The minimum well productivity required by this Department (AMC 15.55) for a 3 -bedroom residence is .31 gallons per minute. All parties concerned are advised that the production capacity of the well may fluctuate. Restriction of non-critical water uses such as washing cars and watering lawns and gardens may be required. MUNICIPALITY OF ANCHORAGE ADVANCED WASTEWATER TREATMENT SYSTEM MAINTENANCE AND REPAIR AGREEMENT THIS MAINTENANCE AND REPAIR AGREEMENT, herein the "AGREEMENT" made and entered into as of this 30th Day of September of 20 22 , by and between Erik D. Mundahl , herein the "OWNER," and the Municipality of Anchorage, herein the "MUNICIPALITY", in accordance with Anchorage Municipal Code (AMC) 15.65.365. In consideration of the mutual covenants contained herein, the parties to this Agreement agree as follows: 1. Advanced Wastewater Treatment Systems. The Municipality grants permission to the Owner to utilize and operate an Advanced Wastewater Treatment System (AWWTS), described as ADVANTEX System located at (legal description) Fire Lake Subdivision, Lot 2, Tract I 2. Maintenance, Repairs and Alterations. (Owner is required to read, understand and initial each section) Throughout the term of this Agreement, the Owner shall enter into a service agreement with an AWWTS service and maintenance provider approved by the Municipality or the manufacturer's representative. The AWWTS shall be maintained in a satisfactory condition capable of performing as designed and producing treated septic effluent in accordance with the equipment's approval for operation in the Municipality. It shall be the responsibility of the Owner during the term of this Agreement to pay for all repair(s), maintenance, adjustment(s), replacement costs, and inspection costs. This includes an annual maintenance fee (typically $400 to $600). 9 Owner agrees that only maintenance and repair personnel approved by the Municipality or the manufacturer's representative will inspect and make any necessary maintenance, repairs or permitted alterations to the system. Owner acknowledges that regular maintenance of an AWWTS reduces the potential failure of the system, which could include sewage backup and costly repairs or drainfreld replacement. GOwner acknowledges that the fine for failing to maintain and repair an AWWTS may be assessed in accordance with AMC 14.60.030. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS. The Municipality will give at least 24-hour notice. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. Owner agrees that the AWWTS installation and maintenance requirements as provided by the AWWTS vendor/installer and approved by the Municipality are the governing guidelines for the construction, maintenance and repair of the Owner's AWWTS. Owner agrees to maintain remote monitoring of the AWWTS as required by the AWWTS approval. 3. Term. The term of this Agreement shall begin on the date of approval by the Municipality to operate the installed system, or upon transfer of title, and shall continue while the AWWTS is operational or until title is transferred. 4. Nonwaiver. The failure of the Municipality at any time to enforce a provision of this Agreement shall in no way constitute a waiver of the provisions, nor in any way affect the validity of the Agreement or any part hereof, or the right of the Municipality thereafter to enforce every provision hereof. 5. Amendment. This Agreement shall only be amended by authorized representatives of the Owner and Municipality. Any attempt to amend this agreement by either an unauthorized representative or unauthorized means shall be void. 6. Jurisdiction: Choice of Lay. Any civil action arising from this Agreement shall be brought in the Superior Court for the Third Judicial District of the State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and obligations of the parties under this Agreement. 7. Severability. Any provisions of this Agreement decreed invalid by a court of competent jurisdiction shall not invalidate the remaining provisions of the Agreement. Palmer, Alaska 99645 (907) 746-1073 March 14, 2010 Municipality of Anchorage On-Site Services 4700 South Bragaw Anchorage, Alaska Re: Wells Fargo Bank Trust for Virginia Ryan Fire Lake Subdivision, Tract I, Lot 2 14521 Fire Lake Drive Chugiak, Alaska REQUEST FOR CONDITIONAL COSA Our office was contacted by Realtor Audrey Mason to perform an adequacy test on the septic system on the above-mentioned property, at which time she stated she was quite sure the drinking water for the house was obtained from Upper Fire Lake. Upon attempting to obtain MOA records on the septic system from the website, it was determined that it was an undocumented system. The MOA said it would have to be documented before a COSA could be issued. The house was built in 1960 according to a neighbor who lives across the street from the property and was present at the time of construction. Another neighbor adjacent to the property confirmed that the water was coming from Upper Fire Lake. On February 14, 2010, a water sample was taken from a hose bib and an inspection was made of a shed located immediately on the edge of the lake that houses a pump with a perforated pipe extending out into the lake. Water is pumped up to a storage tank in the house. No paperwork on the size of the storage tank is available. The storage tank is believed to be at least a 1,000 gallon tank. Enclosed is a copy of the SGS water sample results. An inspection of the septic system was made on the same date. The septic tank had 47 inches of water in it with an after tank clean-out and what appeared to be a line possibly going out to a crib. A Sanitary Pumpers sticker was on the tank clean-out so they were contacted. They stated that they have been pumping the tank since 1978, the most recent pump in August of 2008. They verified that it is a 1,000 gallon tank and indicated they have never had to do any repair work on the line from the house to the tank. They did not know the type of leachfield and they have never had any reason to pump the clean-out on the assumed crib. The clean-out on the assumed crib was also inspected and the pole could only be extended approximately four feet. There was no water, but upon inspection with a flashlight it appeared to have an ice formation at the bottom of the pipe. If it is a crib, the pole should have gone down much deeper. Because the house has been unoccupied since Virginia Ryan passed away in October of 2009, we attempted to pre-soak the leachfield with a 1500 gallon gray water drop by JRs Pumping on February 17, 2010. The water was put in the after tank clean-out by gravity feed over a period of forty-five minutes. The water did not back up into the tank or into the floor drain in the basement of the house. Water rose to a depth of eight inches in the crib clean-out pipe. One hour later the water had dropped to three inches. We feel that it is not a health hazard because of the amount of water that was absorbed (probably over the top of the crib) and no water backed up into the house. Regarding the asterisks on the Certificate of On-site Systems Approval Checklist, the single asterisks refers to being unable to answer the question because it is an undocumented system. The double asterisk refers to the foundation clean-out, which is located in the basement bathroom. Enclosed are bids from Flintstone Enterprises d/b/a JRs Septic Pumping, Dean Construction & Development, and Douglas T Kenley, P.E. for MOA permits, perk test, design, as-built, and documenting the system. A married couple with no children had occupied the two-bedroom house. The husband died approximately seven years ago and Mrs. Ryan continued living alone. There is a good chance the crib may be okay once the ice issue is resolved in the spring when the ground thaws. Wells Fargo Trust agreed to have Mark from MW Sewer & Drain try to thaw the ice in the crib clean-out pipe for an amount not to exceed $1,000. Mark estimated it would take up to four hours at a total cost of $800. After attempting to thaw the ice for two hours, he came to the conclusion that the clean-out pipe had been frost heaved and was separated from the pipe going farther down in the crib or that a rock possibly could have fallen into the pipe.
