I have noted since receipt of your letter draft to Mr. shiers
that the existing absorption trench on his property was off
set from the south property line to make the one-hundred (100)
foot separation requirement to -the neighbor's well0 Therefore,
the only area available for additional absorption is toward
the north property line, however, the full lot width obviously
is not available as you mentioned. A type of seepage pit added
to the north end of the trench uses less total length by
extending width. The pit must have a circumference of
seventy-five (75) feet and a crib depth of nine (9) feet for
a .three (3) bedroom residence.
Mr. Shiers should consider terrain in the area of proposed pit
placement and existing wells to the north of his property. An
ordinance change in October, ].975 mandated an aerobic package
plant in place of a septic tank in high clay content soils~ Mr.
shiers' lot according to independent soil analysis did have
soils that require aerobic plants, which generally cost $900 to
$2,100 more than septic 'tanks. This requirement applies to the
undeveloped lot in questions. The aerobic plants were instituted
in light of a high failure rate for absorption systems in clay
like soils. The functional sewer system life greatly affects
Mr. Shiers since the addition of a seepage pit would leave no
future replacement site. This department, therefore, recommends
that an aerobic unit be installed in the existing septic tank
also.
The public sewer options and holding tank options were acceptable
as mentioned.

The subject lot can not be developed using conventional
on-s.ite sewage disposal techniques. The configuration
of neighboring sewer systems and wells essential].y
voids out any area for a placement of a sewer on the
subject lot until the public .~:ewer line is constructed
in this area.

I have researched the problems concerned with on-site
sewer and water and Ahe development of lot 2, block 4 in
Granite View Subdivi'sion. There may be a few different
methods you can. approach to provide water and sewer facilities
for your lot.
You might hold off development of the property until
public sewer is extended to serve tile property. Although this
may be the best solution for the future, economically it may
not be feasible at this time.
The Health and Environmental Protection Department has
indicated you could apply for a holding tank permit. If the
permit were issued, there would be the added expense incurred
by the homeowner in maintenance costs for the system. If you
wish to apply for this permit, the department indicated they
would take into account the particular development problems you
are faced with.
There is the possibility that a "shared" sewer system of :" '

In addition, it may be advisable to secure a document
which indicates this "shared" system and the responsibilities

that go wi. th such a system cannot be blocked by the owner of
lot 1 or the owner of lot 2, now or in the future. It may be
best to have such a document recorded in the District Recording
Office to preclude any problems in the future.
If you are unsatisfied with the above methods for develop-
ment or feel the municipality J.s responsible for the undevelop-
ability of lot 2 your next recourse would be to seek legal
advice. Tl~e court should be the final determination concerning
any responsibility questions which may arrise. Usually claims
for damage are initiated simply by filling out a damage claim
form at the Clerk's Office and leaving it with 'them. Tile
MunicJ. pality would process it to determine whether they wou]_d
pay the claim voluntarily.
At any rate, these are the options. The Department sounds
open %o finding a solution. You may wish to contact Mr. Les
