RE: Well to Septic Encroachment - Lake Ridge Terrace Block 8, Lots 4 & 5
Gentlemen:
Per MOA Permit Number SW000304, the well on Lake Ridge Terrace Block 8, Lot
4 was drilled as proposed and prior to the septic system upgrade of the adjacent
property-Lake Ridge Terrace Lot 5. Subsequently, the new septic tank on Lot 5
was placed within the required 100 feet setback to the well on Lot 4.
On March 30, 2002 ADEC issued multiple waivers under 18 AAC 72, Wastewater
Disposal Regulations, including a 98 feet horizontal separation distance waiver
between the private water system source well located on Lot 4, Block 8, Lake
Ridge Terrace Subdivision and the septic tank located on Lot 5, Block 8, Lake
Ridge Terrace Subdivision. The owner of Lot 4 has no objection to the issuance
of any ADEC or MOA waivers for the referenced encroachment, however; any
necessary fees to obtain such waivers should be paid by the owner or his agent of
Lot 5.

Dear Mr. High:
I have completed my review ofthe'submitted information and the Department's file on the
above-reference facility in regards to the requested separation distance waivers.. Based on this
review, I believe that.the requested waivers are reasonable.
Due to the existing soil types, low nitrate levels, lack of. bacteria~ the great depth 0fthe soume
wells in the area, changes in State regulations that impact the requested separ~ition distances, and
all the information that has been collected for similar separation distance waNers in this area, the'
requested waivers appear to be reasonable. Therefore, in accordance with the'Wastewater
Disposal Regulations [18 AAC 72], the following waivers are granted:
The horizontal separation distance between the Class C public water system source
well and the complete wastewater disposal system located on Lot 5, Block 8, Lake
Ridge Terrace Subdivision serving a duplex has been waived from 150 feet to 98 feet.
The Department has no objection to the following waivers under 18 AAC 72, Wastewater
Disposal Regulations:
· The horizontal separation distance between the private water system source well
located on Lot 6A, Block 8, Lake Ridge Terrace Subdivision and the septic tank
located on Lot 5, Block 8, Lake Ridge Terrace Subdivision from 100 feet to 98 feet.
· The horizontal separation distance between the private water system source well
located on Lot 6A, Block 8, Lake Ridge Terrace Subdivision and the soil absorption
system located on Lot 5, Block 8, Lake Ridge Terrace Subdivision from I00 feet to
82 feet.
· The horizontal separation distance between the private water system source well
located on Lot 4, Block 8, Lake Ridge Terrace Subdivision and the septic tank
located on Lot 5, Block 8, Lake Ridge Terrace Subdivision from 100 feet to 98 feet.

The above noted distances were taken from your submittal. If the proposed wastewater disposal
system located on Lot 5, Block 8, Lake Ridge Terrace Subdivision fails or needs to be upgraded,
this waiver becomes invalid. If the n~w system fails or needs to be upgraded, additional
treatment to the waste stream will be required.
With the change in both in the State Drinking Water and Wastewater Disposal Regulations, it is
hard to determine if the water system serving Lot 5, Block 8, Lake Ridge Terrace Subdivision is
truly a Class C public water system. Due to all the concem over separation distances, I issued
the requested separation distance waivers as ifthe existing water system is a Class C public
water system. As a result, the submitted Class C public water system registration form will be
processed in the same manner.
The enclosed copy of the signed Class C public water system registration form constitutes final
operation approval of the existing public water system. The Public Water System Identification
Number assigned to this public water system is 218658. Please make sure that this number is
placed on all water test requests sent to an approve water testing lab. The use of this number will
ensure that the test results will be properly credited to this public water system. I recommend
yearly testing for total coliform bacteria and nitrates.
These waivers and approvals do not imply the granting of any additional authorizations, nor
obligate any local, state, or federal i'egulatory body to grant required authorizations.

Dear Mr. Rieth,
Attached are the Record Drawings and the "Construction and Operation Certificate" for the
replacement septic system on Lot 5. As we discussed this afternoon, we have encroached
on the waiver distances granted in your approval letter of September 5, 2000. The waivers
· were necessary due to a new well being installed on Lot 4 and unstable soil conditions in
the leach field ~rea. I can assure you that we did everything we could to stay within the
approved limits.
The location of the new improvements, as shown on the record drawings, have been
determined based on a field survey completed by our firm; and I believe all the distances are
correct as shown. All distances are computed from the outside of the well casing and have
been rounded downward to the nearest foot.
The items requiring an adjustment to the waivers granted in your letter of September .Sth

The subject permit, issued November 9, 1995 by this office for a
single family well and/or on-site wastewater system, has
expired as of November 9, 1996.
A new permit must be obtained from this office for a well
and/or on-site wastewater system NOT installed by the
expiration date.
If you have drilled the well, a well log must be sent to
this office for documentation of the installation and to
close the permit.
If a licensed Professional Engineer has inspected the
installation of the on-site wastewater system, the original
as-built inspection report must be sent to this office for
review, approval and documentation. Ail inspection reports
must be submitted within 30 days of construction completion.
When applying for a new permit, the fees are: $320.00 for an
on-site wastewater permit; $120.00 for a well permit and
$440.00 for a combined on-site wastewater and well permit.

We race red the above request dated Ob-'tober 19, 1995. Included were a well waiver
data eh{~et, system plan review checklist, tope map, well profiles, site plan, soils logs,
well Iog.% water analysis, and septic system installation.specifications. Your client, John

The reqL est is to reduce the required 150' separation distance from an unapproved
Class C ~vell on Lot 5 to the southwest to 140'. Because ~ physical and separation
distance cohstraints, the requested location for the applicant's septic drainfield is the
only one available.
We have! ~arefully reviewed all of the above information and approve, per 18 AAC
· 72.0150: ) and t 8 AAC 80.030, the waiver reducing the distance between the Class C
well end your proposed drainfleld Eom 150 feet to 140 f~et. Your client should be
aware that there is a chance that the dratnfield will contaminate his proposed well, even
though J'e meets the separation distance required of 100'. This is because of local
terrain, ~oils, and water table, He may want to test. his well for contamination on a
regular I:asis. This approval is for existing conditions; any change in land use on Lots 4
or 5 ma!, require another waiver application.
This approval does not imply the granting of any additional authorizations nor obligate
any Ioc~, state, or federal regulatory body to grant required authorizations. We

Narrative & Permit Application
Dear Mr. Cross:
The proposed well and septic system will have very limited impact on adjacent properties for the
following reasons:
The surrounding lots are developed. Their reserve area is limited by their own
well radius.
2. Immediate neighboring septic systems are all +28' distance.
o
Reserve space is provided for a two bedroom facility. The reserve area will be
constructed at this time and connected to a diversion valve.
4. Drainage will not be affected and is not a major consideration in our design.
Due to the limited area outside the 100' lake setback, we are placing the reserve leachfield area
within 10' of the driveway and providing additional insulation in this area, see specification C.6.
The primary leachfield is located 142' from an unregistered class "C" well. The ADEC has
granted a waiver to allow the separation distance, recognizing that the Lot 5 septic system
encroaches on its own well. If you have any questions please call our office at 694-5195.

SPECIFICATIONS FOR ON-SITE SEPTIC SYSTEM
LEGAL:

A. GE~RAL
1. The well and septic plan is for a two bedroom single family residence only.
2. The drawing and or site plan shall be a part of this specification.
3. All materials and workmanship shall meet the Anchorage Department of Health
requirements.
4. Al1 soil tests are advisory to the design and are to be verified or modified in the
field by the engineer.
5. All excavations and depths are advisory and are to be verified in the field by the
contractor to meet Municipality of Anchorage requirements.
6. It is the responsibility of the owner to obtain all necessary pemfits or easements
and to locate any adjacent multi-family wells.
7. The excavation is to be exactly in the area shown on the site plan, any deviation
requires engineer approval.
8. It is always recommended that a surveyor locate the nearest lot line position and
the location of any easements.
9. Any remaining open test hole excavations shall be filled.
B. SEPTIC TANK/INTERIOR GRINDER PIJMP
1. A solid handling grinder type pump with basin and controls shall be placed inside
the dwelling where it can be monitored for any leakage.
2. The septic tank shall be placed into the hill to allow gravity feed to the leachfields.
Tank is to be insulated with 2" of burial foam and soil mounded 2' over insulation
and graded away a slope not to exceed 3:1 in any direction.
C. TRENCH
1. The trench is to follow the natural land contour to maintain uniform total depth of
the trench bottom.
2.The bottom of the trench shall be level, plus or minus 1.5".
3.The total depth of the trench excavation is not to exceed 9' at any point.
4.The trench gravel is to be covered with typar fabric material.
5. A combination of 18" soil and 2" extruded board insulation is to be placed over the
leachfield, mounding as necessary. 4" insulation shall be placed over the leachfield
located within 10' of the driveway.
6.A Bull-Run type diversion val~e shall be installed between the two trenches.
7.Flush mount covers over cleanouts located in driveway.
8. The area over the trench is to be finish graded to prevent ponding of surface water
runoff. Area over the trench and tank is to be seeded.
9. The septic tank and leachfield must not be closer than 100' to any existing private
well, 130' to any Class "C" well, or 200 feet to any community well.
RECOMMENDED LEACHFIELD DIMENSIONS:
TOTAL DEPTH = 9' GRAVEL DEPTH = 7.5' under pipe, 2" over pipe
TRENCH LENGTH = 34' TRENCH WIDTH = 3'
SOIL RATING = 0.6 GPD/ft2 BEDROOM CAPACITY = 2
SEPTIC TANK = 1,000 gallons

I am responding to your letter of January 29, 1992. I understand your concerns about the fill
permit process of the U.S. Army Corps of Engineers. In fact, I share some of your same
opinions.
More specifically, I have sought a review of your permit request from municipal departments.
T..e D..~.artm~..t of Econo.mm Development and Plarming have supported your request. ~.~-k,,ey
stated, "The applicant has proven justification for the project based on need and lack of
alternatives due to lot constrictions and septic requirements." This was transmitted through
the State of Alaska on November 14, 1991.
The matter of the waiver has been discussed with the Department of Health and Human
Services. They indicate that the matter is not appropriately before them. They do not issue
waivers or even address them prior to actual design and construction. They do not intend to
issue a waiver under current circumstances.

Review
Dear Mr. Butera:
This is in response to your submittal, received in this office on April 23, 1991, in which
you requested that the Department either waive the current minimum 150 foot separation
distance between an unapproved Class C Public Water System Source Well on Lot 5,
Block 8, and the on-lot soil absorption system on Lot 4, Block 5 or take enforcement
actions. I have reviewed the submitted information and find that I can not agree with your
conclusion that the requested waiver should be granted. However, I do believe that
some type of action can be taken on resolving this problem.
Even if the Class C Public Water System had been approved by the Department, your
submittal did not provide sufficient information to justify a waiver under 18 AAC 80.020 of
the Drinking Water Regulations and 18 AAC 72.035 of the Wastewater Disposal
Regulations. As noted in your letter, Lot 6A, Block 8 had previously received a waiver.
However, our records indicate that Mr. Donald Krafft, owner of Lot 6A, Block 8, did not
submit the information requested by the Department in it's August 18, 1979 letter. That
being so the waiver, issued by the Department March 2, 1990, may be invalid.
I believe it is appropriate to grant a temporary waiver for Lot 4, Block 8, which will
terminate when the water system source well located on Lot 5, Block 8 Lake Ridge
Terrace #1 is either determined to be a private water system or approved as a Class C
Public Water System. The waiver is being granted in accordance with the Wastewater
Disposal and Drinking Water Regulations. The separation distance between the
unapproved Class C Public Water System Source Well on Lot 5, Block 8 and the new
wastewater disposal system on Lot 4, Block 8 is hereby waived from the minimum 150
feet to 130 feet.

The Department will investigate the situation further and contact the owner/operator of the
Public Water System on Lot 5, Block 8. A permanent waiver will not be necessary if the
Department finds that the system serves a single-family residence. However, if the
investigation reveals that the system should be classified as a Class C Public Water
System, the owners of Lots 4 and 6A, Block 8 may need to submit additional information
to obtain the required waivers.
