Dear Mr. Fields:
We are submitting herewith the test boring results and our comments
regarding soil conditions encountered at the subject site. This in-
vestigation was performed in accordance with your request of December 13,
1976, and those procedures outlined in a letter dated July 15, 1975, by
Mr. Rolf Strickland of the Municipality of Anchorage Department of
Environmental Quality.
A single test hole was put down within the subject site area for the
purpose of defining general subsurface soil conditions for the proposed
sanitary system. Excavation was accomplished with a tractor-mounted backhoe
and the test hole was extended to a total depth of 8 feet below ground
surface. The final log prepared for the test hole has been included in
Drawing A-01.
Groundwater was encountered in the test hole during inspection.
We appreciate being given this opportunity to be of service to you. Should

'Sirs:
This office has been retained by Eonroe and Custava Fields to
represent their claim for a variance from a plat restriction
presently existing on their lot, the official description of
which is found above. The restriction in question reads as
follows:

Chronlogically, the circumstances of our client's case are as
follows:
Hr. and Mrs. Fields purchased the above lot on or about October
20, 1976 from Carl Holmes. Before and at the time of purchase,
Hr. Holmes was informed of our client's %ntentions to place a
trailer on this lot and to construct on lot water.and sewer
,facilities. Not once during many discussions related to this
transaction did Mr. Holmes explain the existence of the above
mentioned restriction.
The sale and escrow arrangements were handled by Security Title'
Inc. who were also informed of these same intentions by oar clients.
At no time did ~curity Title explain either the existence or
the implications o'f said'restriction on our client's potential
use of their newly acquired property. The transaction was closed
on October 20, 1976.
In December of 1976, Hr. and Mrs. Fields contacted Ms. Gdil Johnson
and Mr. Joe Stenson with~e Department of Zoning--to discuss the
.procedures involved in ~ permits for the on lot water and
sewer facilites. After hearing the Fields requests and discussing
the results of the appropriate soil tests which the Fields initiated
at their own expense, the zoning department sent our clients to
the Department of Health where they were to apply for well and
holding tank permits. At no time did these individuals at the

zoning department expl f
g to the Fields the nature of the'
above mentioned restriction and it is my belief that they did
not investigate the platting of the subdivision in question to
discover this restriction.
It appears that the health department on December Z0, 1976, through
the offices of John Kennedy and Joe Blair, approved the use of
a holding tank on the Pield's lot. It is my belief after speaking
with Mr. Kennedy and meeting with Mr. Blair, that once again the
municipality negligently failed to apprise our clients of this
restriction or to familiarize their, otfice with the lot by pulling
the plat to check for any existing restrictions.
In full and justifiable reliance upon the representations of the
aforementioned individuals our clients improved their lot by
transporting gravel to the lot at a cost of approximately Six
Thousand Dollars ($6,00~'). Moreoever, as mentioned above, the
Fields brought in experts to r~n tests on the lot to establish
the appropriate procedures for/obtaining o~ lot water and sewer.
In sho~t, our clients treated/this lot as thief own unrestricted
property. '~ ~$~ ~ ~ ~ ~ z~
It was not until June 21, 1977, six months after firs~ receiving
permission for the on'lot h~lding tank, that the Fields. learned
of the plat restriction. It was at this time that the municipality
retracted the initial permit-on the grounds that'this plat restriction
existed on their propertoy.
The platting board should also be informed that the Fields family
has been living on the lot since late Decemker. The family had
hoped to dig the well and holding tank..at their first opportunity
in the spring. Since December they have been transporting water
daily and have been forced to use an outside chemical toilet'which
',they have rented at their own expense. Therefore, fhe municipality
may be responsible for a grossly inquitable situation'which the
Fields have been forced to endure since notification in June and
which my persist indefinitely unless an equitable variance is
granted in this case.,
Upon further investigation I have learned from Mr. Rolff Strickland
of the health department that no set procedure exists by which the
municipality may inform potential buyers and users of property with-
similar plat restrictions that such restrictions do exist and the
rationale for their existence-:. I strongly urge that the municipality
develop such procedures immediately to avoid such drastic mis-
understandings as typified by our'client's case. Furthermore, it
is our belief that the Pields family should not be made to suffer
such a tremendous loss when they'merely operated on the representations
of individuals who they assumed should have been familiar with
municipal procedures.
The Fields family have been residents of Anchorage since 1951. They
have owned two different lots since that date and have drilled on
each of. these lots. Neither Hr. or Hrs. Fields has an education
above the eighth grade and while part of this problem may stem ~
~rom their inability to articulate their position or desires,
it is our belief that given all the facts of this case and the
lack of organization on the municipality's part, the Field*s
should be granted a ~ariance by the platting hoard. This variance
would allaw thts.£amily'.to.fp~fill their.in§tillable anticipations
which led them to enter into the initial transaction with Hr.
Holmes.

As a result, we are submitting the fei!owing exhibits and data for your

assistance and application for a S~ecial Land ttazard Perm£t in accordance
with Section 7.1, "Special Land .qaL_ard Permit" of the proposed Greater
Anchorage Area ~orough flood plain ordinance.. Included in this submittal
are:
(1) 200-scale aerial map of the area between Lake Otis Road and
the New Seward Highway. Superimposed on the aerial are one-foot ground
contours covering Shelikof, Calatea and a 700-foot+ wtde strip downstream
from Shelikof. Also shmm is the proposed channel--alignment of the North
Fork of Little Campbell Creek.
(2) Profile from Lake Otis Road to the New Seward Highway showing
the existing ground linc along the proposed channel alignment, the proposed
channel invert, and finish floor elevations of the housing units adjacent..
to the channel. '.i
(3) Lax*ge S0-scale pre]iminary grading and drainage maps for
Shelikef and thc north half of Galatea Estates showing in more detail the
one-foot ground contours based on field survey, the lot and housing layouts,

shallow, landscaped 'channel to carry the regulatory flood waters. In the
center of ti;is channel is a small ditch to carry normal flows. The pro-
posed c::::n:v~l' ' w~!l carry anDroximately.. 1,450 cfs at 0.6% grade and a 42foot
flood dc?th. 'This should be adequate to safely carry the intermediate
regional flood as rccor, unendcd by the Corp of £nginccr~. The Corp study
shows the creek flowing at the rate of 1,100 cfs at the Old Seward tlighway
crossing and a cer.:bJned flow of approximately 1,900 cfs at Lake Ctis Road
during 100-year floods.
{S) Thc Developers will provide the necessary easements, permits
and/or releases from the property owner dot, mstream of Shelikof.
(6) All subdivision street crossings will be designed to accomodate
the lO-)'ear flood, with adequate provision and protections for overtopping
by the more severe floods.
(7) Construction of the proposed flood channel and thc sewer trunk
from the Seward Highway to serve the subdivision should effectively lower
the water table be]ow the foundation level.
It is our.understanding that the Borough may submit this report to
the Corp of Engineers for a detailed analysis. As this analysis ma)' take
considerable time, we do request a letter from the Borough indicating our
flood proposal is under study so that the developer has a progress report
to present to his financiers.
Please advise if more detailed or specific information is required.

Dear Mr. Strickland:
Attached are two prints of Galatea Subdivision with added note:
"No structure or building will be constructed until water and sewer
service is available".
Also attached is a letter from the City of Anchorage regarding water
service.
This plat was submitted to the Planning & Zoning Commission and
approved in the fall of 1971. At that time, there was a question as to
whether Central Alaska Utilities or the City of Anchorage would serve
this area with water. OnMarch 15, 1972, it was resolved that the City
would serve this area.
In the meantime, our approval has lapsed and it is our intent to
reverify approval of the subdivision design and then proceed with de-
tailed water and sewer designs.
It is our intent to construct one lift station serving Shelikof and
Galatea Subdivisions (total 268 lots). This will provide economies to
both developers and was agreed to by the Borough. A copy of their
June 4, 1971, letter relating to Shelikof is attached for your reference.
If this fulfills the requirement of the Planning & Zoning Commission
as stated: "Providing the Department of Environmental Quality with
engineering reports and/or designs as needed to show how each lot/lots
can be provided with a safe, adequate water supply and sewage disposal
facilities", please concur in space provided below.

A letter, 14 test hole logs, and location maps. There is no mention of pene-
¥ tration rates ~low counts), a necessity when considering suitable foundation
E mater£als in this' area. Since four of the test sites encountered surface
water table conditions, a review of the subsurface geology by backhoe techniqu~
, was impossible. As you know, much of the northerly part of the site is also
within the 100 Year Floodplain of the North Fork of Campbell Creek (U. S.
A Army Corps of Engineers, June, 1971).
In light of the geologic information received to date, our department can
not recommend approval of this proposed subdivision. We must have assurance
that the soils are structurally sound for the building contemplated and that
the extremely high water table can be adequately handled.

The soil descriptions shown on- the Iogs are the best estimate of the soil
characteristics at the time of field examination. Such examinations do not achieve
the precision of laboratory tests for the various properties.

Dilatency - is the ability of water to migrate to the surface upon vibration or
jolting of a sample, an aid in determining whether a soil is predomi-
nately a clay or silt.

Organic Content - estimated by volume, not particularly precise,
Clayey Soils - a field method now being used as an aid to identification of
these soils as a combination ball drop, and rolled thread tes~ in which
a 2" diameter ball of the Sand-Silt-Clay fraction is dropped 2' until
a 1" thick pat develops. The diameter of a thread at crumbling rolled
from the resultant pat determines whether clay or silt predominates.
Dry Strength - a small sample of the soil is formed into a cube and air dried,
and crushed between the fingers. High dry strength indicates clays
and low silts.
Water Table - the apparent water ~ble at the time of observation. Often the
actual water table may be higher unless the hole Is allowed to remain
open or is conver;ed to an observation well.
Capillary Fringe - change from moist to very damp, or saturated Soil, usually
indicates that water table lo close.
Peat - Fibrous material of macroscopic and microscopic fragments of decayed
vegetable matter; very compressible, unsuitable for foundation or
embankment. Color light brown to black.
Aa - The upper layer, surface soil or topsoil, containing humus and/or Organic
debris, not satisfactory for fo(~ndations.
