on procedures outlined in the Certificate of On -Site Systems Approval Guidelines for this application, shows that the

Municipality of Anchorage files and from my investigation and inspection, the on-site water supply and/or wastewater
disposal system is (are) in compliance with all applicable Municipal and State codes, ordinances, and regulations in

Comments: This investigation was completed in compliance with MOA guidelines, regulations,
and best industry practices / methods. The assessment of the condition of the well and septic
applies only to the conditions as of the day tested. The flow and absorption rates may change
due to subsurface conditions that may not be observed from the surface, changes in land use,
local soil characteristics, groundwater levels that may fluctuate during the year, quality of
construction (workmanship & materials), the water usage of the family being served by the
system and maintenance. The operational life of all well and septic systems are subject to
these various and dynamic characteristics and are outside the control of the evaluator of the

MAINTENANCE AND'REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT," herein the "AGREEMENT" made and

(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreementagree asfollows:
1: Advanced Wastewater Treatment'Svstems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System(AWWTS),
described as A BIOCYCLE SYSTEM

2. Maintenance. Repairs and Alterations.
(Owner is required to read, understand and initial each section)
4fThroughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
' Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs--- drainfield
replacement.

Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
- Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On -Site Systems Approval.
,Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

General
1. Total coliform and nitrates were not detected for the water sample collected from the well on the subject lot. Other
bacteria of 3 colonies per 100 miililiters was reported for the water sample.
2. The well on the subject property was installed prior to 1969. The well appears to be cased to at least 88 feet. The
static water level on May 6, 2005 was 88 feet. The well log from Lot 9A indicates that approximately 30 feet of
gravelly silt and hardpan soils serve to inhibit the migration of untreated wastewater into the aquifer.
3. The Biocycle tank on the subject property was installed on July 6, 2005, with an assumed total depth of 10 feet
from original grade.
4. The house and driveway is located between the well and the septic tank. The lot is generally flat with a slight slope
from north to south. The driveway slopes from east to west. Because of the location of the driveway between the
well and the wastewater disposal system, it appears that the effluent would not travel toward the well head.
5. The location of the septic system is in a very visible area so that if any effluent was to surface, it would be noticed
and the problem corrected.
6. Due to location of water wells on surrounding properties, there appears to be a limited area for a wastewater
disposal system on the subject property to meet the minimum separation requirements to the water wells.

Dear Ms. Makela
A new Bio Cycle tank was installed at Lot 9B Block E Sunset Hills on June 6th, 2005. Due to
site restrictions and a surveying error the separation distance between the septic tank and the well
on lot 9B is approximately 97 feet (98.63' edge of well to edge of Biocycle lid, Lantech). The
location of neighboring wells, the Old Seward Highway, a 4 -foot retaining wall, and a fence
make the cost of moving the tank prohibitive. To prevent an encroachment of the well radius on
Lot 9A, the tank would have to be moved into the driveway, towards the Old Seward Highway.
In addition, construction of a 6 to 10 foot high retaining wall around the east side of the tank
would be required to ensure access for maintenance.
We are applying for a waiver of the separation distances required between the septic tank and the
well serving this lot.
Separation Distance: Well to septic tank 97 feet.
A soil log for Lot 9B Block E Sunset Hills shows 3.5 feet of fill, 3 feet of silty sand, followed by
clean sand to a depth of 16 feet. The percolation rate of the sand material is recorded as 4
minutes/inch.
The well log for the well serving this lot is missing. An on-site sewage disposal system
inspection report dated September 3, 1969 lists the well depth as 80 feet. On May 6" `, 2005 the
static water level was found to be at 88 feet below the top of the casing. At a pumping rate of 5.7
gallons/minute the water level dropped to 90 feet below the top of the casing. A document

search for well logs on the neighboring lots indicate the following soil layers; Hardpan w/ 40%
gravel and small boulders, gravel and cobbles, sandy clay & gravel, wet sand, silty gravel and
cemented gravel.
Water samples were collected on June 3rd, 2005 and analyzed for total coliform, other bacteria,
and nitrate. Total coli form was not detected in the water sample, 3 OB's were reported. Nitrate
levels were below the detection limit.
Mitigating Factors:
The lot slopes from the well towards the septic system. In the event of a septic system failure,
this would tend to carry any surface effluent away from the well.
Water quality analysis indicates that the nitrate and total coli form levels are well below the
required standards.
Bio Cycle tanks are constructed of fiberglass and insulated with closed cell foam. Fiberglass
does not corrode and should never leak. Bio Cycle tanks are inspected on a quarterly basis and if
its integrity were to be compromised it would be noted and repaired. They provide an effluent
that is of higher quality than that of a standard septic tank.
Attached is the soil analysis for L 9B B E Sunset Hills, an As -built survey showing the location
of the well, the septic system and the wells on Lot 9A, and Lot 8, water sample results for coli
form and nitrates (lot 9B). Well logs for lots 9A and Lot 8 Sunset hills, and an estimate of the
cost involved in moving the tank.
At this time we are applying for an On Site System Approval, and request that a formal waiver be

Gentlemen:
Moving the septic tank 3 feet to the west involves considerable costs and challenges. Due to the
configuration of the neighboring wells the tank must be moved a minimum of 4 feet to the west.
This would place the tank in the driveway. The topography of the lot slopes in that direction,
which would require dropping the tank a minimum of 6 feet from its current elevation. In order
to maintain access to the tank without re -grading the entire front lawn a retaining wall would be
required. Below is an estimate of the cost involved. This does not include the cost of replacing
the fence which needs to be moved or returning the front yard to its current condition.
