Lot 2B, Ransom Ridge Subdivision
Septic System Design Permit Application
impacts to Adjacent Properties
Dear Onsite Services Engineer:
The absorption bed on Lot 2B, Ransom Ridge Subdivision has failed with effluent
surfacing in some areas. It is mandatory, therefore the system be replaced to prevent a
possible health hazard and damage to private property. We are therefore applying for a
permit to construct a new septic system to serve the house. The Site Plan shows the
location of the new system along with the location of the old absorption bed. It also
shows the location of the well on the lot.
The existing system was constructed in August of 1985 and included a separation
distance waiver between the absorption bed and the lot line. We are proposing to
replace the existing tank with a new 1,500 gallon STEP tank placed a minimum of 5'
from the foundation. The absorption bed will be a minimum of 10' from the lot line. No
waivers will be required. The testhole placed on the lot revealed silty gravel which
percolated at a rate of 30 minutes per inch. Groundwater was encountered at a depth
of 8', but was found at 6.5' during the monitoring period. We have therefore designed
an intermittent bottomless sand filter with the piping placed 1' below original ground
allowing for a 5.5' separation to the groundwater.
The ground surface on the lot slopes from east to west at approximately 5% and is fairly
flat from north to south. The bed will be constructed parallel to the slope in accordance
with Municipal requirements. The new system will meet all requirements concerning
separation distance from all wells in the area. Similarly, its placement will not affect
septic systems currently in place.
If the system is constructed in accordance with our design the following statements
apply:
The system, if constructed as designed, will have no adverse impact on the wells
in the area or those to be constructed in the future.
2. The system, if constructed as designed, will have no adverse impact on existing
septic systems in the area or those to be constructed in the future.
Lot 2B, Ransom Ridge Subdivision
August '10, 1999
Page Two
The system, if constructed as designed, will have no adverse impact on reserved
space, either surface or subsurface, on any lots located in the area.
The system, if constructed as designed, will have no adverse impact on drainage
patterns in the area. The current drainage pattern will be maintained.
Sincerely,
Michael E. Anderson, P.E.

RE£EIVED
SUBJECT: LOT 2B, RANSOM RIDGE, PLAT NOTE CLARIFIOATION
Dear Mr. Smith:
The purpose of this letter is to receive departmental concurrence
concsrning the rs-alignment of the location o-F the 100' septic
setback lines as neted on the plat for Ransom Ridge Subdivision
(S/D case 8 7364, Plat #84-134, filed 5/17/84).
The reason for bringing this to your attention at this time is
due to concern 'from a lending institution regarding the setback
lines which, really don't apply as shown on the ~iled plat. The
creek has been diw~rted and placmd in a pipe in a new alignment
north o¥ the location shown on tbs plat. We feel the 100' septic
setback lines should relate to the current alignment of the
cresk/pipe and not the incorrect lines as now shown on the filed
plat.
~]£~L~D~!i At the time of tbs -Filing of the plat for Lots 2A
and 28 of Ransom Ridge, a note was added to the plat which rsads
as follows:
"No septic system will be allowed in the 100 ¥0ot setback
creek septic protection area."
In addition to the abov~ n~e, the setback lines bassd upon the
location of the creek at the time of filing were shown on the
plat (see attachment #1, a copy of '/he filed plat).
Submequsnt to the plat filing, the ADOT/PF has reconstructed
Golden View Drive in the area of 'the Lot 2B. The work involved
1) Golden Visw Drive vertical alignment changes which raised the
centerline grade which caussd 2) a diversion of a large majority
of ~he previous creek water which previously passed through this
property to a new area along the east side of Golden View Drive,
which resulted in, 3) the installation of an underground pipe
from the west slops of Golden View Drive to Ransom Drive to
handle any seepage water through the roadway fill area.
Lot 2B, Ransom

R i dge
~!0~!~1~£ We hays completed field measurements of the new
cresk/pips alignment which is now shown on Attachment ~2.
Because of the major re-alignment of the cresk, the existing 100'
septic setback 'lines on the plat do not correspond to the actual
conditions. We haw~ discussed this matter with Mr. Dan Bowles o-F
your office who discussed it with Mr. 8revs Morris who apparently
was involved in ths original revi~w. It appears from that
conversation, that they c~qcu~ with providing the setback lines
in conformance with the cbrrW~'~~ pips/creek alignment.
~2~WsJ!~D~! We feel as DHH8 feels that the note on the plat is
still valid since the requirement to maintain tbs 100' setback
from the creek/pipe location is still necessary. Therefore, ws
arb requesting DHHS approval of the ¥ollowing statement:
centerline on Lots 29 and 2A~_~OggE_~gg_~2X~g~gD._h~g
We sincerely appreciate your time and review of this matter. We
firmly believe your concurrence continues the requirements of the
original action in protecting the creek from -any unwanted
contamination due to the septic system on Lot 2B of Ransom Ridge.
We are available at your convenience to discuss any comments or
questions you. may have regarding this matter. We would
appreciate your expeditious review. When and if your concurrence
is complete, please call us and we will deliver it to the
financial institution.
Respectfully 9ubmittsd,
Concurrence by MOA-DHHS

The Zoning Board of Examiners and Appeals may only grant a variance if the Board finds all of the
following six (6) conditions are met. Each condition must have a response in as much detail as it takes to
meet the condition. Please use additional paper if there is not enough room here for your response.
The applicant hereby alleges that:
1. Special conditions exist which are peculiar to this land, structure, or building involved are which are not
applicable to other land, buildings or structure in the same district. These special conditions are:
This property was acquired through foreclosure. Current owner was not responsible
for the construction of the home and was unaware of the violation.
2. Strict interpretation of the provisions of the Zoning Ordinance would deprive the applicant of rights
commonly enjoyed by other properties in. the same dist~rict~u ,nde( the terms of the ordinan, ce. These
rights are: variance requested is 20~ incnes, siae ±o~ ±lne variance. It is 5ne
owners understanding that the adjacent property also requested and was granted
a similar variance.
3. The listed special conditions and circumstances do not result from the actions of the applicant and
such conditions and circumstances do not merely constitute a,pecuni~a, ry. (mone~tary)hardship or
inconvenience in that: The current owner did not create ~ne conal~lon an~ was unaware
of the situation at the time the property was acquired. The violation prevents
the issuance of a C.O. and therefore the home can not qualify for investor financ-
ing.
Granting the variance would be in harmony with objectives of the Zoning Ordinance and not injurious
to the neighborhood or otherwise detrimental to public welfare for the following reasons:
mhe variance requested is minor and is not apparent when looking at the neighbor-
hood. The home was constructed in 1984 and this violation has not presented any
pwnhl~m~ ~n the pa~,
5. Granting the variance will not permit a use that is not otherwise permitted in the district in which the
property lies in that: The variance requested is not a use variance but a d~mensiona±
variance. We have been· informed that similar type variances have been granted
previously within the area.
6. The variance granted is the minimum variance that will make possible a reasonable use of the land,
building or structure in that: mh~ v~ ~] etlon amount is 1.7' ~ the amount of variance re-
quested to comD1v.
