The Environmental Services Division, on-Site Services Program, has reviewed the
following cases and has these comments:
S-10544
Village View Estates Tracts
Information to satisfy the requirements specified by AMC 21.15 and AMC
15.65 must be submitted for each lot and tract of this proposed subdivision.
This information must include, but may not necessarily be limited to:
1. Soils testing, percolation testing and ground water monitoring must be
conducted to confirm the suitability for development using an on-site
wastewater disposal system. Ground water monitoring must be conducted
during high ground water season in either the fall (October) or spring
(April- May).
2. Areas designated for the original and replacement wastewater disposal
system sites must be identified and must meet all criteria specified in AMC
15.65 including slope and slope setback requirements.
3. Topographical information must be submitted.
4. Supporting documentation on water availability must be provided.

Existing Undocumented Septic System
Gentlemen;
On June i6, 2000, I visually inspected the septic system serving the original homestead.
Pumping records shows that the septic tank has a capacity of 300 gallons. The tank is located 84
feet from the well, the drain field is approximately 91 feet from the well. The tank is 4 feet deep
with four feet of cover.
The "septic system" is clearly not in compliance with present or past regulations. However there
are no signs of surfacing sewage, the closest neighbor is .5 miles distant. The continued operation
of this "system" does not present a danger to the environment or humans

Dear Mr. Weaver:
The owners of Tract A-lC, Villages View Estates, Phase 2 are proposing to subdivide the property into 4
tracts and 1 lot. The property is located directly east of the end of The Villages Scenic Parkway near
Potter Marsh and contains nearly 204 Acres. The ground surface of the parcel is covered with mature
dense Birch, Spruce, Poplar and Alder trees. Ground slopes are fairly steep and the property drains
primarily in a southwesterly direction with some drainage to the northeast in the northeastern quadrant of
the property. Bedrock outcroppings are seen throughout the property and will limit the location and type
of septic systems available for disposal of septic effluent.
Soil studies on properties adjacent to this parcel indicate an organic layer of material ranging in depth
fi.om .5' to 1.5'. The bedrock layer is then found directly beneath the organics in some locations, but
usually plunges to depths ranging from 3' to 15' below the surface. Soil materials encountered beneath
the organics and above the bedrock is generally a loose sand with some gravel which percolates at rates
less than 5 minutes per inch. These soils are considered excellent for the treatment of septic effluent.
The primary problem, however, is the presence of bedrock as the Municipal Ordinance requires a
minimum of 6' separation between the bottom of an absorption bed and the bedrock layer. The use of
nitrate reducing septic systems allows the separation distance to be reduced to 4', however, and appears
to be a solution to the problem.
No groundwater was noted in the studies completed on adjacent properties. No standing water has also
been seen on this particular parcel. It is .logical to assume, therefore, that groundwater or surface water
will not prevent the development of this property. The steep surface slopes may hinder development, J~ut
with minor grading during development of any septic system, the required 50L~lll~l!~between the
absorption areas and any break in grade greater than 25% can be achieved. ,~

A: The existing situation is: The applicant is making minor boundary changes which will provide legal
and physical access to a large tract at the end of Villages Scenic Parkway and addinq a portion of his
original state patent to create proposed Tract B. This brings in the requirement to include the
remainder of his patent in this subdivision which creates lots without or undetermined legal and
physical access and not abutting a publicly dedicated street.
B. The granting of this petition would permit: Eot 1, Tract C and Tract D to be excluded from the
requirements of AMC 21.80.200 and AMC 21.80.330
The undersigned alleges that:
1. That there are such special circumstances or conditions affecting said property that the strict
application of the provisions of this ordinance would clearly be impractical, unreasonable, or
undesirable to the general public. These special circumstances are: Existing access to these
properties is through a lar. qe unsubdivided parcel without dedicated roads. This creates a special
condition.
That the granting of the specified variance will not be detrimental to the public welfare or injurious
to other property in the area in which said property is situated for the following reasons: These
variances effect only the current land owners property.
3. That such variance will not have the effect of nullifying the intent and purpose of this ordinance or
the Comprehensive Plan of the Municipality for the following reasons: Since this property is
surrounded by unsubdivided or undeveloped property, the requirements of the ordinances is simply
impractical at this time, therefore the intent or purpose for this ordinance or the Comprehensive Plan
have not been affected.
4. The above listed special conditions or circumstances do not result from the action of the applicant
and such conditions or circumstances do not merely constitute a pecuniary (monetary) hardship or

Dear Mr. Weaver, Planning Staff, Platting Board
We hereby submit a request for the following amendments to the Conditions of Plat for
Villages View Estates Tracts Subdivision, Platting Case # S-I0544
A. Remove Condition//4.
Condition 4 reads: "Resolving with Chugach State Parks, the need for a public
access easement from the north boundary of the property to the southeast corner of
the property."
This is an unreasonable plat condition and request from Chugach State Park. Currently
there is alternate access though Heritage Land Bank and State Mental Health Trust Land
and down the existing section line easements along the east boundary of the proposed
Villages View Estates Tracts Subdivision. We strongly feel that Municipal and State
Land, and legal access down the section line easements be utilized for access to Chugach
State Park prior to requesting or granting access across private property. As far as
topographic considerations, it is undisputed that the said alternate route is feasible and
from our research, the best route for a proposed access road.
Remove Condition #5.
Condition 5 reads: "Resolving the need for and design of pedestrian access
between Potter Valley Road and Villages Scenic Parkway."
This is also an unreasonable plat condition. This is a very unusual request and we see no
justification for this condition. We found no mention of such a trail in the Area Wide
Trails Plan or any other municipal publication. If this trail were to be constructed, we feel
it would benefit and be used by very few individuals since the subdivisions along
Villages Scenic Parkway are large lot with very low densities. If the properties to the east
along Potter Valley Road are developed with higher densities; we simply do not see the

need for a trail down to Villages Scenic Parkway since there are currently plans for a trail
along Potter Valley Road shown in the Area Wide Trails Plan.
Remove Condition #8~
Condition 8 reads: "If no section line easement exists, resolve the need for a 50
foot public access easement along the east boundary of Tract C with DCPD and
Chugach State Parks."
A section line easement does exist; a public access easement is simply not neede&
Please consider these requests and amend these plat conditions. Thank you for time and

(April - May).
2. Areas designated for the original and replacement wastewater disposal
system sites must be identified and must meet all criteria specified in AMC
15.65 including slope and slope setback requirements.
