TO: FROM: SUBJECT: MEMORANDUM Cliff Judkins Director John Lee (~Fb~/'' Senior Env'~ronmental Specialist May 15, 1972 Daily News Article, "Resident Pumping Sewage Water To Prove a Point." Mrs. Reinders, the center of focus in the subject article, was cited to court by this Department as the result of a complaint filed by a neiqhbor, Robert Pierson, and after a warning citation had been issued by this Department. The fact that she had to be reported indicates to me that she was tryin~ to get away with what she was doing rather than committing the offense as a sort of protest. It would seem she would have notified this office and then have done the pumping if she was truly protesting. 'She indicates that she bought the duplex already built, financed by the FHA. On January 20, 1971, FHA Form 2573 was signed by this Department approving the sewer and water systems. The sewer system had been inspected by us on November 4, 1970 and consisted of a 1500 gallon septic tank and 168 feet of 3 foot wide drainfield based on a soil test figure of 140 square feet per bedroom. There was no indication of water in the drainfield at the time of the inspection. It has been reported that the bottoms of the septic tanks were perforated by Joe Williams but we have no record of this and this has no bearing on the problem. She says she complained to the Borough a year ago but we have no record of this or what the nature of her complaints were. This area is now in a service district which includes drainage which indicates that the Borough does plan to help but since this district was formed during the winter possible drainage problems cannot be cared for overnight. As to complaints to the FHA and to the developer bringing no results I can only say, what were the complaints? If the problems were relative to drainage what were they expected to do? C.P. Judkins Hay 15, 1972 Page 2 A statement is made in which it is said DEQ admitted that Mrs. Reinders had a problem and noted that the septic tanks had been improperly installed. This is not true! Our records indicate the sewer systems were properly installed. What we are tryin~ to get hold of the developer for is relative to the water supply and for this Joe Williams has been sent notice. We do admit that Mrs. Reinders-does have a problem and it is being caused by a hiqh water table and a poor drainage layout in this particular area. The Borough is serving their function by including this area in a roads and drainage district,"how- ever, and we cannot condone anyone pumping their sewer onto the surface of the ground even thouqh it is mixed with run off water.
