For several months now, my clients have been attempting to sell their property and improvements but have been unable to do so because of their inability to obtain Municipal approval of the well which now services their property. As I understand the situation, the reason for the Municipality's refusal to approve the well is that under present regulations ihe well is located too dose to the existing sewer line. My clients have determined, and apparently there is no dispute on this point, that the well cannot be redrilled on their property with the required separation from the existing sewer line. My clients have owned the subject property since late 1978, and there does not seem · to be any current problems with contamination of the water supply and the well adequately and satisfactorily services the property ('Mth soine minor upgrades which my clients intend to make). A purchaser for the property has been found and a sale agreement consummated with the only holdup being the Municipality;s apparent refusal to approve the water system as a prior nonconforming use. I am enclosing with this letter copies of the original request for approval of this water system which was signed as approved by the Municipality on November 9, 1978. This approval was obtained at the request of my clients' lending institution financing the purchase of the home and relied upon by all parties when my clients' purchase was consummated. Also enclosed is a certificate of inspection signed by the Municipality on November 9, 1978, approving the individual water supply system for this property. In spite of these prior Department of Health & Human Services Municipality of Anchorage February 26, 1996 Page 2 approvals, the Municipality now refuses to recognize the validity of my clients' water system to the extent that the pending sale for their property cannot be comPleted. In fact, the attorneys for the purchaser are now demanding that my clients perform under the terms of the signed earnest money agreement or litigation may ensue. AWWU has been contacted by my clients' real estate agent to discuss the problem, but it has not put forth an acceptable solution. AWWU will not put in an extended connection, as was done to accommodate by clients' neighbors, and they are insisting that the water main be extended at my clients' expense, which would cost over $20,000. Given this impasse, I have advised my clients that litigation against the Municipality may be necessary, which litigation would be based upon the Municipality's prior approval of the existing water system and my clients' reliance thereon in purchasing this property in 1978. Unless the Municipality will agree to revisit this situation and either approve the system as a prior nonconforming use or propose some other less-expensive alternative solution, then my clients will be forced to take whatever action is necessary to enforce their rights. Inasmuch as time is of the essence and the proposed purchasers are pressing my clients for a closing, please advise the undersigned within ten days of your receipt of this letter if some accommodation on this issue is possible.
