RE: SEPTIC TANK UPGRADE PERMIT
LEGAL: FISCHER BLK 3 LT 1C
The owner has requested that we obtain a septic permit to upgrade the existing aged steel septic
tank on the above referenced lot. We propose to install a 1000-gallon HDPE tank per the
attached design to serve the existing 3 -bedroom residence. We would recommend a 1500-gallon
HDPE tank be installed for current functionality and future consideration or flexibility. No
groundwater was noted in the MOA on-site file, but if groundwater is encountered during
installation an epoxy coated steel septic tank may be required. The lot and area are served by
private wells and any encroaching wells, easements, … must be staked prior to construction.
After install, the as-built survey is to show the septic field pipes that were recently installed by
Northern Excavation and appropriate action taken as needed. Also, there are 2 wells slightly off
property. One will need to be decommissioned and the other must have an easement if not
already created, which will be submitted. This well, will also have the conduit buried which is on
the ground and new sanitary seal is to be installed.
The design will not impact any of the neighboring properties. Please contact us if you have any

A water sample revealed a nitrate concentration of 5.45 milligrams per liter (mg/Q.
The Environmental Protection Agency (EPA) has established a maximum
contaminant level (MCL) of 10.0 mg/L for public drinking water systems. While
private wells are not subject to this regulation, EPA standards are based on existing
health information and can therefore be used to gauge the relative quality of water
from private wells. Since nitrates are known to slowly increase, we recommend
you monitor the water quality. Please see the attached "Nitrate Fact Sheet" for
important information regarding nitrate.
This advisory must be attached to all copies of the subject Certificate of On -Site
Systems Approval.
Nitrate Fact Sheet
From Northern Testing Laboratories, Inc.
Nitrate is a negatively charged compound of nitrogen and oxygen, which is very soluble in water. Nitrate
is not readily filtered or otherwise removed in the soil and can pass rapidly into ground water wells.
SOURCE: Nitrate is a major component of fertilizer and wastewater. Often the nitrate is in the form of
ammonia or protein first, which through contact with oxygen and certain bacteria, converts to the
oxidized form known as nitrate. Sources of nitrate from wastewater include urea, ammonia cleaners,
food solids, and bacterial cells. It may also result from the breakdown of organic matter buried in the soil.
TOXICITY: Nitrate is generally not toxic to adults or children over the age of two or three years, but is
associated with a potentially fatal infant disease called methemoglobinemia. In the digestive system of
young children, nitrate converts to nitrite, which can pass through the intestinal wall into the blood
stream. There it combines with the hemoglobin and interferes with the ability of the blood to carry
oxygen. For this reason, methemoglobinemia is referred to as "blue baby" disease. The EPA limits the
concentration of nitrate in public drinking water supplies to 10 mg/L. The standard has been lowered
from a previous level of 45 mg/L set by the US Public Health Service and the World Health Organization.
TREATMENT: due to its solubility in water and negative ionic charge, filtration and other common home
water treatment systems such as softening or iron filtration does not readily remove nitrate. The best
method for limiting nitrate in well water is source control. This can include avoiding overdosing of
fertilizer near the well and maintaining good separation distances between septic tank leach fields and
the well. A special anion exchange filter that contains a media with a strong affinity for negatively charged
ions in water, or by a reverse osmosis treatment system or distillation can remove nitrate.
TESTING: Nitrate analysis is usually done by one of the several "wet chemical' methods using a
spectrophotometer to read the final color endpoint. Specific ion electrodes also can be used to detect
the activity of nitrate in water. This laboratory uses several different wet chemical methods approved
under the public water supply laboratory certification program. They also have test kits available, which
the laboratory uses to perform an inexpensive "screening test", and with which the homeowner can
monitor the change in nitrate levels from their well. They recommend comparing the test kit results
against a certified analysis from the lab occasionally to verify the accuracy of the kit. We recommend
using a specially prepared bottle that has been rinsed in hydrochloric acid for collecting samples.

NOW, TIIEREFORE, in consideration of the mutual covenants and conditions contained
herein, and for other good and valuable consideration, the receipt, value and sufficiency of
which is hereby acknowledged, the Parties hereby covenant and agree as follows:
AMENDMENT
Paragraph 1. Use and Maintenance of the Agreement is hereby amended and restated in its
entirety:
1. Use and Maintenance. Brown and their successors in interest, heirs and assigns, shall be solely
responsible for the maintenance of the wells and their necessary piunps, casing, and pipes located
at the well sites, for the appurtenances of the wells which run from the wells to Lot 1 C, and for the
absorption and/or drain fields of each of the wells. Even grants to Brown an access easement for
the purpose of replacing, repairing and maintaining said appurtenances and absorption and/or
drain fields. During the existence of this Agreement, Even shall not utilize the wells and/or the
area around the wells in any manner which will prevent Brown from having full, free and
uninterrupted use of said water wells. Nothing herein contained shall be construed to imply any
warranty by Even as to the condition or status of the water wells and/or the wells' ability to
continue to furnish water, or liability for any damages in the event the welts cease to function.
All other terms of the Agreement are unchanged and of full force and effect.

WHEREAS, the Parties desire to enter into a written agreement for the use and maintenance of
said wells and all appurtenances thereto, as between the Parties;
NOW, THEREFORE, in consideration of the mutual covenants and conditions contained

which is hereby acknowledged, the Parties hereby covenant and agree as follows:

2. Modification of Agreement. Any amendment to or modification of this Agreement shall be
binding only if evidenced in writing signed by each party or an authorized representative of each
party.
3. Term of Agreement. This Agreement shall automatically terminate in the event that the wells
cease to function and/or fail to meet minimum specifications for production of sufficient water
to accommodate Lot 1C. In the event that the wells cease to function and/or fail to meet
minimum specifications for production of sufficient water to accommodate Lot 1 C, Brown shall
drill a new well on Lot 1C. The benefits and burdens of this Agreement shall constitute a
covenant running with the properties herein described and shall be binding upon the heirs,
successors in title and assigns of the Parties hereto until termination.
4. Subject To. The rights granted under this Agreement are subject to all encumbrances, liens,
easements, conditions, covenants, reservations and restrictions of record or that can be ascertained
by an inspection or survey of the property as of the effective date of this Agreement.
5. Successors and/or Assigns. Each covenant and condition contained in this Agreement shall
inure to the benefit of and be binding on the Parties to this Agreement and their respective heirs,
executors, administrators, personal representatives, successors and assigns, except as otherwise
provided herein.
6. Time of Essence. Time is of the essence for each covenant and condition of this Agreement.

7. Governing Law. This Agreement shall be governed by and construed in accordance with the
laws of the State of Alaska.
S. Waiver, No waiver of any breach of any of the covenants and/or agreements herein contained
shall be construed as, or constitute, a waiver of any other breach or a waiver, acquiescence in
or consent to any further or succeeding breach of the same or any other covenant and/or
agreement.
9. Severability. If any term or provision of this Agreement shall, to any extent, be held invalid
or unenforceable, the remaining terms and provisions of this Agreement shall not be affected
thereby, but each remaining term and provision shall be valid and enforced to the fullest extent
permitted by law.

RE: WAIVER WELLS & SEPTIC OFF PROPERTY
LEGAL: FISCHER BLOCK 3, LOT 1C
The two existing wells & the excavated end of the absorption field is off property &
we respectfully request waiver of wells to property line of 10’ off property & 15’ of
septic absorption field off property per the attached recorded easement with exhibit
drawings & as-built survey.
These systems have been in operation for many decades since 1977 with no known
issues, there is no separation issues and we do not expect there to be any adverse
effect on the subject lot or adjacent lots be granting the requested waiver.
