Ref: Septic Design for Two Lots Subdivision; Tract A -A2
To whom it may concern:
The three (3) proposed house will be served by a private well and septic system. Two test hole
where excavated on the property. The septic system will be designed around the 30 foot radius
of test hole #1. We are proposing that a 1500 gallon advantex tank and bed type drainfield be
installed. Comments regarding the design are summarized as follows:
1. SOILS: Attached is a log which shows the soil classifications, groundwater monitoring, and
the percolation test results. It is our opinion that due to the overall appearance of the soils, an
application rate of 1.0 gallons/day/ft2 should be used.
2. TRENCII DESIGN:
a. Percolation Rate: 2.85 minutes/inch
b. Allowable Application Rate: 1 gallons/day/ft2
c. Design Flow: 450 gallons per day
d. Minimum Absorption Area: 450 ft2
e. Total Depth: 3 feet (max.)
f. Effective Depth: .5 feet
g. Width: 15 feet
h M.O.A. Approved Sand Filter: 2 feet
i. Minimum Length: 30 feet long
j. Effective absorption area = 450 ft2
3. SURFACE WATERS: There are no surface waters within 100 feet of the proposed
upgrade.

4. TOPOGRAPIIY: As can be seen on the attached topography dwg. the proposed drainfield is
to be installed on less than a 10 percent slope running approximately southeast to northwest.
I am unaware of any adverse impacts this installation would have on adjacent wells or septic
systems. If you have any questions, please contact us at 337-6179. Thank you for your

NOTE: Attached is a site plan drawing, a design drawing, a topography site plan, a soil log, and
a 7 page construction specification letter which are all part of the design package for this septic
system.

The Department has reviewed the subject property for feasibility
of on—site wastewater discharge. This letter does not constitute
approval or disapproval as the Municipality of Anchorage has
approval authority in this instance. The EPA Design Manual for
Onsite Wastewater Treatment and Disposal Systems states that for
mound systems on slowly permeable soils, the restricting layer
should be at least 3 feet below the natural soil. The soils logs
indicate the impervious layer at 2.5 feet which does not meet the
3 foot requirement. I would suggest finding an alternate site.

Dear Mr. Moore:
This will confirm the verbal decision given to you yesterday in
my office to deny the request for an on-site sewer permit for
Tract A-2 in the Kimberly Manor Subdivision #2. The primary
basis of this decision is the very high degree of probability of
percolate from an elevated mound system being subjected to freezing
after it leaves the umbrella overlying the basal bed area. I have
no reason to believe that the twelve(12) inches of peat layer overlying
the eighteen(18) inch strata of accepting soil is sufficient to
prevent freezing. The soil underlying the eighteen(18) inch strata of
accepting soil is impermeable and will not provide a downwards disposal
of the percolate. As you will recall, Mr. Bruce Erickson of the
Alaska State Department of Environmental Conservation is in complete
agreement with these conclusions. Your client does have the recourse
of requesting a permit for a holding tank, to pursue the possibility
of installing an innovative system such as the Clearwater System or
Rid -Waste System, or to form an alliance with an adjoining lot utilizing
a community type disposal system.

Dear Dr. Wilson:
On October 18, 1985 my client, Nick Menegatos, submitted to
your Department soils information and a proposed wastewater
disposal mound which I had designed to serve a three bedroom
residence to be located on Tract A -2A of Two Lots Subdivision
(formerly a portion of Kimberley Manor Subdivision). Over the
intervening time there have been numerous discussions between
myself, my client, members of your staff, and DEC personnel
regarding this proposal. Yesterday, I received a "redi-letter"
dated 10/28/85 from Susan Oswalt denying the requested permit
because "The design and soil test does not meet our minimum
requirements for installation".
I do not believe this denial can be justified from an
engineering viewpoint. While some of the soil characteristics
are less than optimal, others are well above minimum requirements
and I have made a very conservative, oversized design, which I
believe will result in a totally satisfactory on-site wastewater
disposal system. Allow me to set forth the facts as I see them.
The lot is over two acres in size and is virtually
surrounded by public rights of way, giving it an effective area
on the order of three acres. At no depth in the test holes was a
water table encountered, nor is there any surface water nearby
which could be contaminated. The nearest surface water is in a
ditch across Rabbit Creek road on the uphill side of the lot.
This ditch, incidentally, does contain water year round and does
pass along the downhill side of numerous small lots well within
100 feet of recently approved septic systems.
The underlying soils on this lot are a gravelly silt (ML).
Despite a measured perc rate of 1/8 inch per hour, this soil
should probably be classified as impermeable for design purposes.
The best soils I was able to locate on the lot are near it's
center where one foot of peat is underlain by 18 inches of a
reddish sandy loam over the abovementioned gravelly silt. The
Unified Soil Classification System does not provide a distinct
category for this sandy loam, so I visually classified it as
either OL or ML, a sandy silt with some organic material. It is
a very dry, friable soil with a perc rate of 13 minutes per inch
measured after being presoaked overnight and resoaked two hours
prior to the test. The reddish color is a good indicator that
the soil is well aerated, a desirable condition for on-site
disposal.
My original design called for removing the peat layer and
placing an additional 2 1/2 feet of clean sand on top of the
natural soil for a total of four feet beneath the gravel and
distribution piping. I believe that this will provide very
effective and adequate filtration and space for oxidation of the
effluent before it percolates down to the ML layer and begins to
migrate horizontally until it eventually evaporates or is
absorbed. To provide an additional safety factor, I sized the
base of the sand portion of the mound at twice the area dictated
by the percolation characteristics of the underlying soil. Thus
I effectively have created a replacement system integral with the
original system. The natural receiving layer does extend beyond
the perimeter of the proposed mound, and was noted at some other
places on the lot, however I have chosen what I believe to be the
center of best materials as the proposed location.
After Susan Oswalt and Steve Morris expressed some initial
concern relative to the thickness of the natural receiving layer,
and suggested that they would welcome the opinion of DEC staff
familiar with mound system design and operation, I arranged a
meeting to discuss the proposed design with Bruce Erickson, the
district supervisor at DEC. I invited Steve Morris to attend,
but he was unable to do so. During the meeting, Bruce expressed
his basic approval of the design, while suggesting that we
specify no more than 5% fines in the sand and increasing the sand
thickness to achieve 6 feet between the bottom of the
distribution piping and the "impermeable" layer. Bruce suggested
that we tell your staff to contact him if there was any question
regarding his recommendation.
Despite this, your staff decided to stick with its original
recommendation for denial, based on an internal guideline your
office uses which calls for a minimum of 20 - 24 inches of
natural receiving soil under a mound. Apparently this number
originated in the EPA Design Manual for On -Site Wastewater
Treatment and Disposal Systems". The EPA manual, however,
defines their 20 - 24 inches as being the distance between the
original soil surface and seasonally saturated horizons or
bedrock, not merely the thickness of the receiving layer.
Interestingly enough, elsewhere in your Department's
guidelines entitled Design of On -Site Wastewater Disposal Systems
the statement is made that "If a seepage bed design is used, the
bed must be laid on a minimum of one foot of soil strata....lying
above an impervious strata." A mound is essentially a seepage
bed, yet this requirement is a far cry from the 20 - 24 inch
requirement refered to above, to say nothing about the six foot
separation from an impervious strata required by State law.
The distinction between 20 vs. 18 inches is really a very
minor point. Such guidelines are based on very rough empirical
data, and should not be treated as absolute. While I would not
personally recommend it, I understand that some localities allow
mound systems to be constructed with no in-situ percable
receiving layer over an impervious layer. It is hard for me to
see how your staff is hung up on this point affecting neither
water table nor surface waters when there are so many genuine
examples of public health problems associated with inadequate
disposal systems on too small lots directly contaminating water
supplies in Anchorage.
Would you please re-evaluate this design, and if your staff
is still reluctant to issue a permit, then advise me of: (1) The
technical documentation supporting their position, and (2) The
design modifications necessary to make the system approvable, or
(3) What expert or body of experts could convince you that the
design is adequate (assuming those experts so decided).

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of On -Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer
of title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or
water supply system. DSD also Issues COSAs upon request to homeowners. Certificates of On -Site Systems
Approval are valid for 90 days from the date of issue for properties served by a private or Class C well and may
be reissued with new water samples. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

investigation, based on procedures outlined in the Certificate of On -Site Systems Approval Guidelines for this application,

for the number of bedrooms and type of structure Indicated herein. I further verify that based on the
information obtained from the Municipality of Anchorage files and from my investigation and inspection, the

and State codes, ordinances, and regulations in effect at the time of installation.

In conducting this evaluation, GEG, LtD. attempted to provide a thorough,
conscientious engineering analysis of the system In accordance with ADEC and MOA
DSD Guidelines & Regulations. The reported results described the performance of the
system under the conditions encountered at the time of the test, and separation
distances measured to readily identifiable features. The operational life of all wells and
septic systems depend on the local soils condition, groundwater levels that may
fluctuate during the year, and the water usage of the family being served by the system.
These conditions are outside the control of the evaluator of the system. Satisfactory test
results do not guarantee future performance of the system, nor do they guarantee that
there are no hidden defects or encroachments. GEG, LTD. can therefore not provide
any warranty or future estimate of how long the system will continue to meet the
operational requirements of the ADEC or MOA DSD. The content of this report is for
the sole benefit of the owner listed above. My reliance upon or use of this report by any
other person or party is not authorized, nor will it confer any legal right whatsoever.

THIS MEMORANDUM OF UNDERSTANDING made and entered into as ofthis

herein the "OWNER," and the Municipality of Anchorage, herein the
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality
grants permission to Owner to utilize and operate{�an Advanced Wastewater
Treatment System (AWWTS), described as adknn-±-.( located

2. Definitions.
A. Alteration. Any change to the design or function of an AWWTS that
Includes the installation or removal of any pans, components or pieces not
included in the original construction permit and design. Prior to
performing any alterations to an AWWTS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code thereinafter, "AMC") 15.65.
B. Certificate of On -Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with AMC 15.65.
•
These approvals certify that the systems are adequate for the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included in
the original design which would allow the AWWTS to continue to
perform as designed.
E. Permit (Construction) An On-Site Wastewater Disposal System
Construction Permit as defined by AMC 15.65.
F. Permit (Operating) An Advanced Wastewater Treatment System
Operating Permit. An annual permit, issued by the Municipality, that
allows the Owner to operate an AWWTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On-Site Wastewater System Construction Permit and
all relevant provisions of AMC 15.65
3. Fee. Owner shall pay to Municipality an annual fee of
.00), payable on or before the issuance of the operating permit and annually
thereafter. The annual fee is due on or before the anniversary date of the approval by the
Municipality of installed system.
4. Term. The term of this Memorandum of Understanding shall be for the life of the
AWWTS.
The term begins on the date of approval by the Municipality of the installed system and
shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On -Site approval is issued to
the new owner or transferee of the property.
5. Alterations, Installation and Removal of Additional Equipment. Owner agrees
not to make any alterations, removal of parts or additions to the AWWTS without a
Construction Permit from the Municipality.
6. Maintenance and Repairs.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the
Owner during the term of this Memorandum of Understanding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2)
maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs.
Further, Owner agrees to comply will all applicable ordinance, laws, regulations,
rules and orders for the AWWTS.
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWWTS Operating Permit. This
schedule shall be submitted to the Municipality annually upon the renewal of the
permit. The schedule of maintenance and repair contained in the Owner's AWWTS
Operating Permit is: k1

C. Owner acknowledges tat the fine schedule for failing to maintain and repair an
AWWTS are codified in AMC 14.60.
D. Owner agrees that only maintenance, repair personnel certified by the
Municipality will inspect and make any necessary maintenance, repairs or permitted
alterations to the system.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
G. Owner agrees that the relevant provisions of the standard specification guidebook
for AWWTS is the governing professional guidelines for the construction,
maintenance and repair of the Owner's AWWTS.
7. Nonwaiver. The failure of either party at any time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way effect the validity of the Memorandum of Understanding or any part
hereof, or the right of such party thereafter to enforce each and every provision
hereof.
8. Amendment.
A. This Memorandum of Understanding shall only be amended, modified or changed
by a writing, executed by authorized representatives of the parties, with the same
formality of this Memorandum of Understanding was executed and such writing shall
be attached to this Memorandum of Understanding as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this contract, the only authorized representatives of the parties are:

C. Any attempt to amend, modify, or change this contract by either an
unauthorized representative or unauthorized means shall be void.
9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.
10. Severability. Any provisions of this Memorandum of Understanding decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining provisions
of the Memorandum of Understanding.
