To whom it may concern:
This is a request for a septic permit on the above referenced lot. The current 5-wide
system has two trenches, (52’ & 35’) and the 52’ trench has failed. The smaller
35’ trench was dry during the initial testing of the system. This will be corrected
during the excavation. We are proposing to rebuild the 52’ trench not the 35’
trench but the piping to the smaller field will be checked for flow. From the new
asbuilt survey the 57’ trench is located in the 15’ utility easement, see the site plan.
All of the letters of non-objection have been included in this submittal. The lot has
a small septic mound in the front yard where the trenches are located with about 15
to 20 percent slope. From the soil letter by S&S dated Nov. 6, 1990 we have a
reading of 67 inches which allows us to install per the design.
This new septic design will not impact any of the surrounding neighbors and the
entire subdivision is connected to the community water supply.

Dear Kim and Lorrie DuFour,
MEA has no objection to the existing septic leach field located within the 15 ft platted Utility Easement on
Lot 17, Block 7, Thunderbird Heights Add No. 3A Subdivision, Plat No. 81-264, Section 25, Township 16
N, Range 1 W, S.M., as it pertains to MEA's use of the easement and is subject to the underlying
landowner's approval, as shown in the drawing dated May 6, 2024, on page 2, subject to the following
conditions:
1. The improvement will in no way restrict or limit the current or future ability of MEA to fully enjoy the
benefits of the easement for any and all utility purposes that it presently enjoys under the easement.
2. MEA will be held harmless by the landowner from liability for any and all damages or injury to any
person or property that may result from the existing and future use of the easement by MEA, its
contractors, or assigns.
3. MEA will be held harmless by the landowner for any and all liability arising out of or relating to any use
of the easement by others under a Letter of Non -Objection.
4. The landowner will be liable for any damages caused to MEA facilities by the improvement in the
easement.
5. The landowner will be responsible for any special construction costs incurred by MEA due to the
improvement in the easement.
6. The landowner will assure compliance with all applicable safety codes relating to the improvement in
the easement.
7. Use of this letter by the landowner, their successors or assigns will constitute acceptance of these
conditions.
8. Alteration of these conditions shall invalidate this letter.
9. This letter is not effective unless it is recorded in the Anchorage Recording District before ownership of
the referenced property is changed from the above -named landowner.

To whom it may concern:
ENSTAR Natural Gas Company, LLC (ENSTAR) has no objection to the existing septic pipe
encroachment within a fifteen foot (15FT) wide utility easement located within Lot 17 Block 7,
THUNDERBIRD HEIGHTS ADD NO.3A Subdivision, according to the official plat thereof, filed under
Plat No. 81-264, in the records of the Anchorage Recording District, Third Judicial District, State of
Alaska.
Acceptance and use of this letter of non-objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
• Landowner/Contractor working near ENSTAR gas facilities shall contact the Alaska Digline, Inc.,
(907) 278-3121 or 811 for line locating two (2) business days prior to any related excavation. This
service is free of charge.
• ENSTAR will be held harmless, now and forever for any damages or injury to any person or
property as a result of this encroachment.
• Any ENSTAR facility damaged or destroyed, as a result of this encroachment will be repaired at
no cost to ENSTAR.
• Any costs incurred by ENSTAR for special construction necessitated by this encroachment will be
borne by the land owner.
• This letter of non-objection will in no way preclude ENSTAR from full use and enjoyment of its
rights within any portion of its right-of-way.

This letter of non-objection in no way precludes GCI Communication Corp from
full use and enjoyment of any rights it may have within any portion of the utility
easement and or the right-of-way, including unlimited access for servicing its
facilities. Also, any additional and extraordinary costs incurred durin g any future
required construction, repair, or reconstruction of GCI’s facilities to accommodate
any or all the encroachments shall be paid by the property owner.

By this document Matanuska Telecom Association, Inc. (MTA) declares that it has no
objection to the existing septic encroachments located within the platted utility
easement of Lot 17, Block 7, Thunderbird Heights Add. No. 3A filed as Plat No. 81-264
in the Anchorage Recording District, State of Alaska.

Please be advised that MTA through the issuance of this document does not forfeit
any of its rights to the use of the area cited. In the exercise of these rights MTA will,
if needed, upgrade, maintain, repair, and/or replace buried or aerial
telecommunications facilities within the easement. Any repairs that may be
required to the encroachment as a result of utility construction will be borne by the
property owner of record. This document does not authorize the placement of any
additional encroachments within the easement area. Property owners are
required to obtain utility locates before doing any kind of work in the utility
easements and will be liable for any damages caused by their construction work in
the easements.
This document is in no way an agreement to vacate any portion of the utility
easement and should not be interpreted as such.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The septic tank and add on lift station on Lot 17, Block 7, Thunderbird Heights
Subdivision No. 3A have failed and must be replaced. We are proposing to replace the
tanks with a new 1,500-gallon combination steel STEP tank to serve the four-bedroom
home on the lot. We are therefore requesting a permit be issued for the construction
of a new STEP tank to serve the home. The attached Site Plan and backup
documentation identify the location and configuration of the existing septic system and
the location of the new tank. Also identified on the plans is the existing water service on
the lot. The subdivision is served by a community water system. The existing tank and
lift station on the lot will disposed in accordance with Municipal Code. The drainage
patterns on the property will be maintained after construction.
The ground surface on the lot slopes to the southeast at a 3% grade in the area of the
new tank. The tank will be placed in the same location as the existing tank at nearly the
same elevation. It will then be tied in to the existing service line. The tank will be
constructed parallel with the contours of the land as much as possible in conformance
with Municipal requirements.
If the tank is constructed in accordance with our design the following statements apply:

the area or those to be constructed in the future.
The tank, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.

RequeSt you issue a permit to upgrade the septic system located on the
referenced property.
The existing septic system was installed in June, 1983 at a depth of $
- 4ft. Due to groundwater intrusion into the cr~l space of the house
a curtain drain was inst~led around the r~ar of the house which drains
into a dry w~l~ located on the Northeast portion of the property.
During the installation of the curtain drain there were groundwater
monitoring tubeS installed on the property. In particular, groundwater
levels were monitored at the teSt hole location shown on the site plan
attached and within the existing l~achfi~ld monitoring tube. (The house
has been vacant since the end of 1988.11. The results of this monitoring

As ~an be seen, the seasonally high water level is 67 inches below the ground
surface at the test hole and 37 inches below the ground level at the existing
leachfield monitoring tube. (This is approx~ately the sa~e elevation since
the test hole ground lev~ is higher than the existing leachfi~d. ) As can be
seen from the design, we have designed a leachfield 1.5 ft. b~ow the ground
elevation at the soi£s test hole.
We feel this is the best solution to bring the ~xisting septic system into
compliance with regulations. Since this subdivision is served by a privately
owned public water system, there are no w~s on neighboring lots. The
proposed system is over 200 ft. from the w~ serving this water system. A~so,
since the proposed septic system is located more than 30 ft. from any
neighboring septic systems, we feel the proposed septic upgrade w~ll have no
inpact on the adjacent properties.
Since this entire project was initiated almost u year ago and the decision was
made to upgrade the septic system based upon water monitoring establ~hed
several months ago, it is our opinion that this permit should be issued based
upon the Municipal Ordinance that ~xisted at the time the proje~ was
initiated.

Dear Mr. Duff:
Following our conversatiDn this morning I had an opportunity to
review the letter and recommendations by Mr. Shafer, of S&S
Engineering. I can foresee no reas6n for any objection to the
alternatives recommended. However, the present situation, from
both an individual and public health view, is intolerable and as
such must be dealt with as soon as possible.
The law in this case is quite specific. Under AMC 15.65.020 a
person may not allow wastewater to gain access to the ground
surface, surface or ground water or be discharged in such a
manner as to become a health hazard. In addition to either of
the engineered alternatives the following requirements must be
met.
1. Pursuant to 15.65.02'0 C.5,6,8 the septic tank must be
pumped and all discharge to fhe absorption fiel~d
discontinued.
2. The stagnant water in the crawl space must be removed and
the ~'rea thoroughly disinfected.
3. The septic tank must be severed from the field by a blind
flange until such time as the septic system can meet
existing code.
4. A test hole must be dug adjacent to the absorption field,
and a monitoing tube installed, to determine the exact level
of ground water. The results of the monitoring will be
required before an on-site sewer permit will be issued.
The above requirements are in accordance with existing state and
local codes and as such must be complied with upon receipt of
this notice.

Dear Mr. and Mrs. Duff,
A visual ins.oection was performed on the referenced- property at your
request. This inspection included observations exterior to the house,
a visual inspection of the septic system and an examination of the
crawl space under the house. ~ Mz. Duff accompanied me'during this inspec:icn
and provided historical data conce---ning previous attempts to correct
problems caused by existing conditions. Cbse~gaticns made during this
inspection are as follows:
The yard area to the rear of the house was uneven with vegetative
growth in a natural state. Surface water was present in various
places and the ground was extremely saturated. According to
Mr. Duff, at least on two different occasions, excavation work
had been performed at the rear of the house in an attempt to
divert surface and subsurface water away from ~he residence.
A footing drain, supposedly installed along ~he rear of the
house and draining towards the northeast side of the property,
did not have a visible daylight drain.
The septic system installed in the front of the house appears
to be completely saturated. The water level in the monitoring
tube within the seepage bed indicates that the bed is totally
saturated. In accordance with the on-site sewage disposal
system inspection report, the system was installed at approximately
the same depth as the floor in the crawl s.~ace and the seepage
bed comes within five feet of the foundation.
4. An inspection in the crawl space revealed a number of problems:
A. There was standing water in the crawl spece with depths
up to two inches.

B. There was no ventilation provided to the crawl space from
the outside.
A sump pump installed in the south half of the crawl space
discharged to the outside at the rear of the house through
an kBS pipe that was exposed above grade and runs vertically
down below grade along the foundation. It appears that this
sump pump recycles the water and there is no apparen~ .~urface
discharge.
A water sample was taken f~om the water in the crawl space
and processed at CHEMICAL AND GEOLOGICAL LABORATORIES OF
ALASKA, INC. The results of this analysis indicated t-hat
the water in the crawl space contains bacteria ~r6w~h too
numerous to count.
E. Water appears to be entering the crawl space from underneath
the footing.
5. The vinyl floor in the kitchen appears to be buckled. It is s~spected
that this is a result of the particle board taking on moisture
as a result of the high humidity which exists in the crawl space.
CONCLUSIONS:
1. The ground saturation at the rear of the house makes the area
totally unuseable and prevents effective landscaping.
2. The existing curtain drain and footing drain are ineffective.
3. The existing sump pump. is ineffective in removing the water from
the crawl space.
4. The lack of proper ventilation in the crawl space with the moisture
available will cause premature deterioration of framing members.
The septic system seepage bed appears to be in non-compliance
with State codes relative to separation with the ground water
table and the seepage bed appears to be allowing septic effluent
to leach into the crawl space causing a health hazard to exist.

RECOMMENDATIONS:
Alternative A - intended to lower the groundwater table sufficiently
to prevent groundwater intrusion into the crawl space and involves
the construction of a curtain drain across the south and east
property line to either a daylight point or sump pump discharge
at the northeast corner of the property. (See abtached sketch.)
This alternative would also include installation of venbilation
into the crawl space at the rate of 1 square foot par 1500 ~,~e
feet of surface area. The existing sump pump would need to be
properly installed to remove an~ residual groundwater until the
curtain drain had become fully effective. Approximately 5 cubic
yards of pea gravel will need to be added to the crawl space floor
surfaces and a new 6 mil vis.cueen barrier installed ove[the floor
area. A 4 inch ADS perforated- pipe will need to be run around
the perimeter of the footing with disc.barge into the sump basin.
The sump_ basin should be a mini~m 30 gallon container. The sump
pump_ discharge needs to be man underground to the curtain drain
discharge along the east prope_~cy line.

Curtain drain - $9700.00
Crawl space - 3200.00
TOTAL 12,900.00
Alternative B - would involve jacking the house off the existing
foundation and adding three courses of C~U units. This solution
would raise the house approximately two feet. This involves cutting
the house loose from the existing foundation, raising it, installing
a new foundation, filling the existing crawl space with two feet
of gravel, reconnecting all plumbing, wires, utilities, etc.
The yard area would ~hen be filled approximately two feet to establish
a positive slope away from the house to include re-establishing
a paved driveway and landscaping. Foundation ventilation would
also be installed at this time along wi~h a new 6 mil visqueen
barrier over the crawl space surfaces. ·

2. Further evaluation of the septic system should be performed to
positively determine it's encroachment into the groundwater.
Estimated cost - $450.00 - Groundwater monitoring
Assuming groundwater encroachment and leaching into the crawl
space, an upgrade of the septic system absorption area%rill be
required.
Estimated cost - permits, deqign and MOA fee - $440.00
An upgrade of the system will probably involve the installation
of a lift station and an elevated mound system at a cost of approximately
$7OOO.OO

Gentlemen:
The residence on Lot 17, Block 7, Thunderbird Heights was
vacated approximately 18 months ago because of health concerns.
Your agent, Jack White Company, has negotiated with an engineer
and an excavating company to alleviate ground water problems on
the lot. This includes installing a curtain drain along two
sides of the property. The contractor mobilized during the week
of 1/8/90. Our Architectural and Covenants Committee contacted
the engineer on 1/10/90 and requested that they accomplish no
work until plans had been submitted and approved by the
Committee. We do not consider the submittal to be complete, and
requested resubmittal on 1/15/90 (see attached). Contrary to our
request, the contractor removed trees on 1/15/90.
We concur with correcting the deficiencies associated with this
residence. The Association and the adjoining property owners are
very concerned that the remedial actions may negatively impact
other residences. The two primary concerns are: (1) that it may
affect groundwater tables on the two adjoining lots downhill from
this lot; and (2) that it may cause groundwater to flow in the
street right-of-way. The latter poses two potential problems:
(a) glaciation on Thunderbird Drive and Raven Court which could
create severe public safety problems; and (b) possible sewage
contamination which could infect the children who play in the
area and be carried to all residences by vehicles which pass
through glaciated overflow.
It is essential that the corrective work be well-engineered and
accomplished in a competent manner. Based on the design
submittal and actions/attitudes thus far, we do not consider this
to be the case. Approval by

design was to install a lift station to pump the water into the
street right-of-way. Pen and ink changes indicate that a
drywell would be constructed. This change was apparently made
following our initial contacts with the engineer, when he was
informed that such discharge requires a permit from the
Anchorage Department of Public Works. Lacking information on
past soil borings and percolation tests, we question that a dry
well can be effectively constructed. Further work should not be
accomplished until an engineering analysis assures that this is
the proper and best corrective action.
Several of the adjoining property owners are considering legal
action against the individuals and companies involved in this
matter. Should general contamination occur, be assured that the
negligence lawsuits will include all parties, including
yourselves.

17, Block 7, Thunderbird Heights. Regretfully, we can not
approve your submittal at this time as the information conflicts
and it lacks a professional stamp. Your proposal to Jack White
Company was to install a lift station and pump the groundwater to
daylight in the street right-of-way. Pen and ink annotations
indicate that a drywell will be substituted. Nothing indicates
that a drywell can be constructed or that it would be effective,
if constructed.
Please understand that we concur with correcting the ground water
problems which resulted in this residence being declared a heath
hazard. However, it is essential that the work does not impact
other residents in the subdivision and that it is accomplished in
conformance with the subdivision convenants. You have already
commenced work, including removal of approximately ten shade
trees, without obtaining approval of the Architectural and
Covenants Committee. Be aware that we consider you responsible
for your actions and will expect restoration of all unauthorized
damages as required by the Covenants.
Please prepare a complete set of construction plans and resubmit
them for approval. Until approved, we request that you
accomplish no further work.
We would also like to inform you that several of the adjoining
property owners are considering legal action against your firm,
the engineer, and other companies involved in this matter. I
strongly advise against your taking inappropriate action at this
time.
