June 14, 2023 Municipalities of Anchorage On-Site Water & Wastewater Program 4700 Elmore Road Anchorage, AK 99507 RE: SEPTIC SYSTEM UPGRADE PERMIT LEGAL: TRANQUILLITY HEEIGHTS BLOCK 1, LOT 35 The undocumented septic absorption field will be decommissioned at 16’+ to the proposed field along with the existing tank and per the owner we request a septic permit to upgrade the existing septic system on the above referenced lot. We propose to install a deep trench with an Advantex system to serve the proposed 3- bedroom residence per the attached design. The design is based on the test holes conducted on the subject Lot 35 and adjacent Lot 34 on September 20, 2019. No groundwater was observed at excavation or monitoring of these test holes. The slopes are moderate at 0-5% at the proposed upgrade location. The lot and immediate area are served by private water with no known private wells within 50’ of the proposed septic system. Correspondence with ADEC indicate the lots to the south and west are served by private water and there are no known public water systems. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as AN ADVANTEX SYSTEM located at (legal description) TRANQUILLITY HEIGHTS BLOCK 1, LOT 35 2. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). VOwner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. i Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfield replacement. (rev. 05/18/2018) Page 1 of 3 Owner acknowledges that the Municipality may request records of maintenance and repairs from the manufacturer's representative or maintenance provider. _ j� Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new VII Certificate of On -Site Systems Approval. f P Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. R&M No. 75].229 Dave Schwsb 4110 DeBarr Space 23F Anchorage, Alaska subject: Soil Investigation for Sanitary Sewer System, I~t 35, Block 1, Tranquility Heights Subdivision, Anchorage, Alaska Dear Mr. Schwab: At your request of August 25, 1977, we conducted a subs[~faee soils investigation at the proposed location of the sanitary sewer system on tile subject lot. The investigation complied with those procedures required by the Municipality of Anchorage, Department of Health and Environmental Protection. This investigation, which was accomplished on Septen~er 19, consisted of a test hole drilled to a depth of 19 feet below the existing ground surface. The test hole was sited according to your instructions ~]d its location is shown in attached Drawing A-01. Drilling was accomplished with a rotary drill rig using continuous flight solid-stem auger with au outside diameter of 6 inches. A sample was taken at the depth shown on the soils log in Drawing A-01. The sample will be held in storage at our lab for approximately six months. In addition, all material brought to the surface by the augers was conti~luously monitered by ~l experienced engineering geologist. The topography at the drilling site is generally horizoatal. At the time of the investigation the site had original vegetation consisting of small spruce and birch, and sparse m%derbrush. The top of the test hole was located at original ground surface. The soils encountered in the bore hole are sho%~l in the test hole log in Drawing A-01. The symbols used in Drawing A-01 are explained in Drawings B-01 and B-02. This log displays specific conditions encountered at the test location. However, s~surface conditions may vary in other parts of the lot without any apparent surficial evidence ef the change. Groundwater was not encountered in the test hole. Bedrock was not encountered. At the time the hole was drilled seasonal frost was not present and permafrost was not encountered. A percolation test was performed within tile bore hole at the depth shoYm in the attached Table 1. Ali. depths were measured from the top of the hole. The data in Table 1 show average infiltration from the depths indicated to tbe bottom of the hele. The measured percelation rate was 2.17 minutes ]per inch.
