Soledad Street, #A Santa Barbara, California 93103 Anchorage Recording District FTA: F-243207 SEPTIC SYSTEM EASEMENT & MAINTENANCE AGREEMENT This SEPTIC SYSTEM EASEMENT & MAINTENANCE AGREEMENT ("Agreement") is entered into this J day of 2025 ("Effective Date"), by TRACY BALLARD, an unmarried person, whose mailing address is 505 N. Soledad Street, #A, Santa Barbara, California 93103 ("Ballard"). RECITALS: A. Ballard is the owner of that certain real property located in Anchorage, Alaska, as more particularly described as: Lots 1 and 2, VANDENBERG SUBDIVISION, according to the official plat thereof, filed under Plat No. 71-81, records of the Anchorage Recording District, Third Judicial District, State of Alaska (individually referred to as "Lot 1" and "Lot 2"). B. Lot 1 and Lot 2 are each referred to herein as a "Lot" and collectively referred to as the "Properties". The owner of any Lot is referred to herein as the "Lot Owner" of such Lot. C. Lot 1 is currently served by a septic system located within a portion of Lot 2, which system consists of a septic tank and drain field, and related appurtenances designed for the storage, conveyance, treatment, and/or disposal of waste and wastewater from Lot 1 (collectively the "Septic System Improvements"). D. The Septic System Improvements within Lot 2 are located within the area shown and labeled as "50' Septic System Easement" on Exhibit A. attached hereto and made part hereof (the "Easement Area"). E. Ballard desires to establish a permanent non-exclusive easement within the Easement Area in favor of Lot 1 for the continued use, maintenance, repair, and replacement of the Septic System Improvements serving Lot 1, upon the terms and conditions set forth herein. Now, THEREFORE, Ballard hereby reserves within and grants unto the Properties the following easements, subject to the covenants, conditions and restrictions contained herein. 1. Recitals. The foregoing recitals are true and correct, and are hereby incorporated into this Agreement as if fully set forth herein. Ballard hereby reserves and grants to the Lot Owner of Lot 1, and to its agents, successors, assigns, tenants, guests and invitees, a perpetual, rent free, non- exclusive easement appurtenant in, over, upon, across and through the Easement Area within Lot 2, for the continued use, operation, testing, maintenance, repair, removal and replacement of the Septic System Improvements serving Lot 1. The Lot Owner of Lot 2 shall have the right to use, occupy, and improve the Easement Area for any and all purposes not inconsistent with the rights granted herein, including, but not limited to, making landscaping improvements; PROVIDED, HOWEVER, that the Lot Owner of Lot 2 shall not take any action that interferes with the reasonable use and enjoyment of the Septic System Improvements by the Lot Owner of Lot 1, including but not limited to the placement of permanent or semi-permanent improvements within the Easement Area, which is strictly prohibited. The easement hereby granted shall constitute a covenant running with the land, intended to burden Lot 2 and benefit Lot I. Responsibility and Standards for Maintenance, Repair and Replacement. (a) The Lot Owner of Lot 1 shall be solely responsible for the maintenance, operation, testing, repair and replacement of the Septic System Improvements, and for the payment of all costs and expenses related thereto. (b) The use, operation, testing, maintenance, repair, removal or replacement of the Septic System Improvements, and any construction or other work performed within the Easement Area by the Lot Owner of Lot 1 pursuant to this Agreement: (i) shall be conducted in a good and workmanlike, safe and efficient manner, pursuant to any required validly issued building or similar permits; and (ii) be in compliance with all applicable laws and regulations and after obtaining all necessary approvals from governmental authorities. (c) The Lot Owner of Lot I shall maintain the Septic System Improvements in a clean, safe and orderly condition. (d) The Lot Owner of Lot I shall ensure that excavations within the Easement Area (if any are necessary) neither remain open without proper safeguard nor remain open for any longer than the minimum period reasonably necessary for the performance of the work for which such excavations are necessary. (e) Upon completion of any work performed within the Easement Area, the Lot Owner of Lot 1 shall remove all equipment and debris from the Easement Area, and shall restore the surface of the Easement Area to at least as good of a condition and appearance as existed prior to commencement of such work. 4. Damage to Lot 2. In the event the Lot Owner of Lot 1, or its agents, contractors, tenants, guests or invitees, damages or disturbs any portion of Lot 2, including, but not limited to, fencing or landscaping (the "Lot 2 improvements"), due to the use, operation, testing, maintenance, repair, removal and replacement of the Septic System Improvements, or through negligent or willful misconduct, then the Lot Owner of Lot 1, at its sole cost, shall be responsible to immediately restore the Lot 2 Improvements to the condition in which they existed prior to being damaged or disturbed. For purposes of this Agreement, the Lot Owner Lot I shall be responsible for any damages caused to the Lot 2 Improvements by its respective agents, contractors, tenants, guests, and invitees. Use and Use Restrictions, The Easement Area shall be used by the Lot Owner of Lot 1: (a) only for the continued use, operation, testing, maintenance, repair, removal and replacement of the Septic System Improvements serving Lot 1; and (b) in a quiet and peaceful manner so as not to disturb or unreasonably interfere with the use and reasonable enjoyment of Lot 2 by the Lot Owner of Lot 2, or its tenants, guests or invitees. 6. Approval of Alterations, Construction or Other Work Within Easement Area. To the extent that any alteration of the Septic System Improvements or any construction or other work performed within the Easement Area by the Lot Owner of Lot 1 requires the prior approval of any governmental authority, then such alteration, construction or other work shall also require the prior written approval of the Lot Owner of Lot 2, which approval shall not be unreasonably withheld. The Lot Owner of Lot I shall provide the Lot Owner of Lot 2 with copies of any plans submitted to any governmental authority in connection with any proposed alteration of the Septic System Improvements or any construction or other work performed within the Easement Area. 7. Indemnification and Hold Harmless. The Lot Owner of Lot 1 shall indemnify, defend, and hold the Lot Owner of Lot 2, harmless from all claims of injury to persons or property, and all damages, costs, expenses, fines and penalties relating thereto (including reasonable attorneys' fees), arising from: (a) the use, operation, testing, maintenance, repair, removal or replacement of the Septic System Improvements by the Lot Owner of Lot 1, or its agents, contractors, tenants, guests or invitees; (b) the activities, actions or omissions of the Lot Owner of Lot 1, or its agents, contractors, tenants, guests or invitees, within the Easement Area; and/or (c) any violation of the terns and conditions set forth herein by the Lot Owner of Lot 1, or its agents, contractors, tenants, guests or invitees. The Lot Owner of Lot 2 agrees that the Septic System Improvements shall be permitted in the Easement Area at the Lot Owner of Lot 1's sole risk, and in no event shall the Lot Owner of Lot 2 be liable for any damage or injuries of any nature or type whatsoever arising from the Septic System Improvements, except to the extent caused by the activities, actions or omissions of the Lot Owner of Lot 2. 8. Covenant Running with the Land. Each and every one of the benefits and burdens of the covenants contained in this Agreement shall be covenants running with the land and shall be binding upon and inure to the benefit of the owners from time to time of every portion of Lot 1 and Lot 2, their legal representatives, heirs, executors, administrators, successors and assigns. 9. Authority to Execute. The person or persons signing this Agreement are duly authorized and have full power and authority to bind the party or parties for which they are signing. 10. Partial Invalidity. Whenever possible, each provision of this Agreement shall be interpreted in such a way as to be effective and valid under applicable law. If a provision is prohibited by or invalid under applicable law, it shall be ineffective only to the extent of such prohibition or invalidity, without invalidating the remainder of such provision or the remaining provisions of this Agreement. 11. Titles and Headings. Titles and headings to articles, sections, or paragraphs in this Agreement are inserted for convenience of reference only and are not intended to affect the interpretation or construction of the Easement. 12. Waiver. Any waiver of strict compliance with any of the terms and conditions of this Agreement must be in writing and signed by the party to be charged, and any such waiver shall not constitute SEPTIC SYSTEM EASEMENT & MAINTENACE AGREEMENT Page 3 of 8 FAT.- F-243207 3of8 eRecorded Document 301-2025-026189-0 a waiver of that party's rights under any other provision of this Agreement or a waiver of that party's rights to strict compliance with any of the terms and conditions of this Agreement thereafter. 13. Severability. The invalidity or unenforceability of any provision of this Agreement under any present or future law, rule, regulation or ordinance will not affect any other provision of this Agreement, and the remaining provisions of this Agreement shall continue with the same force and effect as if such invalid or unenforceable provision had not been inserted in this Agreement. 14. Doctrine of Merger. In the event of a finding that the easement rights granted under this Agreement would otherwise be extinguished or be of no effect under the doctrine of merger, this Agreement shall be considered as a "Springing Easement Effective upon Date of Sale", which will result in the easements as set forth above taking effect at such time as the dominant or servient estates (or portions thereof containing or affected by the easements) are transferred, sold or conveyed in a manner so as to, be under separate ownership (i.e., such merger due to common ownership shall not result in the extinguishment of this Agreement). This covenant shall automatically create the subject easements upon the recording of a deed conveying either the dominant or servient estates (or portions thereof containing or affected by the easement) to another party, whether or not the easements are referenced in the deed. From and after the date that the easement thus becomes effective, the affected Properties shall be subject to all terms and conditions contained herein. 15. Amendment; Termination. No modification or termination of this Agreement shall be binding upon a Lot Owner unless it is in writing, signed by all Lot Owners, or their legal representatives, successors or assigns, and recorded in the records of the Anchorage Recording District, Third Judicial District, State of Alaska. 16. Governing Law; Submission to Jurisdiction. This Agreement shall be governed by and construed in accordance with the law of the State of Alaska. Grantor and Grantee agree that any legal action or proceeding under or with respect to this Agreement shall be brought in the courts of the State of Alaska. Wolverton a request for a waiver of the separation distances stated in Title 18 Alaska Administrative Code Chapter 80.020 is hereby requested. Mr. Wolverton is presently building a dwelling on lot 2 of Hall Subdivision. Hall Subdivision was subdivided one year ago. Formerly is was identified as Lot 11, Section 10, T12N, R4W. A residence was located on what is now lot I. The septic system for this residence was upgraded in 2983 and sized to serve 6 bedrooms in anticipation of Mr. Wolverton building on lot 2. The separation distance between the well and this system is 139 feet. Immediately to the west of Hall Subdivision is Vanderberg Subdivision, consisting of 4 lots, one of which, lot 1, has been developed, housing a duplex. The well serving this duplex is located in the south east corner Of lot 2, Vanderberg. The septic system occupies parts of Lots 1,2, and 3. Both the well and the septic system was installed in 1977, the septic in August and the well in September. Municipal Records do not indicate if a waiver was issued or if the well was inspected. At the closest point the distance between the well and the drainfield is 65 feet, the distance to the septic tank is 150 feet. The owner of lot 1 Vanderberg intends to relocate the drainfield serving the duplex, locating the new field along the west property line of lot I. By obtaining a lot line waiver from the municipality the new drainfield can be placed outside the 150 feet radius of the well. However, he is requesting a waiver for the septic system on lot 1, Hall Subdivision. Tobben Spurkland P.E. I feel that this waiver of 11 feet should be granted. The well is 275 feet deep, with a 50 foot thick impervious layer between 80 and 130 feet. The well is up hill from the septic system in Hall Subdivision further reducing the possibility of accidental conta- mination. The well casing ends two feet above ground level. The sanitary seal is in place and the wire is in rigid conduit. I have enclosed the well log and Municipal inspection reports for the two septic systems. An AS -BUILT based on field measurements are also included. Mr. Ernest Hall is the owner on record of all the lots in Vanderberg Subdivision. He is also the owner of Lot 1, Hall subdivision. Gentlemen: On behalf of Ernest Hall, owner of Lot 1,Vandenberg Subdivision, we are requesting a waiver from the recommended distance between a lotline and elements of a septic system, presently 10 feet. The justification for this waiver request is that the lot is presently served by a septic system installed in 1977. The drainfield occupies space on three lots, and is also within 65 feet of a Class C well. In order to make the system compliant to the State Code, a new drainfield must be installed on Lot 1. In order to maintain 150 feet separation to the well, this trench must be installed close to the lotline. The maximum separation between the trench and the lotline will be 5 feet.
