Subject: Septic Tank Upgrade Permit—T12N R4W SEC 10 W2 LOT 12
The owner has requested we proceed forward to obtain a septic permit to
upgrade the failed septic tank on the subject lot. The proposed upgrade will
serve the existing 4-bedroom duplex. Attached are the ADEC record documents
of the existing septic system to augment the MOA file.
The area is served by private and public water as noted on the design. There is
no surface water within 100' of the proposed tank. We do not expect there to be
any adverse effect on adjacent lots by the development of this tank. If you have

Review
Dear Mr. Spurkland:
This letter is in response to your submittals, received in this office on January 27, and
February 3, 1993, in which you requested approval for the omsite Clas~ C Public Water
System and Wastewater Disposal System. In addition, you requested that the Department
waive the separation distance from the existing Class C Public Water System Source Well
and the septic tank located on Lot 17 from the minimum of 150 feet to the exiting 140
feet. I have reviewed the submitted information and this office's files on the above-
referenced project. Based on this review, I have the following comments.
WASTEVVATER DISPOSAL SYSTEM
From the information submitted and found in the files, it appears that the wastewater
disposal system was installed substantiaiiy in accordance with State regulations and
guidelines at the time. The results of the adequacy test conducted on December 16,
1992 also verify that on the day the adequacy test was performed the wastewater
disposal system was accepting the necessary flows. Therefore, the wastewater disposal
system is approved for the concerns of this Department. The enclosed signed Approval
of On-Site Residential Water and Sewer Systems, constituting this approval, is enclosed
for the existing wastewater disposal system.
DRINKING WATER SUPPLY SYSTEM
The existing Cfass C Public Water System was approved by this Department on July 30,
1987. The results of the total coliform bacteria and nitrate (as nitrogen) was below the

maximum contaminant concentration levels found in 18 AAC 80.070. As a result, this
public water system is in compliance with the provisions of 18 AAC 80 State of Alaska
Drinking Water Regulati0n~. The noted Approval of On-Site Residential Water and Sewer
Systems also constitutes approval of the Class C Public Water System.
WAIVER
From the submitted information, it appears that the existing lesser separation distance
does not effect public health and your client has no objection to the separation distance.
Therefore, in accordance with the provisions of 18 AAC 72.015, Wastewater Disposal
Regulations, and 18 AAC 80.030, Drinking Water Regulations, the requested waiver is
being granted. The separation distance between the Class C Public Water System
Source Well on Lot 12 and the septic tank on Lot 17 has been waived from the minimum
distance of 150 feet to the existing 140 feet.
If the demand on the existing Public Water System changes in any way, this waiver will
become invalid.
The Department is assigning Public Water System Identification (PWSlD) Number to all
public water systems in the State. As a result, the PWSlD Number assigned to this Class
C Public Water System is 218043. At this time the State Drinking Water Regulations do
not require monitoring for Class C Public Water Systems nor do the conditions in which
the waiver was granted require monitoring. However, if the State Drinking Water
Regulations do change, to ensure that the information gets to the correct person, please
fill in the highlighted areas on the attached form entitled "INVENTORY UPDATE FORM"
and return it to this office as soon as possible.

Gentlemen~
This system was installed in
1983, but
has never been approved.
An ASBUILT was submitted in March, 1984, but this ASBUILT was not
in conformance with the permit issued in 1983. The total
absorption area was less then that required by the permit. The
native soil is a very clean and coarse gravel with a percolation
rate higher than one inch per minute.
To system was tested on December 27, 1984. On inspection the tank
was found full and the sump to the drainfield dry. One hundred
gallons was added to the sump, The water level in the tank did
not rise, the water level in the sump rose immediately to 36
inches and stayed at that level. Within 2 hours the sump was
again dry, indicating that the system could absorb substantially
more than the required 450 gallons per day.

Dear Mr. Spurkland:
Thank you for your reply letter of March 14, 1985 regarding the issue of system
adequacy versus system size° Paragraph IIo3 of the Health Authority Approval
(HAA) guidelines addresses situations where records are not available for a
system° It would be very costly in these situations to investigate the physical
size and construction of a system through soil borings and excavations, and our
Department does not routinely require this° However, we do require that the
depth of field be determined in relation to the maximum seasonal high water
table, which does require several soil borings and excavations. This is the
least that we will require in order to "certify" a system where records are not
available for that system.
Where as-built records exist for a system, we have always required that the
minimum system size be present, based on the number of bedrooms, in addition to
passing an adequacy test. This was explained to you in my last letter.
Your request cannot he approved. The system must be enlarged in order to obtain
our approval and certification.

I have received your letter of March 4, 1985. which does not
state the specific reason this system can not be approved. You
call the system sub standard, talk about margin of safety without
stating what this margin of safety should be,both at the time of
construction and during the life of the system. I do not have to
tell you that nowhere in the procedures and guide lines developed
by your department is this subject discussed. The only criteria
for adequacy is that the system can absorb 150 gallons of water
per bedroom per day.
Paragraph II.3. of the guide lines sta%es that "an adequacy test
will also be required if an As Built is not available and the
system must be verified". What is to be verified is not clear,
but one can assume that what the Department is interested in is
the absorption rate of the system, not the physical size.
This system, which according to your letter, is more than three
and one half year old, is absorbing more than three times ~ the
required minimum. It is difficult to understand how you can call
that a sub-standard system.

Dear Mro Spurkland:
This will have reference to your letter dated December 28, 1984 pertaining to
the wastewater disposal system serving a three bedroom single family residence
on the lot described as the west 1/2 of BLM Lot 12, Section 10-Ti2N-R4W, Seward
Meridian° In a meeting in my office on Friday afternoon, March 1, 1985, you
requested that this Department approve the on-site wastewater disposal system
based on the results of an adequacy test taken on December 27, 1984 regardless
of the fact that the system contains less than one-half of the required absorp-
tion area°
Commencing in 1979, with the issuance of the initial "Well and On-Site Sewer
Permit" (No. 790557 dated 9/20/79) and continuing through March 9, 1984, there
have been numerous inconsistencies and infractions by the installer and
inspecting engineer involved in this on-site well and sewer installation° A
chronological summary of the events and actions relative to the on-site well and
sewer is as follows:
On 9/13/79, a soil test was taken by Earl Re Barnard (PE) which indicated
that a GW (85 sq ft/bedroom) soil strata was observed at a subsurface depth
of i' to 15'o The total depth of the test hole was not specifically iden-
tified, however, for design purposes, it was assumed to be at 16'o (On one
copy of the soil test log, it was indicated in ink that the total depth was
19' o)

On 9/20/79, a "Well and On-Site Sewer Permit" (No. 790557) was issued to
Frits Meyer for a three bedroom single family residence in the subject leto
The design requirements of this permit specified that a 12' deep trench 26'
in length with 5' of gravel should be installed. This specific design
would provide the required 255 square feet of absorption area°

3. On 12/31/79, a letter was sent to Frits Meyer advising that the Well and
On-Site Sewer Permit Noo 790557 had expired because this office had received
no information which would indicate that the on-site system had' been
installed° This letter also advised that (1) "if you have drilled that
well, a well log should be sent to this Department to document the installa-
tion date", and (2) "if an engineer has inspected the installation of the
on-site sewer system, please have them submit as-builts for our files."
There was no response to this letter°
4. On 9/30/81, a "Well Permit" (No° 810259) was issued to Frtts Meyer for the
subject loto
5° On 1/4/82, a letter was sent to Frits Meyer advising that the Well Permit
NOo 810259 had expired because this office had received no information which
would indicate that the well had been completed° This letter also advised
that "if you have drilled the well~ a well log should be sent to this
department to document the installation date°" There was no response to
this letter°
6. On 3/9/84, an "On-Site Sewer Permit (Noo 840036) was issued to Frits Meyer
for an upgrade to an on-site sewer system that was apparentl.~ installed in
October, 1979 having less than one-half of the required absorption area°
This situation was brought to our attention when we received an as-built
drawing by Earl Barnard, PE, dated 3/8/84° This as-built and copies of the
"Inspector's Daily Report" dated 10/4/79 were prepared and signed by Earl
Barnard, PE0 According to the information contained in the as-built drawing
and the inspectors daily reports, the sewer system which was installed
approximately, 31/2 years earlier, contained only 108 square feet of absorption
area %~ereas the required area sho~n on the permit was 255 square feet°
7° On 1/7/85, the office received a copy of a well log prepared by T&T Drilling
indicating that a well had been completed on the subject lot on 5/8/81
(approximately 31/2 years earlier) to a total depth of 265' with a completion
potential of 5 gallons/minute°
8. On 1/8/85, this office received your letter dated 12/28/84 which summarized
the results of an adequacy test taken on the on-site sewer system on
12/27/84, and also to which was attached the results of a potable water
analysis report dated 12/8/84o
In several telephone conversations and in our meeting last Friday, March 1,
19857 you have requested that this office grant our approval to this sub-
standard system° Your request is supported by the results of the recent ade-
quacy teSto. As you are aware, the design criteria of an on-site sewer system is
such that a margin of safety is included ~tch is to enhance the longevity of
the system° It is a recognized fact that the results of an adequacy test con-

ducted during the early life of a system can be expected to be very good. This
early performance is not indicative of the longevity of the system. The design
criteria for on-site wastewater systems are very explicit, and this Department
is required by ordinance to adhere to these criteria. I am in total agreement
with Mr. Bandt's and Mrs° Oswalt's decision not to approve this substandard on-
site sewer system° Before any departmental approval will be granted, the
existing system must be upgraded. It has recently been brought to our attention
that the on-site well serving the subject residence has shown a drastic reduc-
tion in productivity and probably does not meet the minimum requirement for a
three bedroom single family residence. By receiving a copy of this letter, ~.
Frits Meyer has been made aware of the problems with his on-site well and sewer
systems, and should take action accordingly°

Minimum distance between a well and any on-site sewage disposal system is 100 feet
for a private well or 150 to 200 feet from a public well depending upon the type
of public well. Minim~ distance from a private well to a private sewer line
is 25 feet and to a co--unity sewer line is 75 feet. Well lo~s are required
and must be returned to this department within 30 days Of the well completion.
Other requirements may apply. Specifications and construction diagrams are
available to insure proper installation.
