Wastewater Disposal System-ADEC Plan Tracking Number 5333
Dear Mr. Dee High:
On November 22, 2005 our office received an engineering plan for a failing onlot wastewater
treatment system to install a new 2,000 gallon STEP septic tank and a new soil absorption system
for the five bedroom duplex as located above. The proposed plan requires two waivers be
approved.
The waivers are from the existing well serving the duplex. Each have been reviewed and based
upon the engineers recommendation, soil conditions, well test results and site conditions are
approved as follows:
1 The new STEP septic tank can be placed at a distance no closer than 93 feet to the
existing well which serves this duplex.
2• The new onsite soil absorption field can be placed at a distance no closer than 87 feet
to the existing well which serves this duplex.
The new 2000 gallon STEP tank will pump into an onsite soil absorption system which has a
length of 94 feet with an effective depth of 4 feet and is 5 feet wide. The engineer's design has
required 3 feet of cover material and 2 inches of Dow Chemical Company Styrofoam HI (Blue
Board) or equivalent.
The soil is a silty, sand, and gravel, with percolation tests results of 15minutes per inch and
1.8minutes per inch test resulting. The soil absorption system was designed using the 15 minute
per inch value.
The Department has reviewed the engineering plans submitted for the subject project and
conditional approval to construct the proposed system is hereby issued. A "Certificate to
Construct" for the community wastewater system is enclosed. Please use the referenced plan
number in correspondence regarding this system.
This approval is contingent upon compliance with the following conditions:
1) The soils information has values which are not consistent, to assure the design is
complied with, please provide site inspection by the engineer at the time the soil
absorption system is installed.
2) If the applicant fails to construct, alter, install, or modify the system within two (2) years
after the date that the department issues an approval to construct, the approval is void,
and plans must be resubmitted, [along with associated fees], for department review and
approval.
3) Deviations from approved plans which affect capacity, flow, operation, major design of
units, point of discharge, materials of major system components (such as.pipe, lagoon
liners, etc.), or separation distances, must be approved by DEC
implementation. in writing prior to their

6) You are advised that if this development will require placing fill in wetlands or working
in a stream, river, or lake, permits from the U.S. Army Corps of Engineers and the Alaska
Department of Natural Resources may be required. A Coastal Projects Questionnaire
will help you identify other permits and approvals that may be required for your project.
This approval does not imply the granting of additional authorizations nor obligate any state,
federal or local regulatory body to grant required authorizations.
Any person who disagrees with this decision may request an adjudicatory hearing in accordance
with 18 AAC 15.195-18 AAC 15.340 or an informal review by the Division Director in
accordance with 18 AAC 15.185. Informal review requests must be delivered to the Division
Director, 555 Cordova Street, Anchorage, Alaska 99501, within 15 days of your receiving the
decision. Adjudicatory hearings requests must be delivered n the Commissioner of the
.Department of Environmental Conservation, 410 Willoughby Avenue, Suite 303, Juneau, Alaska
99801, within 30 days of the decision. If a hearing is not requested within 30 days, the right to
appeal is waived.

Submit to ADEC two maps. A site map showing the exact location, (latitude and longitude), of all facilities associated with the
project.
Include a topographic map or aerial photograph showing the general location of the facility, discharge area, and expected flow direction
of the discharge, including nearby drinking water sources within '/4 mile. Also indicate approximate distance from any surface water
(stream, river, ocean etc). Provide name of nearest surface water.

BEST MANAGEMENT PRACTICES: Provide a description of the practices that the facility operator will use to reduce the amount of
wastes that would otherwise be disposed of in the wastewater. This includes ways to reduce the amount of wastewater that would include
toxic materials (oil, antifreeze, household cleaners, solvents), solid wastes (paper, plastics, etc), and excess wastewater. Local educational
programs can be proposed as a way to help the community reduce these wastes before they enter the wastewater, and to conserve water. This
will help reduce the pollution accumulations in and near the community, as well as meet the requirements of State Law (AS 46.06.021).

Duplex Residential Structure
Well Waiver - Separation to 150' Protective Well Radius
Dear Mr. Rieth,
There exists on Lot 5, Block E, Sunset Hills Subdivision a duplex consisting of 4 bedrooms. ``The duplex was
constructed in the 1960's. The existing septic system has failed and the Owners is pumping the tank and field on
a regular basis. The current system was built in the 1960's with an extension to the absorption field in 1977. The
existing tank sets about 67 feet from to existing well.
A replacement system can not be constructed outside the 150' protective well radius and will therefore require a
waiver from your Department. A design for a replacement system is attached. The septic tank and the absorption
field have been moved as far away from the existing well as possible. The tank now set 93.6 feet from the well and
the field sets 87.6 feet from the well.
Attached is a copy of the water sample report showing Coliform and nitrate results. The is zero coliform , zero
bacteria, and nitrate's were non-detectable. As you can see, there has been no contamination from the existing
system which has been in place for over 30 years and which set a lot closer to the well than the new design.
The following is the documentation which supports those prior approvals. Our analysis is based on the procedures
as outlined in the State of Alaska Memorandum dated January 3, 1985, prepared by Mr. Bruce Erickson.
Geological:
a. Water Table:
The static water for this well is 91 feet, Research of other wells in the immediate area suggests the
static water level is around 90 feet below the surface..
The bottom of the septic pit is 7' below grade, giving a separation distance of 83 feet.

b. Soil Type:
The well log indicates that the Soil type is a mixture of silt and gravel. In looking as other information,
the soils have a slow percolation rate. These type of soils significantly reduce the risk of cross
contamination.

The water table'in this portion of the Hillside area have gradients which slope to the west, The point
source would be toward the well; at gradients of 94%.

These five categories give a Total Point Value for this well of: 15.7
This point value indicates that no biological pollution is likely and chemical pollution is possible but unlikely from
household chemicals. The water samples tests indicate
e no biological pollution over the past 30 years, confirming
our analysis. In addition, the new design improves the separation distance for some of the system from what is
currently existing on the property.
Proposed system appears to meet all the requirements for a waiver. Please give us a call if you have any

Linda Bingle, being first duly sworn, on oath says:
that I have reason to believe that there is concealed on the
premises owned by a Howard Luther and described as Lots 5 and
, Block E, Sunset Hills Subdivision, on Dennis Way within
~he jurisdiction of Anchorage, Alaska, a defective and impro-
.erly maintained on site septic tank-seepage pit system that
~auses or permits the discharge and flow of sewage upon the
in violation of Anchorage Municipal Code S~ 15.70.020(C)
and (H); that this affidavit is based upon the following
reasons for my belief:
1. On August 23, 1977, in response to complaints
from Mr. and Mrs. Barnes, area neighbors who own Lot 12,
Block 2, Turnagain Subdivision No. 2, my inspection of Mr.
Luther's property described above revealed a standpipe
filled with sewage and 'the presence of a bad odor. Mr.
Luther refused to allow me to dye test his sewer system to
see whether it was functioning properly.
2. On September 8, 1977, I again inspected the
of Mr. Luther described above and observed sewage
~lowing on the ground down from Mr. Luther's house and
across his property and smelled a strong sewage odor. I
collected a water sample from a puddle of water within the
sewage stream about 12 feet from its source. Subsequent
analysis of the sample revealed a coloform density of 160,000
units as the most probable density per 100 ccs.
3. On September 13, 1977, I again inspected
~ property and detected some sewage odor and observed
5 green-gray discoloration on the ground indicating the

To whom it may concern:
The existing property has a 4-bedroom duplex on it that is served by an onsite well and septic system.In 2005,septic
systems serving duplexes were regulated by ADEC. In 2005 the property owner retained DHI Consulting Engineers
to design a septic system for the subject property. On November 29, 2005 ADEC issued "Approval to Construct"
(ATC)for a new septic system on the subject property. A copy of the design and the ADEC ATC construct letter is
attached with this submittal. In May of 2006 Beek's Contracting, Inc installed the septic system (see the attached
letter from Daniel Beek dated September 5, 2017); however, we have been unable to find any evidence that the
installation was inspected/documented by a professional engineer. We contacted DHI Consulting Engineers in
September of 2017 and they were unable to find any evidence that they performed any inspections or documentation
of the installation. Furthermore,ADEC did not have any records of the installation and did not issue"Final Approval
to Operate". In short, the installation appears to be undocumented. Since the time of the installation, regulatory
oversight of septic systems serving duplexes within the Municipality of Anchorage(MOA)transitioned from ADEC
to the MOA. The purpose of this submittal package is to document the installation with the MOA and obtain a
Certificate of Onsite Systems Approval(COSA).
Per the ADEC ATC letter the following waivers were granted:
• STEP tank to well: 93 feet
• Absorption field to well: 87 feet
Based upon the Lee Karabelnifoff, LS asbuilt survey (dated 5/23/2017) and GEG's limited field investigation, it
appears that the well is approximately 83 from the lift station and approximately 87 feet from the drainfield. In
addition,the drainfield is located approximately 3 feet from slopes greater than 25%(see attached slope drawing). It
should be noted that the drainfield was not exposed,so the exact separation to the lot line is unknown. Per the 2005
design drawings by Dennis Dee High, P.E., a portion of the trench at the southeast end extends unknown distance
towards the east lot line (assumed 10'+). We are requesting that your department waive the required separation
distances as follows:
• Private well on lot to the STEP tank on lot: 80 feet
• Private well to on lot to the drainfield on lot: 85 feet
• Drianfield to slopes greater than 25%: 3 feet
Justifications for granting these waivers are summarized as follows:
• The geological conditions that were used to obtain the initial ADEC waivers granted in 2005 still apply
• All the subject encroachments has existed for approximately 12 years(since May 2006)

• Water samples were pulled on 8/25/17,the results are as follows:
-Arsenic: ND<5 ug/L
-Nitrate: 0.335 mg/L
-E.Coli:Negative
-Total Coliform: Negative
• No daylighting of sewage was observed on 9/12/2017
• The well has a casing stick-up of approximately 18 inches and is located on the opposite(northwest)side of
the home
• Given the site topography,if the drainfield were to fail,the sewage could not travel towards the well.
As can be seen there is minimal risk in granting these waivers. We are unaware of any adverse impacts associated
with the granting of these waives
The following record drawings are based upon the following limited information:
• Design package and waiver requests submitted by Dee High,P.E to ADEC on November 16,2005
• ADEC issues of Approval to Construct dated November 29,2005
• Written Statement (copy attached) from Daniel Beek, dated September 15, 2017, declaring that the septic
system was installed as per the DHI Consulting Engineers design.
• Written Statement(copy attached)from Daniel Beek,dated September 15,2017,declaring that the old septic
system was decommissioned per the Uniform Plumbing Code(UPC).
• Asbuilt survey prepared by Lee Karabelnikoff,IS and dated May 23,2017
• Email statement by the property owner Brad Sathers(attached)that the electrical work was inspected by the
Municipality of Anchorage
• Limited investigation prepared by Garness Engineering Group Ltd(GEG)Field Technician, which included
establishing elevations(relative to a benchmark—Top of STEP tank MH lid)of bottom of tank, bottom of
monitoring tubes,and final grades. Work also included swing-tie measurements to all visible clean-out pipes
and monitoring tubes. GEG performed no subsurface investigation.
• GEG review of ADEC records which were provided to GEG by the property owner and ADEC
• STEP tank pumping receipt dated 8/18/2017
GEG makes not statement regarding this installation or its compliance with ADEC or MOA regulations other than the
other than what was obtained from the aforementioned information. Based upon the information provide, we are

This letter is to inform you that Dan Beek, President/Owner, Beek's Contracting Inc., installed a new
septic system for Brad Sathers at 2420 Dennis Way,Anchorage,Alaska, in May 2006. The new system
was designed by DHI Consulting Engineers and installed as per their design. The old system was
decommissioned per the Uniform Plumbing Code (UPC). Inspections were performed at the time of
installation of new system as required.
