Dear Mr, Roth:
On behalf of our client, Eklutna~ Inc., we are applying for
Municipal ltealtb and Human Services Department approval for the above
referenced subdSvision.
The proposed subdivision is being undertat~en to consolidate
several irregular shaped lots owned by Eklutna, Inc. in order to
provide usable acreage. The attached plot plan shows our proposed
septic area for this simple 3 lot subdivJ, sion. Lots 1 and 2 contain
soils that are rated 85-155 and therefore, as per attached soil logs,
an area of 10,000 S.F. is required for Lot 1 with an area of 12)000
S.F. required for Lot 2. The: area proposed for use as septic: reserve
is an area that bas been made available through public land order'
1613. This ]and was deeded back to Eklutna, Inc. with a reservation
for highway purposes. We are presently in the process of obtaining a
letter' of non-objection on airspace rights for septic system use from
the State Department of Transportation. Our proposal is to provide a
septic area reserve for Lot 2 which extends partially in front of Lot
1 as shown on the plot plan.
These two lake fcont lots, being long and narrow and observing
the proper lake, lot line, top of slope and roadway setbaeks, require
an innovative method of providing a septic ares. lfowever, I believe
that a combination of excellent soils and the flat bench ares will
provide a suitable situation where several septic systems and their
eventual replacements can be obtained while allowing these two lake
front lots to be developed. PublJ. c sewer service is located where
futnre connection is possible when lateral extensions are completed.

Lot 3 is addressed separately as this lot is simply a
modification of an original BLM Lot ~]08. Our modification of this
let simply increases the size of Lot 108 to 3.7 acres and provides
limited access to the Old Glenn llighway. As we are adding, area to an
existing lot, we ask that the requirement of a test hole and septic
review be waived for Lot 3. Attached is a site plan showing the
original Let 108 area.

VARIANCE JUSTIFICATION
for variance from Section 21.80.330 (A)
1. The strict application of this section would be impractical,
unreasonable, and undesirable to the general public for several
reasons. A) It would be unreasonable an~ eimpractical in that
there is no way to lay out the lots otherwls , given the position
of the Old Glenn Highway and Upper Fire Lake and B) It would be
undesirable to the general public because it would mean that the
lots would remain configured as they are with no restriction as
to access onto the Old Glenn Highway effectively doubling the
potential for direct access over what is requested by this
variance.
2. The granting of this variance would not be detrimental to the
public welfare or injurious to other property in the area because
it would create a safer situation than is allowed now (it will
allow only one direct access rather than two).
3. The granting of this variance will not have the effect of
nullifying the intent and purpose of this ordinace because it is
a special situation (resulting from topography and pioneer road
alignment) and the result will be a better condition than now
exists.
4 The above conditions or circumstances do not result from the
action of the applicant and do not merely constltut a pecuniary
hardship or inconvenience in that the situation was created by
the U.S. Bureau of Land Management and the Alaska Road Commission
before the applicant was given title°

Dear Lou,
I have reviewed your most recent soil test and preliminary plat
on the proposed subdivision. The following items must still be
resolved prior to final plat approval.
Submit water monitoring results on all testholes. The
department will require readings from the period May 15
through June 15. Ail other readings may be monthly.
As previously agreed upon, suitable plat notes will be
added to(a) protect the integrity of the reserved
disposal areas on Lots 1 and 2, and (b) permanently
designate Tract A as open space.
Although there are adequate reserve~ areas on Lots 1 and
2, a ten foot property line setback on the north must
be maintained and will slightly decrease reserved area
as shown on the plat.

Dear Mrs, Oswalt:
We have received your comments dated February 4, 1988 regarding
our proposed Walking Bill Subdivision and have addressed each comment
as numbered:
Comment #1. A ~il test hole has been excavated with
results attach~ed, A test hole for Lot 3 will not be
necessary as we have redrawn the plat to eliminate Lot 3.
Comment #2. Not necessary due to elimination of Lot 3,
Tract A is to be designated as open area for wetland and
creek maintenance.
Comment ~3. N/A. Tract A will not be used for septic
systems.
Comment #4. Plat Note #1 allows for common driveway. At
the time of this letter, we had not added the note "No
access shall be allowed to cross reserved sewage disposal
area on Lot 1." However, this note will be added at 'the
k~j. lNe of final plat.
Comment. #5. We have rio problem with water monitoring
.through May 31 and will submit monthly results at that
~~me, As of February 27, 1988, no water is indicated in any
~ test hole.

Comment #6. I have attached a revised site plan showing
possible well locations and access routes. I hesitate to
designate well sites on the final plat for several reasons.
Designation of a well site does not allow any flexibility 'to
the owner to place his well ~here he thinks water is
located. Wells can actually be placed anywhere along the
lake shore without infringing on the septic reserve area.
It is assumed that the ordinance requirements of ]0,000 -
12,000 S.F. reserved area allow such an excess of reserve
area, that the intent to provide one original and two
replacement septic systems, is provided regardless of future
well orientation. I would have to ask, does 'the current
ordinance require designation of well sites? If there is a
concern that future land holders will not properly locate
their ~ell and possibly destroy available reserve area,
· these concerns are addressed when the property owner applies
for a well and septic permit and a site plan is required.
We are requesting that specific well siting be eliminated as
a plat requirement.
Comment #7. All reserve areas for the purpose of area
calculatien are noted to be 100' from lake.
