As part of this project we are requesting approval from the State Department of Environmental Conservation to drill a Class 'C' well and to install a wastewater holding to serve the 4-plex located on the property. This submittal is subsequent to your memorandum dated July 21, ~1~93~ to the Department of Economic Development and Planning'for the referenced property. Please refer to the file information copied to you for this property and our letter to Keven K. Kleweno of this date for the history of this property and the current status. On the attached design/site plan we've proposed the installation of shallow drainfield trenches to serve the single family home located on this property. We've also designated two alternate leachfield sites. Shown are the locations of test holes excavated in the area of the proposed upgrade. Also shown are property slopes in the area of the proposed upgrade. The slope varies between 20% and 45%. Therefor, we are requesting a waiver to AMC 15.65.060 A.2.a. requiring septic systems to be installed on slopes less than 25%. We feel this requirement may be waived in this case due to the semi-poor soil Conditions which exist. The silty, sandy gravels which exist will tend to direct the migration of effluent downward into the soils as opposed to horizontally. Thus the potential for effluent daylighting through the steeper slopes will be minimal. We also propose the area ON SITE WASTEWATER DISPOSAL SYSTEM DESIGN 17034 EAGLE RIVER LOOP, SUITE 204, EAGLE RIVER, ALASKA 99577 p~ge 2 Lot if Block 1, March 10, 1993 Valley View Terrace #1 over the proposed drainfields to be filled with drainage directed away from the system to further prevent the potential for daylighting effluent. As can be seen from the site plan, the proposed septic upgrade is outside of neighboring protective well radii as well as the proposed well radius to serve the adjacent Lot 2. We do not anticipate any adverse effects on neighboring properties by the installation of the proposed upgrade. As you know, we intend to subdivide the property as shown by the proposed lot line. Due to the limited room available on the proposed property for future septic upgrades, we intend to designated the locations of the alternate leachfield sites on the plat in accordance with AMC 15.65.180 B.2. We will also designate the maximum dwelling capacity on this property to be 3 bedrooms. Dear Mr. Shafer: The Department has reviewed the information received in this office March 11, 1993, regarding the above subject which included a letter describing the current state of the system, a letter to the Municipality of Anchorage for a proposed septic upgrade serving the single family home, and a set of drawings for the proposed upgrades. From the information submitted and a review of this office's files concerning this property the Department has the following comments: Wastewater Disposal System: The previous history of this site has illustrated that due to the poor soils, facility size, high groundwater levels, and lot slope the present conventional on-site wastewater disposal system is prone to failure. In addition, the limited area of the property prevents the installation of an appropriately sized leachfield for the given facility size. Therefore, in accordance with State Wastewater Disposal Regulations (18 AAC 72) approval for the installation of a wastewater holding tank at the proposed location is granted by this Department subject to the following conditions: Submittal of an as-built of the wastewater holding tank system under the stamp of a registered Professional Engineer (P.E.) to verify soils, watertable and impermeable strata separation. Installation of a dual alarm system for the holding tank and regularly scheduled pumping of the tank. 4 Existing leachfleld is to be abandoned as proposed along with effluent lines from the septic tank. Drinking Water System: The proposed location Of the new Class "C" well appears to meet the concerns of this Department. Therefore, in accordance with State Drinking Water Regulations (18 AAC 80) approval to construct the well is granted. Enclosed is a Construction and Operation Certificate with a signed "ApprOval to Construct". Approval to operate will be granted based upon the ,follov~iBg conditions: 1. Verification that the existing well is abandoned according to DEC recommended guidelines. 2. Location of the well in longitude and latitude. Satisfactory results of water analyses for total coliform bacteria and inorganics for nitrate. 4. Well log. Well yield and calculations to show adequate yield, include storage tanks if necessary to meet peak demand requirements. Verification that no lead solder, flux, or piping was used during the installation of the water system (18 AAC 80.800). Submittal of an engineered as-built of the water system under the stamp of aP.E. The proposed property line as indicated on the submittal does not appear to adversely impact development of this area. However, alternative site 'B' for the proposed drainfield trenches for the single family home appears to be located near a known spring which may make this site unsuitable for the intended usage. Definitions. A. Alteration. Prior to performing any alterations to an AWWTS the owner must obtain a Wastewater Disposal System Construction Permit from the Municipality pursuant to Anchorage Municipal Code (hereinafter, "AMC") 15.65. B. Certificate of On -Site Systems Approval. An approval by the Municipality of existing water and wastewater disposal systems given at the time of property sale and title transfer in accordance with AMC 15.65. These approvals certify that the systems are adequate for the homes that they support and meet the codes that were in place at the time of system construction. C. Damage. Any man-made or natural change in a system that would inhibit the system from performing as designed. D. maintenance and Repair. The scheduled and as needed replacement of existing parts, components and pieces of an AWNN7S that were included in the original design which would allow the AW WTS to continue to perform as designed. E. Permit (Construction) An On -Site Wastewater Disposal System Construction Permit as defined by AMC 15.65. F. Permit (Operating) An Advanced Wastewater Treatment System Operating Permit. An annual permit, issued by the Municipality, that allows the Owner to operate an AWWTS, upon meeting all the requirements of this agreement, the conditions of Operating Permit, the requirements of the On -Site Wastewater System Construction Permit and all relevant provisions of AMC 15.65 3. Fee. Owner shall pay to Municipality an annual fee of ($ .00), payable on or before the issuance of the operating permit and annually thereafter. The annual fee is due on or before the anniversary date of the approval by the Municipality of installed system. 4. Term. The term of this Memorandum of Understanding shall be for the life of the AWWTS. The term begins on the date of approval by the Municipality of the installed system and shall continue while the AWVVTS system is in use or operational or until the property is sold or title is transferred by owner and a new certificate of On -Site approval is issued to the new owner or transferee of the property. 5. Alterations, Installation and Removal of Additional F,guipment. Owner agrees not to make any alterations, removal of parts or additions to the AWWTS without a Construction Permit from the Municipality. 6. Maintenance and Repairs. A. Throughout the term of this Memorandum of Understanding, the Owner shall maintain AW WTS in good repair. In addition, it shall be the responsibility of the Owner during the term of this Memorandum of Understanding, and any extensions or renewals thereof, at the owner's sole expense, to pay for any and all: (1) repair(s), (2) maintenance, (3) adjustment(s), (4) replacement costs, and (5) inspection costs. Further, Owner agrees to comply will all applicable ordinance, laws, regulations, rules and orders for the AWRrrS. B. Owner agrees to provide the Municipality a written schedule of routine maintenance and repairs which have been performed on the system pursuant to the terms and conditions contained in the Owner's AWWTS Operating Permit. This schedule shall be submitted to the Municipality annually upon the renewal of the permit. The schedule of maintenance and repair contained in the Owner's AW WTS Operating Permit is: C. Owner acknowledges that the fine schedule for failing to maintain and repair an AWWTS are codified in AMC 14.60. D. Owner agrees that only maintenance, repair personnel certified by the Municipality will inspect and make any necessary maintenance, repairs or permitted alterations to the system. E. Owner agrees to grant the Municipality reasonable access to test and inspect the AWWTS upon 24 hours written notice. F. Owner agrees that any sale or transfer of title of the property will not occur without a new Certificate of On -Site Systems Approval. G. Owner agrees that the relevant provisions of the standard specification guidebook for AWWTS is the governing professional guidelines for the construction, maintenance and repair of the Owner's AWWTS. 7. Nomviiver. The failure of either party at any time to enforce a provision of this Memorandum of Understanding shall in no way constitute a waiver of the provisions, nor in any way effect the validity of the Memorandum of Understanding or any part hereof, or the right of such party thereafter to enforce each and every provision hereof. 8. Amendment. A. This Memorandum of Understanding shall only be amended, modified or changed by a writing, executed by authorized representatives of the parties, with the same formality of this Memorandum of Understanding was executed and such writing shall be attached to this Memorandum of Understanding as an amendment. B.
