The existing situation is: the petitioners own a 5 acre lot with a single family home. They wish to sell 2 acres at the rear of the lot including a 20 foot wide flag for access to the new lot. The resulting flag portion exceeds the maximum length allowed by title 21. B. The granting of this petition would permit: the creation of a desirable building lot in the mid-hillside area while maintaining privacy for the petitioner's residence. The applicant alleges that: 1. There are special circumstances or conditions affecting said property that the strict application of the provisions of this ordinance would clearly be impractical, unreasonable, or undesirable to the general public. These special conditions are: the existing home was constructed in 1992 and is set back 200 feet from Totem Road. The remaining property is suitable for one additional home on a lot with a flag pole. Title 21 limits the length of the flag pole to 200 feet and due to the lot configuration the petitioners need 365 feet. 2. That the granting of the specified variance will not be detrimental to the public welfare or injurious to other property in the area in which saidproperty is situated for the following reasons: The resulting new lot not be visible from the street except for the driveway, which in this case will be somewhat longer than usual. 3. That such variance will not have the effect of nullifying the intent and purpose of this ordinance or the Comprehensive Plan of the Municipality for the following reasons: The Comprehensive Plan states that one of the goals of the plan is to create a living environment of the highest possible quality. In the view of the applicant the proposed subdivision as designed is the highest and best use for this property and xvill create a living environment of the highest possible quality. 4. Undue hardship wouM result from the strict compliance with specific provisions or requirements of the subdivision regulations. The applicant may supplement the form with supporting information. The 200 foot length for a flag pole appears to be an arbitrary administrative requirement without any logical basis. However, the testholes that we perfo[i~-~ed on October 15, 2002 does not provide conclusive evidence to the presence of suitable soils or the feasibility of on-site septic systems. We conducted only two testholes on the property, one of which is not suitable for on-site septic-please see the attached testhole logs. We are submitting the requested information for the above referenced property for your review and approval. Attached is documentation of water availability of properties in the immediate vicinity, topographic data, proposed septic reserve area and corresponding soils logs. DSD well data shows the average yield for the surrounding area to be approximately 17.5 GPM, with a range from 10 GPM to 40 GPM. All adjacent properties have on-site well and septic systems. The subject lot will be approximately 2.17 acres. The average percolation rate for the three testholes within the proposed 16,000 square foot septic reserve area was 14.53 minutes per inch, with a range of 6.67 to 24 minutes per inch.
