separation of a septic system to a private well has been approved.
The approved separation distance(s) are from the private well on
the referenced property to the septic tank on Lot 4 of 85 feet
and from the referenced well to the leachfield on Lot 4 of 90 feet.
This waiver approval applies to the existing septic system to
well separation only. Any future upgrade to either will
require all separation distances be met or another approval
from this department.

Request you issue a permit to upgrade the septic system serving the
referenced property, and grant waivers for the separation distances

Considerable investigation was performed on the septic system serving

the referenced property in 1989, which resulted in the issuance of a

permit to upgrade the septic system (see DHHS file). The permit
expired January 1, 1990.
We have performed a soils test in the area of the proposed septic

upgrade. Attached is a site plan design for the upgrade.
& FLOW TEST
During our investigation we found the well serving the referenced
property encroaches the septic system on the adjacent Lot 4. The
septic tank serving Lot 4 was installed in 1970 with the existing

leachfield trench installed in 1976. The well serving the referenced
property was installed in 1982.
For the following reasons we feel the separation distance waivers may
be granted.
ROAD DESIGN
1. Nitrate sample results from the well show no nitrates
detected. This indicates the well is still not influenced
after 10 years of operation with the existing encroachment.
SOIL TEST
2. It appears there is a confining soil layer above the drinking
water aquifer. This is evidenced by the well log showing that
a "water bearing sand" was not encountered until 53 ft.,

whereas, we measured the static water level in the well at 19

ft. below the top of the casing. This suggests an artesian
aquifer kept under pressure by a confining soil layer. A
confining soil layer separating aquifers is further confirmed
by a water level within our test hole at 8 ft. below the

3. From a well flow test recently performed, we found that after
continuously pumping the well for four hours at 7.5 gallons per
minute, the static water level drawdown was S ft. This indicates a
large water producing aquifer. (Well log estimates a production of 15
GPM). Therefor, normal use of this well would not create a large
hydraulic gradient so there would be little tendency for the septic
effluent to be "drawn" toward the well.

Subject: Notice of Violation
Lot ,5', Block D Timberlux No. 1
Dear Mr. & Mrs. Phillips:
On June 14, 1989 a written notice was left at your residence.
This notice informed you that the On-site Sewer Permit, which
was issued by this department on March,29, 1989, was suspended
due to the presence of groundwater within 4.5 feet of existing
grade. The notice also requested that you contact this
Department immediately.
Based on information provided by your Engineer, Mr. Leroy Reid,
it is our understanding that you intend to construct a curtain
drain to intercept and lower the groundwater level. Mr. Reid
was advised that the septic system should be pumped until a new
septic system could be installed or until the groundwater levels
could be monitored and verified as being lowered to a depth of
8.5 feet below existing grade.
On June 22, 1989 it was observed that both the test pit and the
area where the curtain drain was to be installed had been
filled, graded and seeded. An inspection of the monitoring tube
adjacent to your septic system indicated that groundwater was
present at approximately 4.5 feet below grade. Based on
available information, your existing wastewater disposal system
is discharging effluent to groundwater. This discharge is in
violation of State Wastewater Disposal Regulations and Anchorage

June 91 1989: Site visit no one home, observed water in
excavation to the north of septic system. Water depth was —1'

June 131 1989: Phoned Phillips no answer. Corwin has not been

June 141 19889: Site visit no one home, left card on door to

to take care of water problem. Ried said that he planed to
install a curtain drain upslope of the house. Told Ried to
ensure that the tank: is pumped until such time as a new system
is installed or the 'water levels drop to the rejuir'ed 4'
separation. Ried said he '.could tell this to the owners and let
us know 'what he found.
June 2, 1989: Site visit7 both the area east of the house and
the area of the test pit have been leveled and seeded. Water in
monitoring tube at —4.5' of existing grade, bottom of existing
absorption field at —4.5' Public Works has no record of a ROW
permit having been issued for the discharge of a curtain drain
for the subject lot.

Received notice in mail that certified letter at post office
7/12/89: Picked up notice AM -was Letter from John Smith, Muni. of Anch.
7/12/89: Phoned Mr. Smith regarding letter to explain the following:
1, We had not received any other messages to call him except
for a hand written note on the back of his card that our
permit was suspended. We immediately contacted our private
Engineer, Dr.:Lbe Reid and he said he would contact him. I
talked to Dr. Reid and he said it was not necessary for me
to contact the Muni, it was ok. He did tell me to keep
the tank pumped during construction of curtain drain. I
had pumped it just prior to construction 6/6/89 and since
the system was not flooded I did not realize I needed to
continually pump it.
2. Dr. Reid explained to our contractor that he needed to place
a monitoring tube 10 ft. below surface which he''thought'had
been done. I later had told Dr. Reid that there was no water
in the test hole, not realizing our contractor placed the
monitoring tube only 5.5 feet in the ground. I told Mr.
Smith I was making arrangements to have a contractor to dig
a 10' hole and insert a new pipe. He demanded that he be
advised. as to when this would happen so he could be there.
Mr. Reids office later advised me that this was extremely
unusual. I called Mr. Smith back and said my contractor
would be there 5:30 that night, he said he would be there.
He never showed up.
3. I advised Mr. Smith I was having someone come our. to pump
system again immediately. This was done on 7/14/89.
4. Mr. Smith demanded that the receipts for pumping and design
plans and as -built drawings of the curtain drain be supplied
to him no later than the 18th or 19th. I told him I would do
my best but that my Engineer would have to prepare the necessary
papers. (Also I asked him if he had the legal right to demand
this paper since it would defi.nately cost myself more expense.
He started quoting Code and asked if I had access. I said yes
I have a brother in law in the legislature and immediately he
changed his tone and said well let me do some further checking
and I will call you back and let you know the exact section. A
conversation later that day indicated he said he found it and
would supply me with a copy in the mail.
I am still questioning the fact if he infact has legal rights to
request or demand this information from me.
During our first conversation Mr. Smith told me firmlyj Mrs. Phillips,
You are in Violation of the Code and I can Cite you. I quickly answered,
Excuse me, but are you threatening mel He did not answer but only
repeated the same sentence.
My complaint: I am a law abiding citizen and had -or have no intention of
ignorin3 authorities or the laws, but I believe my rights of privacy have
been violated as a property owner. Cghis letter leads me to believe that
Mr. Smith or employees of the Muni have gone on to my property at their
leisure without my consent. Two: I, in good will, immediately called
Mr. Smith upon receipt of this letter as I never intended to not answer
a message; his letter makes it sound as if I am ignoring authorities.
Three: We had a test done on our ground water in 1986 and the municipality
approved it, there were no evident problems with our water level. If
a problem has developed it did not develope overnight and it was not caused
by negligence of myself or my husband. We have been working with an
engineer on our septic system since March, installed a curtain drain in
June, and were going forward. These things do take time and I will
cooperate with the law, but I believe'I have been treated unjustly and
unfairly and would like a response.

I am writing this letter in reply to your letter to us dated July 7,
1989 and to follow up on our conversation of July 12, 1989. You specifically
requested that I reply in writing. I also wanted to address the fact that,,
your letter was dated July 7, 1989, however not mailed certified to us
until July 10, 1989. This being the reason why we did receive the letter
until July 12, 1989.
Your letter makes it sound as if my husband and I have been trying to
avoid you by neglecting to respond to messages. The only message we ever
received from your office was a hand written note on the back of Dan Bolles'
business card which was left on our property on July 14, 1989. Our
contractor immediately contacted our hired engineer, Dr. Lee Reid. Dr.
Reid telephoned your office the same day to discuss the situation with you
or another office personnel. It was not relayed to Dr. Reid that you still
desired to talk directly to us or we would of called. Dr. Reid was calling
on our behalf. We did not receive any further notices from you. If you
needed us to contact you why didn't you tell Dr. Reid? We both work during
the day so who did you leave messages with?
As I stated over the telephone to you, Dr. Reid instructed our contractor
to install a 10' monitoring pipe which he thought had been done. I (through
innocent lack of knowledge in this area) measured and found no "water in the
pipe relaying this back to Dr. Reid. Of course not realizing that the pipe
was only 5.5 feet into the ground and suppose to be 10 feet. I explained to
you over the phone that I was making arrangements to install a 10' pipe and
you said you wanted to know when the contractor would be there so you could
be there. I faithfully called you back relaying a 5:30 appointment that
evening and you stated you would be there. You never showed up.
I requested you send me a copy of the Muni. Code 15.65.040 to verify you had
legal right to demand design plans and asbuilt drawings of my curtain drain.
I received this information on July 15th and thank you.- After reviewing the
section you highlighted, I still have a question -of whether of not you have
legal right to make this demand. My curtain drain is well over 30 feetabove
my septic system. Dr. Reid also does not understand how you can demand this

information at my expense. He told me last week he was going to write a letter
to you Monday or Tuesday and include a scetch of where the curtain drain is
located on our property.
I have enclosed a copy of two pumping receipts. One dated June 6th and the
other dated July 13th. We will be pumping our system again as needed. There
are only three people residing in our home and our tank is 1250 gallons.
I was unaware that the Municipality was going on and off my property without
contacting me first. I request that I or my husband be contacted if your
office needs to access our lot. I strongly object to my rights of privacy
being violated by your Department.
I would also like to know if there has been a complaint placed in your office
regarding our property and if so the nature of the complaint.
In closing, Mr. Smith, I would like to express the fact that we take great
pride in the fact that we are law abiding citizens. We would never try to
avoid government officials or do any harm to our comm6nity. The situation
we currently find ourselves in is not due to our negligence. We have been
working with Dr. Reid to take care of our problems. We have not been ignoring
the fact that there are problems. If there is a high water table in the
Rabbit Creek area it did not develope overnight. The Muni. approved our
water table in 1986. I hope that your department will deal reasonably with
us and not make unreasonable time demands on us. We are aware of other
property owners on the hillside who have high water tables causing problems
with their systems. How wide spread is this problem and are the same demands
being made with other individuals?_

I would prefer that you place any instructions or demands on us in writing.

The Municipality of Anchorage Development Services Department (DSD) Issues Certificates of On -Site Systems
Approval (COSA) based only upon the representations given in paragraph 4 by an independent professional civil
engineer registered in the State of Alaska. Certificates of On -Site Systems Approval are required for the transfer
of title (except between spouses) for properties served by a single-family on-site wastewater disposal and/or
water supply system. DSD also issues COSAs upon request to homeowners. Certificates of On -Site Systems
Approval are valid for 90 days from the date of Issue for properties served by a private or Class C well and may
be reissued with new water samples. (Certificates may be reissued for a period of up to one year with valid water
samples.) Certificates are valid for one year for properties served by Class A or B wells or a public water system.
The Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

new water sample results. (Certificates may be reissued for a period of up to one year with valid water samples.)
Certificates are valid for one year for properties served by Class A or 8 wells or a public water system. The
Municipality of Anchorage is not responsible for errors or omissions in the professional engineer's work.

conduct inspections or analyze data before a certificate is issued. The Municipality of Anchorage is not
responsible for errors or omissions in the professional engineer's work.
