Absorption Trench to Footing Drain
Dear Onsite Services Engineer:
Very little area is available on the subject lot to construct a new absorption system due
to the location of the well and the 100' setback required from Little Campbell Creek. IN
addition, the house has a full basement and each spring groundwater infiltrates the
basement. The footing drain placed many years ago has not been successful in
controlling the water intrusion. A new footing drain project is currently ongoing. The
new footing drain at the northeast corner of the house must be placed approximately 8'
from the sidewall of the existing absorption trench due to poor soil conditions and other
construction limitations. We are therefore requesting a waiver to allow the placement of
the footing drain at 8' from the absorption trench. The majority of the trench will be
more than 12' from the footing drain as required in the proposed Municipal Wastewater
Ordinance. A waterproof 7 mil visqueen membrane will be placed along the sidewall of
the footing drain in the area where the separation distance is less than 12'. This
distance is expected to be 10'. In addition, the septic system on the lotris a Category III
Nitrate Reducing System and the possibility of releasing contaminated septic effluent
into the footing drain is remote. The outfall to the drain is more than 100' from the
location of the encroachment between the absorption trench and footing drain.

Absorption Trench to Lot Line
Dear On Site Services Engineer:
Very little area was available on the subject lot due to the location of the well and the
stream crossing the lot in the back. The absorption trench was inadvertently placed
within 2' of the east lot line as the line was not clearly marked. Placement of the
absorption trench at this location will not adversely affect the neighboring lot as the well
is a substantial distance away. We hereby recommend a lot line waiver be issued
allowing placement of the absorption system within 2' of the eastern lot line.

Septic System Design and Permit Application
Impacts to Adjacent Properties
Dear Onsite Services Engineer:
The existing absorption trench on the subject lot has failed and must be replaced to
prevent a safety and health problem. We are therefore requesting a permit be issued
for a new septic system to serve the home. The available area for the septic system is
very limited due to the presence of Little Campbell Creek in the back of the house and
the location of the well in the front. We have therefore decided to place an Advantex
Treatment System on the lot to provide the most effective treatment of the septic
effluent prior to discharge into the surrounding soil strata. The location of the
absorption system is shown on the attached Site Plan along with the location of the
stream and the well. Drainage patterns are also shown on the plan and will not be
modified as a result of the proposed construction.
The test holes placed on this lot revealed silt with gravel and sand (ML) in the area of
the proposed absorption trench. Soil materials were dense to the bottom of the hole
with a percolation rate approaching 60 minutes per inch. No groundwater was noted
during placement of the test hole and none has developed over the ensuing monitoring
period. Our design provides for the bottom of the absorption trench to be placed 11'
below the surface. We are therefore proposing to place a four-bedroom Advantex
Treatment System. The absorption trench will be 42' long x 3' wide x 8' effective depth.
The distribution line in the trench will be placed at 3' below the existing ground level.
Total depth of the trench will be 11' below the surface. 3' of fill will be placed above the
trenches and 4' over the septic tank to meet Municipal Code and prevent freezing.
The surface of the lot slopes to the northwest at shallow grades. The new absorption
trench will be constructed parallel to existing ground contours in conformance with
Municipal requirements for the most part, but due to lack of space a small segment will
be slightly perpendicular to the contours. At no time will the effective area be out of the

percolation zone. Ail components of the septic system will be constructed a minimum
of 100' from any surface water and 100' from the well on this lot and those on adjacent
lots. No conflicts exist between the proposed well and septic system and those in the
area.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
The system, if constructed as designed, will have no adverse impact on reserve
space, either surface or subsurface, on any lots located in the area.
The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.

Due to the configuration and location of the old trench the new trench must be placed
within 4' of the old trench. The new trench will be served by an Advantex Treatment
System which reduces the total nitrate content in the septic effluent. We therefore
recommend the new trench be placed at 4' from the abandoned trench on the lot.

Absorption Trench to Slope Contour Waiver
Dear Onsite Services Engineer:
The subject lot has limited surface area for construction of a septic system upgrade due
to the location of the well and the presence of Little Campbell Creek to the north. The
entire length of the new trench cannot be constructed parallel to the ground contours
and remain 100' from the creek. The slope of the surface in the area of the new trench
is very shallow and ranges from 0% to 2%. The trench will remain in the soils verified
suitable by the percolation test and test hole. The new trench will be 2.5' below the
surface at the northeast end and 3.0' below the surface at the southwest end. The Site
Plan showing the location of the trench and the soils encountered on the lot is attached
for your review. We hereby request a waiver be issued allowing the trench to be placed
other than parallel to the existing ground contours.

MEMORANDUM OF UN~DERSTANDING

THIS IvI~MOP. A.N~DUM OF UNDERSTANDING made and entered into as of this
herein thc "OWNER," and the Municipality of Anchorage, hcrcin the
"MUNICIPALITY." In consideration of the mutual covenant~ conuined herein, thc
parties to this Memorandum of Understanding agree as follows:
1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality
grits permission to Owner to milL~e and operate an Adv~ccd Wastewat~r
Treatment System (AWWTS), described as ~,~ a ~'~-~q located

2. Definitions.
A. Alteration. Any change to thc design or function of an AWWTS that

thc time of property sale and title transfer ~ accordance with .AMC 1 ~.6~.
These approvals ce~f'y that the systems are adequate lot',he homes that
they support and me~t the codes that were in place at the lime of system
construction.
C. Damage. Any man-made or natural change in a system that would inhihh
the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing paris, components and pieces of an AWWTS that were included in
the original design which would allow the AWWTS to cominue to
perform as designed.

all relevant provisions of AMC 15.65

shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of On-Site approval is Issued to
the new owner or transferee of the property.
5. Alterations~ ln~t~llation and Removql of Additional Equipment. Owner agrees

Construction Permit from the Municipality.
6. ]VIaintenance qnd Repairs.
A. Throughout the t~rm of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good rcpak. In addition, it shall be th,, responsibility of thc
Owner during the term ofthi~ Memorandum of Underseas. ding, and any extensions or
renewals thereof, at the owner's sole expense, to pay for any and all: (1) rcpalr(s), (2)
maintenance, (3) adjustment(s), (4) replacement: costs, and ($) inspection costs.
Further, Owner agrees to comply will all applicable ordinance, laws, regulations,
rules and orders for the AWWTS.
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the
terms and conditions contained in the Owner's AWWTS Operating Permit. This
schedule shall be submitted to the Municipality annually upon thc renewal of the
permit. The schedule of maintenance and repair contained in the Ov;~er's AWWTS
Operating Permit is:

Municipality will inspect and make any necessary maintenance, repairs or permitted

maintenance and repair of thc Owner's AWWTS.
7. ~i'~. The failure of either party at any time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions,
nor in any way effect the validity ot'the Memorandum of Understanding or any part
hereof`, or the right of such patty thereafter to enforce each and every provision
hereof.
8. ,~mendment.
A. This Memonmdum of Understanding shall only be amended, modified or changed
by a v,a'iring, executed by authorized representatives of thc parties, with the same
formality ofthls Memonmdum of`Understanding was executed ~nd such writing shall
be attached to thls Memorandum of Understanding as an amendment.
13. For the purposes of'any amendment modification or change to the terms and
conditions of`this contract, the only authorized representatives of the parties are:

MAINTENANCE AND REPAIR AGREEMENT
THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and
entered into as of this Day of S4 -t of 20 by and between

Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code
(AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this
Agreement agree as follows:
1. Advanced Wastewater Treatment Systems, The Municipality grants permission to the
Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS),

2. Maintenance, Repairs and Alterations.
(Owner is required to read, understand and initial each section)
M�✓ Throughout the term of this Agreement, the Owner shall enter into a service agreement
with an AWWTS service and maintenance provider approved by the Municipality or the
manufacturer's representative. The AWWTS shall be maintained in a satisfactory
condition capable of performing as designed and producing treated septic effluent in
accordance with the equipment's approval for operation in the Municipality.
M*� It shall be the responsibility of the Owner during the term of this Agreement to pay for all
repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This
includes an annual maintenance fee (typically $400 to $600).
--� Owner agrees that only maintenance and repair personnel approved by the Municipality
or the manufacturer's representative will inspect and make any necessary maintenance,
repairs or permitted alterations to the system.
Owner acknowledges that regular maintenance of an AWWTS reduces the potential
failure of the system, which could include sewage backup and costly repairs or drainfield
replacement.

repairs from the manufacturer's representative or maintenance provider.
Owner acknowledges that the fine for failing to maintain and repair an AWWTS may be
assessed in accordance with AMC 14.60.030.
Mr/ Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS. The Municipality will give at least 24-hour notice.

Certificate of On -Site Systems Approval.
M ✓ Owner agrees that the AWWTS installation and maintenance requirements as provided
by the AWWTS vendor/installer and approved by the Municipality are the governing
guidelines for the construction, maintenance and repair of the Owner's AWWTS.
Owner agrees to maintain remote monitoring of the AWWTS as required by the
AWWTS approval.
3. Term. The term of this Agreement shall begin on the date of approval by the
Municipality to operate the installed system, or upon transfer of title, and shall continue
while the AWWTS is operational or until title is transferred.
4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this
Agreement shall in no way constitute a waiver of the provisions, nor in any way affect
the validity of the Agreement or any part hereof, or the right of the Municipality
thereafter to enforce every provision hereof.
5. Amendment. This Agreement shall only be amended by authorized representatives of
the Owner and Municipality. Any attempt to amend this agreement by either an
unauthorized representative or unauthorized means shall be void.
6. Jurisdiction: Choice of Law. Any civil action arising from this Agreement shall be
brought in the Superior Court for the Third Judicial District of the State of Alaska at
Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the
parties under this Agreement.
7. Severability. Any provisions of this Agreement decreed invalid by a court of competent
jurisdiction shall not invalidate the remaining provisions of the Agreement.
