SUBJECT: S-7362 Shackelton Subdivision
The Platting Board, at their December 21, 1983 meeting, requested
the staff review the possibility of allowing the applicant to
develop his property in conformance with Department of Health's
guidelines, but at the same time still obligating the individual
to vote affirmatively in any lateral sewer districts should they
be formed. The rationalization behind the idea is that this
individual is allowed to develop within the guidelines
established by DHEP, but they would not vote against any sub-
sequent sewer districts.
I would like your ideas concerning this as the two individuals
have gone to great length to obtain DHEP's approval for a one
bedroom home on each lot and I suggest, if you can establish the
legal language, that the note be removed for these two particular
lots, 23A5 and 23A6, and establish a legal binding agreement
that these two individuals vote affirmatively for any lateral
sewer district that is formed in the future.

DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS
Herman Knott, Jr. is the owner in fee simple of the
following described real estate:
Lot 23A-5, SHACKELTON SUBDIVISION, according
to Plat 74-86, filed in the Anchorage
Recording District, Third Judicial District,
State of Alaska.
Herman Knott, Jr. for and in consideration of the action
of the Anchorage Platting Board in Subdivision Case S-7362, for
himself, his heirs, executors, administrators and assigns,
covenants and agrees as follows:
1. The Municipality of Anchorage may, on behalf of
Herman Knott, Jr., his heirs, executors, administrators and
assigns, execute any document necessary to evidence the consent
of the owners of the above described property to the inclusion
of the above described property in a lateral improvement
district.
2. Herman Knott, Jr. ,for himself, his heirs, executors,
administrators and assigns, covenants and agrees that the
inclusion of the above described property in a lateral impro-
vement district pursuant to the execution of documents
authorized under Paragraph 1 above will subject the above
described property to the lien of an assessment for sewer
improvements in accordance with the Alaska statutes and the
charter and ordinances of the Municipality of Anchorage.

may not be altered or revoked without the consent of the

TO WHOM IT MAY CONCERN
This is a letter of intent, in which to waiver Lots 23A-5 }�-6, SHACKELTON
SUBDIVISION from Platt Notes on the State Recorded Plat rt. 6(Atch / ).
We have contradicting current soil tests done by Alaska Environmental Control
Service, Inc, stating the soil at the leachfiled level is of a sandy sparcely
gravel soil and is excellent for this need (Atch<2). The two lots are 90' x 140'
each and meet all municipality minimum distances from surrounding wells and
septic systems (Atch 3).
We met with Robert Robinson, Environmental Engineering Manager, Environmental
Health Division and John Lynn, Envirorental Engineering, Environmental Special-
ist. Both agree this can be done within the Municipality Health Codes. We sat
down and plotted an acceptable leachfield and septic system, size and location
on corresponding lots to accommodate the proposed structures.(ATcH H)
With your support, this will enable us (my brother and I) to continue with our
building project without further adieu.
The aforementioned lots were originally purchased on July 29, 1982 as perspective
buildable lots from Don Showers. This was our first venture in real estate. During
our preliminary commitment for title, we were given a letter from Ray Blackman,
Manager, Engineering and Construction, Anchorage Water and Waste Water Utility
(Atch .�_). From this we based our purchase. Later we found out that the sewer
wouldn't be in that year but anticipate construction next spring. On this basis
we proceeded on with our plans, appraisals, construction permits, building bids
and bank financing. Later that spring, we were told that the project has been
delayed and hopes to be done by the fall of '83. Now that fall is here, the
story gets worse. Don Keefer, Project Engineer of Water and Waste Water Utility
says that it may be three or more years before the project is completed. In the
meantime, we are left with non -buildable lots that is why we would like to be
given a septic permit to tie us over until such time municipal sewer is available.

As you know, this department recently instituted a system of grouping
two or more lots into one building parcel in order to permit limited
development of properties which otherwise could not be developed to
our standards due to lot size, poor soils, etc. L-1
Weanticipate limited use of this provision in areas which are not
served by public sewer and/or water presently, but will have these
facilities available in the foreseeable future.
This memorandum will serve to notify you that the subdivision plats
listed below have recently been approved by the Planning Commission
utilizing specific lot ties which are delineated on the respective
plats.
These plats are on file in the Planning Department.
By alerting the counter personnel, we are hopeful that we will be able
to enforce this provision successfully at the sewer or building permit
acquisition level.
Please tell your counter people to feel free to call me for additional
clarification if they become doubtful or any problems arise in connec-
tion with this arrangement.
