Dear Mr. Smith,
This letter is in reply to your letter dated O~tober 2, 1990
the referenced property.
On October I0, 1990 the contractor excavated a tut hole adjacent to
the northside of the absorption bed. This test hole was ~xcavated in a
manner that wou~d provide a cross-sectiono~ view of the absorption bed
and was to a depth of 4' below the sand layer. The hole was dry at the
time of ex.ration.
On October 11, 1990 the co~ractor, Dan Roth from your office and
myself ~xamined the t~st hole which at this point in t~e had water in
the bottom of the hole. Measuring vertically from the bottom of the
sewer rock to the water was $9". M~asurements identified by item #2 of
your l~tter could not be verified. However, since the separation
distance was less than 4' the contractor proceeded to construct a
~rtain drain approximately 25' up slope from the absorption bed.
The curtain drain was completed on October 20, 1990 and a 4" monitoring
wU was installed approximately h~f way between the ~zrtain drain and
absorption bed. Mr. Roth and Mr. Robinson of your office revisited
the site with me on October 24, 1990, measurement~ taken in the
monitoring w~ll verified a separation between the water lev~ and the
bottom of the absorption area to be in ~xcess of 4'.
Additional fill was placed on the lower side of the asborption bed to
flatten the slope and ~xtend the toe of the slope. This work was
inspected by Mr. Robinson and Mr. Roth and found to be satisfactory.
Exposed water and sewer piping upstream from the septic tank had been
plac~d behind a shifting materi~ that completely enclosed the crawl
space ar~a under the house. The piping is now protected in a manner
similar to that provided by standard crawl space construction and
shoed satisfy your concerns.

Notice of Violation

Dear Mr. Shafer:
The purpose of this letter is twofold, namely (1) to return the
attached disapproved as-built drawing so the corrected
deficiencies in the mound system can be shown, and (2) to serve
as your Notice of Violation for the deficiencies in this
installation defined below.
Permit #SW900206 was issued on July 19, 1990 for the
installation of an engineer designed mound system upgrade on Lot
3 Sunny Valley Subdivision. It was clear!y stated on this
permit that the "Engineer must notify. DHHS 24 hours prior to
construction. DHHS must be present during both required
inspections." This office was not aware that construction of
this upgrade had been commenced until the as-built drawing was
received on September 14, 1990. This is in violation of AMC
15.65.135.A, which was in effect at that time. Subsequent to
receiving the as-built drawing on this upgraded system, this
office conducted three on-site inspections during which the
following discrepancies were noted:
There is insufficient separation between the eastern
most edge of the mound and an approximate 45% slope
which drops vertically an estimated 40 feet. AMC
15.65.040.I.2, which was in effect at that time
requires a 50 foot horizontal separation.

Groundwater observations on September 20, 1990 and
September 24, 1990 showed a vertical separation between
the bottom of the absorption field and the groundwater
table to be 2.05 feet and 2.04 feet respectively. This
is iR violation of AMC 15.65.060.A.3 which was in
effect at that time.
3. The exposed sewer and water piping upstream of the
septic tank and well must be insulated as required by
the permitted design.
The above itemized deficiencies must be corrected before this
system will be approved. If this residence is occupied before
remedial action is completed; the septic tank must be blind
flanged at the discharge outlet and Utilized as a temporary
holding tank. If this action is initiated, appropriate high
level alarms must be installed and a pumping contract
negotiated· It is strongly recommended that the remedial work
be completed before the ground is frozen. No additional permits
will be required for this remedial work.

Dear Ms. Brittan:
It has come to our attention that the subject property has
recently undergone foreclosure. It is our understanding that
Rainer Mortgage is the current title holder of this property.
This property is served by a private sewage disposal (septic)
system and well. During the past three months the Department
of Health and Human Services has responded to numerous
complaints of overflowing sewage glaciating on the roadway
below the subject property. An investigation of these
complaints determined that the septic system serving this
property was the cause of this sewage overflow. This poses an
immediate health hazard to the neighborhood. The current
resident of the pr6perty, L.H. Knight was notified that he was
in violation of Anchorage Municipal Code. Attempts to gain the
cooperation of Mr. Knight and a voluntary resolution of the
problem have been unsuccessful.
There are a number of possible causes of the septic system
failure. The failure could be the result of ground water
intrusion, system overuse, or perhaps freezing. The precise
cause of the failure cannot be determined without further
investigation.
This investigation should take place as soon as possible
because it is very likely that system failure may be seasonal;
the problem may occur only during the winter and early spring.
A private civil engineer should be hired to determine the cause
of the problem. In any event, the design and installation of a
remedy to the problem should be completed by July 1, 1987.
Designs for the proposed installation should be reviewed by
this Department prior to construction.
As a temporary solution to the problem, we asked Mr. Knight to
convert his existing septic system into a holding tank by blind
flanging the outlet of the existing septic tank. This would
prevent sewage from being discharged into the leachfield until
a permanent remedy for the septic system's problems could be
found. This temporary fix would allow the house to be occupied
until the spring thaw when any excavation required for a
"permanent fix" could be accomplished at a more reasonable
cost. Mr. Knight has refused to blind-flange the tank.
Dye wasintroduced into the septic system on March 20 in order
to detect any further occurrences of overflowing sewage. A
citation will be issued to Mr. Knight and/or the registered
property owner if the dye surfaces below the leachfield. As
title holder to this property, please be aware that you can be
cited for a violation of municipal code.
It is our intention to bring this problem to your attention and
bring about its expedient resolution. Thank you for your

Dear Mr. Knight:
As you know, the septic system serving your house has been
determined to be illegally discharging sewage onto the surface
of the ground and into groundwater. This is a violation of
AMC 15.65.020. You were notified of this violation on the 6th
of February.
After observing the septic system over the past weeks,
measuring the levels of the effluent in the absorption bed, dye
tracing the effluent, and measuring fecal coliform levels in
the groundwater and glaciation below the septic system, we have
come to the conclusion that the septic system is being
innundated by groundwater. This groundwater is mixing with the
effluent from your septic system and emerging on the surface of
the ground below the system. Dye tracing and high levels of
fecal coliform bacteria in the ice and groundwater below the
system have confirmed that the septic system has indeed
contaminated surface and groundwater.
This is a situation that unfortunately has no easy solutions.
The illegal discharge of sewage cannot be ignored indefinitely
however. You will have two weeks from the receipt of this
letter to modify or upgrade your septic system so that
untreated sewage is no longer being discharged onto the ground
or into the groundwater.
This can be accomplished in a number of ways. An acceptable
short term solution is simply to seal off the outlet of the
septic tank to prevent sewage from reaching the absorption
bed. The septic tank will then serve as a holding tank. This
tank will have to be pumped on a frequent basis because of its
relatively small volume. A permanent solution to the problem
can then be delayed until after breakup.
Another possible alternative is to construct a curtain drain to
divert groundwater around the absorption bed. The feasibility
of this alternative must be determined by an engineer and plans
approved by this Department before construction begins. It is
possible to construct the curtain drain before breakup thereby
providing a permanent solution to the problem now.
If the curtain d~ain alternative is not feasible, it may be
necessary to construct a mound-type septic system. The
existing absorption bed would have to be rebuilt and raised
four feet above the water table. Construction of this type
system is best delayed until after breakuP.

In any event, weare requiring that the system be brought into
compliance within two weeks of receipt of this letter. In the
interim period the septic tank must be pumped weekly. Failure
to comply with the terms of this notice will result in legal
action.

The length dimension is the length(in feet)'of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the o~tfall pipe
the bottom of the excavation(in feet).

of residences that the well will serve.

Backfilling of any system without final inspection.and approval by this department
will be subject to prosscution.
Minimum distance between a well and any on-site sewage disposal system is 100 feet
for a private well or 150 to 200 feet from a public well depending upon the type
of public well. Minimum distance from a private well to a private sewer line
is 25 feet and to a community sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days Of the well completion.
Other requirements may apply. Specifications and construction diagrams are
available to insure proper installation.

Subject: Lot 3 Sunny Valley Subdivision, Septic System Approval
Dear Ms. Caselli:
Please consider this letter as a follow-up to the phone
conversations we have had in the past week. You are well aware
of the problems that the septic system serving the subject
property had last winter. The primary interest of this
department is to prevent a re-occurrance of these septic system
problems in the future.
Given the past problems of the septic system, you have asked if
the Health Department would object to you occupying the house
prior to completely resolving the problems with the septic
system. The department does not object to the occupation of
the house on a temporary basis with the following stipulations:
The existing 1250 gallon tank must be blind-flanged
(the outlet must be capped-off) and equipped with a
high water alarm system.
The occupant of the house must enter into a pumping
contract with a department-approved septic system
pumper and pump the tank on an as-needed basis.

Ground water monitoring must be initiated to
determine the cause of the problems with the
existing septic system and to determine if the
existing septic system is in compliance with
municipal code. This investigation may also serve
to provide engineering data for a new septic system
if it is determined that the existing system is
non-functional or does not meet code requirements.
This investigation must be conducted by a registered
civil engineer.

The house plumbing must be insulated and heat taped
or otherwise satisfactorily protected from freezing.
Funds must be escrowed in an amount sufficient to
cover the cost of a septic system upgrade to meet
municipal code requirements. If deemed necessary,
this upgrade must be completed no later than July
15, 1988.
This letter does not constitute a formal "Health Authority
Approval" (HAA) for the subject property. A HAA can be issued
for the property pending a satisfactory well flow test and
water sample results. This HAAwould be issued with the same
stipulations referred to above.
