Septic System Upgrade
To Whom It May Concern:
Attached please find the application and supporting documentation for upgrading the
septic system for the referenced 3 bedroom house. Waivers are requested under
separate cover. The existing crib, installed in 1974, has failed, and is proposed to be
abandoned. It is proposed to install an advanced wastewater treatment system to serve
this property.
The proposed design is based upon Test Hole #1, dug April 22, 2003. The absorption
field is outside of the 30 ft radius of TH#1, due to a requested change of location of the
drainfield. Thus, a confirmation test hole (#2) will be dug within 30 ft of the proposed
drainfield during the installation. Test Hole #1 was dug to a total depth of 12.25 ft. The
soils encountered were fill, organics, sand, and gravel. The high groundwater level was
at 8.84 ft below ground surface, or 6.34 ft below the top of the organics. A soils log is
attached. A percolation test was run from 5 to 5.5 ft, in the sand and gravel layer. The
absorption rate was less than one minute / inch. A sand filter is proposed below the
sewer rock to slow the absorption rate. The maximum proposed depth of the sewer
rock is 4.8 ft or 2.3 ft below the top of organics.

This tank and drainfield are proposed to be installed within the 10 ft utility easement
along the south property line, as this is the only remaining space on the lot. Letters of
non -objection have been obtained from the utilities. Responses are attached.
Waivers are requested for the following:
• Absorption Field to Surface Water: 80ft
• Septic Tank and Absorption Field to Lot Line: 1 ft
The waiver justification is under separate cover.
I am not aware of any adverse effect that this upgrade would have on any adjacent
properties' water and wastewater treatment needs.

Encroachment. Permittee has proposed to construct the following improvement on or within the
real property subject to said Easement:

A septic system that encroaches approximately Seven Feet (7') into the
Easement for a distance of approximately Thirty-three Feet (33'),
(herein "EncroachmenV').
3. Permit. Chugach hereby authorizes Permittee to continue the existence of the
Encroachment in its location subject to the covenants set forth in this permit.
4. Indemnification. Permittee shall indemnify and hold Chugach harmless from any
claims for personal injury, property damage or other loss arising in any way from the continuation of
the encroachment.
5. No Expansion or Increase. Permittee shall not in any way expand or increase the
extent to which the Encroachment occupies any of the real property encumbered by the Easement
without the prior written consent of Chugach. Chugach has no obligation to provide such consent. If
it is necessary to remove the shed from the Easement to work on the electric facilities, the shed shall
not be replaced within the Easement.
6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the
Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in tJae real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Pennittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine of adverse possession. This permit
creates no interest in the real property subject to the easement.
7. Modification of Util�y Facilities. If the electric utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment is not made within thirty (30) days ofwritten demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
8. Covenants Running with the Land. The obligations ofthe Permittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the Permittee's
interest in the land subject to the Easement and shall benefit the Easement.
9. Termination. Chugach may terminate this permit after the giving of thirty (30) days
written notice of such termination if:
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.

b. The Encroachment is damaged by any means to an extent of more than thirty percent
(30%) of its rcplacerneiit cost at the time of destruction.
C. Permitte; fails to make the payment described in paragraph 7, above.
10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years
from the date hereof.
11. Entire Agreement. This written permit constitutes the entire agreement between the
parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous
agreements, oral or written, between the parties. No modifications, amendments, deletions, additions
or alterations of the permit shall be effective unless in writing and signed by all of the parties hereto.

This letter of non -objection in no way precludes GCI Cable from full use and enjoyment
of any rights it may have within any portion of the utility easement and or the right-of-

The Anchorage Water & Wastewater Utility received your request on April 9, 2003, for a
letter addressing AWWU's position regarding the existing septic system that encroaches
into the utility easement located on the south 10' of the referenced lot. A lot survey
certification drawing was submitted with the request.
AWWU water mains are not available to the referenced lot.
Wastewater facilities are to be in accordance with the Hillside Wastewater
Management Plan (HWMP).
AWWU is not using the utility easement and has no objection to the encroachment.

consideration of the mutual covenants contained herein, the parties to this Memorandum of
Understanding agree as follows:
1. ADVANCED WASTEWATER TREATMENT SYSTEMS. Municipality grants
permission to Owner to utilize and operate an Advanced Wastewater Treatment System
(AWWTS), described as AdVan7ix AND located at 12'750 & Sff4�:e

2. Derinitions.
A. Alteration. Any change to the design or function of an AWWTS that
includes the installation or removal of any parts, components or pieces
not included in the original construction permit and design. Prior to
performing any alterations to an AWWTS the owner must obtain a
Wastewater Disposal System Construction Permit from the Municipality
pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65
B. ' Certiflcate of On -Site Systems Approval. An approval by the
Municipality of existing water and wastewater disposal systems given at
the time of property sale and title transfer in accordance with AMC

15.65. These approvals certify that the systems are adequate for the
homes that they support and meet the codes that were in place at the time
of system construction.
C. Damage. Any man-made or natural change in a system that would

inhibit the system from performing as designed.
D. Maintenance and Repair. The scheduled and as needed replacement of
existing parts, components and pieces of an AWWTS that were included
in the original design which would allow the AWWTS to continue to
perform as designed.
E. Permit (Construction). An On -Site Wastewater Disposal System
Construction Permit as defined by AMC 15.65.
F. Permit (Operating). An Advanced Wastewater Treatment System
Operating Permit. An annual permit, issued by the Municipality, that
allows the Owner to operate an AWWTS, upon meeting all requirements
of this agreement, the conditions of the Operating Permit, the
requirements of the On -Site Wastewater System Construction Permit
and all relevant provisions of AMC 15.65.
3. Fee. Owner shall pay to Municipality an annual fee of

Municipality of installed system.

4. Term. The term of this Memorandum of Understanding shall be for the life of the
ANVWTS. The term begins on the date of approval by the Municipality of the installed system
and shall continue while the AWWTS system is in use or operational or until the property is
sold or title is transferred by owner and a new certificate of on site approval is issued to the
new owner or transferee of the property.
5. Alterations, Installation and Removal of Additional Equipment. Owner agrees not
to make any alterations, removal of parts or additions to the AYAWS without a Construction
'Permit from the Municipality.
. 6. Maintenance and Repairs.
A. Throughout the term of this Memorandum of Understanding, the Owner shall
maintain AWWTS in good repair. In addition, it shall be the responsibility of the Owner
during the term of this Memorandum of Understanding, and any extensions or renewals
thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3)
adjustment(s), (4) replacement costs, and (5) inspection costs. Further, owner agrees to
comply with all applicable ordinances, laws, regulations, rules and orders for the AWWTS-
B. Owner agrees to provide the Municipality a written schedule of routine
maintenance and repairs which have been performed on the system pursuant to the terms and
conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be
submitted to the Municipality annually upon the renewal of the permit. The schedule of
maintenance and repair contained in the Owner's AWWTS Operating Permit is:

C. Owner acknowledges that the fine schedule for failing to maintain and repair an
AWVVTS are codified in AMC 14.60.
D. Owner agrees that only maintenance, repair personnel certified by the
Municipality will inspect and make any necessary maintenance, repairs or permitted
alterations to the systems.
E. Owner agrees to grant the Municipality reasonable access to test and inspect the
AWWTS upon 24 hours written notice.
F. Owner agrees that any sale or transfer of title of the property will not occur
without a new Certificate of On -Site Systems Approval.
G. Owner agrees that the relevant provisions of the standard specification
guidebook for AWWTS is the governing professional guidelines for the construction,
maintenance and repair of the Owner's AWWTS.
7. Nonwaiver. The failure of either party at any time to enforce a provision of this
Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in
any way affect the validity of this Memorandum of Understanding or any part hereof, or the
right of such party thereafter to enforce each and every provision hereof.
8. Amendment.
A. This Memorandum of Understanding shall only be amended, modified or
changed by a writing, executed by authorized representatives of the parties, with the same
formality as this Memorandum of Understanding was executed and such writing shall be
attached to this Memorandum of Understanding as an amendment.

B. For the purposes of any amendment modification or change to the terms and
conditions of this contract, the only authorized representatives of the parties are:

C. Any attempt to amend, modify, or change this contract by either an
unauthorized representative or unauthorized means shall be void.
9. Jurisdiction: Choice of Law. Any civil action arising from this Memorandum of
Understanding shall be brought in the Superior Court for the Third Judicial District of the
State of Alaska at Anchorage. The laws of the State of Alaska shall govern the rights and
obligations of the parties under this Memorandum of Understanding.
10. Severability Any provisions of this Memorandum of Understanding decreed invalid
by a court of competent jurisdiction shall not invalidate the remaining provisions of the
Memorandum of Understanding.

On behalf of Carol McCarty, I respectfully request waivers for the following for installation of a
septic system upgrade on Elmore #2, Blk 12, Lot 613:
Absorption Field to Surface Water: 80 ft
Septic Tank and Absorption Field to Lot Line: I ft
The existing septic system on the subject lot is currently in failure, and is in need of an upgrade.
It consists of a 1000 gallon steel septic tank and log crib installed in 1974. The log crib
encroaches upon the property to the south by 2 ft. There is no remaining space available on the
lot for a septic system. Elmore Creek runs through the center of the lot north of the house. The
creek has changed its course from the platted easement and is now within 90 ft of the south
property line. The current course is shown on the attached survey dated 517/03.
The existing system and the proposed system are located within a 10 ft utility easement along
the south property line. Letters of non -objection and an encroachment permit have been
obtained.
The proposed septic system upgrade is an AdvanTex AX -20 advanced wastewater treatment
system and a 15 ft long x 5 ft wide absorption field. I believe that approval of these waivers will
not lead to contamination of the subject property's well or the surface water due to the quality of
the effluent from the AdvanTex AX -20, the surface conditions, and the well depth. The lot line
waiver will not have any adverse impact on the property to the south. Further details are
presented below.
I believe that the above waiver from the absorption field to surface water will not create an
undue risk of contamination to surface water. This is based upon the following justification:

> Potential septic effluent discharge would occur in the basement rather than the ground
surface,
> The actual route of any potential discharge from the absorption field or AdvanTex tank to
the surface water would be greater than 100 ft, and
> Good quality effluent from the AdvanTex AX -20 system (on file at MOA).
The elevation of the basement is lower than the ground surface elevation at the absorption field,
so a potential discharge would occur inside the house before it emerged at the surface. This
problem would be noticed immediately and the situation corrected.
The route of any potential discharge from the absorption field to Elmore Creek would exceed
100 ft, due to the natural topography. Effluent would flow westward down the hill before
traveling northwards toward the creek. During our site visit on June 19, we discussed this
situation and concurred that the route would be to the west rather than towards the creek. The
approximate path of effluent is depicted on the attached topographical map.
A lot line waiver to I ft from the south lot line of lot 6B will not adversely affect the adjoining lot.
The septic system for the lot to the south (Timberlux #3, BIk G, Lot 1) is 80 ft south of the
proposed drainfield for the subject lot.
