Box 10-1776 Anchorage, Alaska 99503 Anchorage, Alaska 99510 Subject:~Lot 2 BLock 6 Zodiak Manor Subdivision, Mr. Gary Lehnerz '---~ ~11% k~equest for Waiver of Well to Sewer Trunk Setback Requirement 2 f On Tuesday, July 22, 1986 under the Appearance Request portion of the Assembly meeting, Mr. Gary Lehnerz spoke concerning the denial by the Department of Health and Human Services (DHHS) of his request for waiver of the State and Municipality setback requirements between an on-site well and sewer trunk line. As I pointed out under questioning by Mr. Parnell, in 1985 the Alaska Department of Environmental Conservation (ADEC) granted the authority to the Municipality to waive certain setback requirements of on-site septic systems and potable water wells under very stict guidelines provided by ADEC. Mr. Lehnerz's request for setback requirement waiver was reviewed by Mr. Steve Morris, a civil engineer in the On-site Services Program of DHHS, and Mr. Morris denied the request based on his evaluation under the ADEC quidelines (see attached letter). In my response to Mr. Parnell querries, I pointed out that Mr. Lehnerz was advised that he could appeal Mr. Morris's denial to ADEC, and that I would be glad to assist him in arranging a meeting between himself, ADEC and this office. At 9:00 a.m., Friday, July 25, 1986 a meeting was held in the ADEC office which was attended by Messrs Lameraux and Erickson from ADEC, Robby Robinson and Susan Oswalt from DHHS, Mike Mills, Ombudsman, Gary Lehnerz and his real estate agent Marian Lampman. At this meeting, Mr. Erickson explained the background history of the transfer of waiver authority from ADEC to the Municipality, and that the waivers granted by DHHS were subject to random rew[ew by ADEC. Mr. Erickson further added that the guidelines for reviewing and granting (or denying) waiver requests were inded very strict, and that he had no intention of over- ruling the denial of Mr. Lehnerz's request. He further agreed (with Mr. Robinson) that the best and most economic solution for Mr. Lehnerz's problem would be to relocate his well outside of the 75' protective radius from the sewer trunk line. It is estimated that the well relocation would cost approximately $3,800.00. Mr. Erickson inquired as to the possibility of issuing a temporty waiver (up to three year duration) pending the availability of public water services (WID) to the subject lot. I told Mr. Erickson that AWWU had advised us that (1) a proposed WID will still be 1,300 feet from the subject lot, (2) it is not feasible to extend water service to the subject lot, (3) there are no plans in the forseeable future for a water extension to the subject lot. Mr. Dave Walsh Mr. Kevin "Pat" Parnell July 28, 1986 Page Two With this, Mr. Erickson reiterated his previous statement that ADEC wouid not over-rule the waiver request denial by DHHS, and he and Mr. Lameraux excused themselves from the meeting. After Messrs. Erickson and Lameraux left the meeting, Ms. Oswalt and I explained to Mr. Lehnerz what we thought his alternatives were. These are as follows: Request a "conditional" Health Authority Approval (1L~A) with money escrowed to cover the cost of relocating the well. At the same time, initate a claim with Risk Management to recover the cost (or part thereof) of relocating the well. Relocate the well at his own expense and then obtain the H~ without any waiver request or conditional approval. 3. Initiate a petition to AWWU for the creation of a WID serving his area. Arrange for alternative financing for the sale of his property such as loan assumption or owner financing. We explained that the DHHS has no intention of issuing a citation or notice of violation for the non-conforming well.
