Based on our review we offer the following: 1. The subject property is served by a well that is located approximately 34 feet from a public sewer manhole or clean out. At the time the well was drilled,'the required separation distance was 50 feet. In 1983 the required distance was changed to 100 feet, 2. A permit to drill the well was issued by this office on January 18, 1977. The permit specified that the applicant, Peterson Construction, was responsible for constructing the well with adequate separation distance to the sewer line which was constructed in 1976. This office was not responsible for the -improper location.of the well. 3. A Health Authority Approval (HAA) was issued on May 9, 1977 for the well. There is no indication that the required Separation distance was waived. This HAA should not have. been approved until the separation distance inadequacy was resolved. 4. Subsequent -requests for HAA's were denied in 1981 and again in 1984. ' 'Max Gifford', November 24,-1992 Page 2 5. The issue regarding this separation distance problem was previously brought to our attention by Senator Jan Faiks and Assemblyman Larry Baker in 1985. Correspondence regarding that inquiry is attached for your information. 6. Lot 2, Block 1 and Lot 3, Block 2, Dawn Village did receive conditional waivers and HAA's providing that the property owners provide annual water sample test results and that they connect to public water within 3 years. Neither of these conditions have been met by either,property owner and both HAA's are considered void. _.._ Recoimendations The requirements and standards for review and issuance of HAA's and separation distance waivers have changed over the past several.years. Issuance of a HAA and separation distance waiver will require that the owners retain the services of a Professional civil Engineer to prepare and submit the necessary HAA and waiver applications. The current separation distance of 34 feet between the well and the sewer manhole or clean out is significantly less than the currently required 100 feet and can not be unconditionally waived. However, a conditional waiver maybe considered if the property owners agree to -contract with a third party to sample the well on an annual basis for bacteria and nitrate contamination until such time that public water is extended to the property. To whom it may concern: 1. Well Adequacy: The subject property, and the lots surrounding it are served by city sewer, therefore, an adequacy test was only performed on the well. The test was performed by pumping 6.42 gpm for a total of 76 minutes (488 gallons). During that time the drawdown on the well varied from 1.0-2.5 feet, and recovered completely within 5 minutes after stopping the test. Based upon these results, the well was deemed to be adequate for a 3 bedroom house (450 gpd). 2. Well is 33 Feet from Public Sewer MH: Attached is a copy of a letter written by John Smith, P.E. regarding the history of this well and previous attempts to obtain a waiver and/or a HAA. Per the conditions outlined in this letter, we are requesting a conditional waiver of the subject separation distance with the requirement that appropriate funds be escrowed so that water sampling can be performed on an annual basis until such time that the home is connected to public water. It is imperative the buyers understand that if the well becomes contaminated, they would have to pay to connect to public water. It is also recommended that a contract for the sampling be awarded prior to closing on the house, with the conditions of the contract established by DHHS under the conditional waiver. 3. Depth of Well Casing Unknown: The depth to which the well was cased is not stated on the well log. Since the static water level in the well was at 14 feet, and I was unable to draw it below 16.5 feet during the adequacy test, it was not possible to visually verify whether the well is cased to at least 40 feet. The VanAlphen's tell me the sewer line was put in by the Municipality in 1976 and wells con- structed in 1977. The well construction report was approved by the Municipality. The well is 34 feet from a manhole. The VanAlphen's are selling their home. AHFC will not approve the prospective buyers' loan because the well is located too close to a manhole. The state requires a distance of 100 feet. DEC has disapproved the waiver request as it fears any contam- ination at the manhole could easily infiltrate the water system due to the well and manhole's proximity. Several issues are raised. Since 1959, law has required distances of at least 50 feet -- considerably more than the 34 feet which the Municipality approved in 1977. Insufficient distance is not isolated to only the VanAlphen's property; I'm told all 20 wells on the street are located within similar proximity to the sewer line. As a result, I believe it is important the Municipality determine how this happened in the first place and if inaccurate well reports continue to be a problem. I believe it is also emtremely important the Munici- pality address this probler.•, i=ediately before additional families encounter similar problems as the VanAlphen's. One option, of course, is for the VanAlphen's to corer the expense or a new well which meets the 100 feet reeuirement. However, this does not seem fair given the distance recuire- ments have not changed since they purchased the home in 1982. What appears to be the base of the problem is the Municipality's original approval of the well permit when the houses were constructed. As a result, I would appreciate your reviewing the well permits for the homes located on Teschler Drive to determine hcw the permits were approved in the first place by the Municipality. At the same time, I am also inter- ested in learning what responsibility the Municipality will take in correcting the burden its error has placed on the VanAlphen's, as well as the potential impact the error will have on their neighbors should they decide to sell their home in the future. Unfortunately, the application cannot be approved by the Municipality of Anchorage because of currently enforced seperation standards between water supply sources and sewage systems. That is not to say that your water system is inadequate, in fact the opposite is more indicative of your system. Our technical evaluation indicates the water system is satisfactory in construction and operational design and we anticipate it will provide years of adequate water supply in both quantity and quality. The contradiction between your well being technically adequate and yet not meeting HAA approval requires some explanation. The State of Alaska has always had seperation requirements between water supplies and potential sources of contamination. The standards were enforced whenever plans for new construction were reviewed by the State Department of Environmental Conservation. However, in the Municipality of Anchorage, the technical review of new systems was generally accomplished by an appropriate City agency, with on-site systems serving private residences being enforced under the Department of Health and Environmental Protection. Strict enforcement of State standards did not always occur and in fact the Municipality often gave waivers to these standards. In the past year, the State has become more involved in on-site system review and has determined that the Municipality of Anchorage never has had the legal authority to grant waivers from State standards and thus acted improperly in issuing waivers. The State will not honor MOA waivers. How does all this influence a system that has been functioning properly for a number of years? Legally there is little if any impact. Neither the State of Alaska nor the Municipality of Anchorage has any desire to have people relocate wells or sewage systems. However, in the late 7O's lending institutions began demanding some form of assurance that on-site water and sewage systems were adequately constructed and maintained. The procedures have been useful in enhancing the overall qualilty of on-site utilities but they can not and never will be able to guarantee non failure. Therefore the question of liability has become a big issue recently. This issue has become further entangled by the recent determination that the Municipality has been acting beyond their limit of legal authority. It is this recent concern over liability that is the major reason for an HAA not being granted in this situation. We feel con- fident that if the State had not become involved in the Anchorage procedure for on-site utility approvals, the Municipality would have issued an HAA for this situation. 'This is supported by the fact that a similar approval was issued in 1977. It now becomes a question of the level of assurances required by the lending authority. If the well were located behind the house, the technical confidence level of system reliability would not be enhanced significantly. If the ground water is contaminated by the sewer system, the direction of contami- nation would most likely follow a downward gradient since the ground water level is approximately twenty feet below the sewer whereas the well is almost 40 feet horizontal from the sewer system. Likewise, almost every well in this particular sub- division is in violation of current standards and could serve as a source of contamination, if in fact the direction of contami- nation was horizontal. Therefore, moving one well will have negligable impact on water quality in the immediate area. This is a very unfortunate situation caused by a lack of en- forcement of State standards by a public agency. However, the actual risk imposed by the existing system is minimal and certainly no higher than that caused by the.general overall development in the Anchorage area. Relocation of the existing well would serve no technical purpose other than meeting an existing State regulation. No one could guarantee longer life or more reliable service from a new well opposed to the existing well. The years of satisfactory service of the existing well is evidence to that fact.
