Deck / Deck Stair Support to Tank Separation Distance.
Waiver Request
Ladies and Gentlemen:
I am writing to request a separation distance waiver between the existing deck stair supports and the
new septic tank to zero feet (0.0'). The upgrade septic tank was installed on 6/21/2019 and swing ties
were taken on 7/2/2019. During the install and final inspections and when the swing ties were taken,
the stairs were not present. PES received the As -Built for the property on 1/23/2020 and we noted that
the stairs appeared to be over the tank.
MOA code states the following.
15.65.205 8.1.d states: "For decks and stairs located more than thirty inches above grade, a
septic tank shall not be located within feet of an associated deck or stair support. For decks
thirty inches or less above grade, a septic tank shall not be located under an associated deck
support."
PES conducted a site visit to verify the final position of the stairs (see -attached photo). The centerline of
the stairs lands approximately atop the spring line of the tank with the support of the stairs consisting of
a section of large dimension sawn lumber. As a result this stair support creates a load (based on ASCE
7-16 LRFD Load Combinations) of 5,019lbs distributed over the three foot long (3') section of
dimensional lumber.
The tank is buried at a depth of nine and one-half feet (9.5') to the top of tank. Extrapolating the data
found on the live load data for AASHTO H-25 loading (45,0001b axle load) the effect of this on a tank
buried at 9.5' is 0.02 pounds per square inch (0.02psi) or two point eighty-eight pounds per square foot
(2.88psf). This load is a minimal increase to the overall load from the soils and will not have a
detrimental effect on the tank. Further, since the load from the stairs is distributed across the large

timber at the base of the stairs and that load is off the center of the tank (centered on the spring line)
that further mitigates from any negative effect on the tank.
Finally, due to the depth of bury of the tank, should the tank fail due to age and collapse a soil -bridging
effect will control and the soils surrounding the tank will maintain its shape and not collapse.
Granting this waiver will not pose a threat to the safety of this lot or the surrounding lots.

My fi~m was contacted to a Health Authority Approval of the septic system serving this lot. The
existing trench was inundated with liquid when I arrived. The system is in failure. Two test holes
were excavated on June 29, 2002 on the lot. Thesoils report and a percolation test result are
attached. Ground water was monitored for seven days. No bedrock or ground water was
encountered in the test hole. Two trenches will be installed to obtain the required length. The
Contractor is required to slake the well radiuses to ensure separation distances. The new system
will need to be installed approximately 0.5 feet off of the south property line. I request a separation
waiver to lot lines to accomplish this installation.The soils encountered in the test holes require a
large replacement system. Due to the constraints of soils, and small lot s~e, the replacement
trench will need to be installed adjacent to the lot line. I reviewed the optionsavailable and the
only option that would not require a lot line waiver is to install a lift station or aerated system to
reduce the required length. These options were presented to the owner, and he elected to seek a lot
line waiver. The neighboring lot is developed but will not be adversely affected. The existing septic
system will remain in place. A diverter valve will be installed after the tank to separate the two
fields.
The lot is approximately 11,545 square feet in size. Lot 4 slopes to the west at approximately 1
percent in the area of the test holes, and then steepens to approximately 5% on the western
portion of the lot. The existing septic tank will be verified and reused if found competent and
replaced if leaking. The proposed installation will be located on the eastern portion of the lot. The
lot is served by a private well. The proposed location is greater than 100 feet amy from existing &
neighboring wells and 25 feet from the water service lines. The surrounding wells are located
greater than 100 feet from the proposed installation. The proposed installation will not affect the
future development of the surrounding orexisting lots. See the attached design.

is 25 feet and to a community sewer line is 75 feet. Well logs are required
and must be returned to this department within 30 days of the well completion.

In conducting an adequacy test, I attempt to provide a thorough, conscientious engineering analysis of the system in accordance with MoA

To Whom It May Concern:
We respectfully request a lot line waiver for the existing septic system on Thunderbrush
Lot 4 to the east lot line for a separation distance of 5 ft. This system was installed in
September 2002, and has been determined by a recent survey to be less than the
required 10 ft from the east property line. A previous waiver (#WR 020058) was
approved for the south lot line.
I do not believe that this reduced separation distance will have any adverse effect on
the adjacent lot to the east, Thunderbrush Lot 2. Their septic system is in the south
central part of the lot, and they have 2 drainfields installed with a diverter valve. A copy
of the septic as-built is attached.

Encroachment and any additions thereto, even if in violation of this permit, has not and shall not in
the future give rise to any interest or estate in the real property subject to the Easement or any other
real property. Without in any way limiting the foregoing, Permittee acknowledges that the
Encroachment is not adverse to any interest of Chugach and its continuation is entirely with the
permission of Chugach for purposes of the common law doctrine ofadversepossession. 'this permit
creates no interest in the real property subject to the easement.
7. Modification of Utility Facilities. If the electric utility facilities located within the
Easement are upgraded, added to, replaced or reconstructed, Pcgmitte¢ shall pay that portion of
Chugach's total costs for such modification which is reasonably attributable to accommodating or
preserving the Encroachment. If such payment i$ not made within thirty 00) days of written demand
for same, Chugach may terminate this permit in accordance with paragraph 9, below.
8. Covenants Running with the Land. The obligations of the Peimittee arising from this
permit shall be covenants running with the land which shall burden the Parcel and the l'ermittee's
interest in the land subject to the Easement and shall benefit the Easement..
9. Termination. Chugach may terminate this permit after the giving of thirty (30) days
written notice of such termination iff
a. The Encroachment is enlarged, increased or extended within the real property
affected by the Easement.
