We are submitting an application for a septic system upgrade for this lot. The existing septic system
is less than 100 fett from the well serving the residence and must be replaced. This submittal
consists of three (3) drawings showing the present improvements on the lot and the adjoining
properties, (sheet 1/3), the proposed improvements of the lot, of which only the septic system are
subject to this permit application, (sheet 2/3), and a schematic of the septic system, (sheet 3/3). Soil
logs and percolation tests of applicable test holes are also enclosed. The septic system design is
based on the following :

A new permit must be obtained from this office for a well

expiration date.
If you have drilled the well, a well log must be sent to
this office for documentation of the installation and to
close the permit.
If a licensed Professional Engineer has inspected the
installation of the on-site wastewater system, the original
as -built inspection report must be sent to this office for
review, approval and documentation. All inspection reports
must be submitted within 30 days of construction completion.
When applying for a new permit, the fees are: $320.00 for an
on-site wastewater permit; $120.00 for a well permit and
$440.00 for a combined on-site wastewater and well permit.

This letter Is In reference 1 o the supplemental materials received in this office March 23,
1995, concerning an application for a Bed and Breakfast. The Department has completed
Its review of the submitte d materials which Included results from 'a requested septic
system adequacy test, we II flow test and a neighboring well log. Based upon this and
previously submitted Infor ration the Department has the following comments granting
approval of the Bed and f IreaKast application;

From the materials contai led in the submittal It appears that this system was. installed
substantially in accordance with the existing guidelines and regulations in effect at the
time. For the intended us age of this water system, there appears to be minimal risk of
contamination due to a separation distance less than.the required 150 feet between a
class "C well and an on -sl ;e wastewater disposal system. Thus, a waiver of the required
separation distance can bii granted.in accordance with State Drinking Water, Regulations
(18 AAC 80.045). The rec ant water sample. analysis submitted for total coliform bacteria
and nitrate were satisfact 3ry and meet the concerns of this Department. Therefore,
assuming that the change in status from a single family residence to a light commercial
operation (bed and breakfi ist) does not Increase the peak or daily demand requirements,
the present water systel n' for, -the , subject properly satisfies the, concerns- of this
Department.

the test was performed the wastewater disposal system was accepting the wastewater
flow rates for which the syt tem was designed. Assuming that there will be no increase
In the volume of wastewater being treated by the existing wastewater disposal system due
to the change from a single family residence to a Bed and Breakfast, the existing system
meets the concerns of this I )apartment:' Attached is a certificate for an Approval of On -
Site Residential Water an i Systems verifying this approval.
For this class 'V public water system, the Department recommends that annual
monitoring with semi-annue I monitoring preferred, for total coliform bacteria and nitrate
be conducted for this watei system.

SAND LAKE SUBD ADDN NO. 1, LOT 1
Dear Members,
On behalf of Nancy Sydnam, owner of record of Sand Lake Subd Addn
No. 1, Lot 1, I would like to request your approval of the vacation of the
Right of Way (ROW) adjacent to Lot 1 and described elsewhere in this
package.
The subject ROW is a 30 foot wide strip of land between Lake Shore
Subdivision and Sand Lake Subdivision Addition No. 1. These are two
residential subdivisions on the shores of Sand Lake.
The reasons for this request are as follows:
1) The lot to the west of the ROW is owned by David Ring, who
maintains a rather large salvage yard. Mr. Ring has continually used the
ROW for storage of large amounts of unsightly personal property. The
Municipality of Anchorage (MOA), Nancy Sydnam, and other neighbors
have continually been after him to confine his personal property to his own
lot. At the present time, Mr. Ring has cleaned up the ROW per order of
the MOA. However, he has also built a gravel road across the ROW
without a permit. (There is currently a complaint filed with the MOA
ROW Enforcement Office regarding this new road.) MOA Enforcement is
currently awaiting the result of this Vacation Request before taking action
on the illegal road. There is little doubt that Mr. Ring will spill back into
the ROW again. This has been his pattern for years.
By returning this small strip of unused ROW back to private ownership,
the MOA can avoid the expense and manpower drain of the inevitable
future zoning and ROW enforcement actions.
It is the intention of Nancy Sydnam and myself to use this strip of land as a
greenbelt buffer between our lots and Mr. Ring's salvage yard. We are
realistic enough to expect that his yard will never be cleaned up in the
foreseeable future. We want to do what we can to protect the beauty of
our lots and preserve our property values.
2) Lot 1, which would benefit from this vacation, is currently rather
narrow at 70' wide. It is very steep near the lake and it would benefit
greatly from the extra room. The plan for this lot is to sell it to me (Tim
Rittal), owner of Lot 2. My plan is to build a guest house on this lot and
maintain the buffer between myself and Mr. Ring's salvage yard.
Due to the configuration of the wells, lake and septic system on these lots,
the additional 30' will make expansion of the existing systems more
feasible.
3) The 30 feet was taken from the Sand Lake subdivision, which was
platted August 26, 1948. When Lake Shore Subdivision was subdivided
and platted on October 11, 1971, the matching 30 feet of additional land
was not set aside from that subdivision. Therefore, it seems likely that it
was decided as early as 1971 that this road ROW was no longer needed.
4) Since the ROW is only 30' wide and has a fairly steep grade as it
approaches the lake, it seems obvious that no road will ever be constructed
here.
5) Since this ROW is surrounded by private single family residences and
lots, it has no infrastructure to support a safe and reasonable public access.
Thirty feet is barely wide enough to park one automobile and there is no
reasonable, safe parking on the roadway due to a street intersection
(Endicott Street), driveways and a small hill on West 80th Avenue. There
is already public access to the lake via a park at the end of the lake.
6) There are no utilities and no easements of any kind which might be
affected in this ROW.
It appears that this ROW no longer has a function and should be returned
to the private property owner. Such action appears to have no detrimental
effect upon the health, safety or welfare of the public.

Subject: Septic System Evaluation

Dear Mr. Rittel;
Per your verbal request we have inspected and evaluated the
septic system on your lot.
The Municipal Department of Health and Human Services have no
information about your well and septic. The Assessors Office
shows that your house was built in 1951 and contains 5 bedrooms.
The enclosed drawing 1/2 shows the configuration of your lot with
the residence, well, septic and lake frontage located.
Prior to 1968 there was no State or Municipal regulation regard�
ing separatio� distances between septic systems and wells/surface
waters. In t�at respect L.1 systems is "grandfathered'/.
You informed me that a "sinkhole" developed some time ago next to
tho septic tank. It is �robable that this was caused by the log
cr�b collapsing.
It is obvious that presently you do not have a working system,
and that an absorption field must be provided. With the well
l�cated where it is, there is no avai1able location on your lot.
You indicated that the owner of lot 1 would grant you an easement
to install a septic trench on tat lot. In order to evaluate this
possibility we performed �hree percolation tests and a ground
water monitor test on this lot. The test results indic�tos that
there are no ijroblems with the soil. There are however evidence
that a substantial amount of surface water flows over the ground
during heavy rain. This drainage must be controlled.
A trench 50 feet long, 10 feet deep and backfilled with 5 feet of
septic rock will meet the requirement for your residence. This is

In order to install this tre:c� you must obtain Munic��al approv-
al. Based on my survey I consider this approval unlikely. Due
again to the location of your wzll und the well on lot 3, and the
reguired setback distances from lot lines and lake, the available
area on lot 1 is very limited. ln order to obtain Municipal
approval we will have to show that a well can be installed on lot
1; as well as an original septic system for that lot and a re~

WHEREAS, the grantor is the owner in fee simple of the following

WHEREAS, the grantee is the owner in fee of another and adjoining
parcel of land described as follows:

to the official Plat thereof, filed as Plat p-112 in

WHEREAS, the grantee is desirous of enjoying the use of a certain
portion of the grantor's land for the sole purposes of ingress
and egress to grantee's land for the purpose installing and
maintaining a private septic system,

WHEREAS, the grantor has agreed, in consideration of $10.00 (Ten
Dollars and No Cents) and other good and valuable consideration,
the receipt of which by grantor is hereby acknowledged, to grant
to the grantee an easement solely for said defined purposes and
for no other,
NOW this grant witnesseth that in return for said specified
consideration paid by the grantee to the grantor, the grantor
hereby grants unto the grantee, his heirs and assigns, full and
free right and authority to install and thereafter maintain a
private septic system upon a portion of grantor's land as shown
by the " Septic System Design and As -Built" by Tobben Spurkland,
P.E. dated Aug 23, 1991.
This Grant of Easement is intended to be appurtenant to grantee's
above-described land and touches,concerns and runs with said
lands. This is not intended to be an exclusive easement: the

grantor herein expressly reserves unto himself equal rights of
ingress and egress and all other rights as the owner in fee
simple of the described premises.
If the Grantor sells or develops lot 1, this easement becomes
null and void and Grantee,will abandon this system and install a
legal system on lot 2 by moving the well on lot 2 to make room
for such a legal system.
Likewise, if Public water and sewer become available, this
easement becomes null and void and the Grantee will abandon the
encroaching system and connect to the Public utilities.
Any dispute or disagreement arising under or in any way
concerning this instrument shall be submitted for resolution to
the process of binding arbitration in accordance with the Alaska
Statutes made and provided for said arbitration. The
jurisdiction of the Arbitrator shall commence 60 days from the
onset of the dispute and shall operate to toll all applicable
Statutes of Limitation.

in the Certificate of Ohi'Site Systems Approval Guidelines for this application, shows that the on-site- water supply and/or wastewater

A Certificate of On -Site Systems Approval inspection and test of potable
water was recently conducted on the well water supply on Block , Lot
1 of Sand Lake #1 Subdivision. This inspection revealed an arsenic
concentration of 46 micrograms per liter (ug/L) for the property's well water
sample. The Environmental Protection Agency (EPA) has established a
maximum contaminant level (MCL) of 10.0 ug/L for public drinking water
systems. While private wells are not subject to this regulation, EPA
standards are based on existing health information and can therefore be used
to gauge the relative quality of water from private wells. Information on
arsenic is available from the On -Site Water and Wastewater Program
website (www.muni.org/onsite) or at 343-7904.
This advisory must be attached to all copies of the subject Certificate of On -
Site Systems Approval.
