Box 196650 Anchorage, AK 99519-6650 Subject: Septic Upgrade — T15N R1W SECS LOT 76A / JOANN LOT 75B Gentlemen: The owner has requested we proceed forward to obtain a septic permit to upgrade the existing failed system on the subject lot. After exhaustive measures to locate another suitable location for the on-site septic upgrade, due to shallow groundwater no other location was found to have suitable soils. Per previous discussions with your staff, the system will be upgraded in the same location as the existing system. The general slope of the septic area is 0-5%, with steep slopes greater than 25%. We have designed our system utilizing the slowest percolation rate of the existing testholes that are in the MOA file. An existing 23' deep groundwater monitoring tube was monitored on May 14, 2004 and found to be dry. The lot is served by an individual well. We propose to install two 5' wide shallow trenches with an AdvanTex Orenco Package System. The system will be excavated to the laterals of the existing system, 2' of sand installed and followed by 2' of sewer rock for the absorption system. This system will be manufactured by Anchorage Tank & Welding to meet Orenco Systems, Inc. latest design criteria and in accordance to MOA requirements. Box 196650 Anchorage, Alaska 99519-6650 Unvar April 28, 1995 Clarence Torkelson PO Box 670551 Chugiak, Alaska 99567 Subject: T15N R1W Section 5 Lot 76A NOTICE OF VIOLATION Dear Mr. Torkelson: In September, 1993, your septic system on the captioned lot was upgraded so as to facilitate the wastewater generated from an eight bedroom house. This installation was apparently completed on October 3, 1993. On June 3, 1994 (eight months after the work had been completed) this office received an application to upgrade the existing septic system. On August 3, 1994 this office received an as -built drawing of the unpermitted and unapproved septic system upgrade. After several site visits by engineers from this office, a number of discrepancies and inadequacies on the upgraded system were noted. These were thoroughly discussed with the civil engineer, Mr. David P. Williams, responsible for the design, permitting, installation, inspections, and as -built drawing submittal. These problems include but are not necessarily limited to the following: 1. The septic system upgrade was illegally performed without a valid permit issued by this office. 2. The original soil/percolation tests used in the design of the absorption system were conducted by the property owner and not by a civil engineer; nor were they stamped by a civil engineer. 3. The procedures used in conducting the soil/percolation tests were not satisfactory. 4. The design of the absorption system utilized an average of the percolation rates ranging from 1.55 to 37.0 minutes per inch. This practice is not acceptable. In cases where there is more than 20 minutes per inch Torkelson Page 2 difference in percolation rates, the highest of the percolation rates must be used in calculating the required absorption area. 5. The upgrade system was located "off' lot on Lot 75B without prior approval by this office. A recorded easement has not been reviewed by this office, which allows the septic system to be installed on the adjoining lot. 6. The upgrade system was installed by the owner without prior approval by this office. 7. This office was not notified of the first, second and final inspections by the engineer. his office will not approve the upgraded system"aud as -built drawing, nor will we issue any Health Authority Approval Certification required in any financing of the property until the following problems have been resolved. 1. The old trench must be disconnected from the upgraded system and be permanently abandoned. 2. The practice and procedure of utilizing inflatable balls to direct or divert the flow of septage into the trenches does not meet the code and must be discontinued and the ball removed. 3. Driving across and parking over the absorption field must be prohibited by the use of barricades or curbs. 4. The 100 feet of trench utilizing eight effective feet of gravel provides an absorption area adequate for a six bedroom house only. Until such time that the disposal field (trenches) is enlarged, the upgrade system' can only be approved for a six bedroom residence. Presoaking: This is a concern on Test #I, #4, and #5. Test #1 was filled with 12 inches of water at 8:41 a.m., it was refilled with 6 inches of water at 11:41 a.m. At 1:20p.m. the test hole was refilled to 6 inches of water. Since this test was run continuously, the only effect of additional soak time is to partially restrict usage of the data from the first period. Test #4 and #5 were initially presented in a different format to DHHS. It was requested that the data be place on the stancard form, and in doing so the initial soak data was not included. A copy of the initial test log is included. It shows that the Test #4 was soaked overnight, and Test #5 had about 4-1/2 hours of soaking. 2. Water Monitoring: 3. Maximum Head: 4. Perc. Rates: Water monitoring is required for a minimum of 7 days after installation of a monitoring tube. Water monitoring is not allowed within five feet of a proposed trench or field. Test #2 had a monitoring tube installed on 5 August 1993. It was momtorred on 5 September and 5 October of 1993. All of the other tests are within 5 feet of the proposed trench Iocations. The well log from the potable water well indicates the static water level at over 100 feet below the ground sur- face. The geology and topography of the area do no give any indication of groundwater close to the surface. This is identified as a concern on all of the tests. Test #1 is the only test that was overfilled once. All of the other tests maintained no more than a 6 inch head dur- ing the course of the test. The initial reading on test #1 is to a 12 inch head for presoaking. This hole had some sloughing that had to be removed after soaking. When the datum was reset, it was 12-1/8 inches above the gravel. Test #1: This test was not well performed and could easily be dropped for con- siderration. However, the data it provides as a perc rate in the 15 to 20 min/inch range is useable for engineering purposes. Test #2: This test was run for one hour per DHHs guidance. since 10 minute interval readings were not obtainable (it dropped more than 6 inches in 10 min- utes), the last drop defines the perc. rate. This rate is 1-15/16 inches over 3 I/i zfL minutes, or 1.55 minutes per inch. The initial calculation was performed using a method that takes the three closest rates over the hour, and averageing them. Both rates provide an application rate of I.2 gpd/SF. Test #3: This test was also run for one hour. The readings were taken at one minute intervals as the initial drops indicated that ten minute readings would pos- sibly include interference from the uneven gravel at the bottom of the hole. Again the last drop is the accepted reading for the soil rating. This is 2.5 min/inch for an application rating of 1.2 gpd/SF. Test #4: This test was in a tight soil, and readings were aimed at every 30 min- utes. The readings at 10:38 and 11:08 are within 1/16 inch. The rate for this test is based on those readings. This is 37 min/inch, for an application rate of 0.45 gpd/SF. Test #5: This test is also from the tighter soils, and readings were taken every 30 minutes. Prior instructions from DHHS have indicated that a minimum of six readings at 30 minute intervals are to be taken when two successive drops within 1/16 inch are not obtained. This instruction indicated the rate should be deter- mined from an average of the three closest rates. This test utilized this proce- dure, averaging three rates (22.0, 24.0, and 23.1 mintinch) for a rate of 23 minutes/inch. This gives an application rate of 0.6 gpd/SF. Test #6: This test was run with readings every 5 minutes. Drops stabilized to- ward the end of the test at 0.94 inchs every 5 minutes. This gives a rate of 5.3 minutes/inch. The average of the closest rates for this test is 5.0 minutes/inch. Either rate reduces to 5 min/inch for an application rate of 1.2 gpd/SF. In consideration of the mutual covenants contained herein, the parties to this Memorandum of Understanding agree as follows: 1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality grants permission to Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as 'A\1_\alocated at 2. Definitions. _T\6 Alaska. A. Alteration. Any change to the design or function of an AWWTS that includes the installation or removal of any parts, components or pieces not included in the original construction permit and design. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC') 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. Maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWWTS that were included in the original design which would allow the AWWTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 J. Fee. Owner shall pay to Municipality an annual fee of -7 LA -0 ($_ID_.00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWWTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional Equipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWWTS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AWWTS Operating Permit is: C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nonwaiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. S. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this contract, the only authorized representatives of the parties are: Owner: Anchorage: Purchasing Officer C. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of Understanding shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties wider this Memorandum of Understanding. 10. Severability. Any provisions of this Memorandum of Understanding decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Memorandum of Understanding.
