AGREEMENT FOR EASEMENT
THIS AGREEMENT, made this 16th day of June, 1986, is be-
tween Marie Fried and Stephen M. Fried, husband and wife, of
Anchorage, Alaska (hereinafter referred to as "the Frieds"), and
Lee Damron and Alissa Crandall, of Anchorage, Alaska (hereinafter
referred to as "the Damron/Crandalls").
Whereas, the Frieds own a parcel of real property,
hereinafter referred to as the "Fried lot," located in the
Anchorage Recording District, Third Judicial District, and more
particularly described as follows:
Lot Four (4), Shadowbrook Subdivision,
within the Anchorage Recording District,
Third Judicial District, State of Alaska;
and
Whereas, the Damron/Crandalls own a parcel of real prop-
erty (hereinafter referred to as the "Damron/Crandall lot")
located within the Anchorage Recording District, Third Judicial
District, and more particularly described as follows:

Whereas, the septic system now servicing the Damron/
Crandall lot encroaches onto the southeast boundary of the Fried
lot in the following manner:
1. The septic tank encroaches approxi-
mately one foot into the southeast bound-
ary of the Fried lot.
2. The leachfield and septic tank stand-
pipes are approximately 0.7', 1.5', and
2.4' from the southeast boundary of the
Fried lot which indicates that there is
an encroachment onto the Fried lot.
Title 15 of the Anchorage Municipal Code
requires the leachfield and septic tank
standpipes to be a minimum of 10' from
the property line. 15.65.060.
3. The sphere of influence of the septic
system encroaches approximately 10' onto
the southeast boundary of the Fried lot;
and
Whereas, the Frieds and the Damron/Crandalls each wish
to refinance the mortgages on their respective lots which
requires approval of their waste water systems from the
Municipality of Anchorage, Department of Health and Environmental
Protection~ and
Whereas, the Municipality of Anchorage, Department of
Health and Environmental Protection will not. approve the Damron/
Crandalls' system unless the Frieds grant the Damron/Crandalls an
easement; and
Whereas, the Damron/Crandalls wish to avoid the expense
and difficulty associated with relocating their septic system to
avoid encroachment onto the Fried lot; and
Whereas, the Frieds desire to define and make certain
the rights and responsibilities of the parties with respect to
the encroaching septic system now serving the Damron/Crandall
lot;
WITNESSETH :
For and in consideration of the mutual covenants and
promises herein contained, the parties hereto agree as follows:
1. Grant and Conveyance of Easement By Frieds. The
Frieds do hereby grant and convey to the Damron/Crandalls, sub-
ject to paragraph 2, below, an easement and right-of-way for the
limited purpose of operating and maintaining a septic system
across and under the following-described real property in the
Anchorage Recording District:
A portion of Lot Four (4), Shadowbrook
Subdivision, and more particularly
described as follows:
A ten foot (10') strip of land
northwesterly of and adjacent to
the southeasterly property line of
Lot Four (4) of the Shadowbrook
Subdivision, together with the
right of ingress and egress to and
from the above-described real prop-
erty at such times and for such pur-
poses as described in paragraph 2,
below.
2. Scope of Easement. The following shall be con-
ditions precedent to entry upon and the use of the easement
granted in paragraph 1, above:
a. The easement described and conveyed herein
shall expire automatically and be immediately null and void
upon the failure of the existing septic system or upon the
availability of a sewerage system, whichever occurs first.
b. The easement described and conveyed herein is
expressly restricted to the present septic system maintained
and utilized by the Damron/Crandalls. Any expansion of the
scope of the present septic system or the activities per-
mitted under the easement granted herein will render this
easement immediately null and void.
c. Subject to the provisions of paragraph 2(d),
the right of ingress and egress to and from the easement
described and conveyed herein is expressly limited to main-
tenance to the leachfield or septic tank standpipes. In no
event shall any equipment of any nature be driven across the
Fried lot in order to access the easement for repairs or

maintenance. The Damron/Crandalls expressly agree that all
such equipment shall be driven across the Damron/Crandall lot
to access the easement.
d. In no event, other than an emergency as
described herein, shall the Frieds be given any less than one
week's notice of any proposed entry upon the real property
described in paragraph 1, above. Said notice shall be writ-
ten, shall be hand delivered to the address described in
paragraph 4, below, shall contain a designation of the times
and dates Upon which the activity is to begin and end and a
brief description of the activities contemplated by the
holder of the easement, its agents and servants. An emer-
gency as defined herein shall be deemed to include any unfore-
seen contingency or event which may reasonably be deemed to
pose an imminent threat of damage to life or property.
e. The Damron/Crandalls must, within seven (7)
days of the completion of any maintenance, repair or other
activity permitted hereunder, restore the Fried lot to its
condition' immediately preceding such activity, including the
replacement of any trees removed with trees of like nature,
and remove all debris, trash, and waste materials connected
with such activity. In the event that winter weather con-
ditions preclude restoration of the Fried lot to its natural
condition, said restoration shall take place as soon as is
practicable, but in no event later than June 15 of the next
summer. The Frieds shall be given no less than three days'
notice as to the nature of the restorations and the date on
which they shall commence. It is the express understanding
of the parties hereto that any and all activities conducted
hereunder shall be at the sole expense of the Damron/
Crandalls, their successors and assigns.
3. Successors and Assigns. This Agreement and the
easements described herein run with the land and are binding upon
the successors and assigns of the parties to this Agreement and
the obligations imposed upon the Damron/Crandalls herein shall
also be the obligations of any future owners of the Damron/
Crandall lot.
4. Notices. Notices required or authorized by this
Agreement shall be delivered by hand to the parties or their
agents at the following addresses:

5. Integration. This instrument constitutes the
entire agreement hereto and sets forth the rights, duties, and
obligations of each to the other as of the date of its execution.
'Any prior agreements, promises, negotiations, or representations
not expressly set forth herein are of no force and effect and all
understandings and agreements are merged herein and no provision
hereof~ may be waived except in a writing signed by the party to

be charged with such waiver. This Agreement inures to and shall
be binding upon the heirs, executors, administrators, successors
and assigns of the parties hereto.
6. Severabilit¥. If any provision of this Agreement
or the application thereof to any person or circumstance is held
invalid, the invalidity shall not effect other provisions or
applications of the Agreement which can be given effect without
the invalid provision or application and to this end the provi-
sions of this Agreement are declared to be severable.
