The Department bas reviewed the advanced treatment system and the onsite soil absorption
system to serve the throe plex and conditional approval to construct in accordance with
Wastewater Resoled= 8 AAC 72.225. The proposed system is hereby Issued a "Certificate to
Constnut for the edvanced wastewater system (enclosed). Please use the referenced plan
tracking rumba in corn spondenuro regarding this system.
This approval Is contingent upon compliance with the following conditions:

I) The A7t20 pod when starting to operate requires field adjustment to meet the expected
discharge design effluent requirements. Include an inspection report on the treatment
system after the adjustment et start up of the units has been completed
2) A current Maintenance Agreement must be on file with tbia office. In:Jt4c the name and
address of the maintatcncc providers. The maintenance provider be trained on the
proper operation of the unit by the mamfactmer. Be advised a current mettle's/nee
provider must be in-place for the life of the system. Maintenance inspections must occur
at least once each year and include an inspection of the soil absorption arm to assure that
effluent from the system is not surfacing. A brief tvdtten report for each annual
inspection roust be provided by the maintenance provider to the owner. The owner of the
system must retain all maintenanwinspection records and make them available to the
department if requested. The treatmer; system should be pumped -out on an as•oecded
basis, based on the annual inspection. If the inspection reveals surfacing effluent or if
seepage from the soil absorption system is noted at any time, the owner must notify the
Anchorage ADEC office within one working day.

Dear Mr. Kvasager:
In response to your letter of October 2, it is my understanding
that staff had some concern with the note placed on the plat and
referenced in your. letter. Specifically, their concern is whether
the note adequately portrays the full intent of the Platting
Board's decision with respect to Lot 782. As you know, once a
plat is filed and property becomes a lot of record, the
regulations governing the use of an on-site septic system are
different from those covering unsubdivided property.
With the above thought in mind, I understand that my staff through
Jerry Weaver, the Platting Officer, suggested an additional noLe
for the plat that they felt would address their concern and
clearly express the full intent of the Platting Board. On October
6, Mr. Weaver advised my staff that you objected to placement of
this note on the plat. At the conclusion of that discussion, my
staff concurred with Mr. Weaver that the plat should be filed.
This has been accomplished to the best of our knowledge.
I do not find any evidence of coercion in this matter on the part
of staff. They made a proposal to you, you rejected it and that
ended the discussion No doubt you have been advised by now that
the plat was filed earlier this month. I hope this adequately
explains our interest in this matter and that we can now consider
it closed.

The referenced plat was heard and approved on March 1989. The approval was
contingent upon placing a specific note regarding development of on-site sewer and
water. This note was to be:
"Lot 7B1 cannot be developed until public sewer and water is available and Lot
7B2 cannot be developed until public sewer and water is available or approval
from DIMS has been obtained for on-site septic."
This plat and its contingent approval did not happen in a vacuum. All departments
commented and a thorough public hearing was held. The Platting Board carefully
considered this plat and, after lengthy and sincere discussion, approved 88753 with the
note as above recited. Mr. Smith and Mr. Browning, personnel in your department, were
against the plat and continue to oppose its recording. However, the Water Quality
Supervisor, Mr. Marc Little, had "no comment" on his September 26, 1988 review of
S8753. It is my position that if your department had such an overwhelming concern
about the impact on the public's health, safety, welfare and convenience, your department
should have appealed the Plv " "g Board's decision of March 1, 1989 and conducted
another public hearing at the Municipality of Anchorage Assembly. The time frame for
that appeal expired nearly six months ago. The attempt by your department to coerce an
amended note prior recording is not fair.
Let me tell you a story about a similar platting situation, Many years ago during Mayor
Sullivan's administration, I presented a plat on Commercial Drive for Mr. Loren
Lounsbury and Mr. Clarence I-Ierschbach. The plat was extremely straight forward,
except the Planning Department wanted a bike trail dedication/easement along
Commercial Drive. The Platting Board approved the plat without the bike trail easement.
"I'he planning staff felt so strongly about the public's need for this bike trail that the
platting staff appealed the Platting Board's decision to the Assembly. Their appeal was
timely filed within the appeal period. The decision of the Platting Board was not
overturned, and the plat was recorded without any reference to bike trail easements.

My point in re -telling this story is to advise you that a department may not agree with the
conclusion of the Platting Board. However, specific courses of action are permitted to

As you are aware, this department made rather comprehensive
comments during our review of The Villages plat. These comments
primarily noted that soils reports did not meet the minimum
requirements established'by ordinance for a preliminary plat.
In fact, this department recommended denial of the plat due to
poor soils, inadequate soils reports, and high groundwater. We
felt that the developer had not met the minimum criteria in AMC
15.65.145 or 21.15.110. Unfortunately, the plat was
subsequently approved by the Platting Board.
I am concerned that the Platting Board, in approving the plat,
has ignored both your comments as well as those made by this
department.
The On -Site Wastewater ordinance, AMC 15.65.145, sets out
specific standards for development of land into subdivisions.
Section B requires an original and two replacements sewage
disposal sites; Section 0 requires the applicant to show a
calculated disposal reserve area; and Section D allows DHHS to
require delineation of areas with less than 25% slope. In
addition, AMC 21.15.110 specifies additional requirements for
soils which must be met before the plat can be taken to the
board. We found that the information which was submitted was
either deficient in meeting criteria (such as no water
monitoring), had improperly conducted percolation tests, or
showed ground water above acceptable levels. The developer
failed to address surface water concerns and to show how there
are three viable disposal sites on each lot. No reserve area
calculation was rnade. Finally, there was no effort made to show
the availability of an adequate and safe potable water supply.

The Villages
Since the developer did not meet the minimum requirements as
required by ordinance, we feel the plat should not have been
heard by the Platting Board. But since it was, it appears that
the Board was unaware that the proposed subdivision was in
violation of both ordinances.
We are particularly concerned about this situation since the
code requirements for subdivisions are substantially different
from those pertaining to "lots of record." When AMC 15.65 was
amended in 1986, the intent was to allow development of
pre-existing lots, but to impose more stringent requirements on
new development. The action of the Platting Board will have the
effect of circumventing those more stringent requirements. Once
the plat is recorded, DHHS will be unable to impose regulations
contained in 1.5.65.145.
Therefore, as we have previously discussed, this department will
not sign the final plat as we feel that to do so would seriously
compromise our position of enforcing AMC 15.65. We also feel
that our signature on the final plat implies that all our
concerns have been met, and obviously that is not the case. We
are willing to sign the plat, however, under either of the
following conditions:
1. Provide an additional note to read "No development will
occur on either lot until public sewer is available."
2. Provide an additional note to read "No development will
occur. utilizing on-site sewage disposal until such time
as conditions in 15.65.145 and 21.15.110 have been met."

Staff member JERRY WEAVER stated that this property is
undeveloped and zoned R-6. The Assemby rezoned the
property to R-7 contingent on several things, including
the extension of public sewer, which is not available at
this time. The reasoning behind this request to divide
this property into two tracts is to allow division of
interest between two partners. Staff is concerned
because of the soils condition, slope, and water table
which would preclude the ability to have on-site sewer
systems. Because of the proximity of surround
development and the condition placed on the R-7
rezoning, Staff was supportive of this replat with a
note added that this property not be developed until
public sewer is available. Staff felt the vacation of
Greece Drive was premature until the surrounding area is
developed and recommended denial of all vacations.
CHAIR ISAACS asked if condition #3 on page 007 should be
included as a condition of this replat. Staff had no
objection.
The public hearing was opened.
JIM SAWHILL, representing the petitioner, stated that the
purpose of this request was to facilitate division of
ownership of this property. He stated that, when sewer is
extended to this area, the property will become zoned R-7/SL.

One of the petitioners in this case objects to the note being
required by Staff and the other does not object. The former
(owner of Lot 782) objects in light of soils investigations
on his property that show three test holes as areas adequate
for on-site sewer systems. The petitioner feels the vacation
of Greece Drive is appropriate because it is presently
unconstructed and will likely remain so. MR. SAWHILL
distributed a copy of a concept plan for developing this
property to higher density with no connection to Greece
Drive. He stated that it would not be appropriate to channel
higher density traffic through the R-6 development in the
Villages Scenic Parkway area, so Greece Drive will not be
needed. MR. SAWHILL suggested modifying the note requirement
to be placed on Lot 7B1 only and adding #3, "Placing a note
on the plat that Lot 7B2 cannot be developed until public
sewer is available or additional soils tests are provided and
approved by DHHS."
BOARD MEMBER JOHANNES stated that all the tests she read
indicated that no soils were suitable for on-site systems.
MR. SAWHILL referenced page 046 of the packet and indicated
three test holes which may be adequate. MS. JOHANNES stated
that she had been reading test results on pages 060 through
065. MR. SAWHILL stated that those tests were done in 1978
and were not done to current standards.
BOARD MEMBER JOHANNES asked why the 10' utility easement was
being requested for vacation. MR. SAWHILL replied that it is
adjacent to the right-of-way being requested for vacation and
would be moved to the edge of the property.
BOARD MEMBER MAGBY asked how the subdivision would receive
access if the R-7 is in effect and there is no access via
Villages Scenic Parkway. MR. SAWHILL replied that, under the
present R-6 zoning, the access would be via Villages Scenic
Parkway; but in the future, any subdivision would be done in
conjuction with the property to the east and access would be
provided there. MR. MAGBY asked what were the requirements
for on-site systems. MR. SAWHILL replied that there must be
one primary and two secondary locations for each system which
translates to 10,000 to 12,000 square feet of usable area.
He stated that the note on the plat would allow DHHS the
opportunity to monitor and determine whether these lots were
acceptable for on-site systems.
BOARD MEMBER BRADY noted that the previous soils tests were
done in April, whereas these were done in December when the
water table has less chance of fluctuating. MR. SAWHILL

acknowledged this and stated that more tests are planned for
this spring.
BOARD MEMBER JOHANNES asked for Staff's comment regarding the
note change suggested by the petitioner. MR. WEAVER stated
that this would be substituting the Board's judgement for
that of DHHS. He noted that the Board originally denied this
plat and, at that time, DHHS wrote a strong letter of
objection to this subdivision. He suggested that the Board
could postpone the matter to allow the petitioner to work
with DHHS.
BOARD MEMBER KORTING asked for the petitioner to respond to
the suggestion of a postponement. MR. SAWHILL stated that he
would like a decision this evening.
ALLEN MOORE, area resident, stated that this area was
recently rezoned and the argument used by the owner to
get that rezoning was that the property would not be
developed without utilities and access would be via Greece
Drive and not via Villages Scenic Parkway. He objected to
vacating the easement: because there was an argument made
during the rezoning that utilities would be developed and
those would not be available to people on Villages Scenic
Parkway if they did not come down Greece Drive. He stated
that Villages Scenic Parkway/Potter Road has poor sight
distance, so he felt the preferable alternative would be to
have traffic access via Greece Drive.
BOARD MEMBER JOHANNES asked if the owners promised during the
rezoning that they would bring utilities to the Villages
Scenic Parkway boundary. MR. SAWHILL was not at that public
hearing. He was aware that utilities were a major. issue. He
stated that it is not the intent of the developers to cut
anyone off from utilities. He noted that AWWU requires the
extension of utilities along the full length of the property
when development occurs.
BOARD MEMBER MAGBY noted that DHHS's comments state that only
Test Pit 5 of the recent tests is acceptable. MR. SAWHILL
stated that he had a meeting with them where he pointed out
that Test Pits 3 and 7 were also acceptable and they
suggested monitoring.

to the Staff conditions.

BOARD MEMBER JOHANNES stated that she considered moving to
change the note, but felt that the developers had made it
clear to the neighbors that there would be utilities on this
property. She noted also that Staff and DHHS recommended
denial of this rezoning previously. She did not add a note
regarding no access via Villages Scenic Parkway because it is
not required, but was just suggested by the Planning and
Zoning Commission.
In response to a question from BOARD MEMBER KORTING, MR.
WEAVER stated that it is not Staff's policy to recommend
favorably for lots being created that cannot function on
their own. However, Staff felt it was in the public
interest in this case to approve this replat with
conditions.
BOARD MEMBER JOHANNES moved for approval of the vacations
subject to filing a suitable replat within 18 months.
BOARD MEMBER MAGBY seconded.
BOARD MEMBER JOHANNES stated that she would vote against her
motion because it would be premature until the surrounding
properties have developed.
BOARD MEMBER MAGBY noted that approval of these vacations
would not be in accordance with the Municipal Vacation
Policy.

lots.
BOARD MEMBER BRADY moved a substitute motion for approval of
the replat subject to Staff condition #1, #2 "Placing a note
on the plat indicating that. Lot 781 cannot be developed until
aublic sewer is available," and adding #3 "Placing a note on
the plat that Lot 7B2 cannot be developed until public sewer
is availabe or additional soils tests are provided and
yproved by DHHS."

too restrictive, but he could see no objection to allowing

The Environmental Services Division, On-site Services,
of the Department of Health and Human Services has reviewed
the following cases and has these.comments:
85-80: John Wayne Subdivision Agreement - Two Time

8-8753: Tracts 7B1, 7B2 The Villages Subdivision - with
Vacation of R -O --W
There have been at least thirteen soil tests
performed on this piece of property. Of that
number, six are old tests which show unsuitable
soils, high ground water, or both. None of these
tests includes water monitoring. Since the tests
were performed in mid-April, it would be expected
that the seasonal high water table is actually
higher than shown. Of the recent test holes,
only TP -5 is acceptable. The percolation
results for TP -6 and TP-7are invalid and will
need to be re -run according to the EPA falling
head percolation test procedure. We will require
a percolation evaluation on TP -4, particularly in
the layers of ML material. TP -1 and TP -2 show
unsuitable conditions for on• -site disposal. TP -3
may be acceptable provided platting does not
object to cutting brush and trees in the screening
easement when the sewer system is installed. There
is a further concern, based on the tests submitted,
that the water table on this lot may fluctuate,
and that there may be new springs created when
development occurs. The developer has failed to
show how an original and two replacement systems
may be constructed for each lot; in fact, it is
doubtful that it can be shown. Because most areas
have slopes in excess of 10%, seepage beds cannot
be used. Due to tight soils and high ground water,
it is doubtful that deep trenches will be practical.
The overall picture is one of a lot with many areas
of poor soils, complicated by the presence of an
unpredictable and definitely fluctuating ground water

table. The developer has failed to show the
availability of an adequate and safe potable water
supply. If approved, the department will require
the engineer to show (1) that each lot has the
required amount of reserved area based on soil
tests; (2) that additional soils tests are performed
to prove the suitability of disposal sites; (3)
that water monitoring continues monthly through
April, then weekly through May; (4) that water
availability is addressed. However, this
department strongly recommends that the plat be
denied.

Greece Drive Right• -of -Way Vacation
Greece Drive Right -of -Way (ROW) exists, but has no road constructed at this
time. There are no plans to construct this road and the property to the East
does not intend to use Greece Drive for access. In fact, the neighborhood at
the re -zone hearing for this property expressed a desire that this road not be
constructed. Greece Drive is not required for adequate access to the two
tracts being platted under this action.
In the future these tracts may be further subdivided into a R-7 configuration
with water and sewer. At that time their access would be from roads
constructed across the property to the East, with no access to the Villages
Scenic parkway.

SUBSURFACE INVESTIGATION
TRACT 7B, THE VILLAGES
Site Description
The project site consists of 6 acres, on the East side of
Villages Scenic Parkway, about 1/4 mile South of Potter Valley
Road. The site is wooded with trees including Spruce, Birch and
Alder.
The only development on the site is associated with the
construction of Villages Scenic Parkway along the west boundary.
Greece Drive has not been constructed next to the site at the
time of the exploration. A small borrow area (road cut) has been
developed on the West edge of the lot. A cut bank about 15'
high, exposing sand with gravel (SP), exists at that point. Test
pit Al was excavated near the toe of the cut.
A limited subsurface investigation was conducted by others in
1979 for an area including this site. Partial results are
attached as Appendix 1. The areas investigated at that time had
either shallow ground water or unfavorable percolation rates.
This (1988) investigation concentrated on areas not covered by
the previous study.
It is the intention to resubdivide this lot into two equal
parcels. The purpose of this investigation is to see if soils
will support on-site wastewater disposal for the proposed two
lots.
Field and Laboratory Investigation
Subsurface investigation was begun on 12-09-88 and completed on
12-13--88, using an International 630 backhoe operated by S and A
Enterprises. Test pits were logged by Mark Hansen. The test
pits were excavated to 16' depth, unless ground water or
exceptionally dense soil was encountered at a shallower depth.
The test pit logs describe the soil as observed in the field.

Soils were classified and described using the Unified group
symbols and group names outlined in ASTM D 2487. Samples of
important soil strata were taken from the backhoe bucket. The
samples may not entirely represent the coarser portion of the
soil. The presence of large gravel, cobbles and boulders should
be noted on the logs when interpreting sieve analysis results.
The classification shown on the test hole logs may not always
agree with sieve analysis, as the logs reflect the affect of the
larger particles on the classification. The samples also do not
represent stratification which causes the soil to be somewhat
sorted in the field. Where appropriate, a 1" slotted PVC pipe
was left in the hole to facilitate future ground water
monitoring. Ground water was rechecked in each hole the day
following excavation. Percolation tests were run adjacent to
test pits #6 and #7. Future ground water monitoring will be
performed by Lounsbury and Associates, and is to include
monitoring through the spring thaw.
The location sketch shows the test pit locations only
schematically. Locations of the old (1979) holes were traced
from information supplied by Lounsbury and Associates. No
physical evidence of the old series of test holes was observed in
the field. The new (1988) test hole locations are shown
schematically on the sketch. These were located relative to the
topography, but have not been located by survey methods. The 1"
PVC pipes at the test hole locations are well marked for future
location.
For the percolation tests, a second shallower hole was excavated
adjacent to the test pit using the backhoe. A 6" diameter by 1'
deep percolation hole was hand dug in the bottom of the second
hole for the percolation test. Two inches of pea gravel were
placed in the small hole and the hole soaked overnight. The next
day, the hole was refilled with water and the drop in water level
monitored.

Findings
Suitable soil for the construction of on-site wastewater soil
absorption systems was identified in test pits #3, #5 and #7.
Marginal but possibly usable soil was encountered in test pit #6.
The soil types are quite variable within a small distance. The
presence of shallow ground water over part of the site will be a
constraint on the location of on-site wastewater disposal
systems.
The only observation of bedrock was in test pit #1. This pit was
located at the toe of a cut bank, and the bedrock is estimated to
be in excess of twenty feet below natural ground surface at that
point.
Based on initial observations, test pits #3, #5, #6 and #7 appear
suitable from a ground water point of view. This needs to be
confirmed after monitoring water depths through the spring thaw.
The soil at usable depth in test pits 113 and #5 was free draining
sand -gravel mixtures. No percolation tests are necessary to
establish the suitability of this type of soil.
Test pit #6 encountered dense glacial till. Percolation rate at
4' to 5' was 50 minutes per inch. The density and cobble content
of this soil increases with depth to the point that excavation
below 11' was discontinued. It would be impractical to construct
a deep soil absorption system at the location represented by test
pit #6. A shallow system at that location may be feasible, but
the soil is less permeable than normally utilized for shallow
systems.
The soil at depths shallower than 6' at test pit #7 was Poorly
graded Gravel with Sand (GP) as shown by sieve analysis of the
sample removed from the percolation test. The soil was very
dense and had nearly enough silt for a (GP -GM) Unified
Classification. The soil at this location appears well suited
for a shallow soil absorption system, but a deep system would be
difficult to construct there, as the deep soil is difficult to
excavate. Percolation rates are 9.1 minutes/inch at 3'-4', and
7.7 minutes/inch at 4.5'--5.5'.
