We are requesting an expedited review of this application. Our review of available documentation and field investigation show that this project will not adversely impact any nearby Wells, Wastewater disposal systems, replacement disposal sites, or drainage flowing onto and off of the subject property. As shown on the plan, the tank will be greater than 10’ from the house foundation. The tank will be of MOA approved construction. The tank shall be covered with a minimum of 2” moa approved insulation and 3’ of cover or a minimum of 4’ of cover without insulation. The repair must be performed by a moa certified installer in accordance with MOA requirements. If groundwater is encountered during excavation of the tank hole, an alternate tank type may be required. Repair of the proposed system will not negatively impact adjacent lots. Upon completion of the installation, a record drawing will be submitted showing the location of the new tank, leach field, well, and other applicable features. A new septic tank was installed in late 2023. The permit application erroneously indicated that the permit was for 3-bedrooms. A 1250 gallon tank rated for 10’ burial was installed and the drawings, as well as previous permits and COSAs, indicate the system is suitable for 4 bedrooms. The tank was installed near a deck. The existing sonotube deck supports are greater than 5 feet from the tank. The center deck support was extended below the tank by the contractor and is about 5-feet from the tank. The leachfield is within the utility easement. We are requesting approval of the encroachment into the lot line. Letters of non objection have been submitted. The current as built survey shows that the leachfield may encroach on the property line by 0.3 feet. We are requesting that the 10 foot separation distance be waived to 9.7 feet. Based on our observations, this would not impact adjacent lots as currently developed, or likely future developments. Both the encroachment within the easement and to the lot line have existed since 1978 and previous COSAs have been approved without comment from the department. The muni is requiring letters of non-objection from utility companies before issuing the COSA, I am applying on their behalf for any/all letters of non-objection. Their leechfield encroaches slightly into the 15' backyard powerline easement. There is a 10' utility easement in the front yard, but I want to confirm through which easement Enstar has run the gas line, so I know if I need to request a letter of non-objection from Enstar as well as MEA, MTA and GCI. I attached the sellers' 2023 as-built for your reference.
