Subject: Lot Line Waiver Request for Lot 46; Block 4; Sand Lake Subdivision//2
To whom it may concern:
When the septic system for this lot was installed in 12/83, it was documented that the trench was
5 feet from the east lot line, which would have put it 5 feet into the utility easement. However,
after the homeowner located all the septic pipes for purposes of obtaining a Health Authority
Approval, it was deternfined the leachfield is located in the utility easement as well as in the road
right of way, approximately 8 feet (see attached asbuilt survey). Attached are letters of
non-objection from ATU, Chugach Electric, GCI, and Enstar. We are also in the process of
obtaining a Right-of-way Encroachment Permit fi'om MOA, Department of Public Works. We
are requesting that you waive the required separation distance between the trench and the lot line

ATU Telecommunications has no objection to the encroachment of the
septic system into a platted easement located on Lot 46, Block 4,
Sand Lake Subdivision # 2, as depicted on the as-built drawing
submitted.
Acceptance and use of this letter of non-objection by yourself, your
heirs, your assigns, or your successors, will constitute agreement to
the following stipulations:
ATU will be held harmless, now and forever, for any
damages or injury to any person or property as a result of
this encroachment.
Any ATU facility damaged or destroyed as a result of this
encroachment will be repaired at no cost to ATU.
3. Any costs incurred by ATU for special construction
necessitated by this encroachment will be borne by the
property owner.
4. Ail applicable safety code regulations will be observed
and maintained.
5. This letter of non--objection will in no way preclude ATU
from full use and enjoyment of its rights within any
portion of its right-of-way.

Dear Mr. & Mrs. Mathers:
The Anchorage Water & Wastewater Utility received a written request on August 17, 1999,
from Jeffrey Garness on your behalf for a letter of non-objection for the existing septic
system that encroaches across the utility easement located on the east 10' of the referenced
lot and into the Seacliff Street right-of-way. A recertification as-built drawing dated March
22, 1984, submitted with the request, has the location of the septic system sketched on it.
AWW..U water and sanitary sewer mainlines are not available to the referenced lot. AWWU
is not'using the referenced easement or right-of-way and issues this letter of non-objection
to ,the existing septic system with stipulations, and by using it the property owner is
agreeing to the following:
1. AWWU will be held harmless, now and forever, for any damages or injury to any
person as a result of the encroachments;
2. All applicable codes and regulations wilt be observed and maintained within the
right-of-way and easement;
3. This letter of non-objection will in no way preclude AWWU from full use and
enjoyment of its rights within any portion of the right-of-way and easement; and,
4. The property owner shall pay any additional and extraordinary costs incurred to
accommodate tt~e encroachments during any future AWWU facility installation and
its subsequent repair or reconstruction. .

This permit is between Chugach Electric Association, Inc., an Alaska non-profit
electric cooperative, (herein "Chugach"), whose address is P. O. Box 196300, Anchorage,
Alaska 99519-6300 and Earnest and Monica Mathers, (herein "Permittee"), whose address

Meridian, Alaska,
(herein "Easement") which pertains to the following described real property:
The East Ten Feet (E 10') of Lot 46, Block 4, Sand Lake Subdivision No. 2,
according to Plat Number P-176 recorded on the 26th day of April 1950, on file in
the office of the District Recorder, Anchorage Recording District, Seward Meridian,
Alaska.
Permittee acknowledges the validity of the Easement. Permittee warrants and represents that
Permittee is the owner of the fee simple interest in the land subject to the Easement and the
following described real property to which the Easement is adjacent:
Lot 46, Block 4, Sand Lake Subdivision No. 2, according to Plat Number P-176
recorded on the 26th day of April 1950, on file in the office of the District Recorder,
Anchorage Recording District, Seward Meridian, Alaska,
(herein "Parcel").

2. Encroachment. Permittee proposes to continue the existence of the following
improvement(s) on or within the real property subject to said Easement:
A septic system across said Easement at a point approximately 15 feet north
of the south property line,
(herein "Encroachment").
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its proposed location subject to the covenants set forth in this pe~xnit.
4. Indemnification. Permittee shall indmnnify and hold Chugach harmless from
any claims for personal injury, property damage or other loss arising in any way from the
continuation of the Encroachment, to include any damage to the septic drain field/pipes from
vehicle traffic in the Easement area.
5. No Expansion or Increase. Permittee shall not in any way expand or increase
the extent to which the Encroachment occupies any of the real property encumbered by the
Easement without the prior written consent of Chugach. Chugach has no obligation to
provide such consent.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall
not in the future give rise to any interest or estate in the real property subject to the Easement
or any other real property. Without in any way limiting the foregoing, Permittee
acknowledges that the Encroachment is not adverse to any interest of Chugach and its
continuation is entirely with the permission of Chugach for purposes of the common law
doctrine of adverse possession. This permit creates no interest in the real property subject
to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within
the Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that
portion of Chugach's total costs for such modification which is reasonably attributable to
accommodating or preserving the Encroachment. If such payment is not made within thirty
(30) days of written demand for same, Chugach may terminate this permit in accordance with
paragraph 9, below.
8. Covenants Running with the Land. The obligations of the Permittee arising
from this permit shall be covenants running with the land which shall burden the Parcel and
the Permittee's interest in the land subject to the Easement and shall benefit the Easement.

9. .Termination. Chugach may terminate this permit after the giving of thirty (30)
days written notice of such termination iff
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.
b. The Encroachment is damaged by any means to an extent of more than thirty
percent (30%) of its replacement cost at the time of destruction.
c. Permittee fails to make the payment described in paragraph 7, above.
10. Term. This permit shall, if not sooner terminated by Chugach, expire forty
(40) years from the date hereof.
11. Entire A_A_A_~eement. This written permit constitutes the entire agreement
between the parties with respect to the subject matter hereof and supersedes all other prior
or contemporaneous agreements, oral or written, between the parties. No modifications,
amendments, deletions, additions or alterations of the permit shall be effective unless in
writing and signed by all of the parties hereto.

The septic system that serves the subject property was installed in 1983. During our recent septic
evaluation for purposes of obtaining a Health Authority Approval (HAA), we found most of the
septic pipes were buried. We advised the owner all the septic pipes would have to be located and
extended above grade in order to meet MOA requirements for Health Authority Approval. It has
been determined the septic system extends all the way through the 10 foot utility easement at the
east property line, and approximately 8 feet into the road right-of way. Attached is a copy of the
as-built survey. Although the 10' utility easement is not shown on the asbuilt survey, Chugach
Electric has confirmed them is a documented 10' easement - Recording book 1144, page 215.
We are unaware of any other potential conflicts associated with this encroachment. Attached are
letters of non-objection from the utility companies shown on the distribution list. It would be
appreciated flail correspondence is faxed to 338-3246.

THIS AGREEMENT, made this 19th day of October., 1999, by and between ROCK &
JOHANNA REBER and their heirs, administrators, and assigns, hereinafter called "PERMITTEE',
and the Municipality of Anchorage, a municipal corporation organized and existing under its Chattel'
and the laws of the State of Alaska, hereinafter called the "PERMITTER".
WITNESSETIt:
WHEREAS, PERMITTEE is the owner of the following described real property:
LOT 46, BLOCK 4, SAND LAKE NO. 2 SUBDIVISION, according to the
Official records thereof, on file in the office of the District Recorder,
Anchorage Recording District, Alaska,
and;
WHEREAS, PERMITTER owns and/or maintains the real property more particularly
described as follows:
THE SiXTY FOOT (60') RIGHT OF WAY OF SEACLIFF STREET,
immediately to the east of the PERMITTEE'S property, as shown on
Plat # P-176, on file in the office of the District Recorder, Anchorage
Recording District, Alaska,
and;
WHEREAS, PERMITTEE has placed a septic system upon the above-described real property
which encroaches upon the PERMITTER'S Seacliff Street Right of Way.
NOW, THEREFORE, it is mutually agreed between the parties hereto that:
1. The PERMITTER, acting through the Director of Public Works, hereby grants to
the PERMITTEE the privilege of allowing their septic system to encroach upon
the PERMITTER'S Seacliff Street Right of Way, as shown on "Attachment A",
included herewith.
The PERMITTEE agrees forever to indenmify, defend, save and hold harmless,
the Municipality, its officers and employees, from any and all lawsuits, claims or
actions brought by any person for or on account of damage to property or injury,
disease, illness or death of persons, including all costs and expenses incident
thereto, arising wholly or in part from or in connection with the existence of,

alterationS, maintenance, repair, renewai, reconstruction, operation, use or
removal of thc encroaching septic system, as placed upon the PERMITTER'S
Seacliff Street Right of Way.
The PERMITrEE shall not assign or transfer any of the rights granted herein to
another individual or company without first notifying and securing the approval
of the Director of Public Works.
4. This Agreement and Permit grants PERMITTEE no interest in PERM1TTER'S
real property whatsoever, except only the encroachment rights described herein.
The PERMITTER reserves the right to revoke this permit upon twenty days (20)
written notice to the PERMITTBE. The PERMITTEE agrees upon such notice of
revocation, to move said encroachment from the Seacliff Street Right of Way, in
which it is placed. Should the PERMITTEE refuse or fail to comply with said
written notice, the PERMITTER, may without further notice to the PERMrI-TEE,
remove or cause to be removed the encroachment, and the PERMITTEE hereby
agrees to reimburse the PERMITTER for all costs incidental to the removal
thereof.
In addition to the mutual promises heretofore made, the PERMITTEE hereby promises to
pay the PERMITTER a one-time permit fee of one hundred dollars ($100.00).
IN WITNESS WHEREOF, the parries hereto have hereunto set their hands and seals the day
and year first hereinabove written.
