly water samples can be required over an indefinite period
to assure the safety of the users.
