HAMMOND, Governor J 338DENALISTREET MACKA V 8 UI L OI NG— ROOi14 850 ANCHORAGE 99501 February 18, 1975 This letter is being written as the result of a phone call from Mr. Glen Huff representing Contracting Engineers €, Associates on Februa y 27, 1975, during which he indicated that you wished a letter :from this Department containing our opinion with regards to the Schulz Subdivision addition #]-in the Fagle River .area. The following points were considered based on the in:fonflatior presented by Mr. Schulz. 1) There are at least three sewage disposal systems and three wells on the property purposed to he subdivided, This subdivision would Effect- ively reduce the number of wells and waste disposal systems by one. This :is also premised on the fact that 147c. Schulz will see that a normal two to three bedroom house :is constructed on the western lot. As we see it this not increasing the nlmloor of systems on the lot but in:fact :is perhaps creating a more desirable situation as long as all th e productive radii_ which are required are adhered to. 2) The soils test presented by Mr. Schulz's soils consultant appeared to indicate that adequate soils for sewage disposal were present in the subdivision. 3) The lots purposed by Mr. Schluz are the same size (approximately 16;000 square :feet) as the two lots immediately to the north In a prior sub -- division. The lots immediately to the south appear to be much smaller on. the order possibly of 10,000 to 12,000 square feet. There fore the subdivisi_onis not out of the general lot size in the immediate area. 4) It has been our policy in the past .in the MatanusRa-Sustina and Kenai Boroughs where the quanzty of sewage to be disposed of in a given existing area was not substantially increased and the lot sizes were, within keeping with past practice in the area and as long as the required protective radii have been met we have no objection to -the subdivision. It would appear that this is a transitional case where we are still possibly paying the price for improper practices in the past. If this were raw land and not within previously subdivided property and perhaps even in. a larger subdivision we would take quite a. different view )but common sense in this case indicates to us that we would not see -any problem with the purposed subdivision. As stated above this letter is based on the information that we reviewed. This letter is in no way :intended to override the authority of the Department of Environmental Quality or the Planning Department of the Greater Anchorage Area. Borough in this instance. This letter is intended to represent our finding of .fact in this case and should be viewed entirely as such. If for any reason you feel that this subdivision should be denied we will not take any action to attempt to overturn your decision as we feel this should rightly made at the local govern- ment level. S-3578 Schulz Subdivision #1, We received none of the data (soils, topography, water availability data, etc.) that would normally be submitted with this case. However, on this case it is not necessary because the two lots are so small that there is no possible way this proposal could meet our requirements. Public sewer and water are not in this area to serve these lots and there is no possible way of increasing the lot sizes to our minimum of an acre and a quarter. o trickland , R.S.
