RE: WILLIAMSON #1 B1, L14 -- SEPTIC SYSTEM UPGRADE PERMIT w/ WAIVERS
The property owner has requested we obtain a permit to upgrade the failed septic system of the above
referenced lot. This is an extremely limited area & the reserve field is proposed. After discussions with
MOA staff, it was decided to install one pressurized deep trench to 10’ from grade with waivers per the
attached design to serve the existing 4-bedroom residence. The design is based on the Rober Cowan, PE
test hole conducted on March 19, 2004, with no groundwater being observed at test hole excavation or
monitoring.
Due to the very limited area, field-to-field waivers of the property & adjacent property absorption
trenches of 10’ between is requested. This waiver is justified with the tighter, silty soils and shows that
any potential effluent transference or interaction would be negligible between the existing and proposed
fields. The property is best served by retaining the original field for future use due to the lot’s
characteristics. The mitigating factors of soil type justify the issuance of the waiver and indicate the
proposed field will have no effect on the functionality of the existing or adjacent fields.
Also, due to the lot’s characteristics it is requested that property line (PL) waiver separations be granted
for 5’ & 1’. The adjacent property trenches & corresponding sewer rock effective depth (ED) have
sufficient separations to the proposed trench. Please see the attached design. MOA previously issued a
WR#050062 PL waiver of 3’ & 9’ & there have been no known issues for over 20 years and do not
expect there to be any adverse effect on the adjacent lots be granting the waiver.
The slopes are 15-20% at the proposed upgrade location. The lot and area are served by private water.
The design will not impact any of the neighboring properties. Please contact us if you have any questions.

The above property is a new 3 bedroom house served by a private well and septic system. We
request you grant a 92 feet separation distance waiver from the well on referenced property to
the septic system on Lot 17, Block 1; Williamson S/D #l. The following items are justification
for the waiver:
- The topography slopes such if the septic system was to overflow the effluent would
not travel toward the well head.
The other path of contamination is subsurface migration of wastewater. As can be seen on the
attached well logs the average depths of the wells range from 60-261 feet deep. The average
static water levels in these wells vary from 21-179 feet with various layers of silt, clay and
hardpan soils that have served to inhibit the migration of untreated wastewater into the aquifer.
Recent water sample results were taken from the well on referenced lot and the results indicated
nitrate levels to be 0.205 mg/L and coliform and bacteria results to be non detectable. These
water sample results indicate that the surrounding area does not have elevated nitrate levels.
Based upon the aforementioned facts, it appears that there is minimal risk associated with the
92 feet separation distance waiver.
We do not anticipate any adverse effects on the neighboring properties by the granting of this
waiver.

Comments: This investigation was completed in compliance with MOA guidelines, regulations,
and best industry practices / methods. The assessment of the condition of the well and septic
applies only to the conditions as of the day tested. The flow and absorption rates may change
due to subsurface conditions that may not be observed from the surface, changes in land use,

Due to seasonal breakup, site conditions, road restrictions and other factors, we are requesting a
Conditional COSA for the above referenced property. The permitted OSP261041 3-bedroom
septic tank upgrade has been impeded due to these conditions and other factors with no specific
known date on when the septic system will be installed. Although unknown, it is anticipated that
the septic will be installed prior to June 15, 2026, once the conditions are favorable for
installation.
The system has been working for the occupants and granting of this Conditional COSA
(CCOSA) will not impact any of the neighboring properties or pose a public health risk.
Attached are three septic install estimates and escrow letter from the title company for the
pending installation. Please contact us if you have any questions.

Conditional Certificate of On -Site Systems Approval (CCOSA) issued by the Municipality of Anchorage

This agreement made this 1st day of May, 2026 by and between Johnathan J. Boyce and Giselle T. Boyce
(hereinafter jointly referred to as Seller), part of the first part, Hirohiko Ito (hereinafter jointly referred to as
Purchaser), part of the second part, and Alyeska Title Guaranty Agency, Inc. (hereinafter referred to as Escrow
Agent), party of the third part.
WITNESSETH:
WHEREAS, the Seller owns the following described real estate:

WHEREAS, the Purchase and Sale Agreement, dated 29th day of April, 2026 provides for Seller to complete the
following to the above property: Septic Excavation install
WHEREAS, the real estate has been sold to Hirohiko Ito and
WHEREAS, weather and/or supply prevent the completion of said items, and
WHEREAS, it is the desire of Seller and Purchaser to close the sale prior to the completion of the improvements
and, at the earliest possible date, and
WHEREAS, the Lender is willing to disburse the loan proceeds provided a cash escrow is established to assure
completion of the uncompleted item(s).
NOW, THEREFORE, for and in consideration of the premises herein above set forth and to make possible the
immediate delivery of possession of the property to the Purchaser hereinabove named and at the same time
assure the satisfactory completion of said improvements, the parties hereto agree as follows:
1. The Seller covenants and agrees to complete the improvements enumerated below on or before June 15,
2026.
2. The Seller agrees to pay for all labor and materials necessary to complete the work and improvements. The
Seller further agrees to pay for the final inspection performed by the approved appraiser or lender hereinabove
named, if applicable.
3. The Seller additionally agrees that he is personally liable to Purchaser for the satisfactory completion of the
work, free and clear of all material and labor liens, and indemnifies the Purchaser and the Escrow Agent for
any liability of Claims of Lien filed against said property for the improvements mentioned hereinafter for the
closing of this sale.
4. The Seller herewith deposits with the Escrow Agent and the Escrow Agent acknowledges receipt of the sum of
$69,701.00 which said sum shall be held by the Escrow Agent in a non interest or ❑ interest bearing

account at a financial institution insured by the Federal Deposit Insurance Corporation, and disbursed as
follows:
a. In the event the Seller completes the work and improvements in full accordance with this agreement the
Escrow Agent shall thereupon pay to the Seller the sum deposited, plus the accrued interest, if applicable.
b. In the event the Seller fails to complete all or any part of the improvements enumerated below, on or
before the date specified in Paragraph 1 hereof, the Buyer/Purchaser shall have the right to enter into a
contract with any third party for the completion of such part of the work as the Seller has failed adequately
to perform. In such event Escrow Agent, shall pay over, at the direction of the Purchaser, all or any part of
the escrowed funds in such amounts and to such persons as may be specified in the presentation of bills
for work performed. The Seller hereby releases the Escrow Agent from any liability whatsoever to pay
over or account for all or such part of the funds deposited hereunder as may be expended at the direction
of the Seller as provided herein.
c. If a dispute arises regarding the disbursement of the escrowed funds, the Escrow Agent shall not be
required to take any action or disburse any funds but may withhold and stop all further proceedings
without liability until such time as mutually agreeing written instructions have been delivered to the Escrow
Agent or a court order
5. It is the intention of the parties that this Agreement is made for the benefit of the Buyer. The Escrow Agent, in
the execution thereof, shall act solely on the request and instructions of the parties as specified herein with
respect to all sums deposited hereunder and for so doing, the Buyer and the Seller hereby expressly release
and relieve the Escrow Agent of any and all liability or claim of any nature.
6. The Escrow Agent shall have a prior lien on the funds deposited herewith for any costs, including costs and
reasonable attorney's fees which may be incurred by it consequent to its being made a part to all legal or
equitable proceeding which is brought by any of the parties hereto, concerning the disposition of the funds
held.
7. Upon payment of invoices, any remaining funds will be returned to Seller.
