The surrounding lots are large and have established septic sites, allowing sufficient room for several septic sites. There is public water supply to each lot. 2. Immediate neighboring septic systems are all +30' distance. 3. The soil is permeable and adequate for leaching. Surface drainage will not be affected and is not a major consideration in our design. The design for this leachfield provides a xvide drainfield design at the highest soil elevation with an Orenco system lift station for intermittent dosing. The'well & septic plan is for a 3 bedroom single family residence only. 2. The drawing and or site plan shall be a part of this specification. 3. Ail materials and workmanship shall meet the Anchorage Department of Health requirements. 4. All soil tests are advisory to the deslgn and are to be verified or modified in the field bY the engineer. 5. All excavations and depths are advisory and are to be verified in the field by the contractor to meet Municipality of Anchorage requirements. 6. It is the responsibility of the owner to obtain all necessary permits or easements. 7. The excavation is to be exactly in the area shown on the site plan, any deviation requires engineer approval. 8. It is always recommended that a surveyor locate the nearest lot line position and the location ofany easements. 9. Any remaining open test hole excavations shall be filled. B. SEPTIC TANK WITH LIFT STATION i. The septic tank shall be an Anchorage Tank 1250 gallon septic tank with integral OSI lift station pump model OSI-05-20-tltlF. 2. A receipt from a licensed electrician shall be provided to the engineer verifying lift station wiring to all applicable codes. 3. Existing septic tank is to be abandoned by pumping, crushing and burying in place on lot. C. DRAINFIELD 1. The drainfleld is to follow the natural land contour to maintain uniform total depth of the drainfield bottom. 2. The bottom of the drainfield shall be level, plus or minus 1.5". 3. The total depth of the trench excavation is not to exceed 5.5.' at any point. 4. The effluent line is to be a I-I14" PVC line with 118" holes drilled i.4' OC within the leachfield, placed face up with orifice shields placed over holes. Line from tank to field is to be I-1/4" HDPE. 5. The drainfield gravel is to be covered with typar fabric material. 6. Soil or combination of soil and extruded board insulation to a depth of 3' or equivalent is to be placed over the drainfield to make adequate cover. 7. The septic tank and leachfield must not be closer than 100' to any existing private well, 150' to any Class 'C" well, or 200 feet to any community well. John Smith, P.E., Program Manager, On-site Servicesj~cr~'~-r SUBJECT: Claim Against the Municipality of Anchorage File No. 22700 - Lot 3, Block 29, Northwoods Subdivision In response to your request for backup information regarding the subject claim, the following information is provided: Background and History Lot 29, Block 3 North Woods Subdivision: Permit #810556 dated June 18, 1981 issued by the Municipality of Anchorage permitted design was for a wide drainfield total depth 4.0', 5' wide, 123' long, 2.5' gravel depth. The above permitted design was based on a soil test dated June 16, 1981 which showed a silt and gravel soil from 1.0' to 7.0'. Groundwater was monitored at a depth of 7 Ft. On December 16, 1992, the property owner, Mr. Bruce Landry, applied for a Health Authority Approval certificate. The application was reviewed by this department and a conditional approval was issued on December 23, 1992. The conditional approval required that a groundwater monitoring tube be installed adjacent to the system to verify a vertical separation of 4 Ft. between the bottom of the system and any groundwater table. As part of the Health Authority Approval process, a system adequacy test was performed by S & S Engineering on December 15, 1992. Before the adequacy test, there was 15.5 inches of water in the drainfield, during the test there was 22.5 inches of water in the field and after the test, there was 18.5 inches of water in the field. It should be noted that there is 30 inches of gravel in the absorption field. The engineer was asked to provide a written statement attesting to the fact that the system did not encroach on the groundwater table. The engineer has declined to provide such a statement. Scott Wetzel Services, Inc. March 18, 1993 Page 2 Groundwater Data from Adjacent Lots Lot 27 Block 3: Two lots to the east of Lot 29, Block 3. The leachfield was upgraded on June 3, 1991 due to the encroachment of groundwater into the original leachfleld. A soil test taken on September 26, 1990 showed groundwater to be at 9 feet after 7 days of monitoring. Lot 30 Block 3: The adjacent lot to the west of Lot 29, Block 3 the leachfield was upgraded on February 8, 1987 due to the encroachment of groundwater into the original leachfield. A soil test taken on April 28, 1987 showed groundwater to be at 3.0 feet after 7 days of monitoring. Lot 31 Block 3: Two lots to the west of Lot 29, Block 3. The leachfield was upgraded on April 20, 1987 due to the encroachment of groundwater into the original leachfield. A soil test taken on April 4, 1987 showed groundwater to be 4.5 feet after 7 days of monitoring. Lot 12 Block 3: The adjacent lot to the north of Lot 29, Block 3. The leachfield was upgraded on September 28, '1990 due to the encroachment of groundwater into the original leachfield. A soil test taken on May 5, 1992 showed groundwater to be at 3.75 feet after 9 days of monitoring. Reference to Anchorage Municipal Code AMC 15.65.060.2(b) states that a subsurface disposal field may not be located where the water table during any season of the year will be within four feet of the bottom of the absorption area. Based on the reported 4.5 Ft. depth of the existing system, and the presence of a groundwater table depth of between 3 and 5 feet on adjacent lots there is sufficient reason to suspect that the subject systems does not have the required 4 Ft. vertical separation to the groundwater table. AMC 15.05.160.C states that the department shall issue a Health Authority Certificate if the department finds that information provided by an engineer demonstrates that the system for which the certificate is sought conforms to all applicable portions of the Anchorage Municipal Code. March 18, 1993 Page 3 The department has found that the information provided by S & S Engineering does not support or demonstrate that the system conforms to all applicable portions of the Anchorage Municipal Code. Therefore an unconditional Health Authority Certificate could not be issued. AMC 15.05.160.E states that all test procedures used to collect the information necessary to meet the requirements for a Health Authority Certificate shall be approved by the department. In order to satisfactorily support and demonstrate that the system conforms to all code requirements, the department has approved the installation of a groundwater monitoring tube as the most reliable and cost effective method to confirm that the bottom of the system is 4 ft. above the groundwater table. Summary and Conclusion There is significant evidence which supports the department's concern that groundwater encroachment may be a p~oblem at the existing leachfield on Lot 29, Block 3 North Woods Subdivision. Therefore the department has acted correctly and in accordance with municipal code in requiring that groundwater be monitored prior to issuance of an unconditional Health Authority Approval. The engineer, S & S Engineering, has declined to provide a statement attesting to the fact that the system does not encroach on the groundwater table.' It should also be noted that the claimant purchased the subject property on a "where is as is" agreement. At the time Mr. Landry purchased the property he elected not to have the on-site wastewater system approved by this department. Had Mr. Landry availed himself of the Health Authority Approval process, any groundwater encroachment problems would have been resolved prior to his purchase of the property. Our On-site Services Program was not able to issue Mr. Landry an unconditional Health Authority Approval (HAA) as there is good evidence to suggest that his present septic system does not meet minimum vertical separation distance to groundwater. State and municipal regulations require a 4 foot minimum separation between the bottom of the septic absorption field and the seasonally high water table. Septic systems on lots immediately to the north, east and west of Mr. Landry's lot have had to be upgraded since 1987 due to the water table encroachment problem. I have personally talked to Mr. Landry's engineer (as have members of the On-site Services staff) and asked him to provide a written statement attesting to the fact that the septic system did not encroach on the groundwater table. The engineer has declined to provide such a statement. There is little choice at this point except to have Mr. Landry install a water monitoring tube near his system to confirm the depth to groundwater. We advised Mr. Landry that we would approve a conditional HAA subject to this installation and any necessary resulting action required, but he has declined that approach. It is our understanding that Mr. Landry purchased his lot under an "as is where is" agreement. Our office would not have any knowledge that such a sale was taking place; however, if Mr. Landry had availed himself of the HAA process and available information in our property files, the potential groundwater problem could have been resolved prior to his purchase. I have not provided all the detail of this situation, but this is the basic picture. Please advise if you desire more details. Due to a decision by Department of Health and Human Service's, I lost the sale of my home, necessitated by a Permanent Change of Station, of which you are aware. Many incottsistencies occurred during my attempted sale of my property, through Heritage Real Estate. I Ibund out two ~veeks prior to the iinal closing date that DHHS, would not pass my homes septic system, due to the possibility of my system being within 10 feet of ground water, which varies throughout the year in .Alaska, a fact that I am sure you are aware They required me to escrow 150% of the cost of raising my septic system,, which would have cost me $15,000.00. This was bad, but had I known that the municipality was aware of a water encroachment problem, which according to DHHS official Lee Browning, they had prior 'knowledge, due to testing in the area appro.'ximately 7 years ago, why were the residents of Northwoods Subdivision not notified--either by individual notification or by public notice. I asked Nh'. Browning if they had conducted either and he stated that all residents should have known about this, due to thc tests. I did not. I assumed the property in good faith from CMSgt Robert Delong, Legally I should not have been allowed to assume the property-au AHIrC/VA guaranteed home--I am not a Vietnam Era Veteran, but due to an error bv National Bank of Alaska and a La,wet hired by CMSgt Delong, I was allowed to assume the loan, and would have remained in the home nntil retirement if the USAF had allowed me to. Mr. Delong stated that all tests as rcquked were conducted at the time he purchased the home, 31 May 1985, and that the complete system was adequate and he had never had a problem. I asked Mr. Browning if the Muhicipality (Dill-IS) had approved the initial installation, and he stated it was required, but in the late 70's and early 80's the inspections were not always done properly due to the rapid constructiona'expansion during the oil boom. I asked into the liability of the original engineer and the Municipality and was told that they were exempt ti'om claims due to inspecfion--A techn/cnl advantage as to their requh'ement for a licensed engineer required on all sales to approve/disapprove the septic system--and the reason behind the disclaimer printed on the bottom of their form. "DH}IS will act solely on the approval ora licensed engineer in the state of Alaska, and only utilize information from said engineer. There were a number of things unsettling about the incident, not the least of which were highly paid public and private individuals, who received payments, for little or no services rendered. I should start with a brief description of the situation. I placed my home located at Block #3, Lot 29, Northwoods Subdivision,. on the market ear.ly in October. An offer to purchase was received a week later, and the supposedly necessary, but cos. t~, real estate requirements ensued. The home required an/inspection by a licensed engineering firm to conlirm the adequacy of the water supply and lhe septic system, an appraisal, and four minor repairs from an independent housing inspector hired by the perspective buyer. The total for these serxices and repairs was approximately $2,000.00. Xx, qaich I accepted as fair real estate practices, ffsuch an enterprise exists. On appro.-dmately 27 Dec 92, I learned from my Realtor, Roll Milton, of Heritage Real Estate Corporation, (907) 694-4994, that there was a possible problem with my septic system, and that he was in contact with Department of Health and Human Services (DHHS), a MunicipaliB' of :Anchorage Inspection office. After numerous day's ofconferr/ng with DI-H--IS and attempting to get S & S Engineering, the company that conducted the site irrspection on my home, to get together, and either come to a mutual agreement or to come up with a possible alternative, I ~vas contacted and not/fled [ had lost the perspective buyers. I at this time had 2 weeks remaining on my tour of duty in .Alaska. I am a member of the military and was being reassigned to Kansas. The week prior to my departure I received a copy of the real estate paperwork, and clearly DHI-IS had disregarded a statement on the bottom of their own certificate statin~ they would only accept inspections from licensed eng/rleers in their assessments of systems. This would have even been accepta~ble if they would take responsibility t'or their actions, but no, their first statement to me was they were exempt from liability for inspections due to their Municipality status. This is the same ofrice that is trying to get additional septic inspectors, and requesting homeowners in the Chugiak/Eagle River area to pay au annual l'ee---No Thank You. The stipulation handed down by DHHS, required me to escrow 150% of the cost of installing a new septic system, which would require testing in thc May-Aug 93, time fi'amc to ensmx: a minimum of i0 foot separation bet~veen ground ~vater and the septic system. Only a tbol would have allowed the system to go in the ground in 1981 without such separation. Both the original engineer who designed the homes system and DH3IS had approved the current system. I asked into their liability for allowing the current system to be placed in the present manner and was notified that the late 1970's and early 1980's was a real estate boom time and that numerous homes were granted approval, with the possibilities of improper or no inspections. But that since they were immune from liability for inspections, it was a mute point.****NOT FOR I spoke to Lee Browning, and the supervisor of Robby Robinson--who stated Robby had personally inspected my system--A fact I question with a 1/3 Chow/Shepard/Wolf standing in my yard. To date No One has ever approached that dog, and truly doubt that Mr. Robinson would have. I am currently trying to get refinanced to prevent the total loss of the home, but since I have not made a full house payment since my departure on 1 February., it is extremely doubtful I will get it. Since the City and the Real Estate Professionals are implicated in this situation I am hereby gMng you notice that a copy of this letter along with my documentation will be sent to Senators Stevens/Murkowski, Representative Young, the Dally News, ACLU, the BBB, and a number of other agencies unless, I receive a written reply ~vithin 5 days, on my liability claim. John Smith, P.E., Program Manager, On-site Servicesj~c~'~-r SUBJECT: Claim Against the Municipality of Anchorage File No. 22700 - Lot 3, Block 29, Northwoods Subdivision In response to your request for backup information regarding the subject claim, the following information is provided: Background and History Lot 29, Block 3 North Woods Subdivision: Permit #810556 dated June 18, 1981 issued by the Municipality of Anchorage permitted design was for a wide drainfield total depth 4.0', 5' wide, 123' long, 2.5' gravel depth. The above permitted design was based on a soil test dated June 16, 1981 which showed a silt and gravel soil from 1.0' to 7.0' Groundwater was monitored at a depth of 7 Ft. On December 16, 1992, the property owner, Mr. Bruce Landry, applied for a Health Authority Approval certificate. The application was reviewed by this department and a conditional approval was issued on December 23, 1992. The conditional approval required that a groundwater monitoring tube be installed adjacent to the system to verify a vertical separation of 4 Ft. between the bottom of the system and any groundwater table. As part of the Health Authority Approval process, a system adequacy test was performed by S & S Engineering on December 15, 1992. Before the adequacy test, %here was 15.5 inches of water in the drainfield, during the test there was 22.5 inches of water in the field and after the test, there was 18.5 inches of water in %he field. It should be noted that there is 30 inches of gravel in the absorption field. The engineer was asked %o provide a written statement attesting to the fact that the system did not encroach on the groundwater table. The engineer has declined to provide such a statement. Scott Wetzel Services, Inc. March 18, 1993 Page 2 Groundwater Data from Adjacent Lots LOt 27 Block 3: Two lots to the east of Lot 29, Block 3. The' leachfield was upgraded on June 3, 1991 due to the encroachment of groundwater into the original leachfield. A soil test taken on September 26, 1990 showed groundwater to be at 9 feet after 7 days of monitoring. LOt 30 Block 3: The adjacent lot to the west of Lot 29, Block 3 the leachfield was upgraded on February 8, 1987 due to the encroachment of groundwater into the original leachfield. A soil test taken on April 28, 1987 showed groundwater to be at 3.0 feet after 7 days of monitoring. LOt 31 Block 3: Two lots to the west of Lot 29, Block 3. The leachfield was upgraded on April 20, 1987 due to the encroachment of groundwater into the original leachfield. A soil test taken on April 4, 1987 showed groundwater to be 4.5 feet after 7 days of monitoring. Lot 12 Block 3: The adjacent lot to the north of Lot 29, Block 3. The leachfield was upgraded on September 28, 't990 due to the encroachment of groundwater into the original leachfield. A soil test taken on May 5, 1992 showed groundwater to be at 3.75 feet after 9 days of monitoring. Reference to Anchoraue Municipal Code AMC 15.65.060.2(b) states that a subsurface disposal field may not be located where the water table during any season of the year will be within four feet of the bottom of the absorption area. Based on the reported 4.5 Ft. depth of the existing system, and the presence of a groundwater table depth of between 3 and 5 feet on adjacent lots there is sufficient reason to suspect that the subject systems does not have the required 4 Ft. vertical separation to the groundwater table. AMC 15.05.160.C states that the department shall issue a Health Authority Certificate if the department finds that information provided by an engineer demonstrates that the system for which the certificate is sought conforms to all applicable portions of the Anchorage Municipal Code. March 18, 1993 Page 3 The department has found that the information provided by S & S Engineering does not support or demonstrate that the system conforms to all applicable portions of the Anchorage Municipal Code. Therefore an unconditional Health Authority Certificate could not be issued. AMC 15.05.160.E states that all test procedures used to collect the information necessary to meet the requirements for a Health Authority Certificate shall be approved by the department. In order to satisfactorily support and demonstrate that the system conforms to all code requirements, the department has approved the installation of a groundwater monitoring tube as the most reliable and cost effective method to confirm that the bottom of the system is 4 ft. above the groundwater table. Summary and Conclusion There is significant evidence which supports the department's concern that groundwater encroachment may be a p~oblem at the exishing leachfield on Lot 29, Block 3 North Woods Subdivision. Therefore the department has acted correctly and in accordance with municipal code in requiring that groundwater be monitored prior to issuance of an unconditional Health Authority Approval. The engineer, S & S Engineering, has declined to provide a statement attesting to the fact that the system does not encroach on the groundwater table.' It should also be noted that the claimant purchased the subject property on a "where is as is" agreement. At the time Mr. Landry purchased the property he elected not to have the on-site wastewater system approved by this department. Had Mr. Landry availed himself of the Health Authority Approval process, any groundwater encroachment problems would have been resolved prior to his purchase of the property.
