The cover has been mounded over the tank in such as fashion as to provide drainage towards the driveway. The contractor also placed material around this area so as to hold any possible over flow (from the holding tank) on the driveway area, so that the occupants of the house would be forced to drive over the sewage, thus causing an immediate need to pump the tank It should be noted that a temporary shed has been placed near the holding tank area, after the installation and our swing ties and final grades were completed. This shed and its location has been approximately shown on our as -built drawing per your department's request. The homeowner would like to upgrade the existing holding tank. We are proposing to decommission the existing holding tank and replace it with a 4000 gallon holding tank One test hole was excavated on the property. Due to the organics & peat, high groundwater table, and surrounding surface waters an on-site wastewater disposal system cannot be installed. WAIVER TO SURFACE WATER: Due to site constraints the proposed holding tank will be installed within 30 feet to the nearest surface water. The surface waters which are within the 30 foot limit will be filled in so that a 30 foot separation distance can be achieved. In short, we are requesting that your department issue a 30 foot waiver from the proposed holding tank to any surface waters. Justifications for this waiver are as follows; • A high water alarm shall be installed so when the tank gets close to capacity the owner can have the tank pumped prior to it filling to 100% capacity. • The final cover shall be mounded over the tank and sloped in such a way that if the tank were to overflow that effluent would flow towards the driveway and away from the surface water. We are unaware of any adverse impacts this installation or the granting of this waiver may have on adjacent wells or septic systems. If you have any questions, please contact us at 337-6179. During a site visit to the property this week for a pre -construction layout, it was observed that the rain events encountered just before freeze-up caused ponding of water on the neighboring property to the West, which froze in place. This frozen ponded water appears to be approximately 17' from the proposed holding tank location. There is no other viable location for this holding tank. As discussed with your office yesterday, we request a minimum separation distance of 15' from surface water to the proposed holding tank. As per the existing design, action will be taken during the final grading of the tank installation to minimize drainage from the new holding tank location to adjacent surface waters. Based on our review of the information you provided and our July 12, 2012, site visit, we have determined the subject property does not contain waters of the United States (U.S.) under Corps jurisdiction. Therefore, a DA permit is not required. A copy of the Approved Jurisdictional Determination form is available at http://www.poa.usace.army.mil/reg/ApprovedJDs.htm under the above file number. Please contact us if you decide to alter the method, scope, or location of your proposed activity. Minimum distance from a private well to a private sewer line is 25 feet and to a community sewer line is 75 feet. Well logs are required and must be returned to this department within 30 days of the well completion. Other requirements may apply. At the same time we also feel that exceptions to the regulation should be granted on a case by case basis to property owners who meet the following criteria: The property owner who, b~sed on your letter of February 23, 1984, made significant improvements on his property with the expectation of receiving a holding tank permit and now is unable to complete con- struction. Or, The property owner who finds himself in an area where balloting for trunk and/or laterals bas failed as a direct result of large parcel owners in the immediate vicinity swinging the vote by virtue of their increased leverage. With regard to the first criterion, we would like to recommend specifically that a holding tank permit be granted to Carl Yanagawa, Lot 84E, USS 3042. Assemblyman Dana Brockway has been approached recently by several other property owners meeting one of the above criteria. Mr. Brockway will supply you with these names.
