Received By: Issued By: Date: S - Date: 8— 10 _0 July 31, 2000 Municipality of Anchorage Department of Health and Human Services 825 "L" Street Anchorage, AK 99502-0650 Subject: Lot 5, Block 1, Woodbourne Subdivision Septic System Design and Permit Application Impacts to Adjacent Properties Dear Onsite Services Engineer: The existing absorption bed on Lot 5, Block 1, Woodbourne Subdivision has flailed and must be replaced as the owner is planning to sell the property and must obtain 'a Certificate of Health Authority Approval. We are thereforeapplying for a permit to construct a new bottomless sand filter absorption system on the lot to serve the five bedroom home. The attached Site Plan and backup documentatior identify the location and configuration of the new absorption system and the parameters used in the design. It also shows the location of the existing well on the lot and its proximity to the septic system on this lot The existing septic tank will be pumped;' crushed and removed from the site. A new 2,000 gallon STEP. tank will be placed in the location of the existing tank: Several test holes were placed on the lot when the original bed was placed in 1983. The original system was.designed for a percolation rate between 15 and 30 minutes per inch. Apparently groundwater was a consideration as a French drain was placed along the perimeter of the lotto protect the absorption bed. _Unfortunately, placement of the drain has now restricted the area available for an Upgrade site. The well and Little Campbell Creek further limit the area available for a new absorption system: We have therefore designed a bottomless sand filter to be placed in the same location as a portion of the existing bed. All remnants of the bed will be removed to 5' outside the perimeter of the new bed. Clean, porous gravelly sand will then be imported to replace the contaminated material removed from the existing bed. The bottomless sand filter will be constructed atop the porous gravelly sand. The new bed will be constructed a minimum of 100'. from the well and 1 00'from Little Campbell Creek =n conformance with the Municipal ordinance. The file on this, property concerning the septic system is large and deals primarily with groundwater problems and proximity to Little Campbell Creek. In 1990 a test hole was placed which verified the groundwater table is a minimum of 4' below the existing bed. We are relying. on this information as still accurate today. The bed is currently flooded making it impossible to determine the groundwater location under the bed in the area for the new upgrade. An attempt will be made at the time of construction to verify the location of the groundwater in the area of the new filter to assure the minimum 4' Lot 5, Block 1, Woodbourne _ July31, 2000 Page Two a e separation-. Care will also be taken to assure the 100' separation distance from Little Campbell Creek is maintained. The9 round surface on the lot slopes from north to south at approximately 2%. Grading will be accomplished to assure surface drainage is away from the new bed. If the system is constructed in accordance with our design the following statements apply. 1. The system, if constructed as designed, will have no adverse impact on the wells in the area or those to be constructed in the future. 2. The system, if constructed as designed, will have no adverseimpact on existing septic systems in the area or those to be constructed in"the future. 3 The system, if constructed as designed; will have no adverse impact on reserve ; space, either surface or subsurface, on any lots located in the area. 4. Dear John: This is in regard to the drawing by Hart Crowser in 1986 that shows the bed on this lot too close to the stream. Our field measurements in 1983 show this stream to be at least 100 feet from the bed. A subsequent upgrade of the system was farther from the stream. Today I visited the stream and found that the stream had been directed toward the system when a dead spruce tree fell across the stream and pushed some willow limbs into the stream channel. Today the stream edge was 96.5 feet to the edge of the bed, The stream was 1-2 feet closer to the bed than in 1986. There was evidence that during high lows the stream was starting to cut a new channel directly to the west. This would farther encroach on the system. Mr. Garnand and I removed that part of the tree and wood debris -rarrW€s�-ssribdverrae+-2�r�ehax Kaska"5er0-(907-271)-rfr3 over the willow limbs that was causing the diversion. The stream returned to its original flow channel. The distance from the bed standpipe to the stream edge is 102.5 feet, corrected for an 8.50 slope. This standpipe is about 1 foot from the edge of the bed. It was moved closer to the bed edge when some of the original pipes were replaced during the 1986 upgrade. Distances were measured with both a tape and a calibrated DME. I have told Mr. Garnand to keep that part of the stream free of debris which could redirect the stream to a point closer than 100 feet from the system. Please call me if you have any questions. Woodbourne ) Subdivision ) DECISION The above -entitled matter comes before the Department of Health and Human Services as a result of an appeal filed by Sandi Garnand. Mrs. Garnand appeals the decision of the Municipality of Anchorage, Program Manager for On-site Services, to suspend a per- mit issued to Randall Garnand pursuant to AMC 15.65.120 (Supp. #3O 3/31/85). A hearing was held on Tuesday, September 2, 1986, at 825 "L" Street, Anchorage, Alaska, at which time both the Appellant and the Program Manager for On-site Services, through a duly authorized representative, were given full opportunity to present testimony, documentary evidence and argument. Having con- sidered all the evidence, the Hearing Officer makes the following Findings of Fact and Conclusions of Law: FINDINGS OF FACT 1. Randall Garnand was issued an On-site Services Permit on October 8, 1985 for the installation of a curtain drain on Lot 5 Block 1 Woodbourne Subdivision, aka, 11.700 Woodbourne Drive, Anchorage, Alaska 99516. 2. The permit was revoked by the Municipality of Anchorage because the curtain drain setback requirements in existence at the time of its issuance were increased from twenty to thirty feet. as a result of the Anchorage Municipal Assembly amending AMC 15.65.040 on May 20, 1986. 3. A request was made by Mrs. Garnand for a hearing to appeal the decision of the Program Manager for On-site Services to deny her waiver request as provided in AMC 3.60.035. 4. The hearing date was set for September 2, 1986 at 2 p.m. in a letter dated August 25, 1986 from the Department of Health and Human Services, and received by Sandi Garnand on August 25, 1986. (MOA Exh. #1) 5. Stephen S. Morris, Civil Engineer for On-site Services, pre- sented the case on behalf of the Program Manager for On-site Services. 6. Sandi Garnand stated at the hearing that she would present the case on her own behalf. Sandi. Garnand resides in the residence which is located on the real property in question. 7. Stephen Morris introduced a packet of information into evi- dence at the onset of the hearing. (See MOA Exh. #1) 8. Robert Robinson, Program Manager for On-site Services for the Department of Health and Human Services, testi:Eied on the nature of curtain drains and their function. He cited a cur- tain drain system located in the Northwoods Subdivision in Peters Creek as an example of a circumstance depicting the pollution that can result from a curtain drain setback that is too close to an absorption field. The tests run in Northwoods were conducted from November 25, 1985 through August 15, 1986. Mr. Robinson stated that, in his pro- fessional opinion, a twenty foot setback is riot sufficient to prevent ground or surface water contamination particularly if the curtain drain is uphill from an on-site system. Mr. Robinson stated that the Woodbourne Subdivision is a con- siderable distance from the Northwood Subdivision. The one study conducted by the Municipality of Anchorage at Northwoods was used as an exemplar of the potential pollution problems that inadequate setbacks could cause. He: stated that only one concentrated study on the issue has been con- ducted thus far. Mr. Robinson also stated that the soils in the two subdivisions are "comparable" but not similar in any other way. 9. Stephen Morris stated that notices were mailed out by the Municipality of Anchorage stating that the permit in question was subject to amendment after May 20, 1986. There was no evidence introduced to establish that Mrs. Garnand had received such notice. It was .stated, however, that the engi- neering firm that contracted with the Garnands to enlarge their on-site system received a copy of the notice. He stated that the notice to the engineering firm explained that the ordinance had been amended and required compliance immediately. Mr. Morris stated that he could only assume that Alaska Environmental Control Services was going to inspect and supervise the changes in the Garnand system. 10. Mr. Morris stated that an on-site system is installed accord- ing to the number of bedrooms in a house. IIe stated that the Garnands intended to install a six -bedroom system for a five bedroom house, "an overbuilt system." He stated that the Municipality had no objection to installing a six bedroom system for a five bedroom house so long as it did not encroach upon the thirty foot setback limitation. 11. Alan Wein stated that his current mailing address is P.O. Box 870318, Wasilla, Alaska 99687. He is an engineer with Alaska Environmental Control Services. AECS was contracted by the -2- Garnands to design an on-site system that would comply with local law and alleviate the drainage problems that occurred at their. residence. It was his opinion that a twenty foot setback in this case was sufficient to provide adequate filtering and prevent- surface water contamination. Mr. Wein stated that, in his professional opinion, the installation of a curtain drain was the only recourse available to solve the Garnand's problem. He stated that AECS was contracted to perform the engineering work, soil testing, and inspections of the old and new on-site systems by the Garnands. Mr. Wein stated that AECS was hired on two separate occasions by the Garnands. The first time was in 1983 when the residence was being built. The second time was in the December of 1984. The business relationship has been in existence off and on since that time. There were no written contracts in effect at any time. 12. Mr. Wein stated that he felt the change in setback distances in the ordinance was based upon administrative needs not on conclusive research. 13. Roger Rupp stated that his current mailing address is 5601 DeArmoun Road, Anchorage, Alaska 99516. Mr. Rupp is owner of DeArmoun Excavating, the firm contracted by the Garnands to install the curtain drain system. Mr. Rupp stated that several delays due to equipment breakdowns, weather con- ditions, and non-availability of supplies prevented his firm from completing the curtain drain installation in the fall of 1985. 14. Mr. Rupp stated that he did not rush to complete the installation of the curtain drain in spring of 1986 because he knew that the Garnand permit was valid until October, 1986. 15. A copy of the Woodbourne Subdivision plat was introduced into evidence by Mrs. Garnand at the request- of the hearing officer. (App. Exh. #1) 16. Mr. Morris stated that the original twenty foot setback requirement adhered to by the Municipality was "never in code, in state code, municipal code. It was purely an infor- mal guideline that we adhered to when we issued permits for absorption fields and curtain drains." The twenty foot set- back was presumed to be adequate based on the "best judgment" at the time. He stated that a technical review committee for the Municipality adopted the thirty foot setback requirement. The committee began its work in February of 1986. He also stated that there is not a lot of data for or against a thirty foot setback. The primary background data for the thirty foot setback evolved from Northwoods research. Additionally, it was a setback requirement recommended by the State of Alaska, Department. of Environmental Conservation. He stated that the state "put pressure" on the Municipality -•3- to change the setback requirements. He stated that the State's thirty foot setback requirement is not in code either. It too is an informal guideline for reviewing a per- mit-. 17. Mr. Morris stated that he could not locate any sources or amounts of contamination in Little Campbell Creek or any ground water source adjacent to the Appellant's property. Fie also stated that he is not aware of any environmental hazards in existence or soon to occur as a result of the Garnand system. 18. Mr. Wein stated that the oversized system was thought to be necessary :in this case "to extend the life of the entire system, whether it be poor soil conditions... or the fact that what home owners put down their systems could cause premature failures..." CONCLUSIONS OF LAW 1. Anchorage Municipal Code 15.05.080, Supp. #30 3/31/85, states that: Permit or license suspension or revocation. In addition to any other provisions of this title or code concerning the grounds for suspending, revoking or otherwise restricting a permit or license required by this title, the director may as provided in Section 15.05.090 revoke, suspend or otherwise restrict a permit or license required by this title upon any of the following grounds: A. Any false statement set forth in the application; B. Any violation of the express terms or provisions of the permit of license; C. The commission of any act not authorized by the per- mit or license or prohibited by that chapter of this title governing the issuance of the permit or license; D. Permitting unauthorized persons to commit any act not authorized by the permit or license or prohibited by that chapter of this title governing the issuance of the permit or license; E. Repeated acts prohibited by law or by the permit or license for which no prior action was taken by the department. (Adapted from CAC 10.56.080). 2. AMC 15.05.080, as amended May 20, 1986, states that: Permit, certificate or license suspension or revocation. In addition to any other provisions of this title or code concerning the grounds for suspending, revoking or otherwise restricting a permit, certificate or license issued under this title, the director may as provided in Section 15.05.090 revoke, suspend or otherwise restrict a permit, certificate or license issued under this title upon any of the following grounds: A. Any false statement set forth in the application; B. Any violation of the express terms or provisions of the permit, certificate or license,- C. icense;C. The commission of any act not authorized by the per- mit, certificate or license or prohibited by that chapter of this title governing issuance of the per- mit, certificate or license; D. Permitting unauthorized persons to commit any act not authorized by the permit, certificate, or license or prohibited by that chapter of this title governing the issuance of the permit, certificate or license; E. Repeated acts prohibited by law or by permit, or cer- tificate or license for which no prior action was taken by the department-. 3. AMC 15.65.010 in pertinent part, as amended, May 20, 1986, states that: A. "Absorption area" means that area in a subsurface disposal field used to absorb the effluent which it receives from the septic tank. B. "Absorption bed" means a shallow rectangular excava- tion containing gravel, perforated pipes and stand- pipes that receives septic tanks effluent and allows it to seep into the surrounding porous soil. C. "Curtain drain" means any subsurface drainage struc- ture which intercepts or diverts underground water flows. D. "on-site wastewater disposal system" means sewer pipes from a structure to and including septic tanks, holding tanks, subsurface disposal fields, treatment plants, lift stations, innovative systems described in section .110 of this chapter, and other attendant equipment. 4. AMC 15.65.035 (A), as amended May 20, 1986, states: -5- 5 6 7 Non -conforming systems. Except as provided in this section, any on-site wastewater disposal system installed pursuant to a construction permit before the effective date of this ordinance must operate in compliance with the installa- tion and design standards for that system which were in effect when the permit for the installation of the system was issued. Cesspools may not be operated under any cir- cumstances. AMC 15.65.040 (1), (3), as amended May 20, 1986, states that: Except as specifically stated otherwise in this chapter, no portion of an onsite wastewater disposal system, excluding connecting pipes, may be located less than: one hundred (100) feet uphill. or thirty (30) feet downhill from a curtain drain system. AMC 15.65.120, Supp. IP30 3/31/85, stated that: Wastewater disposal design permits. A. No persons shall construct or install any septic tank, seepage pit or system, drain field or package waste treatment plant without first obtaining a per- mit from the department. B. Permits required by subsection A will be issued for one installation only and may be requested by and issued to the property owner or permitted excavator. C. Permits required by subsection A expire one year after the date of issuance. D. The department by regulation pursuant to Chapter 3.60 of this code may charge fees for inspections and other appropriate services rendered by the department relative to wastewater disposal systems required by this chapter. (Adapted from GAAB 16.45.060 and new). AMC 15.65.120 (A), as amended May 20, 1986, states that: On-site wastewater disposal permits. A person may not install, nor modify an on-site wastewater disposal system, earth privy or vault privy without first obtaining a permit from the department. A separate permit is required for each installation, modi- fication of an on-site wastewater disposal system, or vault privy. -6- 8. AMC 15.65.150 (B), as amended May 20, 1986, states that: The department may issue waivers of the separation distances between on-site wastewater disposal systems and those areas described in this chapter, if the issuance of such waivers will not adversely affect achievement of the objectives of this ordinance and will not be in conflict with state law. A written application for a waiver from the separation distances contained in this chapter must be submitted by an engineer and must contain, but need not be limited to: A. a description of the separation distances from which the waiver is requested and the reasons why the separations cannot be maintained; B. information on soil., topography, lot size, antici- pated wastewater flow and other technical information relevant to the request; C. any measures which are proposed to mitigate adverse effects associated with the waiver; and D. a statement by the engineer identifying all positive and negative impacts associated with granting the waiver request. E. The department must, unless the applicant submits notarized letters of non -objection from the owners of affected adjacent property, notify adjacent property owners when the application for a waiver is requested, if the granting of the waiver would compromise any separation distance as required by this chapter other than on the lot for which the waiver is requested. 9. Sandi Garnand filed a timely request for a hearing pursuant to AMC 15.65.090 (E), as amended May 20, 1986. 10. A timely hearing was held in this matter within the thirty (30) day period allowed under AMC 3.60.040 (C). DECISION Sandi and Randall Garnand requested an appeal of the decision to deny them a waiver with respect to the installation of a non- conforming on-site wastewater system at their residence in the Woodbourne Subdivision. A permit was issued to the Garnand's in October of 1985 that permitted them to install a system which was in conformity at that time. The Garnands did in fact begin the installation of the system but were forced to cease work before the project could be completed due to forces beyond their control. --7- Up until the point where they decided to install a non -conforming system, the Garnands had expended approximately $4,000 on system upgrades. When it became evident that a six room system for a five bedroom house would probably solve their problems, the Garnands expended another $850 to acquire the necessary gravel. The Municipality of Anchorage amended the applicable ordi- nance in two significant ways: (1) the one year permit life clause was eliminated, and (2) the minimum setback requirement was changed from 20 to 30 feet. There is nothing in evidence to indi- cate that the Garnands received notice of the changes in the Municipal ordinance, either prior to or immediately after it was enacted. Although the Municipality could deny the waiver on a strict constructionist reading of the ordinance, it has failed to reasonably address the reliance factors which have caused the Garnands to expend a great deal of money. The Garnands have acted in complete conformity with require- ments of the old ordinance. They have spent money in reliance upon it and have not abrogated their responsibility with respect to maintaining, or attempting to maintain, a proper functioning wastewater system. Additionally, the germs and conditions of the permit which reads like a contract, and signed by Randall Garnand and Stephen Morris, demonstrate their willingness to comply with Municipal ordinances in effect at that time. I think it is safe to say that they agreed to abide provisions for which they were reasonably expected to be aware of. There is a provision in the amended ordinance which allows for the operation of a non -conforming system if it were installed prior to the ordinance change. It is the opinion of this hearing officer that it would be fundamentally unfair to invalidate a per- mit that was authorized prior to the: ordinance amendments when, as :in this particular circumstance, the property owner has expended a great deal of money in reliance to complete construction. After approval, the curtain drain was installed in October of 1985. The homeowner is now ready to do the upgrade of the sewer system. The proposed upgrade of the system was to be added to the east side of the existing bed. The addition would be 12 feet wide by 50 feet long making the entire bed 35 feet by 50 feet for a total effective absorption area of 1750 square feet. This size would be adequate for a 6 bedroom home. The existing house as a 5 bedroom home, but the owner wishes the system to be of 6 bedroom size for a safety factor and for fixture expansion. riy..f There is no other place on the lot that the upgrade could be located. The area directly to the north would be less than 100 feet from the creek and also quite close to that end of the curtain drain. To the south would also be very close to the curtain drain, and previous soil tests done in that area showed wet SM from 2.5 feet to 5.5 feet and ML below that. To the west is the house, the creek again, and a bank too steep for a bed. During the excavation for the curtain drain portion directly to the east of the existing bed, soil conditions were almost identical to that found in the absorption area, GM. Therefore, we feel that the best and only place for the upgrade is the eastern side of the existing bed. The original design called for the curtain drain to be 20 feet from the upgrade portion of the bed. The curtain was installed slightly further to the east than the proposed diagram shows. With the upgrade of the bed, the distance between the curtain drain and absorption area would be approximately 25 feet. The exact location of the edge of the existing bed is difficult to determine and can only be estimated to within a couple of feet. During the installation of the upgrade, more exact measurements could be made from it to the existing curtain drain. The absorption area is downhill from the curtain drain. Per the new ordinance, Section 15.65.060, B., 3., a disposed field cannot be less than 30 feet downhill from a curtain drain. Due to the conditions outlined above for this lot, we request that you grant a waiver for the required separation distance between the curtain drain and the upgraded absorption area to 20 feet, as originally designed. If the Municipality did grant this waiver., then we would later find ourselves in the difficult situation of being asked to issue a tank upgrade permit to allow for a six (6) bedroom approval. It appears possible for a one (1) bedroom upgrade to be accomplished. A waiver would not be needed for a 6'x 50' one bedroom addition to the existing bed. I believe this is the reasonable and fair resolution to the problem. I regret that a combination of .limited finances and ordinance changes have exacerbated the problem. Last week they had exposed the system in the presence of Larry Montgomery, Environmental Health Supervisor for AECS. At that time they had determined that the septic tank was 7 inches lower then the field. The crew from Southwest was going to remove the tank and see if we could determine why it: was low. Either it had settled or it was originally put in at a lower level than the drainfield. It must be noted that the crew that is doing the renovation of the project, is not the same crew that installed the system. We exposed the tank, looked at the line coming out of the house and then crawled under the house and determined that we could pick up approximately seven inches by raising the plumbing in the house. This would not need any additional repairs as there was sufficient fall. However, the hole through the wall for the pipe would have to be broken out and the pipe raised. We exposed the line to the house and shot it: with a instrument. We could get the seven inches by cutting the line outside the house and then using a relatively flat grade over the approximately seven feet between the house and the system. This would give us sufficient fall and the tank would higher than the field. Upon removal of the tank we found a grey silty gravel. Water rapidly came into the hole. This is shown in Photograph 1. Photo 2 shows where the contractor had dug a hole to allow the water to drain out of the trench. The contractor then took some silty sandy gravel out of the bank and placed into the now drained depression to raise it to the proper elevation. He then used a compactor to compact the soils. However, upon starting the compaction the soils underneath liquified. The contractor removed the soil. down to stable material which is the grey shown in Photograph 3. Photograph 4 shows the fully compacted bed ready for placement of the tank. Photos 5 and 6 show the system as finally completed. Because of the Municipal Code at the time, the system as installed did not call for a cleanout after the septic tank. We felt it would better at this time to install one so that in the future the system could be tested or a roto rooter could be put through it in case of stoppage. R10-;, ?1503-;907! 5615040 Some mitigating circumstances to consider is that there has been some road work done since the system has been installed and better drainage could be built. A puddle of water that was noticed uphill of the field. This water would tend to percolate down into the field, and this may be part of the reason that some of the field has water in it. The standpipe in the field was discovered to be dry by Montgomery. A test hole was dug beyond the end of the field. No water was encountered. The owner of the property is interested in enlarging the field to a 5 bedroom since his tank is large enough and he does have a 5 bedroom house. I explained that this could be done relatively easy by expanding the field and the southeast part by approximately 13 feet. A permit would be needed. The concern for the water running into the field from above could be solved by a curtain drain if this is indeed a problem. However, I recommended that his final grading be done. The system should be watched for several months this summer to see if surface water is percolating into the field. There are two possible reasons the system failed. These are as follows: 1. The system was initially set approximately 7 inches lower than the field. 2. The septic tank settled into the soils. This could have been caused by the plasticity of the soils when they got wet or the hole might have been overdug and then backfilled and not compacted. Once the tank was filled with water the approximately 12,000 pounded additional. weight could have caused it to settle. Although it is difficult to determine exactly why the tank was low I believe that the evidence indicates that the tank was originally placed too low. The reason that this can be stated is that the line from the house to the septic tank was on a relatively steep grade, nearly perfectly aligned, and the pipe was laying on the bottom of the septic tank lip. If the tank had is settled one would had expected that the cast iron pipe to be near the top of the inlet to the septic tank and the pipe joints would be at an angle. This could have happened since the field and tank were put in at slightly different times. The level may have been bumped and not rechecked or the bench mark disturbed. When the tank level was checked, then every thing may have appeared to be correct. The crew that Dick Strahl sent out was supervised by Butch. I was very impressed with the professional competency of his crew. In my experience and watching excavators in the Anchorage area since 1974, this crew would rank right along with some of the best. I noticed in watching them that they were very meticulous. They cross checked their work and they knew what they were doing. Their operation was well planned and there was no waste of time by this crew. The system is now raised and there is adequate fall between the house and the septic tank, and between the septic tank and the field. The system should be put back into operation. I would not expect any further problems with the system. If there is, it will probably be from extraneous water from uphill. If this occurs then a curtain drain should be put around the system to protect it from future incursions of water. The drainfield is in excellent material. The photographs show a puddle of water on the left side where water was coming out of the field. It was percolating into the soils as fast as it was coming out. I recommended that the driveway should be shifted slightly to the east to get it completely off the field to eliminate any future possibilities of freezing. The driveway does not cross the septic tank so the settlement of the tank from vehicular traffic would be discounted. If you have any questions please let me know. Street Anchorage, Alaska 99501 Attn: Robbie Robinson Dear Robbie: January 4, 1984 Environmental Protection on January 3, 1984 our company inspected the sewer system and well located on Lot 5, Block 1, Woodbourne Subdivision and collected a water sample. The water sample was satisifactory and a copy is attached. All the standpipes were capped and protrude above ground level. The finished grade looks good and surface drainage is away from the septic system. The well is located 102' from the system and has a sanitary seal. The wires from the house to the well was not buried and is not feasible to bury it at this time. We recommend a conditional approval be issued until spring when the ground is able to be broken. Permit. An On -Site Wastewater Disposal Permit as required by AMC 15.65 to construct and operate an AWWTS. 3. Term. The term of this Maintenance and Repair Agreement shall begin on the date of approval by the Municipality to operate the installed system or issuance of a COSA, and shall continue while the AWWTS is in use or is operational or until the property is sold or title is transferred by the owner and a new COSA is issued to the new owner or transferee of the property. 4. Alterations, Installation and Removal of Additional Equipment. Prior to performing any alterations to an AWWTS, the owner agrees to obtain an On-site Wastewater Disposal Permit from the Municipality in accordance with AMC 15.65. 5. Maintenance and Repairs. A. Throughout the term of this Maintenance and Repair Agreement, the Owner shall maintain their AWWTS in a satisfactory condition capable of producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. The owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the municipality and the manufacturer of the AWWTS for the entire term of the AWWTS. In addition, it shall be the responsibility of the Owner during the term of this Maintenance and Repair Agreement, and any renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. B. Owner agrees to comply with all applicable ordinance, laws, regulations, rules and orders for the AWWTS. C. Upon request by the Municipality, the owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system. When a record of maintenance is documented and maintained by the system vendor, the owner agrees to allow the Municipality access to this information. D. Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60 for improper discharge. E. Owner agrees that only maintenance and repair personnel approved by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. F. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. G. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. H. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. I. Owner agrees to provide and maintain a telephone connection to the AWWTS as required by the AWWTS approval. 6. Nonwaiver. The failure of either party at any time to enforce a provision of this Maintenance and Repair Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Maintenance and Repair Agreement or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 7. Amendment. A. This Maintenance and Repair Agreement shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality that this Maintenance and Repair Agreement was executed with, and such writing shall be attached to this Maintenance and Repair Agreement as an amendment. B. For the purposes of any amendment modification or change to the terms and conditions of this agreement, the only authorized representatives of the parties are: a. Owner: b. Any attempt to amend, modify, or change this contract by either an unauthorized representative or unauthorized means shall be void. 8. Jurisdiction: Choice of Law. Any civil action arising from this Maintenance and Repair Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Maintenance and Repair Agreement. 9. Severability. Any provisions of this Maintenance and Repair Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Maintenance and Repair Agreement.
