RECIRCULATING UPFLOW FILTER (RUF) SYSTEM
To whom it may concern:
1. GENERAL: The proposed 4 bedroom home will be served by a private septic system and a
private wells. As can be seen from the site plan, the surrounding protective well radii and the
existing drainage pattern/easement limit the available area for a septic system. Also, the presence
of groundwater limits the excavation depth of a drainfield. Given these site constraints, we are
proposing to install the Recireulating Upflow Filter (RUF) system. Two test holes were
excavated and the soils are summarized as follows:
2. SOIL CONDITIONS: Two test holes were excavated on September 13, 1997 to a depth of
13.5 feet in TH#1 and to a depth of 9 feet in TH#2. Groundwater was encountered during the
excavation of TH #2 at a depth of 7 feet, and was monitored at the 5 feet 8 inches on 4/22/98. A
percolation test was performed between the depths of 3 and 4 feet and the absorption rate was
measured at a rate greater than 1 minutes/inch (see attached soil logs).
3. DRAINFIELD: The intent is to install a Recirculating Upflow Filter (RUF) system that will
allow the use of a small drainfield in the area around a 30 foot radius of TH #2. The size of the
drainfield will be based upon the previously established criteria for the RUF systems, which
dictates that soils percolating between 1 & 30 minutes/inch have an allowable application rate of 4
gnd/f[ and soils nereolating between 30 & 60 minutes/inch have an allowable application rate of
2 gpd/ft2. Given the perk rate of>l minutes/inch the 4 gpd/fr apphcat~on rate would apply. We
are proposing to install a 5 foot wide drainfield that is 40 feet long and has an effective depth of 6
inches. This corresponds to an absorption area of 200 ~2, or an application rate of 3.0 gpd/ft2
(assuming 600 gpd total flow).
· 4. ORENCO PACKAGE SYSTEM: The STEP tank with the trickling and upflow filter will
be manufactured by Anchorage Tank & Welding to meet the latest design criteria established by
Orenco Systems, Inc. The point of contact at Anchorage Tank is Lowell McNutt. Since you are
familiar with the operation of the system I won't elaborate. As with their standard STEP tank, it
is equipped with a high water alarm per M.O.A requirements.
5. SURFACE WATER: There are no surface waters within 100 feet of the proposed septic
system.
6. TOPOGRAPHY: Attached is a topography site plan. The average slope on this property is a
20-23% slope in a direction of approximately north to south. The proposed drainfield will be
placed approximately at the mid-point of the west property line which has an average slope of
20% slope. There are no slopes greater than 25% within 50 feet of the proposed trench.
7. CLOSING: I am open to any suggestions from your department that would be an
improvement to the proposed system. I am unaware of any negative impacts that this installation
would impose on adjacent wells, or septic systems. If you have any questions, please call me a

The on-site wastewater disposal system you are purchasing/installing is an "alternative" wastewater
disposal system. This system, known as a "Recirculating/Upflow Filter Septic System", is undergoing
teshng within the Municipality of Anchorage under the Alternative System section of the Wastewater
Disposal Regulations (AMC 15.65). There are certain risks involved with the ownership of one of these
systems:
1. The teclmology used in this system has been shown to be effective in other areas. The system is
currently undergoing a two year testing period in Anchorage under the guidance of the Department of
Health and Human Services (DHHS) and the State of Alaska Department of Environmental Conservation
(ADEC) to determine its effectiveness in a subarctic environment.
2. The system for this property received a vertical separation distance Waiver from both State of
Alaska and Anchorage Municipal Codes to ground water. This waiver was granted due to the system's
expected performance within the site conditions on this property.

Dear Mr. Roth:
Pursuant to our telephone discussion on Tuesday August 26, 1997, please find enclosed a stamped
copy of our work to date at this upper hillside lot. The test datum indicate that the near surface soils
are not suitable for waste water disposal. I would request that information be included in the file for
this property.
The properly owners (lot bought at a land auction) have refused to pay our bill for this work, stating
that the work was done incorrectly in that the percolation pipe was not slotted over the last 6 inches
in the perc zone and that my name and company had numerous complaints at the Better Business
Bureau and at the MOA for bad and incorrect work. Specifically the property owner, Mr. Gary
Franklin was on site during all the work, as well as my engineering Geologist Mr. Tom Culkin, and
the driller and helper from Denali Drilling, Inc. where a hack saw provided by Denali Drilling was used
to slot the pipe. The contention that the pipe was not slotted was made approximately 2 months
after the work was done and payment past due. I personally did the percolation testing on June 17,
1997 after the water monitoring period and adjusted the percolation pipes (4" PVC in a 6" drilled
hole) to allow presoaking of the soil test stratum. The colluvial weathered bedrock (slope wash) soils
at this site did not satisfactorily accept the presoaking water. I did a laboratory falling head
permeability test on the soil sampled from the borings at the site (soil samples still in our lab) and
the result was 10 to the minus 5 centimeters per second or the equivalent of concrete. Whether the
pipe was slotted or not, did not have any affect on the outcome of the testing (4" pipe in a 6" hole)
as the water easily flows around and out the end of the pipe. My contractors insist that the pipe was
slotted. The lot was littered with several sections of 4" pipe, which I presume were left from
previous testing at the lot. The property owners said that they pulled the 4" pipe and found it to be
not slotted (pipe placed to a depth of 7 feet below ground surface). This indicates that the pipe was
loose in the hole and did not impair flow to the soil. We suspect that the property owners changed
pipes in our holes. Note surface water contact springs at this site.

My professional reputation is at stake here, and I will not stand for this slander. There are no
complaints at the BBB or have there ever been in 25 years of practice in Anchorage. In addition, I
am not aware of any complaints at the MOA on my work. By the way, the amount owed is $800.00
and after all the negative comments made by Mrs. Franklin (instructed to be made by her husband),
she offered to pay half the bill.
I would appreciate your scrutiny on this property to ensure that it meets the MOA ordinances with
regard to on-site wast water disposal.

Please find attached copies of our soils logs and percolation test results for the referenced property.
I have also included a copy of my geologists report and field logs for your information documenting
the seven (7) exploratory holes drilled at the site and the work done to date on this project.
Unfortunately, subsurface soils are relatively impermeable and are not conducive for a below ground
septic water disposal system. This is not an uncommon occurrence for this area of the hillside in
Anchorage. We believe, however, that there are other surface mound systems which may be
applicable to this site. This can be discussed with the Municipality of Anchorage, Depadment of
Health and Human Services. Note that there is a surface contact spring between the two
documented soils holes on the site plan and the site is heavily treed with alder bush which tends to
mask subtle surficial features. As you stated, your plan is to reroute site drainage to the eastern
drainage easement.

During a recent COSA on-site inspection and test of the potable water
supply well on Block 5, Lot 3 of Spendlove View #3 subdivision, the well's
productivity was determined to be .73 gallons per minute. The minimum
well productivity required by this Department (AMC 15.55) for a 2-bedroom
residence is .21 gallons per minute. Although the subject well currently
exceeds this minimum requirement, all parties concerned are advised that the
production capacity of the well may fluctuate. Restriction of non-critical
water uses such as washing cars and watering lawns and gardens may be
required.
This advisory must be attached to all copies of the subject Certificate of On-
Site Systems Approval.
ADVANCED WASTEWATER TREATMENT SYSTEM
MAINTENANCE AND REPAIR AGREEMENT
BETWEEN MUNICIPALITY OF ANCHORAGE
AND
THIS MAINTENANCE AND REPAIR AGREEMENT made and entered into as of this

"MUNICIPALITY." In consideration of the mutual covenants contained herein,the
parties to this Maintenance and Repair Agreement agree as follows:
1. Advanced Wastewater Treatment Systems. Municipality grants permission to
Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as

2. Definitions.
Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces not
included in the original construction permit and design.
Certificate of On-Site Systems Approval (COSA). An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with Anchorage
Municipal Code (hereinafter, "AMC") 15.65. These approvals certify that
the systems are adequate for the homes that they support and meet the
codes that were in place at the time of system construction.
Damage. Any man-made or natural change in a system that would inhibit
the system from performing as designed.
Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
Permit. An On-Site Wastewater Disposal Permit as required by AMC
15.65 to construct and operate an AWWTS.
3. Term. The term of this Maintenance and Repair Agreement shall begin on the
date of approval by the Municipality to operate the installed system or issuance of a
COSA, and shall continue while the AWWTS is in use or is operational or until the
property is sold or title is transferred by the owner and a new COSA is issued to the
new owner or transferee of the property.
4. Alterations, Installation and Removal of Additional Equipment. Prior to
performing any alterations to an AWWTS, the owner agrees to obtain an On-site
Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65.
5. Maintenance and Repairs.
A. Throughout the term of this Maintenance and Repair Agreement,the Owner shall
maintain their AWWTS in a satisfactory condition capable of producing treated
septic effluent in accordance with the equipment's approval for operation in the
Municipality. The owner shall enter into a service agreement with an AWWTS
service and maintenance provider approved by the municipality and the
manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it
shall be the responsibility of the Owner during the term of this Maintenance and
Repair Agreement, and any renewals thereof, at the owner's sole expense,to pay
for any and all: (1) repair(s), (2)maintenance, (3)adjustment(s), (4)replacement
costs, and(5) inspection costs.
B. Owner agrees to comply with all applicable ordinance, laws,regulations, rules
and orders for the AWWTS.
C. Upon request by the Municipality,the owner agrees to provide the Municipality a
written schedule of routine maintenance and repairs which have been performed
on the system. When a record of maintenance is documented and maintained by
the system vendor, the owner agrees to allow the Municipality access to this
information.
D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS
may be assessed in accordance with AMC 14.60 for improper discharge.
E. Owner agrees that only maintenance and repair personnel approved by the
Municipality will inspect and make any necessary maintenance, repairs or
permitted alterations to the system.
F. Owner agrees to'grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
G. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On-Site Systems Approval.

H. Owner agrees that the AWWTS installation and maintenance requirements as
provided by the AWWTS vendor/installer and approved by the Municipality are
the governing guidelines for the construction, maintenance and repair of the
Owner's AWWTS.
6. Nonwaiver. The failure of either party at any time to enforce a provision of this
Maintenance and Repair Agreement shall in no way constitute a waiver of the
provisions, nor in any way affect the validity of the Maintenance and Repair
Agreement or any part hereof, or the right of such party thereafter to enforce each and

7. Amendment.
A. This Maintenance and Repair Agreement shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties,with
the same formality that this Maintenance and Repair Agreement was executed
with,and such writing shall be attached to this Maintenance and Repair
Agreement as an amendment.
B. For the purposes of any amendment modification or change to the terms and
conditions of this agreement,the only authorized representatives of the parties
are:

b. Municipality: Director, Community Development or designated authority
C. Any attempt to amend, modify, or change this contract by either an unauthorized
representative or unauthorized means shall be void.
8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance
and Repair Agreement shall be brought in the Superior Court for the Third Judicial
District of the State of Alaska at Anchorage. The laws of the State of Alaska shall
govern the rights and obligations of the parties under this Maintenance and Repair
Agreement.
9. Severability. Any provisions of this Maintenance and Repair Agreement decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining
provisions of the Maintenance and Repair Agreement.

Certificate of On-Site Systems Approval (COSA) # 101340
During a recent COSA on-site inspection and test of the potable water
supply well on Block 5, Lot 3 of Spendlove View Heights #3 subdivision,
the well's productivity was determined to be 0.70 gallons per minute. The
minimum well productivity required by this Department (AMC 15.55) for a
4-bedroom residence is 0.41 gallons per minute. Although the subject well
currently exceeds this minimum requirement, all parties concerned are
advised that the production capacity of the well may fluctuate. Restriction
of non-critical water uses such as washing cars and watering lawns and
gardens may be required.
This advisory must be attached to all copies of the subject Certificate of On-
Site Systems Approval.

Certificate of On-Site Systems Approval # 101340
A Certificate of On-Site Systems Approval inspection and test of potable
water was recently conducted on the well water supply on Block 5, Lot 3 of
Spendlove View Heights #3 Subdivision. This inspection revealed an arsenic
concentration of 12.0 micrograms per liter (ug/L) for the property's well
water sample. The Environmental Protection Agency (EPA) has established
a maximum contaminant level (MCL) of 10.0 ug/L for public drinking water
systems. While private wells are not subject to this regulation, EPA
standards are based on existing health information and can therefore be used
to gauge the relative quality of water from private wells. Information on
arsenic is available from the On-Site Water and Wastewater Program
website (www.muni.org/onsite) or at 343-7904.
This advisory must be attached to all copies of the subject Certificate of On-
Site Systems Approval.

MEMORANDUIVI OF UNDERSTANDING
BETWEEN MUNICIPALITY OF ANCHORAGE
THIS MEMORANDUM OF LrNDERSTANDING made ~md entered into as of this

herein the "OWNER," and the Municipality of Anchorage, herein the ~~L~---~ti2t
"MUNICIPALITY." In consideration of the mutual covenants contained herein, the
parties to this Memorandum of Understanding agree as follows:
1~ ADVANCED ~STE. WATER TREATMENT SYSTEMS. Municipality
grants permission to Owmer to utili~ and operate an Advanced Wastewater
Treatment System (AWWTS), described as ~ r~t.a:t ~.~,,~C.X located
....... Anchorage, Alaska.
2. Definitions.
A. Alteration, Any =change to the design or ffmction of an AWWTS that
Includes the installation or removal of an}, parts, components or pieces not
included in the original =construclion permit and design. Prior to
performing any alterations to an AWWTS the owner must obtain a
Wastcwater Dispo~[ System Construction Permit from the Mtmicipatity
pursuant to Anchorage Municipal Code (hereinafter, "AMC'") 15.65.
P,. Certificate ~f On-Site Systems Approval. An approval by the
MunicipaliV of existing water and wastewater disposal systems given at
the time of property sale and title trm~sfer in accordance witlh AMC 15.65~
These approvals certi~ that the systems arc adequate ~r the homes that
they support and meet the codes that were in place at the time of system
construction.
C. Damage. Any man-made or natural change ia a system that would inhibit
the system from performing .as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included in
the original design which would allow the AWWTS to continue to
perform as designed.
E. Permit (Construction) An On-Site Wastewater Disposal Syslcm
Construction Permit as defined by AMC 15.65.
F. Pemit (Operating) An Advanced Wastewa~r Treatment System
Operating Permit. An annual permit:, issued by the Municipality, that
allows the Owner to operate an AWWTS, upon meeting all the
requirements of this agreement, the conditions of Operating Permit, the
requirements of the On-SiteWasteww~er, System Construction Permil and
.ail relevant provisions of AMC 15.65

5. Alterati_on~, !~tallatlon and Removal of Additiona!Etmi~e0t. Owner agrees
not to make any alterations, rcnnoval of parts or additions to the AWWI$ wilhoul a
Construction Permit from the Municipality.
6. Maintenance and Relmirs,
A. Throughout the term o£this 'Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the
Ov~mer during the term of this Memorandum of Understanding, and an3,' extensions or
mne. wals thereof., at the o,~mer~s sole expense, to pay for any and all: (1) repair(s), (2)
maintenance. (3) a{iustmem(s), (4) replacement costs, and (5) inspection costs.
Further, Ox;met agrees to comply will all applicable ordinance, iaws, rcgulations~
rules and orders For the AWWTS.
B. Owner agrees to provide the Municipality a ~xitten schedule of murine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWWTS Operating Permit. This
schedule shall be submitted to the Municipality annually upon the renewal of thc
permit. The schedule of maintenance and repair contained in the O'wncr's AWWTS
C. Owner acknowledges that the linc schedule for' failing to maintain aM repair an
AWWTS are codified in AMC
D. Owner agrees chat only maint.cnance, repair personnel certified by tt~e
Municipalily will inspect and make any necessary maintenance, repairs or pem~itted
alterations to the system.
E. Owner agrees to grant the Municipality' reasonable access to test and inspect the
AW WTS upon 24 hours written notice,.
F. Owner agrec~ that any sake er transfer of title o£the property wil! not occur
without a new Certificate of On-Site Systems Approval.
G. Owner agrees ~,hat the relevant provisions of the stand~d specification guidebook
for AWWTS is the governing .professional guidelines [or the construction,
maintenance and repair of the Owner's AWWTS,
7. l~'onwai,'er. The failure of either party at any time to entbrce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way efl~¢ct the validity of the Memorandum ~f Understanding or any part
hereo[ or the right of such party thereafter to enfbme each and every provision
hereof.
8. Amendment;
A. This Memorandum of Understanding shall only be amended, modified or changed
by a ;~viting, executed by authorized representatives of the parties, w'ith the same
tb~maliry of this Memorandum of Understanding was executed and such writing shall
be attached to this Memorandum of Understanding as an amendment,

9. ,lufisdiction: Choice of Law, Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern Ihe rights and
obligations of thc parties under this Memorandum of Understanding,
10. Severability,, Any provisions of'this Memorandum of Understanding decreed
invalid by a court of competent jurisdiction shall not invalidate the remaining provisions

The following is a brief report concerning the drilling work on the above-referenced project.
Field Activities
The boreholes were drilled with a CME 45 supplied by Denali Drilling using 6" hollow stem
augers. The drill arrived at the site offupper DeArmoun Road at 11:00 AM on June 6. The first
borehole was completed at a depth of 10.5 feet and piezometer PVC was installed. The next two
boreholes resulted in auger refusal at a depth of 3 feet. TH 4 was completed at 4 feet and 4" PVC
for percolation testing was installed.
Three boreholes were drilled on June 9. The first encountered shallow water. The second was
completed at 15 feet with piezometer PVC installed to 14.6 feet. The percolation test hole was
drilled to 7.25 feet and PVC installed to 7 feet.
Site Conditions
The boreholes in the western portion of the site (TH 1 through 4) showed approximately one foot
of Slit (ML) above a Sandy Gravel (GP-GM) with numerous Cobbles. The gravel interval is quite
dense and the number of cobbies made for rough drilling. Water was encountered at 9.5 feet and
bedrock at 10 feet. The interval from 6 feet to 6.5 feet was fine-grained and very dense,
presenting a possible impermeable layer.
Boreholes TH 6 and TH 7 again showed about one foot of Silt (ML) over Sandy Gravel (GP-
GM). While the number of cobbles was slightly less than in the earlier boreholes, the material was
still very dense and the drilling slow. A possible impermeable layer was present from 5 feet to 6.5
feet. Bedrock and water were not encountered.
