As certified by my seal affixed hereto and as of the validation date shown below, I verify that my investigation,
based on procedures outlined in the Certificate of On -Site Systems Approval Guidelines for this application,
shows that the on-site water supply and/or wastewater disposal system is (are) safe, functional and adequate
for the number of bedrooms and type of structure indicated herein. I further verify that based on the information
obtained from the Municipality of Anchorage files and from my investigation and inspection, the on-site water
supply and/or wastewater disposal system is(are) in compliance with all applicable Municipal and State codes,
ordinances, and regulations in effect at the time of installation.

In conducting this evaluation, GEG provided an engineering evaluation of the well and/or septic system
in accordance with the guidelines and regulations established by the Municipality of Anchorage and
industry practices. The reported results describe the condition of the system/s on the date/s of the

MUNICIPALITY OF ANCHORAGE
ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and
entered into as of this Day of ? JJ tJt C "t of 20` <, by and between
herein the "OWNER," and the Municipality of
Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),
described as

2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

Owner acknowledges that the Municipality may request records of maintenance and
repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.
Owner agrees that any sale or transfer of title of the property will not occur without a new
Certificate of On-Site Systems Approval.
Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction. maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof; or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.

The length dimension is the length(in feet) of the trench or drainfield. The
depth of a trench or pit is the distance between the surface of the ground and
the bottom of the excavation(in feet). There is no set width for trenches.
The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet).

installation inspections of any wells adjacent to this property and the number
of residences that the well will serve.

Backfilling of any system without final inspection.and approval by this department
will be subject to prosecution.
Minimum distance between a well and any on-site sewage disposal system is 100 feet
for a private well or 150 to 200 feet 'from a public well depending upon the type
of public well. Minimum distance from a private well to a private sewer line
is 25 feet and to a community sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days Of the well completion.

available to insure proper installation.

stances, i.e. Drain cleaner, caustic or acid.
4. A further extension of this contract is recommended to reduce
possible breakdown.

Dear Homeowner:
You are now the owner of THE MINI-PLANT waste treatment system. This
unit is ~n aerobic treatment unit which employs a biological process
called the Activated Sludge Method.
It has been professionally designed and tested to adequately meet the
demands of treatment for a home such as yours. The design and select-
ion of each component has been carefully evaluated to provide you ~rlth
the optimum treatment of your household wastes.
THE MINI-PLANT carries the National Sanitation Fotuudation Seal NSF
Seal, in accordauce ~flth Standard No. 40 which covers individual Aerobic
Waste Water Treatment Plants. The importance of t~s seal is to assure
you that the design of this ~nit has been professionally evaluated by a
nationally recognized testing organization whose purpose is to develop
standards and criteria for equipment, products and services that bear
upon health.
The purpose of this manual is to acquaint you, the homeowner, with what
responsibilities you may have, describe the operation of your new home
waste treatment plant and provide you with the important information
covering warranties and service contracts.

The dealer, with whom you have signed a Service Contract, will. take
care of the necessary maintenance for THE MINI-PLANT.
Your only responsibility is to call your dealer in case the ala~,
which is so designated in t~is manual, is activated.
There are three red alarm lights, three green lights, t~ yellow
lights and a buzzer silencer switch on the control panel which you
should check ~ccasionally.
1. Red lights and ~larm
The red lights indicate high water level or a possible pump
or blower out ou overload. If the high water level red light
goes on, a buzzer will be heard. If this happens, please do
the follo,~a~g:
a. Turn off switch to silence alarm.
b. The red light wt]l still be on, tkis is normal. Avoid
using the washing macb_ine if possible.
c. Wait till next morning, and check if the red light is still
on. If this is the case, call your dealer.
Do not call your dealer if the red light is not on, as the
light and buzzer were activated because you used too much
water. Return the alarm silencer back to on position.
If your primp or blower red light goes on, call your servicing
dealer.
Green Lights ~
a. Green-light above alarm silencer switch v~ll be on a~ all
times and indicates that power is on. If not on, you may
have a burned out I~use or there is R major power failure
in your area. Please check that your other appliances
are working before calling your dealer.
b. Green light for blower indicates blower is running.
c. Green light for pump indicates [x~p is running.
Yellow Lights
a. Yellow light for blower indicates blower is on stand-by,

CARE & MAINTENANCE
To insure that your plant operates efficiently and to dimir~ish the possibility
of problems within your own plumbing system, the following practices should
be followed:
DO NOT - ~lush any household waste items, normally placed for
garbage collection, into your piping system and home treatment
unit.
DO NOT - Flush any plastic or plastic treated products into
your system. Such products would be plastic treated paper
towels, napkins and such items.
3. DO NOT - Flush any of your plumbing system with toxic materials.
The use of toilet bowl cleauers should be kept to a minimum.

Use low phosRhate and low fosming detergents only. THE MINI-PL;/~
is designed to handle ONLY S~NITARY HOUSE WASTE~. Storm drains from
house roof, foundations, area-ways ~st NOT be piped to THE M~I-
PL~. Also drainage from garage floors or other sources of oily
waste.s, acids, and lyes must be excluded from the

Sludge should be removed when the sludge reaches a level of within
3 inches fr~n' the botto~ of the effluent p%unp'leaviog' about 5 inches
of sludge on the bottom to reactivate the process.

DESIGN & OPFRATION OF THE MINI-PLANT
THE MINI-PLANT has been designed to function in ha~.ony with man's
daily activities.
The air supply system takes air from the surrounding atmosphere,
filters it and supplies it to the diffusers for providing oxygen
in the air to. the incoming waste. Oxygen is required to maintain
the biologic~! process in THE MINI-PLANT.
The timer is programmed so the aeration stops at 2 a.mo A three hour
period of perfectly quiescent settling follows. After settling, the
pump is used to discharge the treated waste water in THE MINI-PLaNT to
the area designed for your system. The blower will then come back on
and your system will be ready to take and treat the following days
waste load.
If the hydranlic flow patterns for the household changes, the program
timer can be set to operate the proper process functions for the change
in schedules.
There will be abuild-up of excess sludge in the tank and to insure
proper operation, it is necessary that this aerobically treated sludge
be pumped out whenever the servicing dealer determines it to be necessary.
This pumping may be necessary once every 2 to 3 years.
BATCH SYST~3 UA~RANTY.
Eastern ~vlronmental Controls, Inc., hereafter referred to as E. E. C.,
warrants the parts in each MINI-PI,ANT, M;~XI-PLANT and SUPER MAXI waste
treatment systems, when properly registered ~,~th the manufacturer, to be
free frown defects in material and worlons~ship in no,ual use and service.
E.E.C~s sole obligation under this warranty is limited to repairing or
exchanging any c~mponent parts, F.O.B. factory, that in E.E.C*s judgement
show evidence or defects provided that said component pa~ts are returned
through on authorized E.E.C. dealer, transportation prepaid, within 2~
months from the date of installation.
This warranty applies only to equipment supplied by E.E.C. and does not
include any portion of the household plumbing, drainage or disposal system.
In no event shall E.E.C. be responsible for delay or damages of any kind or
character resulting'from, or caused directly or indirectly by, defective
components or material.
The liability of E.E.C. is limited to the replacement of the defective
component parts and E.E.C. shall not be liable for any labor iuvolved
during the removal or replacement of its equipment nor for the subsequent
transportation or handling of any component parts or parts thereof. In
no case will E.E.C. be liable for loss incurred because of interruption
of service or for consequential damages, labor or expense required to
=epair defective units, nor shall this constitute a cause for the
cancellation of the contract of purchase and sale.
E.E.C. reserves the right to revise, change or modify the construction
and design of the E.E .C. Batch Treatment Systems, or any component parts
thereof without incurring any obligation to make such changes or modifications
in the above mentioned equipment. E. E.C. also reserves the right, in
making replacements of component parts under this warranty, to furnish a
component part which, in E.E.C.'s Judgement, is equivalent to the parts
replaced.
Occasional service may be required for the units which is not a result of
defects in material or workmanship in the product, but is due to c.a.uses
beyond E.E.C.'s control. Serwlce charges (parts and labor) necessztated
or damage resulting from (a) accident, alteration, improper use, abuse, or
tampering; (b) failure to follow installation instructions; (c) failure
of purchaser to follow normal operating procedures; (d) having been
repaired or altered in auy manner outside of E.E.C. 's factory tumless
designated in ~a~iting by E.E.C.; or (e) damage due to defective power
supply or faulty installation, are not covered by this warranty and are
not assumed by E.E.C.

Tom Seaward - Septic Systems
In response to the correspondence from Mr. Tom Seaward regarding the Flygt Mini-Plant
Sewage Treawnent System, we have the following cormuents:
In August of 1977 the On-Site Services Section permitted the installation of one "package
plant" septic system on Lot 10, Block 2, Valli Vue Subdivision. The permit stated that
"either a class I or II NSF (National Sanitation Foundation) approved plant may be
installed." It did not limit the installation to any specific make or model, nor did the
permit specifically refer to the Flygt Mini-Plant Sewage Treatment System.
The On-Site Services Section has no records indicating that this Flygt system received any
specific approval beyond the issuance of this permit which allowed a "treatment system"
under the then current codes.
The permit did stipulate that the installation must have met all requirements of Anchorage
Municipal Code (AMC) in effect at that time. AMC 15.65, Wastewater Disposal
Regulations, in effect in 1977 did allow for the installation of "treatment plants" in section
15.65.040.E.3.
A review of the cedes in effect in 1977 and the as~built drawings of this system reveals
that the system installed under this permit (#77620) did not meet all then current
requirements. The code required a two compartment septic tank for any system, and this
installation had a one compartment tank. The perm/t and AMC 15.65.040.E.3 specifically
required a continuous maintenance agreement between the property owner and the local
disU:ibutor or maintenance concern. Copies of the maintenance agreements and results of
any periodic inspections (including work performed) were required to be submitted to this
department within 30 days. This section received no maintenance information regarding
this system after 1979. A Certificate of Health Authority Approval was issued for this
property in June of 1992 reiterating the requirement of a maintenance agreement, but no
agreement has subsequently been submitted.
AMC 15.65 was revised in 1986 and again in 1990. These revisions did not include
treatment plants as approved septic systems. However, as with any change in code
requirements, any individual systems installed prior to these changes would remain legal
j-hr the life of the system as installed. (15.65.120)

The code revisions of t986 and 1990 (the current code) allowed for the installation of
systems other than the standard designs included in the code as "Innovative or Alternative
Systems". The requirements for installing an innovative system are listed in detail in AMC
15.65.130.
The On-Site Services Section strongly supports the installation and testing of septic
systems using new and innovative technology. The section is mandated by code to solicit
designs for alternative systems once a year. The section and the On-Site Wastewater
Technical Review Board spend a great deal of time researching proposed systems and
analyzing data on systems undergoing testing. Although the Flygt Mini-Plant Sewage
Treatment System was installed in 1977 and has been in operation for almost 18 years,
there are less data on the efficiency of this system in local sub-arctic conditions than is
available on innovative systems installed for testing in 1994.
Concerning Mr. Seaward's allegations of a possible ethics violation concerning a "former
director of DHHS", we have the following comments:
In 1992, the On-Site Services Section began an installation and testing process for an
innovative sand filter septic system. This is a technology developed by Orenco Systems,
Inc., of Roseburg, Oregon. This technology is not patented, and has no proprietary
components. The Municipality of Anchorage applied for and received a grant from the
Alaska Science and Technology Foundation to partially fund the installation and testing of
three of these systems. In addition to these three systems, two additional systems were
permitted. These other two systems were constructed entirely at the owner's expense,
including all sampling. One of these two additional systems was constructed for the
former director of DHHS. Following construction, the sand filter project was audited to
insure that no grant funding or municipal monies were applied towards the system installed
by the former director. The audit confirmed the monies were spend appropriately.
This sand filter technology is going through the standard procedure for innovative systems
to become standard septic systems. This procedure is defined in AMC 15.65.130 and all
phases are reviewed by the On-Site Wastewater Technical Review Board. The process for
this system design should be completed in the fall of 1995.
We are unaware of any similarities between the sand filter system technology and the 1977
permitted treatment system. We are also unaware of any benefits the former director of
DHHS will receive from the completion of the review process on this technology. The
former director is not involved in the sales, promotion or installation of this technology,
but was a "guinea pig" volunteer for the project.
