During installation o~ the new trenches at this location we
discovered that the main electrical power lines to the residence
con{li(:ted with the loc:ation o~ the ~rench as originally laid
out. To resolve the con~lict the trenches were moved back, with
the result that. the end o'2 t:l'~e two trenches encroached into the
ten ~oot set back ~rom the property ].ine. One trenc, h clean out
is 5 ~eet ~r'om the line~ the other 8 Ceet. F'lease issue a waiver

THIS AGREEMENT, made and entered into this 14th day of
December, 1992, by and between CHUGACH ELECTRIC ASSOCIATION, INC., an
Alaska non-profit electric cooperative membership corporation of
Anchorage, Alaska, hereinafter called "First Party" and William Engle
of Anchorage, Alaska, hereinafter called 'Second Party', WITNESSETH
THAT:
WHEREAS, First Party occupies an easement on the South side
of Lot Seventeen (17), Block Two (2), Valli Vue Estates Subdivision
No. 2, Anchorage Recording District, Alaska; and
WHEREAS, Second Party ha~

NOW, THEREFORE, for and in consideration of their mutual
agreements and other good and valuable consideration, the receipt of
which is hereby acknowledged, First Party, for itself, its successors

the said easement for the purpose mentioned, subject to the following
conditions:
1. Second Party will hold First Party harmless from
liability for any injury or damage to any person or property which may
result from such encroachment.
2. The said encroachment will be without prejudice to
First Party's full enjoyment of any and all rights it may have in and
to such easement.
3. Any facilities or property of First Party which are
damaged or destroyed ae a result of such encroachment will be repaired
or replaced at no cost to First Party.
4. Second Party will comply with all applicable safety
codes and regulations.
5. Any expenses which First Party may incur in the
relocation or modification of its facilities to accommodate the said
encroachment will be paid by Second Party.
By its execution of this Agreement, Second Party agrees, for
itself, its successors, and aesigns, that its encroachment upon the
named easement ae hereinabove mentioned will be subject to the
foregoing conditions.
IN WITNESS WHEREOF, the parties have caused this Agreement
to be executed by their duly authorized representatives and agents as
of the day and year first above mentioned.

The Anchorage Telephone Utility (ATU) has no objection to the encroachment into a platted
easement located on Lot 17, Block 2, Valli-Vue Estates, as depicted on the as-built drawing
attached.
Acceptance and use of this letter of non-objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
ATU will be held harmless, now and forever, for any damages or injury to any
person or property as a result of this encroachment.
Any ATU facility damaged or destroyed as a result of this encroachment will be
repaired at no cost to ATU.
Any costs incun'ed by ATU for special construction necessitated by this
encroachment will be borne by the property owner.
All applicable safety code regulations will be observed and maintained.
This letter of non-objection will in no way preclude ATU fi'om full use and
enjoyment of its rights within any portion of its right-of-way.

Prime Cable of Alaska has no objection to the septic system
encroaching into the platted southern utility easement on Lot 17,
Block 2, Valli Vue Estates #2.
Acceptance and the use of this letter of non-objection by yourself,
your heirs, and your assigns, or your suacessors shall con~titute
agreement to the following conditions:
1. Prime Cable will be held harmless, now and forever, for any
damage or injury to any person or property as a result of the
encroachment.
2. Any Prime cable facility damaged or destroyed as a result of
this encroachment will be repaired at no cost to Prime Cable.
3. Any costs incurred by Prime cable for special construction
necessitated by this encroachment will be borne by the
property owner.
4. Ail applicable safety code regulations will be observed and
maintained.
5. This letter of non-objection will in no way preclude Prime
Cable from full use and enjoyment of its rights within any
portion of its right-of-way.

above-referenced Class "A" Public Water System and found the following:
The last satisfactory Total Coliform Bacteria Sample results was submitted
to this Department on November 6, 1992. This does meet the provisions
of 18 AAC 80.200(a), of the State Drinking Water Regulations.
The last inorganic Chemical Contaminants Sample results were submitted
to this Department on August 13, 1992. This does meet the provisions of
18 AAC 80.200(a), of the State Drinking Water Regulations.
The last Radioactive Contaminants Sample results were submitted to the
Department on September 9, 1992. This does meet the provisions of 18

Gentlemen :
As per your request I performed a 7 day groUnd water monitoring program on the
subject property. The monitor hole was drilled to a depth of 20 feet with a 6
inch solid flight auger. The location of the hole was as sho~ on the attached
site sketch.
At the end of 7 days water did not appear in the monitor hole. Further inquiry
has revealed, that although the home in question has been vacant, substantial
use of the water did occur during repairs of broken water pipes and subsequent
cleanup work.
Please release the Health Authority Application as soon as possible. Time is of
the essence on this property.
