Construction Requirements and Notes:
1. This permit has been issued based on the assumption that the information contained in the pals and supporting documentation is
correct. Any and all omissions are the responsibility of the permitee. Any change in the scope of work requires a revised or new
permit and Traffic Control Plan (TCP).
2. Contractors' acceptance of this permit constitutes acceptance of the Municipality's bonding requirements, and is contractor
representation that contractor has and will comply with those requirements. Unless a specific bond is applied to this permit by written
reference, the contractor's performance bond on file with Development Services, Right of Way Enforcement, shall suffice as the
required bond.
3. The Permittee shall post a copy of the permit in a conspicuous location at the place to which the permit pertains before any work
there is started and shall remove the permit only after the Right of Way Inspector has accepted the work as being in compliance with
the permit.
4. The Municipality has the right to inspect and/or reject materials and workmanship not to Municipal standards, to stop work until
corrections are made, or to require removal of the facility and to charge time, material and equipment to the Permitee to correct the
facility if they fail to comply with the conditions of the permit.
5. Permitee is responsible for locating and protecting all utilities and survey markers in the work vicinity. For utility locates, call
Alaska Digline at "811" or (907) 278-3121.
6. The contractor shall erect signs, barricades and detours in accordance with the U.S. Department of Transportation "Manual on
Uniform Traffic Control Devices", Part VI — Traffic Controls for Street and Highway Construction, Maintenance, Utility and Emergency
Operations. Failure to do so may result in fines being assessed under Title 14 for work not in conformance with a permit.
7. Changes in the approved road closures or scope of work resulting from emergency circumstances may be allowed during
construction. It shall be the responsibility of the contractor to notify the Permit Office, 343-8206, and/or obtain an approved Traffic
Control Plan (TCP). It shall be the contractor's responsibility to notify the following agencies: Fire Dispatch 267-4950, Police
Dispatch 786-8900, Alaska State Troopers Dispatch 269-5511, People Mover 343-8253 and School Bus 742-1207 or 742-1209.
8. All construction shall be in accordance with the current edition Municipality of Anchorage Standard Specifications (MASS),
applicable municipal codes and regulations and the approved drawings and special provisions of this permit.
9. As a condition of this permit all excavations will conform to the standards outlined in OSHA 29CFR, 1926 Subpart P.
10. The Right of Way shall be restored to the same, or better condition, than it was prior to the contractors' work being performed.
The work shall be performed diligently and continuously, until completed to the satisfaction of the Municipal Right of Way Inspector.
11. All underground installations within a public place shall be buried at a minimum depth of forty-two inches (42") below the final
surface elevation, i.e. bottom of drainage ditches, road shoulder or finished grade.
12. Permanent paving, recycled asphalt pavement (RAP), chip seal, sidewalks and curb and gutter must be replaced within 7 working
days after underground work is completed.
13. Winter Condition Requirements (applicable to all Right of Way Permits).
a. No trenching and or excavation is allowed within the road prism except for emergency repair of existing utility facilities or by
approval of the Director of Development Services.
b. Crossing of the road prism shall be by boring technology.
c. No frozen material shall be placed in the excavation as fill and/or backfill. A source of non -frozen fill and/or back fill
material shall be available.
d. All frozen ground within the Right of Way shall be thawed prior to excavation.

Chugach does not object to the existing septic system within the road right of way of Natrona
Avenue on the south side of Lot 16, Block 3, Elmore Subdivision Addition #l, as shown on the as -
built survey performed by Fixed Height, LLC, dated January 17, 2020. Please note that Chugach has
overhead electric facilities within the western 10' of the road right of way.
It must be your understanding that the installation within the road right-of-way is at your risk.
This non -objection is given without prejudice to Chugach's full enjoyment of any and all rights it
may have in and to such road right-of-way area.
All work within the road right-of-way must be in accordance with the enclosed Electrical Facilitj,
Clearance Reilitirentenn. Also enclosed for your use and information is the 811 Alaska Dig Line
utility locate call center card, and Chugach's What is an Easement? handout.

Natrona Avenue sixty feet (60 FT) wide road right-of-way adjacent to the South property line of
Lot 16, Block 3, Elmore Subdivision Addition No. 1, according to Plat No. P -635A, Records of
the Anchorage Recording District, Third Judicial District, State of Alaska.
Acceptance and use of this letter of non -objection by yourself, your heirs, your assigns, or your
successors, will constitute agreement to the following stipulations:
• Landowner/Contractor working near ENSTAR gas facilities shall contact the Alaska
Digline, Inc., (907) 278-3121 or 811 for line locating two (2) business days prior to any
related excavation. This service is free of charge.
• ENSTAR will be held harmless, now and forever for any damages or injury to any person
or property as a result of this encroachment.
® Any ENSTAR facility damaged or destroyed, as a result of this encroachment will be
repaired at no cost to ENSTAR.
• Any costs incurred by ENTSTAR for special construction necessitated by this

Alaska Communications has no objections to the proposed septic system encroaching into the 10' Utility Easement
located along the northern boundary of lot 16, block 3 Elmore #1 Subdivision, otherwise known as 4360 Shoshoni
Avenue Anchorage, Alaska, as depicted on the drawings provided by Gamess Engineering Group.
Alaska Communications currently utilizes this easement and has no objections to the encroachment. Alaska
Communications hereby issues this letter with stipulations to allow the encroachments of the above mentioned into the
easement.

Ref: Proposed Septic Tank Upgrade for Elmore #1; Block 3, Lot 16
To whom it may concern:
The subject lot is served by a private well and septic system. Per MOA records, the existing septic tank is
36 years old. Per MOA memorandum, a septic tank of this age should be physically inspected and/or
replaced prior to COSA approval. Based upon this fact, we are proposing to replace the septic tank. We
are proposing to decommission the existing septic tank per UPC and install a new 1500 -gallon HDPE
Greer tank rated for 10' burial. See attached design drawings for tank location and other MOA
requirements. In addition, the existing drainfield encroaches upon the creek to the south. We are
requesting that your department issue a variance from tank and drainfield to creek of 60 feet and
drainfield to lot line down to 0 feet. We are also requesting that your department issue a variance from the
new septic tank to the well down to 90 feet. Justifications for granting this waiver is as follows:
• The encroachment has existing for approximately 36 years.
• The area between the tank and drainfield to the creek is vegetated.
• The septic tank will have a high-level alarm float installed. If the drainfield were to become
surcharged, the tank would also become surcharged, triggering the alarm and notifying the
homeowner. In theory, effluent would not overflow form the drainfield as the alarm would sound
prior to effluent daylighting.
• The home is located between the well and the drainfield. If effluent were to overflow, it would not
travel directly towards the well head.
• Water samples were pulled. The nitrate results were 3.78 mg/L. The existing tank is steel and
encroaches on the well. The proposed tank will be HDPE. In short, the proposed tank will be an
improvement on the existing tank.
We are requesting letter of non -objection for the drainfield be submitted with the record drawings and/or
COSA.
We are unaware of any adverse impacts this installation would have on adjacent wells or septic systems.

The gravel depth is the minimum depth of gravel between the outfall pipe and
the bottom of the excavation(in feet).

installation inspections of any wells adjacent to this property and the number

Backfilling of any system without final inspection .and approval by this departmen
will be subject to prosecution.
Minimum distance between a well and any on-site sewage disposal system is 100 fez
for a private well or 150 to 200 feet from a public well depending upon the type
of public well. Minimum distance from a private well to a private sewer line
is 25 feet and to a community sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days of the well completion.
Other requirements may apply. Specifications and construction diagrams are
available to insure proper installation.

I apologize for the delay in responding to your letters of
inquiry about the stats= of your Gewsr system. This was due in
part to ny attempt to gather all pertinent information on the
case prior to response. Since you asked us not to telephone you

Enclosed you will find a copy of a letter addressing your
~ituation (dated February 29, 19S4). As you can gee there
appears to be confusion about a waiver. Our records indicate no
waiver was actually applied for or given. In fact, ~c would
violate State law to give any distance waiver from 100 feet bet-
ween the septic tank and the stream. According to ~ruce Erickson
with the State Department of Environmental Conservation, he can-
not legally waive that distance requirement under any circumstan-

Somehow, a month's wait for a letter does not suggest that the
deparmtent is a responsive agency of our city government. We
hope you agree and would ask that they reply to our letters.

Nevertheless, I made an appointment to meet with Mr. Lynn on

'him the papers worked up by Mr.-tlawthorne. Mr. Lynn made no
mention of a problem with the postion of the house or septic tank
(as planned) relative to the creek; I made specific mention of
the fact that the house had been built before codes in the area

DeArmoun Excavating installed the new tank (larger than
required) and also had the soil in the trenches inspected. The
soil was considerably better than indicated in Mr. Hawthorne's
test, and the trench length was recalculated. The trench was
laid to avoid some large trees, and there is more than adequate
slope for good drainage from the house to the tank to the
trench. Mr. Caputo, of DeArmoun Excavating, made arrangements
for the inspections, and the system was closed November 11. At
no time did anyone indicate to us that the system was not
entirely acceptable. We have paid Mr. Caputo; you will note that
his bill (copy enclosed) notes that the upgraded system was
"Inspected and approved by Ak Envir. Control Services".
There is evidently some lack of con~unication or
misunderstanding here. Would you be kind enough to review the
documents enclosed, as well as your records of this permit, in
the next few days? Representatives of your office are welcome
visit the site. The outfall of the house plumbing is on the
southwest corner of the house~ the snow may be too deep to see
the stand pipes. Mr. Caputo or Mr. Hawthorne can show you the
system should we not be available.

Dear Lee:
A request was made by Mr. Neil Hawthorne last week to have this
Department address a setback distance waiver between the septic
tank and Rabbit Creek on Lot 16, Block 3, Elmore Subdivision.
Referencing a copy of your company's as yet unapproved inspec-
tion report/as-built, the current separation distance is 72 feet
rather than the minimum 100 foot distance.
During discussions with Mr. Jim Green of your company, it was
discovered that, while serving as the onsite inspector, Mr. Green
had in fact, requested DeArmoun Excavators to cease all
excavation/installation activity upon his discovering the 72 foot
setback distance. Apparently,' DeArmoun Excavators refused to
cease all activity until resolution of the problem, stating to
the effect that a waiver was already available. The septic tank
was subsequedtly installed and it is assumed that backfilling
occurred shortly thereafter. Although no onsite visit was made
by this Department to date, both Mr. Hawthorne and Mr. Green have
stated that ground slope between the septic tank and Rabbit Creek
is significant and toward Rabbit Creek.
Our Department has no record of having issued any waiver prior
to this incident. Based on the above information and circumstan-
ces, this Department is hereby refusing to issue a waiver from
the normal 100 foot setback criteria, since we have absolutely no
basis to date for allowing such a condition to exist. It is par-
ticularly disturbing that the excavating company refused to
acknowledge the wishes of the onsite inspector, who must assume
responsibility for the excavator's actions when onsite.

The installation has been completed at Shoshoni. The tank was perminantly equipped with a Anchorage tank float tree
and high water alarm kit. Additionally, we perminantly installed an indoor alarm inside the residence with a remote
monitoring device. This spring we will simply quickly trench between the tank and house to connect a low voltage wire
in conduit between the two together. ARM accepts responsibility to ensure this is completed in a timely manor.

Jeff, Michelle, the wiring on the above well site would be the same as in a crawl space so should be passing with
MOA. The well cap has been sealed so no foreign material can enter. We found a leak in the water system which has
been causing extreme rusting of both the exterior of the well casing and pressure tank. This has been fixed. We also
found there was very little air in the pressure tank. We added air to 38 psi and the system is working fine at this
point. The diaphragm in the tank appears to be damaged. The tank will need to be replaced in the near future or keep
adding air occasionally to prevent the pump from cycling to much. The well casing is below grade, however it is located
within the house in an off space from the lower level. There is a sump pump 3 feet from the well which would negate
water entering or pooling around the well. If you have questions, please let me know.
