It was discovered during the Health Authority Process that the house is served by a cistern ~vater source and that the upgraded septic system did not have an approved as- built. A well permit request was submitted to your department on 3/27/01 which you rejected due to the lack of an approved as-built on the septic system. I have reviewed the record concerning this properties septic system and discovered that an as-built drawing was submitted to your department in December of 1990. It was rejected due to the cistern nearest the septic system not being abandoned. No other deficiencies were noted. The original as-built submitted to your department was not discovered during a document search. We contacted the Engineer of Record and obtained a copy of the as-built drawing submitted in December of 1990. He resigned the document to authenticate it. It is attached. I am resubmitting the well permit request. The existing cisterns and surface water collection systems will be abandoned and filled. Following several on-site visits with both the excavator and the engineer, this office issued an On-site Sewer & Septic Tank Permit (#SW900274 dated 9-5-90) and related waiver (WR900034). The terms and conditions attendant to the permit and waiver stated that "Cistern #2 will be abandoned." Cistern #2 is located in the parking area at the front of the residence approximately 30 feet from the new septic system. On December 28, 1990, this office received an as-built drawing of the new septic system, from Kniefel Engineering with no mention of the abandonment of Cistern #2. We contacted Mr. Kniefel and to his knowledge Cistern #2 is still in use. Your new (upgraded) septic system will not be in compliance with municipal regulations until the terms of the permit and waiver are satisfied, therefore, this Notice of Violation is being issued. You should initiate action immediately to have Cistern #3 abandoned properly under the supervision of Kniefel Engineering in order for the septic system to be approved by this department. Existing septic tank has collapsed and currently presents a health hazard. Original crib installed approximately 17 years ago and trench upgrade installed in 1983. Both installed without permits and both installed to a depth of approximately 10 Ft. Test hole adjacent to trench confirmed 10 Ft. depth to bedrock - existing systems do not have minimum 6 Ft. vertical separation to bedrock. Existing potable water supply consists of two surface water cisterns At least one of which is less than 100 Ft. from the existing wastewater disposal system. The following special provisions are incorporated into the subject permit: 1. This permit is for the replacement of the tank only. The permit will be amended to include replacement of the drainfield. 2. By September 15, 1990 a design for upgrading the drainfield will be submitted to DHHS. 3. Engineer will document the location and use of all footing drains, cistern overflow piping and any gray water piping. 4 o Should the proposed new drainfield encroach on the 100 Ft. protective well radius of cistern No. 1, an application for waiver will be submitted with the drainfield design. 5 o The property owners acknowledge and understand that this wastewater disposal permit does not constitute DHHS approval of any of the existing surface/shallow groundwater collection systems as potable water sources. 6. The waiver requests are as follows: 1, Septic System to Well ]Distance -- The new system will be 30' to Cistern ~2 and 94' to Cistern 41. One of the wells is a shallow cistern (¢2) whose bottom elevation is five feet (5') above the absorption field bottom of pipe. The other wel 1 is also a shallow cistern (.~1) whose bottom elevation is nine feet (9') above the absorption field bottom of pipe. The wells in the immediate area average 400' - 500' depths with very low flows. The owner installed the cisterns as the only method to provide a proper quantity of water for his household, 2, Septic System to Cutbank Setback - The new field ls within ten feet (10') of the cutbank from Vasikof Drive. The bank was inspected for ot~tcrops of bedrock or v~sible signs of leaching from the existing trench, None were noted during the review. Due to the contour of the lot, this is the only area for placement of the bed. The letter dated September 6., 3.990, from Kniefel Engineering to Acreage Systems, Inc. is included as part of this submittal. Also attached to this letter is the desi(.[n for 'the above system. As noted in conversations with Mr. Sanderson and th~ owner. Ms. Konrad, this system has numerous problems with both the septic system and the water supply system. Based upon conversations with you and the MOA DHHS (Mr. John Smith, On-Site Program Manager), following is my understanding of what is being done and its significance: 1. The original request was made to obtain approval for the septic tank which had caused back up into the house. Inspection of the tank showed it had deteriorated, the line to the field was severely plugged and it needed replacement. We completed the necessary paperwork, submitted it to the MOA and received approval for the replacement of the tank with a new 2 compartment 1,250 gal. tank. 2. The current water supply system consists of two shallow cisterns located as shown on the attached permit drawing. The lower cistern near the house was being used for present household water needs. The upper cistern ~s connected to the house supply but the pump operating it was not activated. Field sampling of the upper cistern on September 5, 1990 by MOA personnel (Mr. Robinson) showed a Nitrate level approaching the 15 -- 25 mg/1 area, well beyond the allowable 10 mg/1 standard, We have taken samples of the lower cistern for total coliform and nitrate analysis aad those results are expected by September 110 1990. 3. A review of the. 'MOA records by ourselves and the MOA personnel show no ~ecdrds of the current water or septic systems or any permitted additions or changes. Based upon conversations with Ms. Konrad, it appears %be original septic system consisted of the septic tank connected to the crib, with the trench system added to the crib about 1983. 10741Vosikof Drive September 6, 1990 page two The attached permit drawing is an approximate as-built of the above items. The current septic tank';is within 40 feet of the lower cistern and 94+ feet from the upper cistern. The absorption trench is within 10 feet from the top of a cut bank with a slope approaching the 25% maximum differential level. A field inspection of the cutbank showed no signs of seepage or exposed bedrock, 4, During the review process for the tan]< work, the MOA DH}IS On-Site personnel (John Smith and Robert Robinson) were asked to visit the site to review the concerns with several of the features of the lot, The septic tank was pumped during their visit, at which time the tan]< fully collapsed and was inoperable. Mr, Smith said the MOA would approve the immediate installation of the new tank in order to prevent further contamination of the area. 5. A test hole was dug during the time of the MOA visit to determine any restrictions on the use of the current system or the need for a new system. The soils log attached shows the materials found during this test. Bedrock was noted at 9' depth with. the rest of the material above that level of sand or sa~d and gravel composition. The hole a~so revealed the presence of three underground pipes (11 1/2" black plastic, 2" black plastic, and 4" perforated white plastic). The 2" and the 4" pipes had water flow in them (estimated at 3-4 gpm for the 2" a.~d 1-2 gpm for the 4"), From the orientation of the ~ip~s, it. appeared the two black pla~%ic lines served as overflows for the lower cistern and t~e 4" served as footing drain for the house foundati~n~f 6. A field review by ourselves and Mr. Robinson indicated the lot had little if any area to support an additional site for a new system. It was determined the best method to handle the wastewater would be the construction of a new bed system which would encroach to a minor exte~t on the existing trench system. The system design was to meet the six foot separation from the bedrock found in the test hole. The system will requi~e a request for a waiver for the cutbank setback di~ta!%ce (less than 50' setback] and a waiver for the septic to water supply distance (les~,~han 100 feet from the lower cistern). 7. The attached design shows the new bed system placement which obtains the necessary 100' separation from the upper c~stern. In addition, the existing crib will need to be excavated below the area o~ the new bed, sand/gravel material placed, and the remainder of the crib abandoned after filling with available on-site backfill. 10741Vosikof Drive September 6, 1990 page three This design requires the waiver for the cutbank setback distance but wi 11 not require a waiver for. the 100' se~aration from wat.e~' ~our~:e if tl%e house uses only the upper cistern. We need to know as soon as possible if~t. he, owner wants to only use the upper level or if we need a waiver for the distance. The MOA has indicate'~'they would grant that waiver' if requested. " The water flow in the plastic lines we found will need to be intercepted/captured at the lower cistern area, and piped down the driveway area to the drainage ditch, The most important concern with this system repair is that the MOA DHHS people, the current owner, Acreage Systems, Inc, and Kniefel Engi]~eering all ~gre. e the work being completed will allow the continued use of this wastewater system fo]' the current owner only. All of the above mentioned persons or agencies have ~na3or concerns re~arding the water' supply system and i~s~?~elationship to this repair effort along with the noted., high nitrate concentration levels from adjacent areas. THIS WORK ONLY ADDRESSES A PORTION OF THE SERIOUS ~'ROBLEMS NOTED WITH THIS SYSTEM~ AND IN NO WAY IMPLIES, SUGGESTS OR GRANTS ANY FORM OF APPROVAL OF THE ENTIRE SYSTEM. We ¢:an't stress th~s condition enough to all parties concerned. We have spoke personally with Ms. Konrad and she is very aware and she agrees with this. As you can see, we have worked very closely with the MOA staff. the owner and yourselves to repair and obtain use of this system as shown on the attached design. Everyone involved to date has worked hard to provide the best solution possible in some very trying circumstances. We applaud this effort and will continue to complete this project to the clients and MOA satisfaction. John Lee and myself observed a large amount of water in the area above the pit, where the foundation was to be placed. The soil test taken at the pit by Turtle, noted no water present. John Lee requested and received a three page report from R & M Engineering which stated how the water could be removed from the area via a sump pit and drain. If properly installed Rooney stated, no ground water would be introduced into the seepage pit. Les Buchholz and myself checked subject pit and found one foot ot water in it. I contacted Rooney who stated; Schachle must have not sealed the ditch around the pipe leading to the seepage pit and septic tank with impervious material. I asked Schachle to pump the septic tank and seepage pit so I could check it for seepage a few days later. Alaska Pumping pumped tank and pit. Chuck Sellers and I checked the pit and observed seven inches of water in pit. The water must be following the pipe to the pit, rather than ground water seeping directly into the pit. The pipe line shou)d be sealed tightly to prevent this. However, Konrad has recently landscaped the area and access to the pipe would not be easy. This brings to my mind the situation of Franz Konrad, a potential neighbor of mine. As you know, I filed a formal com- plaint last fall concerning the installation of his septic tank system. As you may know, Mr. Konrad is currently building a house on his lot in Kasilof Hills Subdivision. Concrete work was per- formed during this past week. As far as I know, he has not had approval from your office for his disposal system. You will remember that he had water flow- ing into his septic tank and seepage area. John Lee has photos of this condition. I'm concerned about his system in relation to my well and stream downhill from him. As John knows, I'm having my well water tested periodically and shall continue to do so. I would like to know what DEQ's position is on Mr. Konrad. I believe that he is proceeding with construction in order to cause a situation so it will become increasingly difficult for you to reject his site or to require a fail-safe alternate. I don't propose to become another Robert Drum, but I do intend to follow this up to whatever degree necessary.. Please let me know your course of action in this matter. A review o~ site conditions was made by Mr. James Rooney, Soil Engineer and Mr. Mike Schackle o~ Schackle Excavating on Thursday morning, October 5, 1972. Weather at the time o~ the inspection was overcast with intermittent light rain and an air temperature slightly above ~reezing. Also, a slight crust o~ ground ~:rost was noted within the cleared area. General site conditions observed during the inspection are indicated on the attached rough drawing. The sanitary facilities, including sewer line, septic tank and seepage pit ~or the proposed residence were designated to be at the approximate locations shown on the drawing. Ground water seepage within the house excavation area and around the perimeter was ~ound to typically drain to a sump pit which had been excavated immedi- ately adjacent to the proposed house sewerline connection. Drainage ~rom the sump pit was being achieved by means o~ gravity flow thru a three inch plastic pipe which extended f-rom the sump pit directly over the sanitary ~acilities out to the ~ront o~ the lot. Ground cover over the subdrain appeared to be less than three t~eet in many areas. ANCHORAGE FAIRBANKS JUNEAU October 10, 1972 Mr. John Lee Page 2 Subsurface soil conditions, as noted in the exposed house excavation,varied significantly from the back to the i!ront of the excavation. Along the back~ bedrock was exposed at relatively shallow depth and overburden materials consisted of approximately one to two feet of organic silt (top- soil) underlain by interbedded sandy silts and gravelly sands. Ground water seepage was most evident within the interbedded materials near the bed- rock interface. Near the center, the bedrock dipped steeply while the overburden increased in thickness. In this area a thin stratum of light brown silty gravel was observed below the organic silt surface layer. Nearly all oi= the area toward the t=ront of the site had been reworked or was still covered by organic silt. Since the sewer line trench and pit excavations had been completely backi=illed, it was not possible to verif7 subsurface soil conditions in this area. However, based on the test pit log and the cut face exposure adjacent to the driveway at the base of the slope, it appears that the interbedded granular materials (encountered below the organic silt) extend to the i=ront slope of the property. AI~ the test pit log did not indicate subsurface seepage at that time, s_o_nle limited g~und water seepage was noted at several locations within the cut i=ace. Due to the subsurface seepage conditions and the proximity of the col- lection sump pit and subdrain to the house sewer line, some potential for ground water intrusion into the sewer system appears to exist ii= any ground water seepage or subdrain pipe leakage should occur within the existing trench. With this present drainage configuration it is con- ceivable that ground water over~low from the sump pit could run along the trench and enter the sewer system at some point on the line or ulti- mately at the seepage pit. Under such conditions, it is possible that the sanitary facility could become overloaded and develop potential i=or polution. In order to avoid this likelihood, we suggest that collection of subsuri=ace drainage and drain pipe be relocated to the approximate position shown on the included drawing. This can be accomplished by directing all subsurface drainage to the proposed new sump pit location which would still allow drainage to the front of the property while minimizing the chances of any ground water infiltration into the sanitary system. Drainage from the base of the present sump pit to the base oi= the pro- posed new pit should be achieved by gravity flow. The pipe drain extend- ing from the sump pit should be placed at a minimum grade of 0.5 per- cent and at a depth which will give suitable protection against i=reezing. Caution would need to be used below any driveway sections to provide R&M ENGINEERING & GEOLOGICAL CONSULTANTS October 10, 1972 /V[r. John Lee Page 3 adequate cover and bedding as well as sul~t~icient insulation where greater tSrost penetration below a c/eared driveway can be expected. In addition to the above, provisions should be made to seal ot~t~ the upper portion ot~ the existing trench to t~urther minimize potential seepage within the backfilled trench section. This can be achieved by compacting relatively impervious mater{al, such as the silty gravel,l~or a three t~oot trench length just below the capped sewer line. The above comments have been addressed to the apparent need to insure proper t~unctioning ot~ the installed sanitary system. We have not attempted to evaluate the adequacy ot~ the sanitary system itself, since we have not been involved in the preparation or installation the system. Also, we have not considered t~oundation bearing conditions tSor the house structure as this has been considered to be beyond the scope ot~ the intended review. It is hoped the above information will be otc assistance to you in deter- mining what action may need to be taken in order to insure that the sanitary system meets Borough requirements. Box 196650 Anchorage, AK 99519-6650 RE: Kasilof Hills Block 4, Lot 24A Waiver Request for Septic Tank and Drainfield to Surface Water To Whom It May Concern: A waiver is requested for a horizontal separation distance of 90 ft from the septic tank and the absorption field on the subject lot to surface water. The surface water is a very small stream (approximately 1 ft wide) to the north of the subject lot. The topography of the area prevents flow of potential surfaced septic effluent to the surface water. The septic system was installed in 1990 and was reported to be greater than 100 ft from any surface water. The horizontal separation distance between the septic tank and the surface water was measured on December 4, 2003 with a total station. The distance was determined to be 93.8 ft. The distance between the absorption field and the surface water was measured at 92.6 ft. If septic effluent were to surface from either the septic tank or the absorption field, the natural path of the flow would not be toward the surface water. It would flow downhill to the west, toward the road and would be readily visible from the road. The attached site plan shows measured ground elevations and the predicted flow path of potential surfaced septic effluent. There is a fiat area where the septic system is located, with a steep hill down to the road on the west. (A waiver was requested in 1990 for separation distance to the cutbank). There is another flat area for the driveway. The surface water is on the north side of the driveway, flowing downhill from the east. At point 4 on the site plan, the water goes underground. An inspection of the area west of the surface water was done with only approximately 3 inches of snow cover, and no further surface water was observed. There was also no water running in the ditch along the road. Thank you for consideration of this waiver request.
