The existing tank is 40 years old and is likely perforated and leaking, it will be abandoned per code. Currently the lot is developed. The proposed replacement will be connected to the existing drain field. This lot and the surrounding lots are served by private shared wells. There are currently no wells within 100’ of this upgrade. The wastewater system serving this property was designed and permitted to serve a 2-bedroom dwelling. The dwelling has been listed as having 3-bedrooms since 1984. The property has received several HAA and Onsite approvals since 1984 for a 3- bedroom septic system. PES was contracted by the owner of the property to perform an adequacy investigation of the on-site system to obtain a COSA. The on-site system serving the subject lot consists of a 1000-gallon septic tank followed by a twenty (20.0’) feet of deep trench with eight (8’) feet of drain rock installed on December 28th, 1983. On September 26th, 2024; PES found the existing tank to be in a state of failure. The drain field was observed to be dry prior to the introduction of 497-gallons of clean water. Following 30 minutes of monitoring the drain field was dry. Replacement and or upgrade of the existing drain field at this time is unnecessary and would cause undue financial burden on the current owners which purchased the property in 2015 after it had received a COSA approval for 3-bedrooms. The on-site system has been in operation and has served a 3-bedroom dwelling since 1983 with no documented failures or issues. If the drain field is to ever experience a failure or the structure be modified to include additional bedrooms the drain field shall be upgraded to accommodate the appropriate number of bedrooms. A future drain field upgrade would include one or multiple of the following: • A well waiver be applied for and approved by the MOA Onsite Department. • An advanced wastewater treatment system be utilized. • Letters of non-objection by the appropriate utility companies be granted to perform work in the utility easement. The property owner at the time an upgrade is needed shall be responsible for retaining a State of Alaska Registered Engineer to obtain all necessary permits and approvals. It is the opinion of this office that the existing system on the subject lot is still suitable to serve a 3-bedroom dwelling. 1. Upgrade Tank Design. The tank will be located: 5’+ from any property line. 5’+ from any deck/stair support. 10’+ from building foundation. 10’+ from any water line. 100’+ from any surface water. 100’+ from any private wells. 200’+ from any public wells. The septic system has been in operation since 1983 and has served a 3-bedroom since as early as 1984. Currently, this properties development is listed as a 3-bedroom dwelling with its drain field only sized to accommodate 2-bedrooms. This dwelling has been listed and sold as a 3-bedroom dwelling since construction and has received a Health Authority or Onsite approval in each instance. The existing drain field was sized based on a visual application rate of 150 ft2 /br. The drain field is a deep trench, 20 feet long with 8 feet of drain rock which equals 320ft2 of absorption area. For a 3- bedroom system this drain field would need to be 28.2 feet long. Given the noted soil composition on the soil log and absorption noted during the adequacy test, the receiving soil likely has a percolation rate of 1-5 minutes per inch. By today's code this requires 125ft2 /br and 375ft2 of absorption area. The current drain field would need to be 23.5 feet long (3.5ft longer than what is currently present), to meet current code requirements. We conducted an adequacy investigation of the septic system on 09/26/2024. The drain field monitor tube was dry prior to the start of the test. Water was added directly to the drain field monitor tube at a rate of 7.1 gpm for 70 minutes, for a total of 497 gallons of water. Water levels in the monitor tube rose due to hydraulic loading. Following 20 minutes of monitoring, the monitor tube was again dry. The drain field absorbed the daily flow of wastewater for a 3-bedroom home in 90 minutes. It is safe to assume that the drain field serving this property is in excellent condition given its age. MOA regulations require septic systems be designed for 150 gallons of wastewater per bedroom per day. This value assumes two people are occupying each bedroom which means each person is assumed to produce 75 gallons of wastewater per day. Typically, a 3-bedroom home will have 4 occupants (2 parents and 2 children). 4 people x 75 gallons/day = 300 gallons of wastewater per day. At the original design application rate of 1.0 gpd/SF the drain field would need 300ft2 of absorption area, the existing drain field on the property has 320 ft2 of absorption area. Given that the wastewater treatment system has been in operation for over 40 years with no issues, these reduced flow numbers are feasible. A 1000-gallon septic is the required size septic tank for a 3-bedroom home. This means all wastewater leaving the home is receiving the required primary treatment before being discharged into the soil absorption system. The 2015 COSA approval noted a non-detect level of nitrates from the well serving this property. Our most recent sample collected on 10/08/2024 noted a nitrate level less than the MRL on 0.200 mg/L. Nitrates from this and surrounding wastewater treatment systems are not having a negative impact on the drinking water source. PES has discussed this property and the subsequent COSA with MOA Onsite staff and received a written approval through Eplans during the tank replacement process. Permittee shall indemnify and hold Chugach harmless from any claims for personal injury, property damage or other loss arising in any way from the continuation of the Encroachment, to include any damage to the septic drain field/pipes from vehicle traffic in the Easement area. 5. No Expansion or Increase. Permittee shall not in any way expand or increase the extent to which the Encroachment occupies any of the real property encumbered by the Easement without the prior written consent of Chugach. Chugach has no obligation to provide such consent. 6. No Interest in Real Estate Acquired. Permittee hereby acknowledges that the Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in the future give rise to any interest or estate in the real property subject to the Easement or any other real property. Without in any way limiting the foregoing, Permittee acknowledges that the Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the permission of Chugach for purposes of the common law doctrine of adverse possession. This permit creates no interest in the real property subject to the easement. 7. Modification of Utility Facilities. If the electric utility facilities located within the Easement are upgraded, added to, replaced or reconstructed, Permittee shall pay that portion of Chugach's total costs for such modification which is reasonably attributable to accommodating or preserving the Encroachment. If such payment is not made within thirty (30) days of written demand for same, Chugach may terminate this permit in accordance with paragraph 9, below. 8. Covenants Running with the Land. The obligations of the Permittee arising from this permit shall be covenants running with the land which shall burden the Parcel and the Permittee's interest in the land subject to the Easement and shall benefit the Easement. The Encroachment is enlarged, increased or extended within the real property affected by the Easement. b. The Encroachment is damaged by any means to an extent of more than thirty percent (30%) of its replacement cost at the time of destruction. C. Permittee fails to make the payment described in paragraph 7, above. 10. Term. This permit shall, if not sooner terminated by Chugach, expire forty (40) years from the date hereof. 11. Entire Aereement. This written permit constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all other prior or contemporaneous agreements, oral or written, between the parties.
